J को पूरा करने के िलए और उK चतम F वािलटी मानक� को बनाए रखना आव>यक ह ैजो रा@ीय और अAतररा@ीय �तर पर िविहत मानक� को सिBमिलत कर3गे ;

और, पोषण भो�य और पूव� िम�ण के उQपादन, भRडारण और पSरवहन म3 �वा�<य संबंधी अपे"ाJ को अिधकिथत �कया जाना चािहए;
और, �सं�करणकता� का यह �ाथिमक दाियQव ह ै�क वे यह सुिनिNत कर3 �क पोषण भो�य और पूव� िम�ण इस आदशे म3 अिधकिथत अपे"ाJ को पूरा करते ह; ;
और, केATीय सरकार के उ- �योजन� के िलए नीचे िविनUदV ��ताव बनाए गए ह ैऔर उनको िनया�त िनरी"ण िनयम,1964 के िनयम 11 के उप िनयम (2) क अपे"ानुसार िनया�त िनरी"ण पSरषद को अWेिषत �कया गया ह ै;
अतः अब, केATीय सरकार , क िनया�त (F वािलटी िनयं&ण और िनरी"ण) , िनयम, 1963 ( 1963 का 22) क धारा 6 Hारा �द5 शि-य� का �योग करते :ए , पSरषद से परामश� के पNात् यह राय ह ै�क भारत के िनया�त ,ापार के िवकास के िलए ऐसा आव>यक और समीचीन ह ै:-
1. इस आदशे क अनसुूची म3 यथा अिधकिथत पोषण भो�य और पूव� िम�ण और उनके वगYकरण को अिधसूिचत करती ह,ै जो िनया�त से पूव� F वािलटी िनयं&ण और िनरी"ण के अधीन होगा ;
2. िनया�त (F वािलटी िनयं&ण और िनरी"ण ) िनयम, 2013 के �Zप के अनसुार, िनया�त के िलए पोषण भो�य और पूव� िम�ण के �कार और वगYकरण िविनUदV करती ह ै;
3. इस आदशे म3 संल[ न अनुसूची म3 यथाव\णत िविनदMश� को पोषण भो�य और पूव� िम�ण के िलए मानक िविनदMश के Zप म3 माAयता दतेी ह ै, (क) आयातकता� दशे� के रा@ीय मानक या अंतरा�@ीय मानक; या (ख) आयातकता� दशे म3 Pेता व िनया�तक� के बीच करार तय :ए संिवदाQमक िविनदMश जो �क आयातकता� दशे� क �वा�<य सुर"ा और अAय अपे"ाJ को पूरा करते ह� ;
(ग) उपरो- (क) और (ख) के �कसी भी िविनदMश� क अनुपि�थित म3 , समय समय पर यथा संशोिधत और अिधसूिचत रा@ीय मानक और िविनदMश ; और (घ) खंड (क), (ख) और (ग) म3 उिCलिखत �कसी भी िविनदMश क अनुपि�थित म3 उपरो- म3 भारतीय िनया�त िनरी"ण पSरषद Hारा अिधकिथत कमेटी Hारा अिधकिथत मानक ;
4. अंतरा�@ीय ,ापार के अनुPम म3 पोषण भो�य और पूव� िम�ण का िनया�त का तब तक �ितिष= होगा जब तक �क वह लागू मानक� को पुV न करते ह� और उसके साथ इस �भाव का �माणप& न हो �क वे िनया�त (F वािलटी िनयं&ण और िनरी"ण) अिधिनयम 1963 ( 1963 का 22) क धारा 7 क उप-धारा (1) के अधीन �थािपत िनया�त िनरी"ण अिभकरण Hारा रिज�]ीकृत या अनुमो�दत ह; और मानीटर �कए गए ह; । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
5. इस आदशे म3 ,- (क) पोषण भो�य स ेसू_म जीव या िन\मती, पोषण सामWी और पूव� िम�ण स ेिभ` पदाथ� अिभ�ेत ह; जो एक या अिधक कृQय� के अनुपालन करने के Pम म3 पोषण या जल को साशय िमलाकर बनाए जाते ह; । (ख) पूव� िम�ण से ऐसे पोषण भो�य� का िम�ण या खा$ सामWी के साथ एक या अिधक पोषण भो�य� का िम�ण या जल को वाहक के Zप म3 उपयोग �कया जाता ह ै,जो पशुJ के िलए सीधे िखलाने के िलए आशियत नह9 ह ै;
(ग) �सं�करण सहायक और पशुिच�कQसीय औषधीय उQपाद (कोिसिडयो�टेटस और िह�टोमोनो�टेट से िभ`) इसके अंतग�त नह9 होग3 । अनुसचूीअनुसचूीअनुसचूीअनुसचूी ((((पैरा पैरा पैरा पैरा 1 1 1 1 दखे�दखे�दखे�दखे�)))) पोषण भो�य और पूव� िम�ण और उसका वगYकरण िनया�त स े पूव� F वािलटी िनयं&ण और िनरी"ण का उपखंड होगा ।
1. �थापन का अनुमोदनः— ऐसे �थापन जो नीचे िववरिणत म3 स ेएक या अिधक �Pयाकलाप करने के इKछुक ह� �Qयेक ऐसे �Pयाकलाप के िलए अिभकरण से पूव� अनमुोदन �ा8 करेगा अथा�त् :—
(1) िनc सूचीब= िविनमा�ण या पोषण के ह;डdलग के िलएः Pम स.ं पोषण Sटeपिणयां (क) एAटीबायोSटक समूह के सभी भो�य (ख) कोसीडाया�टेट और अAय औषधीय तQव समूह के सभी भो�य (ग) उQपाद �व�तक समूह के सभी भो�य (घ) िवटािमन, �ितिवटािमन और सुपSरभािषत रसायिनक तQव जो समान �भाव रखते ह; । समूह के सभी भो�य (ड.) अवशेष तQव� समूह के सभी भो�य (च) एAजाइमस समूह के सभी भो�य (छ) सू_म जीव समूह के सभी भो�य (ज) कारोटेनोडस और जैAथा�फल समूह के सभी भो�य (झ) तQव� के उनके एटंीऑFसीड3ट �भाव के साथ �भाव समूह के सभी भो�य (ण) बैFटीSरया समूह के खमीर,शैवाल, िनc कवक स े संबिंधत �ोटीन सू_मजीव� से �ा8 होती ह ै समूह के सभी भो�य (त) �कRवन Hारा अमीन� ऐिसड के सह उQपाद� का िविनमा�ण समूह के सभी भो�य (थ) अमीन� ऐिसड और उसके लवण समूह के सभी भो�य (द) अमीन� ऐिसड के सहधमY हाईhोFसी ऐिसड समूह के सभी भो�य 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 2 नीचे सूचीब= भो�य के �कार स ेतैयार पूव� िम�ण का िविनमा�ण या ह;डdलगः Pम स.ं पूव� िम�ण Sटeपिणयां (क) एAटीबायोSटक समूह के सभी भो�य (ख) कोसीडाया�टेट और दसूरे औषधीय तQव समूह के सभी भो�य (ग) उQपादन �व�तक समूह के सभी भो�य (घ) िवटािमन, �ितिवटािमन और सुपSरभािषत रसायिनक तQव जो समान �भाव रखते ह; । ए और डी (ड.) अवशेष तQव� कॉपर और सेिलिनयम
2. �थापन का रिज�]ीकरणः— ऐसे �थापन जो नीचे िववरिणत म3 स ेएक या अिधक �Pयाकलाप करन ेके इKछुक ह� �Qयेक ऐसे �Pयाकलाप के िलए अिभकरण से पहले रिज�]ीकृत होगा अथा�त ्: —
(i) भो�य के िविनमा�ण या ह;डdलग िजसके िलए एक िविहत अिधकतम �तर रखा गया ह,ै और जो पैरा 1 म3 शािमल नह9 ह;ै
(ii) नीचे सचूीब= भो�य के �कार से तैयार पूव� िम�ण का व िनमा�ण ह;डdलगः �म सं. पूव िम�ण ट�पिणयां (क) िवटािमन, �ितिवटािमन और सुप रभािषत रसायिनक त�व जो समान �भाव रखते ह! । समूह के सभी भो#य िवटािमन ए और डी के िसवाय (ख) अवशेष त�व& कॉपर और सेिलिनयम के िसवाय समूह के सभी भो#य (ग) कारोटेनोडस और जै)था+फल समूह के सभी भो#य (घ) ए)जाइम समूह के सभी भो#य (ड.) सू0म जीव समूह के सभी भो#य (च) त�व& के उनके एंटीऑ3सीड4ट �भाव के साथ �भाव केवल अिधकतम िनयत अंश वाल े [फा. सं. 3/59/2007- िनया�त िनरी"ण] ए. के. ि&पाठी, संयुF त सिचव ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 MINISTRY OF COMMERCE AND INDUSTRY (Department of Commerce) ORDER New Delhi, the28th November, 2013 S.O. 3523(E).— Whereas, for the development of the export trade of India, certain proposals for subjecting Feed Additives and Premixtures to quality control and inspection prior to export, were published as required by sub-rule (2) of rule 11 of the Export (Quality Control and Inspection) Rules, 1964 in the Gazette of India, Part II, Section 3, Sub-section (ii), vide Order No. 1379 dated 28th May, 2013 of Government of India in the Ministry of Commerce and Industry, Department of Commerce.
And, whereas, the objections and suggestions were invited from all persons likely to be affected thereby, within a period of thirty days of the date of publication of the said Order in the Official Gazette;
And, whereas, the copies of the said Gazette were made available to the public on 28th May, 2013;
And, whereas, no objections and suggestions were received from the public on the said proposal;
And, whereas, it is necessary to maintain the highest quality standards and stipulate health requirements of Importing countries and that would encompass the standards prescribed at National and International level;
And, whereas, provisions should, therefore, be made for a procedure for monitoring to ensure the above conditions of equivalence with reference to the requirements of the Importing countries;
And, whereas, health requirements should be laid down for the production; storage and transport of Feed Additives and Premixtures;
And, whereas, it is the responsibility primarily of the processors to ensure that Feed Additives and Premixtures should meet the health requirements laid down in this order;
And, whereas, the Central Government has formulated the proposal specified below for the said purpose and has forwarded the same to the Export Inspection Council as required by sub-rule (2) of the rule 11 of the Export (Quality Control and Inspection) Rules, 1964.
Now, therefore, in exercise of the powers conferred by section 6 of the Export (Quality Control and Inspection) Act, 1963 (22 of 1963), the Central Government after consulting the Export Inspection Council, being of the opinion that it is necessary and expedient to do so for the development of the export trade of India, hereby :-
1. notifies the feed additives and premixtures and its classification, as laid down in the schedule to this Order, which shall be subject to quality control and inspection prior to export;
2. specifies the type of quality control and inspection in accordance with the Export of Feed Additives and Premixtures (Quality Control, Inspection and Monitoring) Rules, 2013;
3. recognises the specification as set in the Schedule as under to this order, as the standard specifications for feed additives and premixtures;
(a) national standards of the importing country or the international standards; or
(b) contractual specifications agreed to between the buyer in the importing country and the exporter provided the same is satisfying the health, safety and other requirements of the importing country;
(c) in absence of any specifications as mentioned in clause (a) and (b) above, the national standards specifications as notified and amended from time to time; and
(d) in absence of any specifications as mentioned in clause (a), (b) and (c) above, the standards laid down by a committee, constituted by the Export Inspection Council of India;

