PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2816] ubZ fnYyh] cq/okj] uoEcj 30] 2016@vxzgk;.k 9] 1938 No. 2816] NEW DELHI, WEDNESDAY, NOVEMBER 30, 2016/AGRAHAYANA 9, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 30 नव᭥ बर, 2016 का.आ. 3595(अ).—भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना स.ं का.आ. 1448(अ), तारीख 1 जून, 2015 ᳇ारा उन सभी ᳞िᲦयᲂ से, िजनके उसस े ᮧभािवत होन े कᳱ सभंावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसचूना अंतᳶव᳥ ह,ै उपल᭣ध करा दी गई थᱭ, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करत ेᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;
और, राजपᮢ कᳱ ᮧितयां 1 जून, 2015 को जनता के िलए उपल᭣ध करा दी गई थᱭ;
और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ स ेᮧा᳙ आᭃेपᲂ और सुᭃावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक ᱧप स ेिवचार ᳰकया गया;
पेनगंगा व᭠ यजीव अभयार᭛ य महारा᭬ ᮝ के यवतमाल और नांदडे िजलᲂ मᱶ ि᭭ थत ह ैऔर इसका िव᭭ तार 400.91 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ ह ै;
और, ᭃेᮢ मᱶ जीव ज᭠ तु और वन᭭ पित कᳱ िविवधता अ᭜यिधक ह,ᱹ जो ‘‘डे कन ᮧाय᳇ीप जोन के 6ख-कᱶ ᮤीय पठार’’ के जैिवक ᮧा᭠ त का ᮧितिनिध᭜ व करता ह ैऔर 150 पᭃी ᮧजाितयᲂ के अितᳯर त बड़ी सं या मᱶ व᭠ य पशुᲐ जैस ेबाघ (पᱶथरा ᳯटगᳯरस), तᱶदआु (िनयोफेिलस नेबूलोसा), रीछ (मलेूरसस उरिसनस), मुंजक (मुि᭠टया कसमुन᭜जक), लकड़ब घा (हयैना), अजगर (पैथोन मोलुरस), नीलगाय (बोसेलाफस ᮝागोकैमलस), चीतल (एिसस एि᭭सस), काला मृग (एि᭠टलोप करिवकापरा), बनलैा सअूर (सस ᭭ᮓोफा), लंगूर (समेनोिपथेकस इंटेलस), भिेड़या (कैिनस लुपस पिैलपसे), लोमड़ी (वु᭨पेस बे᭠गालिे᭠सस), शाही का आ᮰य ह ै;
और, ᭃेᮢ का वन᭭ पित ᮧकार दिᭃणी उ᭬ ण कᳯटबंधीय शु᭬ क पतझड़ी वन ह ैतथा वृᭃᲂ कᳱ ᮧजाितयᲂ, जैस ेसैग (टैटोना ᮕांिडस), रोहन (सोयिमडा फेबᳯरफुगा), बोसवेिलया सरेेटा, अकेिसया कटेचु, दलबᳶगया िससू, बेहाडा (टᳶमनिेलया बलᳯेरका) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और धवाडा (एनोजेसस लᳯेटफोिलया); िबबा समेकेारपस एनाकारिडयम, गुलवेल (ᳯटनोसपोरा िसनेनिसस), अ᭥माि᳖या म᭨टी᭢लोरा, चरोली (बुचानािनया कोिचनिचनेनिसस), मोहा (मधकुा लᲂिगफोिलया), ᮩािचᳯरया रेमोटा, गुलवेल (ᳯटनो᭭पोरा िसनेलिसस), काटे सवार (बोमबैस केइबा), समुᮤा फाल (बा᳷र᭠गटोिनया अकुटा᭠गुला) स ेसहब ᭃेᮢ कᳱ ᮧमुख वृᭃ ᮧजाित सागौन ह ै;
और, इस अभयार᭛य के चारᲂ ओर के ᭃेᮢ का पᳯर रᭃण और संरᭃण करना आव᭫ यक ह ैतथा िज सकᳱ सीमाᲐ को इस अिध सूचना के पैरा 1 मᱶ पेनगंगा व᭠ यजीव अभयार᭛ य के चारᲂ ओर पाᳯर ि᭭ थ ितक संवेदी जोन के ᱧप मᱶ िव िन ᳸द ᭬ ट ᳰक या गया ह ैऔर पयाᭅवरण कᳱ दिृ᭬ ट स ेउ᳒ोगᲂ या उ᳒ोगᲂ के वगᭅ को तथा उनकᳱ सᳰंᮓ याᲐ और ᮧᳰᮓ याᲐ को उ त पाᳯर ि᭭ थ ितक संवेदी जोन मᱶ ᮧितिष करना आव᭫ यक ह;ै अतः, अब, कᱶ ᮤीय सरकार, पयाᭅवरण (सरंᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (सरंᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत े ᱟए, महारा᭬ ᮝ रा᭔य मᱶ पेनगंगा व᭠ यजीव अभयार᭛ य कᳱ सीमा स े एक ᳰकलोमीटर तक के ᭃेᮢ को पेनगंगा व᭠ यजीव अभयार᭛ य पाᳯरि᭭थितक संवेदी जोन (िजस ेइसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:--
1. पाᳯरि᭭थितक सवंदेी जोन का िव᭭तार और उसकᳱ सीमाए-ं(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार पेनगंगा व᭠ यजीव अभयार᭛ य से एक ᳰकलोमीटर तक के िव᭭ तार के साथ 148.86 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ फैला ᱟआ ह ैऔर ऐसे जोन का सीमा वणᭅन उपाबधं I मᱶ ᳰदया गया ह ै।
(2) पाᳯरि᭭थितक संवेदी जोन, महारा᭬ ᮝ के यवतमाल और पेनगंगा िजलᲂ के 39 ᮕामᲂ तक फैला ह ै । पाᳯरि᭭थितक संवेदी जोन के भीतर आने वाल ेᮕामᲂ कᳱ सूची ᮧमुख िब᭠ दᲐु के िनदᱷशांक के साथ उपाबधं II के ᱨप मᱶ सलं न ह ै।