4. prohibits the export of feed additives and premixtures in the course of international trade unless it confirms to the standards applicable to it and is accompanied by a certificate stating to the effect that the processing establishment is registered or approved and monitored by the Export Inspection Agency established under sub-section (1) of section 7 of the Export (Quality Control and Inspection) Act, 1963 (22 of 1963).
5. In this Order, —
(a) “feed additives” means substances, microorganisms or preparation, other than feed material and premixtures, which are intentionally added to feed or water in order to perform, one or more functions;
(b) “premixtures” means mixtures of feed additives or mixture of one or more feed additives with feed materials or water used as carriers, not intended for direct feeding to animals;
(c) processing aids and veterinary medicinal products (other than coccidiostats and histomonostats) shall not be covered.
SCHEDULE [See Paragraph 1] Food Additives and Premixtures and its classification which shall be sub-section to quality control and inspection prior to its export.
1. Approval of establishments.— An establishment desirous to exercise one or more of the activities stated below shall obtain prior approval from the Agency for each of its activities, namely:-
(1) Manufacturing or handling of additives listed below :

पोषण भो�य और पूव� िम�ण का िनया�त स ेपहले रिज�]ीकरण क रीित और ऐसे पोषण भो�य और पूव� िम�ण स े ,वहार करन ेवाले �थापन� का अनुमोदन और मािनटOरग और पSरसर अिभ�ेत ह,ै अथा�त् - (ख) " अिभकरण " से िनया�त िनरी"ण अिभकरण अिधिनयम क धारा 7 के अधीन रिज�]ेशन, अनुमोदन, मािनटOरग िनरी"ण या िनया�त के िलए आशियत �माणीकरण अिभ�ेत ह;ै (ग) " पSरषद " से िनया�त िनरी"ण पSरषद अिभ�ेत ह;ै (घ) " �थापन " से वह पSरसर जहाँ पोषण भो�य या पूव� िम�ण या ऐसे अवयव िजनसे वह तैयार, �सं�कृत, पैक �कया गया ह ैया भो�य ,ापार क भRडारण एकक अिभ�ेत ह;ै (ड़) " भेजने वाले दशे " से भारत अिभ�ेत ह;ै (च) " गंत, दशे " से वह दशे अिभ�ेत ह ैिजसको भारत से माल भेजा गया ह;ै (छ) " �माणप& " से अिधिनयम क धारा 7 क उपधारा (3) के अधीन जारी �कया गया ऐसा �माणप& अिभ�ेत ह,ै जो व�तु क F वािलटी िनयं&ण और िनरी"ण क बाबत शतk क पुिV करता ह;ै (ज) " स"म �ािधकारी " से िनया�त (F वािलटी िनयं&ण और िनरी"ण) अिधिनयम, 1963 (1963 का 22) क धारा 7 के अधीन मुBबई ,कोलकाता, चे`ई, �दCली और कोlी ि�थत िनया�त िनरी"ण अिभकरण अिभ�ेत ह;;
(झ) " पोषण भो�य " से ऐस ेपदाथ�, सू_म जीव या िन\मित, पोषण सामWी और पूव� िम�ण से िभ` पदाथ� अिभ�ेत ह;
जो �Pयाकलाप� का अनुपालन करने के Pम म3 पोषण या जल से िमलाकर बनाए जाते ह;;
(ञ) " पूव� िम�ण " से ऐसे पोषक भो�य का िम�ण या भो�य सामWी के साथ एक या अिधक पोषक भो�य� का िम�ण या जल को वाहक के Zप म3 उपयोग �कया गया ह ैजो पशुJ के सीधे िखलाए जाने के िलए आशियत नह9 ह;;
(ट) " भो�य सामWी " से िविभ` शाकाहारी या पशु से उQप` उQपाद जो अपनी �ाकृितक अव�था से ताजा या पSररि"त ह; और उनके औ$ोिगक �सं�करण स े,ुQप` उQपाद और काब�िनक और अकाब�िनक पदाथ� िजनम3 भो�य सामWी ह� या न हो, अिभ�ेत ह;ै (ठ) " सू_म जीव " से वह मRडल जो सू_म जीव� से िमलकर बना ह ैअिभ�ेत ह;ै या (ड) " भो�य पदाथ� " से शाकाहारी या पशु से उQप` उQपाद जो अपनी �ाकृितक अव�था म3 ताजा या पSररि"त ह ैऔर उनके औ$ोिगक �सं�करण से ,ुQप` उQपाद और काब�िनक और अकाब�िनक पदाथ� जो एकल या िम�ण� से �यु- होते ह; िजनम3 भो�य पदाथ� ह� या न ह� जो पशुJ के िलए मुँह से िखलाए जाने के िलए ह,ै अिभ�ेत ह;;
(ढ) " पोषण भो�य िम�ण " से भो�य सामिWय� का वह िम�ण जो भो�य स ेयु- हो या न हो पशु के मुख स ेिखलाए जाने के Zप म3 पूण� या पूरक भो�य सामिWयां अिभ�ेत ह;;
(ण) " पूण� भो�य सामWी " से भो�य सामिWय� का वह िम�ण जो अपने सिBम�ण के कारण दिैनक राशन के िलए पया�8 ह,ै अिभ�ेत ह;ै ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 (त) " पूरक भो�य सामWी " से भो�य सामWी का वह िम�ण अिभ�ेत ह ैजो िनिNत तQव� क अिधकता रखता ह ैपरAत ु अपने सिBम�ण के कारण दिैनक राशन के िलए पया�8 ह ैय�द वह अAय भो�य सामिWय� के साथ िमलकर �योग क जाती ह;ै (थ) " दिैनक राशन " से पोषक भो�य क कुल मा&ा का बारह �ितशत जो अतंव��तु क आT�ता पर संगिणत ह,ै जो एक �द5 आयु वग� के पशु जीव-जाित के िलए �ित�दन क आव>यकताJ को पूरा करने के िलए आव>यक ह,ै अिभ�ेत ह;ै (द) " �सं�करण सहायक " से ऐसा पदाथ� अिभ�ेत ह ैजो �वयं भो�य सामWी के Zप म3 उपभोग नह9 �कया जाता ह,ै अिभ�Pया के दौरान �कसी तकनीक �योजन को पूरा करने के िलए भो�य पदाथk या भो�य सामिWय� के �सं�करण म3 साशय �योग �कया जाता ह ैया �सं�करण के अंत म3 पदाथ� के अवशेष� या अंितम उQपाद म3 उसके ,ुQप` जो �क िबना आशय के परAतु तकनीक Zप से अपSरहाय� Zप से उपि�थत रहते ह;, परAतु यह �क ऐसे अवशेष पशु के �वा�<य, मानव �वा�<य या पया�वरण पर कोई िवपरीत �भाव नह9 रखते ह;, अिभ�ेत ह;;
(ध) " पशु िच�कQसा औषधीय उQपाद " स,े-
(i) कोई पदाथ� या पदाथk का संयोजन जो पशुJ म3 रोग के रोकथाम या उपचार करने का गुण-धम� रखते ह;, अिभ�ेत ह;;
(ii) कोई पदाथ� या पदाथk का संयोजन जो पशुJ म3 या उन पर मनोवैnािनक कृQय� के भेषज गुणी या �ितर"क य काम के Hारा �Qयावत�न, सुधार या शरीर �Pया िवnान के कृQय� का उपांतरण करने के िलए या िच�कQसीय िनदान क दिृV से �योग �कया जाता ह,ै अिभ�ेत ह;ै (न) " पशु " से ऐसे जीव-जाित स ेसंबंिधत पशु अिभ�ेत ह;, जो साधारणतया पोिषत ह; और पाले जात ेह;, या जहाँ व े भो�य सामिWय� से पोिषत ह;, के मामले म3 जो वन म3 �वतं& Zप स ेरहते ह; और मनुoय या पशुJ के Hारा उपभोग �कए जाते ह;;
(प) " एटंीमाइPोबायल " से ऐसा पदाथ� अिभ�ेत ह ैजो या तो प=ितपूण� या �ाकृितक Zप से सू_म जीव� िजसके अAतग�त जीवाणु, िवषाणु या फफंूद या परजीवी िवशेष Zप से �ोटोजोवा भी ह; क वृि= को रोकने या नV करने के िलए �योग �कए जाते ह;;
(फ) " एटंीबायोSटFस " से �कसी सू_मजीव Hारा उQप` या उसस े,ुQप` एटंीमाइPोबायल जो �कसी सू_म-जीव के साथ अAय सू_म-जीव क वृि= को नV करने या समा8 करने वाला अिभ�ेत ह;ै (ब) " कोक डायो�टेट और िह�टोमोनो�टेट " से �ोटोजोवा को नV या समा8 करने के िलए आशियत पदाथ� अिभ�ेत ह;ै (भ) " अिधकतम अविशV सीमा " से पशु पोषण म3 �कसी भो�य का उपयोग म3 या उसके अवशेष के अिधकतम साATता अिभ�ेत ह,ै जो समुदाय Hारा िविधक Zप से अनुnात Zप म3 �वीकृत �कया जा सकने वाला या �वीकृत Zप म3 माAय भो�य ह;ै
3. अनुपालन का आधार
(1) �सं�करणकता� का यह सिुनिNत करन ेका �ाथिमक दाियQव होगा �क वह िनया�त के िलए आशियत पोषण 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] भो�य और पूव� िम�ण का उपापन, उQपादन, भंडारण, पैpकग और पSरवहन के सभी �Pम� पर समुिचत �वKछ पSरि�थितय� म3 इस �कार �कया जाए जो इन िनयम� म3 अिधकिथत अंतरा�@ीय मानक� के �वा�<य अपे"ाJ के अनुसार हो, और केATीय सरकार Hारा धारा 6 के अधीन �कािशत आदशे म3 माAय िविनदMश� और रा�य सरकार या केATीय सरकार Hारा वािणि�यक या पया�वरणीय संर"ाQमक उपाय� क बाबत अिधरोिपत �कसी भी संिविधक िनबqधन� को वह उQपाद पुV करता हो।
(2) स"म �ािधकारी यह सुिनिNत करेगा �क �सं�करणकता� , िनमा�ता और िनया�तकता� िनयम 4 म3 िनयं&क उपाय� के Zप म3 िविहत अपे"ाJ को रिज�]ीकृत और अनुमो�दत �थापन� क िनयिमत मानीटOरग Hारा उनका अनुपालन करे।
(3) �भावी िनरी"ण, F वािलटी िनयं&ण और �माणीकरण के �योजन के िलए पSरषद समय-समय पर आव>यक अनुदशे जारी करेगी।
4. F वािलटी िनयं&ण, िनरी"ण और मािनटOरग के िलए शतr और ��Pया ,-
(1) आवेदक को भारत म3 सुिवधा �ा8 होगी और रा�य सरकार या केATीय सरकार Hारा वािणि�यक या पया�वरणीय या संर"ाQमक उपाय� क बाबत अिधरोिपत �कसी भी काननूी िनबqधंन� का अनुपालन करेगा।
(2) मानक� म3 िविनUदV और पSरलि"त खतर� और जोिखम� का िवलोपन या कमी को सुिनिNत करन ेके िलए �थापन को अKछी िविनमा�ण �णाली आपदा िवsेषण और आपदा िनयं&ण �Pम या अंतरा�@ीय �तर पर �वीकृत कोई अAय F वािलटी �बंध �णाली पर आधाSरत िनयं&ण �णाली को लागू करना होगा।
(3) उQपाद, आयातकता� दशे िजसके िलए िनUदV �कया गया ह ैके मानक� और अपे"ाJ के अनुपालन म3 होगा:
(क) परAतु यह �क, �थापन अवसंरचना और उपoकर सुिवधाJ, ��PयाJ और अिभलेख� क बाबत �थान म3 उसके अनुपालन क ि�थित को �द\शत कर3गे;
(ख) पोषक भो�य और पूव� िम�ण के उQपादन, भंडारण और पSरवहन के सभी �Pम� पर िनयं&ण के समुिचत उपाय का �योग कर3गे ;
(ग) िजसके अतंग�त सभी �Pम� पर ह;डdलग, भंडारण और �सं�करण के सभी �Pम� पर उQपाद िजसके अंतग�त कlे माल क खोज भी ह ै को पSरलि"त और अनुमाग�णीयता का रखरखाव करेगा और समुिचत अिभलेख का अनुर"ण करेगा;
(घ) परी"ण पSरणाम के कारण अनुपालन न �कए जाने क दशा म3 �कसी भी समय �ित�ेषण िजसम3 आयातकता� दशे Hारा �ित�ेषण भी ह ै�क ि�थित के िलए ��Pया होगी।
4. उQपाद िनc पूरा कर3गे - (क) जब तक �क �थापन के अनुमोदन या रिज�]ेशन म3 या और आयातकता� दशे क उQपादन के �माणीकरण म3 अAयथा उपबंिधत न �कया गया हो इन िनयम� म3 �दए गए मानक� िजसके अंतग�त इन िनयम� क पहली अनुसचूी म3 दी गई साधारण शतr भी ह;, को पूरा कर3ग;े (ख) जब तक �क आयातकता� दशे Hारा अAयथा उपबंिधत न हो इन िनयम� क दसूरी अनसुूची म3 �दए गए लेबल करने के मानक� को पूरा कर3गे। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 11
5. �थापन का रिज�]ेशन या अनुमोदन �ा8 करन ेके िलएः
(1) पोषण भो�य और पूव� िम�ण के िनया�त के िलए आशियत �सं�करणकता� या िविनमा�ता �थापन िजसके अंतग�त पोषक भो�य और पूव� िम�ण का �सं�करण , िविनमा�ण और पैक करन ेक सुिवधा भी ह ैके रिज�]ेशन या अनुमोदन के िलए पSरषद Hारा समय-समय पर जारी अनुदशे� के अनुसार िनकटतम अिभकरण को िलिखत म3 आवेदन करेगा।
(2) आवेदक �थापन के रिज�]ेशन और अनुमोदन के �योजन के िलए इन िनयम� क तीसरी अनसुूची म3 �दए गए �tप म3 तदनुसार घोषणा ��तुत करेगा।
(3) आवेदक इन िनयम� के चौथी अनुसूची म3 यथािविनUदV अपने �Qयेक �Pयाकलाप के िलए रिज�]ेशन या अनुमोदन के िलए यथाि�थित आवेदन करेगा।
(4) आवेदक के Hारा ��तुत �कए गए घोषणा और उसके समथ�कारी द�तावेज� और िनरी"ण और ऐस े परी"ण जो पSरषद Hारा अिधकिथत रीित म3 �कए गए ह;, के आधार पर अिभकरण जब �वयं का यह समाधान कर लेता ह ै �क इन िनयम� और पSरषद Hारा ऐसे �थापन के यथाि�थित रिज�]ेशन या अनुमोदन �दान करने के िलए समय - समय पर जारी �कए गए अनुदशे� म3 िविनUदV अपे"ाJ को पूरा करता ह;ै परAतु यह �क, य�द �थापन उन �Pयाकलाप� से िभ` �Pयाकलाप� को चलाने का िनण�य करता ह ै िजनके िलए उसे यथाि�थित रिज�]ेशन या अनुमोदन �ा8 ह,ै तो उस ेउस �योजन के िलए अिभकरण से िविनUदV रिज�]ेशन या अनुमोदन �ा8 करना होगा;
परAतु यह और �क, य�द अिभकरण संतुV नह9 ह,ै तो वह �थापन का यथाि�थित रिज�]ेशन या अनुमोदन नामंजूर कर सकेगा , और ऐसे नामंजूर �कए जाने को िलिखत म3 उसके िलए कारण� सिहत �थापन को संसूिचत करेगा;
(5) अिभकरण यह सुिनिNत करेगा �क, इस िनयम के अधीन रिज�]ीकृत या अनुमो�दत �थापन� म3 अपे"ाJ का �थापन म3 िनयिमत िनरी"ण, F वािलटी िनयं&ण और मानीटOरग Hारा सतत ् अनुपालन हो रहा ह,ै िजसके िलए अिभकरण को उQपादन, भंडारण और पSरवहन के सभी �Pम� के दौरान �थापन Hारा �वKछता ह;डdलग और भो�य उQपाद� के �सं�करण के िलए �यु- िनयं&ण से संबंिधत अिभलेख� और सभी भाग� के िलए �कसी भी समय अिभकरण क मु- प:चं रहगेी।