(3) पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ अᭃांश और दशेांतर के साथ उपाबंध III के ᱨप मᱶ संलᲨ ह ै।
2. पाᳯरि᭭थितक सवंदेी जोन के िलए आचंिलक महायोजना-(1) पाᳯरि᭭थितक संवेदी जोन के ᮧभावी ᮧयोजन हतेु रा᭔य सरकार, राजपᮢ मᱶ इस अिधसचूना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर ᭭थानीय ᳞िᲦयᲂ के परामशᭅ स ेआंचिलक महायोजना ऐसी रीित मᱶ जो इस अिधसूचना मᱶ िविन᳸द᭬ ट कᳱ जाए तथा ससुंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िसांतᲂ, यᳰद कोई हᲂ, के भी साम᭠ ज᭭ य से तैयार ᳰकया जाएगा ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित स ेरा᭔ य सरकार तथा ससुंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश का िसांत, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना इसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक िवचारᲂ का समाकलन करने के िलए संबंिधत रा᭔ य िवभागᲂ के परामशᭅ स ेतैयार ᳰकया जाएगा, अथाᭅत् :--
(i) पयाᭅवरण;
(ii) वन;
(iii) शहरी िवकास;
(iv) पयᭅटन;
(v) नगरपािलका;
(vi) राज᭭ व;
(vii) कृिष;

(viii) महारा᭬ ᮝ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ;
(ix) ᳲसचाई; और
(x) लोक िनमाᭅण िवभाग ।
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भ-ूउपयोग, अवसंरचना᭜मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार स ेिविन᳸द᭬ ट न हो और आचिंलक महायोजना मᱶ सभी अवसंरचना के िवकास तथा ᳰᮓयाकलापᲂ को और अिधक दᭃ और पाᳯरि᭭थितक अनुकूल ᱧप मᱶ ᮓमगिणत हᲂगे ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-सभंरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मदृा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐस ेअ᭠य पहलᲐू, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान उपासना ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलो᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन े के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुल े ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंत ु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का सपंᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनमुोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए और पैरा 4 कᳱ सारणी के ᭭तंभ
(2) के अधीन मद स.ं 10, स.ं 17, स.ं 23, स.ं 32 और स.ं 35 के सामन ेसूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत ्:-
(i) पाᳯरि᭭ थितक अनकूुल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैस ेटᱶट, लकड़ी के मकान आᳰद ;
(ii) िव ᳒ मान सड़कᲂ को चौड़ा करना और सुदढ़ृ करना तथा नई सड़कᲂ का संि᳖ माणᭅ ;
(iii) ᮧदषूण उ᭜प᳖ न करन ेवाल ेलघु उ᳒ोग,
(iv) वषाᭅ जल संचय, और
(v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सिुव धाजनक ᭭ टोर और ᭭ थानीय सुिव धाए ंभी ह,ᱹ :
परंत ुयह और ᳰक रा᭔य सरकार के पूवᭅ अनमुोदन और सिंवधान के अन᭒ु छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसिूचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भ-ूअिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करन ेके प᳟ात ्रा᭔य सरकार ᳇ारा ᮧ᭜येक मामल ेमᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय को सूचना दनेी होगी । परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजसस ेहᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके सरंᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢ ᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित स ेमागᭅिनदᱷश तयैार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, पयᭅटन महायोजना के अनुसार हᲂगे । जो आंचिलक महायोजना का भाग ᱨप मᱶ िन᳜िलिखत