(6) य�द �थापन अपे"ाJ को पूरा करना बंद कर दतेा ह ैिजसके अंतग�त नामंजूरी, नवीनीकरण, उपांतरण, िनलंबन, रिज�]ेशन और अनुमोदन को वापस लनेा भी ह,ै जो यथाि�थित �थापन को �दान �कए गए ह;, पSरषद Hारा समय-समय पर जारी �कए गए अनुदशे� के अनुसार अिभकरण आव>यक उपाय करेगा।
1. �थापन के रिज�]ेशन या अनुमोदन का िनलंबन या �ितसंहरण या उपांतरण,--
(1) अिभकरण, अंतरा�@ीय और रा@ीय अपे"ाJ पर आधाSरत �व�ेरणा से या आयातकता� दशे के स"म �ािधकारी से अनुरोध �ा8 होने पर पSरषद के पूव� अनुमोदन से �थापन को �दान �कया गया रिज�]ेशन या अनुमोदन यथाि�थित उपांतSरत, िनलिBबत या �ितसंहSरत कर सकेगा।
(2) पSरषद अिभकरण के ��ताव का परी"ण करेगी और ��Pया के अनुसार रिज�]ेशन या अनुमोदन का उपांतरण, िनलंबन या �ितसहंरण का िविनNय करेगी। 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(3) य�द �थापन को पSरवत�न के अनुरोध के समथ�कारी सुसंगत डाटा के साथ अिभकरण, को आवेदन ��ततु करके �कसी पSरवत�न का ��ताव करता ह ै तो अिभकरण उसका िनधा�रण करेगा और �वयं के समाधान होने पर तदनुसार रिज�]ेशन या अनमुोदन �दान करेगा।
7. �थापन क सूचीः- पSरषद सभी रिज�]ीकृत और अनुमो�दत �थापन� क सूची रखेगा, िजसम3 �Qयेक का एक �ािधकृत संvयांक होगा ।
8. �थापन के अनुपालन के िलए शतr और िनबqधन--
(1) �Qयेक �थापन जो शतr और िनबqधन जो अिधरोिपत क गयी ह;, उनका अनुपालन करेगा।
(2) �Qयेक �थापन, यह सुिनिNत करेगा �क जहाँ मानीटOरग क अपे"ा अिधरोिपत क गई है, वहां मानीटOरग का पालन �कया गया ह ैऔर अिभकरण को Sरपोट� ��तुत करेगा और तQकाल अिभकरण को ससंूिचत करेगा,-- (क) पोषण भो�य के िलए �योग क जा रही सुर"ा के मूCयांकन पर �कसी नवीन सूचना िवशेष Zप से जो िविनUदV �वग� के उपभो-ाJ के �वा�<य संवेदना म3 असर कर सकने वाली ह;ै (ख) जहाँ पोषण भो�य का आयात �कया जा रहा ह ैआयातकता� दशे के स"म �ािधकारी Hारा अिधरोिपत कोई �ितषेध या िनब�Aधन ।
9. �थापन का अनुमोदन और रिज�]ेशन का नवीनीकरण.-
(1) �थापन का रिज�]ेशन या अनुमोदन यथाि�थित �दान �कया जाएगा, जो �Qयेक दो वष� के अवसान पर नवीनीकरण का पा& होगा।
(2) �थापन रिज�]ेशन या अनुमोदन के िलए यथाि�थित वांिछत िविशिVय� और ऐस े द�तावेज� िजसके अंतग�त सुर"ा और संशोधन या पूरक शतk क सूचना भी ह,ै य�द कोई हो, के साथ रिज�]ेशन या अनुमोदन यथाि�थित के अवसान के अिधकतम चार मास के पहल ेअिभकरण को आवेदन करेगा ।
(3) अिभकरण, को जब �वयं का यह समाधान होने पर �क �थापन म3 इन िनयम� क अपे"ाJ का और यह �क �थापन ने इन िनयम� के अधीन �कसी उपबंध या रिज�]ेशन या अनुमोदन म3 अिधकिथत शतk का उCलंघन नह9 �कया ह,ै रिज�]ेशन या अनुमोदन का नवीनीकरण करेगा।
(4) रिज�]ेशन या अनुमोदन के संबंध म3 िनयम 5 के उपबंध यथा आव>यक पSरवत�न सिहत, रिज�]ेशन या अनुमोदन के िलए यथाि�थित लागू ह�गे ।
10. भो�य के िनया�त का अनंितम अनुमोदन .- अिभकरण, पSरषद के पूव� अनुमोदन से िविशV मामल� म3, जहाँ िनधा�रणकता� और िनया�तकता� दशे के स"म �ािधकारी के अनुरोध के आधार पर रिज�]ेशन या अनुमोदन अQयाव>यक ह ैभो�य का िनया�त तीन मास से अनािधक अविध के िलए अनंितम tप से अनुमोदन कर सकेगा ।
11. रिज�]ेशन या अनुमोदन क शतr -
(1) �कसी पोषक भो�य को िनया�त के िलए तब तक रिज�]ीकृत या अनुमो�दत नह9 �कया जाएगा, जब तक �क ऐसे रिज�]ेशन या अनुमोदन के िलए आवेदनकता� ने यथोिचत और पया�8 Zप से वह �द\शत नह9 �कया ह ै�क इन िनयम� म3 िविनUदV अपे"ाJ और पSरषद Hारा पोषक भो�य िनया�त के िलए समय- समय पर जारी �कए गए, अनुदशे� म3 िविनUदV शतk को पूरा �कया गया ह;ै ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13
(2) पोषक भो�य उप-िनयम 3 क अपे"ाJ को पूरा कर3गे और उपिनयम 4 म3 िविनUदV िवशेषताJ म3 स े कम से कम एक �वZप को धारण कर3ग;े
(3) पोषक भो�य और पूव� िम�ण वह नह9 रख3गे जोः-
(i) पशु �वा�<य, मानव �वा�<य या पया�वरण पर �ितकूल �भाव रखे;
(ii) ऐसी रीित म3 ��तुत �कया जाए िजससे उपभो-ा भुलावे म3 पड़ सकता हो;
(iii) पशु उQपाद� क सुिभ` िविशिVय� को xास करने के Hारा या पशु उQपाद� के सुिभ` िविशिVय� के संबंध म3 भुलावे म3 ड़ालकर उपभो-ा को अपहािन करे ।
(4) पोषक भो�य और पूव� िम�ण,
(i) पोषक क िवशेषताJ पर अनुकूल �भाव रख3गे;
(ii) पशु उQपादक� क िवशेषताJ पर अनुकूल �भाव रख3गे;
(iii) सजावटी मछली और पि"य� के रंग अनुकूल �भाव रख3गे;
(iv) पशुJ क पौषिणक आव>यकता को तुV करने के िलए;
(v) पशु उQपाद के पया�वरणीय पSरणाम पर अनुकूल �भाव रख3गे;
(vi) पशु उQपादन, पालन या कCयाण पर अनुकूल �भाव िवशेष Zप से गे�]ो-इंट�टाइन वन�पित या पोषणकारी सामWी क पाचनशीलता पर अनुकूल �भाव Hारा; या
(vii) कोसीडायोसटेटीक या ही�टोमोनो�टीटीक �भाव;
(5) पोषक भो�य और इसके पूव� िम�ण के Zप म3 कोसीडायो�टेटीक या ही�टोमोनो�टेटीक से िभ` �ितजैिवक , रिज�]ीकृत या अनुमो�दत नह9 ह�ग;े
12. पोषण भो�य के �वग�- (1) �सं�करण और िविनमा�ता िनcिलिखत �वग� के पोषक भो�य म3 से एक या उसस े अिधक का िनया�त उसके कृQय और गुण� पर िनभ�र रहते :ए, उपाबंध (iv) म3 िविनUदV ��Pया के अनुसार रिज�]ीकृत या अनुमो�दत ह�ग,े अथा�त;्
(i) �ौ$ोिगक भो�य, वह कहा जाएगा, िजसम3 �ौ$ोिगक �योजन के िलए �कसी तQव को पोषण हते ु बढ़ाया गया ह;ै
(ii) संवेदी भो�य, वह पदाथ� कहा जाएगा, िजसे �कसी तQव को भो�य, संवध�न या भो�य के अवयवी गुण� म3 पSरवत�न या पशुJ से �ा8 भो�य के द>ृयमान ल"ण� के िलए बढाया गया ह;ै
(iii) पौषिणक भो�य;
(iv) �ािण-�ौ$ोिगक भो�य, वह कहा जाएगा, िजसम3 �कसी भो�य का �योग पशुJ के अKछे �वा�<य म3 पालन के अनुकूल �भाव के िलए �कया गया ह ैया, पया�वरण पर अनुकूल �भाव के िलए �योग �कया गया ह;ै
(v) कोसीडायो�टेटीक और ही�टोमोनो�टेटीक !