ᱨप मᱶ हᲂगे । (ख) पाᳯरि᭭थितक पयᭅटन महायोजना पयᭅटन िवभाग, महारा᭬ ᮝ सरकार ᳇ारा राज᭭ व और वन िवभाग, महारा᭬ ᮝ सरकार के परामशᭅ स ेतैयार होगी । (ग) पाᳯरि᭭थितक पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत ्:-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार रा᭬ ᮝीय ᭪ याᮖ सरंᭃण ᮧािधकरण (समय-समय पर यथासशंोिधत), पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा जारी मागᭅिनदशेᲂ के अनुसार होगा िजसमᱶ पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व ᳰदया जाएगा और पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा ;
(ii) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के संबंिधत पयᭅटकᲂ के अ᭭ थायी िनवास के िलए आवासन के िसवाय पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और ᳯरसोटᭅ के नए सिंनमाᭅण पेनगंगा व᭠ यजीव अभयार᭛ य कᳱ सीमा के एक ᳰकलोमीटर के भीतर अनु᭄ात नहᱭ हᲂगे ;
परंत ुरा᭬ ᮝीय उ᳒ान कᳱ सीमा के एक ᳰकलोमीटर के परे पाᳯरि᭭ थितक सवेंदी जोन के िव᭭तार तक नए होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना को पाᳯरि᭭ थितक अनुकूल पयᭅटन सिुवधाᲐ के िलए पूवᭅ िनि᳟त और नामिन᳸द᳥ ᭃेᮢᲂ मᱶ और पयᭅटन महायोजना के अनसुार अनु᭄ात ᳰकया जाएगा ।
(iii) आंचिलक महायोजना का अनमुोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत सबंंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात होगा ।
(4) नसैᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपणूᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ संरᭃा और सुरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थल- पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, सरंचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनसुरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वाय ुᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनसुरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, जल (ᮧदषूण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसचूना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय सघंटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम स े पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।
(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासशंोिधत अिधसूचना सा. का. िन. 343 (अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनसुार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनकूुल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी ᳇ारा अनमुोᳰदत होन ेतक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनसुार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(12) औ᳒ोिगक इकाइया.ं- (क) िविध के अनुसार ᭭ थािपत िव᳒मान लकड़ी आधाᳯरत उ᳒ोगᲂ के िसवाय ᮧ᭭ तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर ᳰकसी नए लकड़ी आधाᳯरत उ᳒ोग कᳱ ᭭ थापना कᳱ अन᭄ुा नहᱭ दी जाएगी । (ख) ᮧ᭭ तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वाय,ु मृदा, ᭟ विन ᮧदषूण करने वाल ेᳰकसी नए उ᳒ोग कᳱ ᭭ थापना कᳱ अनु᭄ा नहᱭ दी जाएगी ।
4. पाᳯरि᭭थितक सवंदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सचूी - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-- 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
1. वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइया ं। (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न ेकᳱ इकाइया ंवा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेल ू आव᭫यकताᲐ िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संिनमाᭅण या मर᭥ मत के िलए भूिम को खोदना और मकान बनान े के िलए दशेी टाइ᭨ स या टᲂ का िनमाᭅण करना भी सि᭥ मिलत ह,ै के िसवाय नहᱭ हᲂगी ;