(2) (क) �सं�करणकता� या िविनमा�ता को पोषक भो�य का उपिनयम (1) म3 वगYकृत �PयाQमक समूह के उसके मूल कृQय या कृQय� के अनुसार एक या उससे अिधक पोषक भो�य के िनया�त के िलए यथाि�थित रिज�]ीकृत या अनुमो�दत �कया जाएगा;
(3) जहॉ उपयु- हो, आवेदक िवशेष पालतू पशुJ म3 भो�य उQपादक पशुJ या अAय पशुJ के िलए भो�य पदाथ� क अपे"ाJ को िविनUदV कर3गे ।
13. �माणीकरण :-
(1) अिभकरण को �वयं का यह समाधान हो जाने के पNात् , �क िनयम 14 म3 िविनUदV भुगतान पर ऐस े पोषक भो�य और पूव� िम�ण से लाग ूमानक� क अपे"ाJ को पूरा �कया गया है, को रिज�]ीकृत या अनमुो�दत �सं�करणकता� या िविनमा�ता पोषक भो�य और पूव� िम�ण के िनया�त के िलए �माणप& जारी करने के िलए �ािधकृत करेगा ।
(2) अिभकरण, �सं�करणकता� और िनया�तक के लागू फ स के साथ अनुरोध �कए जाने पर कोई अAय सुसंगत �माण-प& को जारी करने के िलए, यह समाधान हो जाने के पNात् �क संबंिधत मानक� क अपे"ाJ को पूरा �कया गया ह ै�माण- प& जारी करेगा।
14. फ स :—
(1) रिज�]ेशन के िलए �Qयेक आवेदन या यथाि�थित �थापन के अनुमोदन के िलए, आवेदन के साथ ब;क hाzट Hारा 5000 t0 क फ स संद5 क जाएगी।
(2) �सं�करणकता� या िविनमा�ता या िनया�तकता� अिभकरण को िनया�त क व�तु के मूCय के 0.2 �ितशत स े लेकर Aयूनतम 2000 t0 क दर के अ{यधीन पोषक भो�य और पूव� िम�ण� के िलए �ित परेषण मानीटOरग फ स संद5 करेगा।
(3) �सं�करणकता� या िविनमा�ता Hारा दये �Qयेक परेषण के िलए फ स क रकम को tपए के िनकटतम तक पूणाq�कत �कया जाएगा, और इस �योजन के िलए जहां ऐसी रािश मे tपए का भाग सिBमिलत ह ैवहां य�द ऐसा भाग पचास पैसे या अिधक ह ैतो एक tपया जोड �दया जाएगा, और य�द पचास पैसे से कम ह ैतो उस पर {यान नह9 �दया जाएगा।
15. अपीलः- (क) स"म �ािधकारी के इस अिधसूचना के िनयम 5 के उप-िनयम 4 के अनुसार अपना अनुमोदन नह9 �दान करने या इस अिधसूचना के िनयम 5 के उपिनयम 6 के अनुसार अनुमोदन वापस िलए जाने या िनया�त �माण-प& नह9 जारी �कए जाने या िनयम 13 के अनुसार कोई अAय �माणप& नह9 जारी �कए जाने के िविनNय स े,िथत ,ि- ऐसी सूचना क �ाि8 के 15 �दन के भीतर केATीय सरकार Hारा िनयु- अपीलीय �ािधकारी को अपील कर सकेगा। (ख) अपील का िनपटान उसक �ाि8 के 15 �दन के भीतर �कया जाएगा। पहली अनुसचूीपहली अनुसचूीपहली अनुसचूीपहली अनुसचूी [[[[िनयम िनयम िनयम िनयम 4 (4) (4 (4) (4 (4) (4 (4) (कककक) ) ) ) दखे�दखे�दखे�दखे�]]]] उपयोग क साधारण शतr