(ख) खनन संᳰᮓयाए,ं माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमलूपाद बनाम भारत सरकार के मामल ेमᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) स.ं 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामल ेमᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के अनसुरण मᱶ सवᭅदा ᮧचालन होगा ।
2. आरा मीलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
3. जल या वाय ु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाले का िव᭭ तार अन᭄ुात नहᱭ होगा ।
4. जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
5. नए बृहत जल िव᳒ुत पᳯरयोजना और िसचाई पᳯरयोजना कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
6. ᳰकसी पᳯरसकंटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
7. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
8. नए लकड़ी आधाᳯरत उ᳒ोग । पाᳯरि᭭थितक संवेदी जोन कᳱ सीमाᲐ के भीतर नए लकड़ी आधाᳯरत उ᳒ोगᲂ कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा:
परंतु िव ᳒ मान लकड़ी आधाᳯरत उ᳒ोग िविध के अनुसार जारी कर सकता है ।
9. फमᲄ, िनगमᲂ, कंपिनयᲂ ᳇ारा बड़ ेपैमान ेपर वािणि᭔यक पशुᲐ और पो᭨ᮝी फामᲄ कᳱ ᭭थापना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । हालाᳰंक, ᭭थानीय ᳰकसानᲂ ᳇ारा एक छोटे पैमाने पर पहल कᳱ अनमुित ह।ै िविनयिमत ᳰᮓयाकलाप
10. होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭ थितक के अनुकूल पयᭅटन ᳰᮓयाकलापᲂ स ेसंबंिधत पयᭅटकᲂ के िलए अ᭭थायी आवास के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर के भीतर नए वािण᭔यक होटलᲂ और ᳯरसोटᲄ कᳱ अनु᭄ा नहᱭ दी जाएगी ।
11. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी नए वािणि᭔यक संिनमाᭅण को अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय ᭪ यि तयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण िजसके अंतगᭅत पैरा 3 के उपपैरा (1) मᱶ सूचीब ᳰᮓयाकलाप भी ह,ᱹ को करने के िलए अनु᭄ात ᳰकया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 (ख) ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोगᲂ से संबंिधत सिंनमाᭅण ᳰᮓयाकलापᲂ को लागू िनयमᲂ और िविनयमᲂ के अनसुार, यᳰद कोई हᲂ तो, सᭃम ᮧिधकारी कᳱ पूवᭅ अनु᭄ा स ेअन᭄ुात ᳰकया जाएगा । (ग) पर᭠तु, जहा ँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा ह ैतो वहाँ, एक ᳰकलोमीटर के प᭫ चात् और पाᳯरि᭭थितक संवेदी जोन के िव᭭ तार तक ᭭ थानीय ᭪ यि तयᲂ कᳱ सावी आव᭫ यकता के िलए संिनमाᭅण अन᭄ुात होगा तथा अ᭠ य वािणि᭔ यक सिंनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे ।
12. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैस े वायुयान, गमᭅ वायु गु᭣बारᲂ, आᳰद का अभयार᭛य ᭃेᮢ के ऊपर स ेउड़ना । लागू िविधयᲂ के अनुसार िविनयिमत (अ᭠ यथा उपबंिधत के िसवाय) ।
13. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनमुित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनसुार िविनयिमत होगी । (ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ के मामलᲂ मᱶ कायᭅकरण योजना िनदᱷशᲂ का अनसुरण ᳰकया जाएगा ।
14. वािणि᭔यक जल संसाधन िजसके अंतगᭅत भिूमगत-जल संचयन भी ह ै। (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेल ूखपत के िलए जल का िन᭬कषᭅण (सतही और भिूमगत जल) अनु᭄ात होगा । (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भिूमगत जल का िन᭬कषᭅण के िलए सबंंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपिेᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह ै। (ग) सतही या भिूमगत जल का िवᮓय अनु᭄ात नहᱭ होगा । (घ) जल के संदषूण या ᮧदषूण, िजसके अंतगᭅत कृिष भी ह,ै को रोकन ेके िलए सभी उपाय ᳰकए जाएंगे ।
15. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण । भिूमगत केबलᲂ कᳱ अिभवृि कᳱ जाएगी ।
16. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड़ लगाना । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
17. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना । उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनसुार हᲂगे ।
18. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अनसुार वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
19. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
20. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।

22. वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
23. ᮧदषूण उ᭜प᳖ न करन ेवाल ेलघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन मᱶ देशीय माल स े उ᭜पादᲂ का उ᭜पादन करने वाल े गैर ᮧदषूण, गैर पᳯरसकंटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत दशेीय माल स े औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालत ेह,ᱹ अनु᭄ात ᳰकए जाएगें ।
24. वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
25. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
26. वायु और यािनक ᮧदषूण । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
27. ᭟विन ᮧदषूण । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
28. ठोस अपिश᳥ ᮧबंधन। लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
29. दकुानदारᲂ ᳇ारा पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
30. कृिष पित मᱶ कठोर पᳯरवतᭅन। लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे । सवंᳶधत ᳰᮓयाकलाप
31. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । इनमᱶ से कुछ ᳰᮓयाकलापᲂ के अ᭜यिधक िव᭭तार को, आंचिलक महायोजना के अनुसार िविनयिमत ᳰकया जायेगा ।
32. वषाᭅ जल संचयन । सᳰᮓ य ᱨप स ेबढ़ावा ᳰदया जाएगा ।
33. जैिवक खेती । सᳰᮓ य ᱨप स ेबढ़ावा ᳰदया जाएगा ।
34. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप स ेबढ़ावा ᳰदया जाएगा ।
35. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह ᱹ। सᳰᮓ य ᱨप स ेबढ़ावा ᳰदया जाएगा ।
36. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । बायो गैस, सौर ᮧकाश, आᳰद को बढ़ावा ᳰदया जाएगा ।
37. कौशल िवकास । सᳰᮓ य ᱨप स ेबढ़ावा ᳰदया जाएगा ।
38. कृिष वािनकᳱ। सᳰᮓ य ᱨप स ेबढ़ावा ᳰदया जाएगा ।
39. पयाᭅवरण जागᱨकता। सᳰᮓ य ᱨप स ेबढ़ावा ᳰदया जाएगा ।
40. सामुदाियक ᮧकृित भंडार। सᳰᮓय ᱨप से पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय और रा᳦ीय बाघ संरᭃण ᮧािधकरण के ᳰदशा िनदᱷशᲂ को बढ़ावा ᳰदया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9
5. मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए तीन वषᭅ के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत ्:- (क) िजला कले टर, यवतमाल अ᭟ यᭃ;
(ख) िजला कल टर, नांदेड का ᮧितिनिध सद᭭य;
(ग) िजला पंचायत, यवतमाल का मु य कायᭅकारी अिधकारी सद᭭य;
(घ) पयाᭅवरण (िजसके अंतगᭅत िवरासत सरंᭃण भी ह)ै के ᭃेᮢ मᱶ कायᭅ करन ेवाल ेगैर सरकारी संगठनᲂ का महारा᭬ ᮝ सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध - सद᭭य;
(ङ) महारा᭬ ᮝ सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का एक िवशेष᭄ - सद᭭य ;
(च) महारा᭬ ᮝ रा᭔य जैव-िविवधता बोडᭅ का सद᭭य-सिचव/सद᭭य सद᭭य;
(छ) ᮧादिेशक अिधकारी, महारा᭬ ᮝ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ, सद᭭य;
(ज) ᭃेᮢ का क᭭ बा योजनाकार अिधकारी, यवतमाल (झ) उप वन सरंᭃक, पसुाड वन ᮧभाग सद᭭य;
सद᭭य- सिचव ।
6. िनदᱷश िनबंधन :
(1) मािन टरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(2) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.