2. भो�य का िम�ण केवल पूव� िम�ण और भो�य सामWी म3 केवल वहां अनुnात होगा जहॉ वांिछत �भाव� के संबधं म3 िम�ण के अवयव� के बीच रसायन-भौितक और जैव संगतता ह।ै
3. पूरक भो�य सामिWय� को यथा िविनUदV तन ु�कया जा सकता ह,ै जो भो�य के उन �तर� को अंत\वV नह9 करता जो �क पूण� भो�य सामिWय� के िलए िनयत ह ैसे अिधक हो।
4. साइलेज भो�य को अंत\वV करन ेवाल े पूव� िम�ण क दशा म3 लेबल पर " पूण� िम�ण " के पNात ्साफ-साफ "साइलेज का भो�य " बढाया जाए;

1. िनया�त के िलए पोषक भो�य और पूव� िम�ण क पैpकग या आधान पर पैकर या उQपादक Hारा आयातकता� दशे� और अAत�रा@ीय मानक� क अपे"ाJ के अनुसार यथा वांिछत सभी सचूनाJ के साथ अंWेजी म3 और य�द वांिछत हो गंत, दशे क भाषा म3 सहज द>ृय �थान पर �पV,सुपा} और अिमट Zप से लेबल �कए जाएगंे ।
2. लेबdलग सूचना के अंतग�त िनc भी ह,ै अथा�त् -- (क) रिज�]ेशन या अनुमोदन होने पर, रिज�]ेशन या अनुमोदन म3 यथाि�थित या उिCलिखत �PयाQमक समूह के नाम से पहले भो�य को िविनUदV नाम �दया जाएगा । (ख) रिज�]ीकृत या अनुमो�दत �थापन और िनया�तक के रिज�]ीकृत काया�लय का नाम और पता ;
(ग) शु= या तरल पोषण का कुल वजन या Tव भो�य और पूव� िम�ण क दशा म3 या तो कुल मा&ा या कुल वजन ;
(घ) अिभकरण Hारा जहॉ उपयु- हो �थापन को अनुमोदन संvयांक रिज�]ेशन संvयांक सौपा जाएगा । (ड.) उपयोग के िलए िनदMश, और �योग के संबंध म3 �कसी सुर"ा िसफाSरश�, और जहां लागू हो, रिज�]ेशन या अनुमोदन म3 उिCलिखत िविनUदV अपे"ाए ंिजसके अंतग�त पशु �जाितयां और वह �व�ग िजसके िलए भो�य या भो�य का पूव� िम�ण आशियत ह ै;
(च) पहचान संvयांक ;
(छ) �Zप म3 संदभ� बैच संvयांक और िनमा�ण क तारीख/मास/ और वष�
3. वासक सिBम�ण� के िलए, भो�य क सूची शIद " वासक सिBम�ण� का िम�ण" Hारा �ित�थािपत हो सकेगी। मा&ाQमक पSरसीमा के अ{यधीन यह वासक सिBम�ण� पर लागू नह9 होगा जब भो�य या पेय जल म3 �योग ह�गे ।
4. और पूव� िम�ण क दशा म3, शIद "पूव� िम�ण" (केिपटल अ"र� म3) म3 लेबल पर �पVतया अव>य �कट हो, और वाहक सिBम�ण अव>य घोिषत हो, और जहां जल वाहक के Zप म3 �योग हो पूव� िम�ण कर आTता क मा&ा घोिषत होगी। पूव� िम�ण म3 पूरे के िलए �Qयेक के संबंध म3 Aयूनतम केवल एक भRडारण जीवन चयय� उपद\शत हो सकेगा ;

5. भो�य और पूव� िम�ण केवल बंद पैकेट� या बंद आधान� म3 िनया�त �कए जाएगंे, जो इस �कार बंद होने चािहए �क बांधने वाले पदाथ� खुलने के समय ही टूटे और पुनः �योग म3 ना आए ।
6. कितपय पोषण भो�य और पूव� िम�ण के पैकेट या आधान एक �PयाQमक समहू के पूव� िम�ण के िलए लेबल पर उपरो- (2) म3 िविनUदV सूचना के अितSर- िविनUदV सूचना िनcिलिखत Zप म3 धारण करेगाः
(1) �ािणपालन तकनीक भो�य, कोसीडायो�टेट और िह�टोमोनो�टेट (क) िविनमा�ण क तारीख से गारंटी या भRडारण जीवन चयय� के अवसान क तारीख, (ख) �योग के िलए िनदMश, और (ग) सांTता ;

(ख) गट वन�पित �थरीकारकः सू_म-जीव या अAय रसायिनक Zप से पSरभािषत पदाथ�, जो पशुJ को िखलाए जाने पर गट वन�पित क ि�थित पर सकाराQमक �भाव डालते ह; ;
(ग) ऐसे पदाथ� जो पया�वरण पर सकाराQमक �भाव डालते ह;; और (घ) अA य �ािणपालक तकनीक भो� य । [फाइल सं. 3/59/2007- िनया�त िनरी"ण] ए. के. ि&पाठी, सयुं- सिचव NOTIFICATION New Delhi, the 28th November, 2013 S.O. 3524(E).— In exercise of the powers conferred by Section 17 of the Export (Quality Control and Inspection) Act, 1963 (22 of 1963) the Central Government hereby makes the following rules, namely:
1. Short title and Commencement – (a) These rules may be called the Export of Feed Additives and Premixtures (Quality Control, Inspection and Monitoring) Rules, 2013.
(b) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.— In these rules, unless the context otherwise requires,—
(a) “Act” means the Export (Quality Control and Inspection) Act, 1963 (22 of 1963);
Feed additives and Premixtures before its export and the manner of registration, approval and monitoring of establishments dealing with such feed additives and premises, namely:—
(b) “Agency” means the Export Inspection Agency established under section 7 of Act, for registration, approval, monitoring, inspection or certification intended for export;

(c) “Council” means the Export Inspection Council of India;
(d) “Establishment” means any premises where Feed Additives or Premixtures or ingredients for it are prepared, processed, packaged or stored unit of a feed businesses;
(e) “Country of despatch” means India;
(f) “Country of destination” means the country to which goods are dispatched from India;
(g) “Certificate” means certificate issued under sub-section (3) of section 7 of the Act stating that the commodity conforms to the conditions regarding quality control and inspection;
(h) “Competent Authority” means Export Inspection Agencies (EIAs) at Mumbai, Kolkata, Chennai, Delhi, and Kochi established under section 7 of the Export (Quality Control and Inspection) Act, 1963 (22of 1963);
(i) “feed additives” means substances, microorganisms or preparation, other than feed material and premixtures, which are intentionally added to feed or water in order to perform, one or more functions;
(j) “premixtures” means mixtures of feed additives or mixture of one or more feed additives with feed materials or water used as carriers, not intended for direct feeding to animals;
(k) “feed materials” means various products of vegetable or animal origin, in their natural state, fresh or preserved, and products derived from the industrial processing thereof, and organic or inorganic substances, whether or not containing additives, which are intended for use in oral animal feeding either directly as such, or after processing, in the preparation of compound feedingstuffs or as carriers of premixtures;
(l) “Microorganism” means, colony-forming microorganisms or;
(m) “feedingstuffs” means products of vegetable or animal origin in their natural state, fresh or preserved, and products derived from the industrial processing thereof, and organic or inorganic substances, used singly or in mixtures, whether or not containing additives, for oral animal feeding ;
(n) “Compound feedingstuffs” means mixtures of feed materials, whether or not containing additives, for oral animal feeding in the form of complete or complementary feedingstuffs;
(o) “Complete feedingstuffs” means mixtures of feedingstuffs which, by reason of their composition, are sufficient for a daily ration;
(p) “Complementary feedingstuffs” means mixtures of feedingstuffs which have a high content of certain substances but which, by reason of their composition, are sufficient for a daily ration only if used in combination with other feedingstuffs;
(q) “daily ration” means the average total quantity of feedingstuffs, calculated on a moisture content of twelve percent, required daily by an animal of a given species, age category and yield, to satisfy all its needs;
(r) “Processing aids” means any substance not consumed as a feedingstuff by itself, intentionally used in the processing of feedingstuffs or feed materials to fulfill a technological purpose during treatment or processing which may result in the unintentional but technologically unavoidable presence of residues of the substance or its derivatives in the final product, provided that these residues do not have an adverse effect on animal health, human health or the environment and do not have any technological effects on the finished feed;
(s) “Veterinary medicinal product” means,—
(i). any substance or combination of substances presented as having properties or treating or preventing disease in animals;

(ii). any substance or combination of substances which may be used in or administered to animals with a view either to restoring, correcting or modifying physiological functions by exerting a pharmacological, immunological or metabolic action, or to making a medical diagnosis;
(t) “animals” means animals belonging to species normally nourished and kept or consumed by man as well as animals living freely in the wild in cases where they are nourished with feedingstuffs;
(u) “antimicrobials” means substances produced either synthetically or naturally, used to kill or inhibit the growth of micro-organisms including bacteria viruses or fungi, or parasites, in particular protozoa;
(v) “antibiotics” means antimicrobials produced by, or derived from, a micro-organism, which destroys or inhibits the growth of other micro-organisms;
(w) “coccidiostats and histomonostats” means substances intended to kill or inhibit protozoa;
(x) “maximum residual limit” means the maximum concentration of residue from the use of an additives in animal nutrition which may be accepted by the community as being legally permitted or recognized as acceptable in or on a food.
3. Basis of compliance.— (1) It shall be the primary responsibility of the processors to ensure that the feed additives and premixtures intended for exports are handled and processed at all stages of procurement, production, storage, packing and transport under proper hygienic conditions so as to meet the health requirements laid down in these rules as per international standards and that the product conforms to the specifications recognized in the Order published by the Central Government under section 6 of the Act and any statutory restrictions imposed by the State Government or Central Government with respect to commercial or environmental or conservation measures.
(2) The competent authority shall ensure that the processor, manufacturer and exporter comply with the requirements by regular monitoring of the registered and approved establishment as the control measures prescribed in the rule 4.
(3) The Council shall, for the purpose of effective inspection, quality control and certification, issue necessary instructions from time to time.
4. Conditions and procedure for quality control, inspection and monitoring.— 1) The applicant shall have the facility in India and shall comply with any statutory restrictions imposed by the State Government or Central Government with respect to commercial or environmental or conservation measures.
2) The establishment shall have implemented own-check system based on Good Manufacturing Practice, Good Hygienic Practice, Hazard Analysis and Critical Control Point or any other internationally accepted relevant quality management system to ensure elimination or reduction of the hazards and risks identified and specified in the standards.
3) The product shall be in compliance to the requirements and standards of the importing country where it is destined for:
(a) provided that the establishment shall— demonstrate compliance with respect to the required infrastructure and equipment facilities, procedures and records in place;
(b) exercise proper control measures at all stages of production, storage and transportation of feed additives and premixtures;

(c) identify and maintains traceability at all stages of storage, handling and processing of the product including raw material sourcing and maintains appropriate records therefore;
(d) have procedure in place in case of non-compliance due to test results, rejection at any time including from importing country.
4) The product shall meet — a). the standards and requirements set out in these rules, including the general conditions set out in the First Schedule to these rules, unless otherwise provided for in the registration or approval of the establishment, and in the certification of the product as per the importing country’s requirements;
b). the labeling standards set out in the second schedule to these rules unless otherwise provided by importing country.
5. Establishment to obtain registration or approval.— 1) A processor or manufacturer intending to export feed additive and premixtures shall apply in writing to the nearest Agency, as per the instructions issued by the Council, from time to time, for registration or approval of the establishment including the facility to process, manufacture and pack the feed additives and premixes.
2) The applicant shall, for the purpose of registration and approval of the establishment, submit a declaration accordingly in the form set out Third Schedule to these rules.
3) The applicant shall apply for registration or approval, as the case may be, for each of its activity as specified in the Fourth Schedule to these rules.
4) The Agency shall, on satisfying itself, on the basis of declaration along with supporting documents submitted by the applicant and inspection and such testing carried out in the manner laid down by the Council, that the establishment meets the requirements specified in these rules and any other instructions issued by the council, from time to time, grant registration or approval, as the case may be, to such establishment:
Provided that if the establishment decides to carry out activities other than those for which it has received registration or approval, as the case may be, specific registration or approval from the Agency shall be obtained for that purpose:
Provided further that if the Agency is not satisfied, it shall refuse to grant the registration or approval, as the case may be, to the establishment and communicate such refusal in writing to the establishment along with the reasons therefor;
5) The Agency shall ensure that the establishments registered or approved under this subrule, continue to comply with the requirements by regular inspection, quality control and monitoring of the establishments for which the Agency shall at all times have free access to all parts of the establishments and records pertaining to the control exercised by the establishment for hygienic handling and processing of food products during all stages of production, storage and transport.
6) The Agency shall take necessary measures if the establishment ceases to meet the requirement, which may include refusal, renewal, modification, suspension, withdrawal of the registration or approval, as the case may be, granted to the establishment, as per the instructions issued by the Council from time to time.
6. Suspension or revocation or modification of registration or approval of establishment.—
(1) The Agency may, its own initiative based on international and national requirements or following a request received from a competent authority of importing country, modify, suspend 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] or revoke the registration or approval, as the case may be, granted to the establishment, with the prior approval of the Council.
(2) The Council shall examine the proposal of the Agency and decision on the modification, suspension or revocation of a registration or an approval shall be taken in accordance with the procedure.
(3) If the establishment proposes any change by submitting an application to the Agency, accompanied by the relevant data supporting the request for the change, the Agency shall carry out assessment and, on being satisfied itself, grant registration or approval, accordingly.
7. List of establishment.—The Council shall maintain the list of all registered and approved establishments, each of which shall have an official number.
8. Establishment to comply with conditions and restrictions.—
(1) Every establishment shall comply with the conditions or restrictions, which have been imposed.
(2) Every establishment, where monitoring requirements have been imposed, shall ensure that monitoring is carried out and submit reports to the Agency and it shall forthwith communicate to the Agency,—
(a) any new information that might influence the evaluation of the safety in use of the feed additive, in particular health sensitivities of specific categories of consumers;
(b) any prohibition or restriction imposed by the competent authority of the importing country to which the feed additive is exported.
9. Renewal of registration and approval of establishment.—
(1) The registration or approval, as the case may be, granted to an establishment shall be renewable an expiry of every two years.
(2) An establishment shall make an application to the Agency, for renewal of registration or approval as the case may be, along with desired particulars and documents including the information on safety and a proposal for amending or supplementing the conditions, if any, at the latest four months before the date of expiry of the registration or approval, as the case may be.
(3) The Agency shall, on satisfying itself that the establishment this requirement of these rules and that the establishment has not contravened any provision of these rules or conditions laid down on the registration or approval, renew the registration or approval, as the case may be.
(4) The provisions of rule 5 relation to registration and approval shall, mutatis mutandi, apply to renewal of registration and approval.
10. Provisional approval of export of an additive.— In specific cases, where urgent registration or approval is required based on assessment and request from the competent authority of importing country, the Agency, with the prior approval of the Council, may provisionally approve the export of an additive for a period not exceeding of three months.
11. Conditions of registration or approval.—
(1) No feed additive shall be registered or approved for export unless the applicant for such registration or approval has adequately and sufficiently demonstrated meeting the requirements specified in these rules and conditions specified in the instructions issued by the Council, from time to time, for the export of the additive.

(2) The feed additive shall satisfy the requirements of sub-rule 3 and shall bear at least one of the characteristics specified in sub-rule 4.
(3) The feed additive or premixtures shall not.—
(i) have an adverse effect on animal health, human health or the environment;
(ii) be presented in a manner which may mislead the user;
(iii) harm the consumer by impairing the distinctive features of animal products or mislead the consumer with regard to the distinctive features of animal products.
(4) The feed additive or premixtures shall.—
(i) favorably affect the characteristics of feed;
(ii) favourably affect the characteristics of animal products;
(iii) favourably affect the colour of ornamental fish and birds;
(iv) satisfy the nutritional needs of animals;
(v) favourably affect the environmental consequences of animal production;
(vi) favourably affect animal production, performance or welfare, particularly by affecting the gastro-intestinal flora or digestibility of feedingstuffs; or
(vii) have a coccidiostatic or histomonostatic effect.
(5) Antibiotics, other than coccidiostats or histomonostats, shall not be registered or approved as feed additives or its premixtures.
12. Categories of feed additives.— (1) A processor and manufacturer shall be registered or approved to export one or more of the following feed additive categories, depending on its functions and properties, in accordance with the procedure specified in Annexure IV, namely:—
(i) technological additives, that is to say, any substance added to feed for a technological purpose;
(ii) sensory additives, that is to say, any substance, the addition of which to feed improves or changes the organoleptic properties of the feed, or the visual characteristics of the food derived from animals;
(iii) nutritional additives;
(iv) zootechnical additives, that is to say, any additive used to affect favourably the performance of animals in good health or used to affect favourably the environment;
(v) coccidiostats and histomonostats.
(2) (a) processor or manufacturer shall be registered or approved, as the case may be, to export feed additives within one or more of the functional groups categorized in sub-rule (1),according to its principal function or functions.
(3) Where appropriate, the applicant shall specify the requirements of the feed additives for food-producing animals or other animals, in particular pets.
13. Certification. —
(1) The Agency shall authorize the registered or approved processor or manufacturer for the issuance of certificate for export of additives and premixtures, on payment of the fee specified 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] in rule 14, and after satisfying itself that the requirements of the standards applicable to such additive and premixtures are met.
(2) On request from the processor or exporter along with applicable fee, for issuance of any other relevant certificate, the Agency shall issue the same after satisfying itself that the requirements of the standards are met.
14. Fee. —
(1) Every application for registration or as the case may be, approval of the establishment or shall accompany a fee of five thousand rupees payable by a bank draft.
(2) The processor or manufacturer or exporter shall pay a monitoring fee to the Agency at the rate of 0.2 per cent of fee on board value of export subject to a minimum of two thousand rupees per consignment of feed additives or premixtures.
(3) The amount of fee for each consignment payable by the processor or manufacturer or exporter shall be rounded off to the nearest rupee and, for this purpose, where such amount contains a part of a rupee then, if such a part is fifty paise or more, it shall be increased to arupee and, if such part is less than fifty paise, it shall be ignored.
15. Appeal. — a) Any person aggrieved by the decision of the Competent Authority, either not to accord it approval as per sub-rule (4) of rule 5 of this notification or to withdraw approval as per sub-rule (6) of rule 5 of this notification or not to issue certificate of export or any other relevant certificate as per rule 13 may prefer an appeal within 15 days of the receipt of such communication to an Appellate Authority appointed by Central Government.
b) The Appeal shall be disposed of within 15 days of its receipt.
The First Schedule [See rule 4 (4) (a)] General Conditions of Use
1. The quantity of additives which also exists in the natural state in certain feed materials shall be calculated so that the total of the elements added and the elements present naturally does not exceed the maximum level provided for in the registration or approval, as the case may be.
2. Mixing of additives shall be permitted only in premixtures and feedingstuffs where there is physico-chemical and biological compatibility between the components of the mixture in relation to the effects desired.
3. Supplementary feedingstuffs, diluted as specified, may not contain levels of the additives which exceed those fixed for complete feedingstuffs.
4. In the case of premixtures containing silage additives the words “of silage additives” shall clearly be added on the label after ‘PREMIXTURE’.
The Second Schedule [See rule 4 (4) (b)] Labelling and packaging of feed additives and premixtures
1. The packaging or container of a feed additive or a premixture of additives for export shall be labelled by packer or producer with all information as desired by the importing country’s requirements and international standards, in a conspicuous, clearly legible and indelible manner, in English and if desired, in the language of the country of destination.

2. The labelling information shall include the following, namely:-
(a) the specific name given to the additives upon registration or approval, preceded by the name of the functional group as mentioned in the registration or approval, as the case may be,
(b) the name and the address or registered office of the registered or approved establishment and the exporter;
(c) the net weight or, in the case of liquid additives and premixtures, either the net volume or the net weight;
(d) where appropriate, the approval number or registration number assigned by the Agency to the establishment;
(e) directions for use, and any safety recommendations regarding the use and, where applicable, the specific requirements mentioned in the registration or approval, including animal species and categories for which the additive or premixture of additives is intended;
(f) the identification number;
(g) the batch reference number and date of manufacture in the format ‘DD/MM/YY’.
3. For flavouring compounds, the list of additives may be replaced by the words ‘mixture of flavouring compounds’. This shall not apply to flavouring compounds subject to a quantitative limitation when used in feed and drinking water.
4. Moreover, in the case of premixtures, the word ‘PREMIXTURE’ (in capital letters) must appear clearly on the label, and the carrier substance must be declared and, where water is used as a carrier, the moisture content of the premixture shall be declared. Only one minimum storage life may be indicated in respect of each premixture as a whole; such minimum storage life shall be determined on the basis of the minimum storage life of each of its components.
5. Additives and premixtures shall be exported only in closed packages or closed containers which must be closed in such a way that the fastener is damaged on opening and cannot be re-used.
6. In addition to the information specified in “2” above, packaging or container of certain feed additives and for premixtures belonging to a functional group shall bear specific information on the labels as follows:
(1) Zootechnical additives, coccidiostats and histomonostats:
(a) the expiry date of the guarantee or the storage life from the date of manufacture,
(b) the directions for use, and
(c) the concentration;
(2) Enzymes, in addition to the abovementioned indications:
(a) the specific name of the active component or components in accordance with their enzyme activities, in conformity with the authorisation given,
(b) the International Union of Biochemistry identification number, and
(c) instead of concentration: units of activity (units of activity per gram or units of activity per milliliter);
(3) Micro-organisms:
(a) the expiry date of the guarantee or the storage life from the date of manufacture,
(b) the directions for use,

(d) the number of colony-forming units per gram;
(4) Nutritional additives:
(a) the active-substance level, and
(b) the expiry date of the guarantee of that level or storage life from the date of manufacture;
(5) Technological and sensory additives with the exception of flavouring compounds: the active substance level;
(6) Flavouring compounds: the incorporation rate in premixtures.

(l) denaturants substances which, when used for the manufacture of processed feedingstuffs, allow the identification of the origin of specific food or feed materials.

(c) substances which favorably affect the environment; and
(d) other zootechnical additives.