1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अनुसूची के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आन े वाल े ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(3) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयाकं का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐस ेᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ुपाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐस ेᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(4) मानीटरी सिमित का सद᭭य-सिचव या संब कलटर या सरंिᭃत ᭃेᮢ का ᮧभारी ऐस े᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा ।
(5) मानीटरी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमिंᮢत कर सकेगी ।
(6) मानीटरी सिमित ᮧ᭜यके वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠यजीव वाडᭅन को उपाबधं IV मᱶ उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी । 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

8. कोई अ᭠ य मह᭜ वपणूᭅ िवषय । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 30th November, 2016 S.O. 3595(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, by the Government of the India in the Ministry of Environment, Forest and Climate Change vide number S.O.
1448 (E), dated the 1st June 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And Whereas copies of the Gazette were made available to the public on the 1st June 2015;
And Whereas, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
And Whereas, the Painganga Wildlife Sanctuary is situated in Yavatmal and Nanded Districts of Maharashtra and extends over an area of 400.91square kilometers;
And Whereas, the area has a high Faunal and Floral diversity represents biotic province “6 B-Central Plateau of the Deccan Peninsula Zone” and supports large number of wild animals such as the Tiger Panthera tigris, Leopard Neofelis nebulosa, Sloth Bear (Melursus ursinus, Barking Deer Muntia cusmuntjak, Hyaena Hyaena hyaena, Python (Python molurus), Nilgai (Boselaphus tragocamelus), Chital (Axis axis), Black Buck (Antilope cervicapra), Wild boar (Sus scrofa), Langur (Semnopithecus entellus), Wolf (Canis lupus pallipes), Fox (Vulpes bengalensis), Porcupine besides 150 bird species;
And Whereas, the vegetation type of the area is classified as southern tropical dry deciduous forest and teak is the dominant tree species of the region associated with species such as Sag (Tectona grandis), Rohan (Soymida febrifuga), Boswellia serrata, Acacia catechu, Acacia leucophloea Dalbergia sissoo, Behada (Terminalia belarica) and Dhawada (Anogeissus latifolia); Biba Semecarpus anacardium, Gulwel (Tinospora sinensis), Ammannia multiflora, Charoli (Buchanania cochinchinensis), Moha (Madhuca longifolia), Brachiaria remota, Gulwel (Tinospora sinensis), Kate Sawar (Bombax ceiba), Samudra Phal (Barringtonia acutangula).
And Whereas, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Painganga Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view class of industry and to prohibit industries or and their operation and processes in the said Eco-sensitive Zone;
Now Therefore, Now Therefore, in exercise of the power conferred by sub-section(1) and clauses (v) and
(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of up to one kilometer from the boundary of Painganga Wildlife Sanctuary in the State of Maharashtra as the Painganga Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone is spread over an area of
148.86 square kilometres with an extent of up to one kilometer from the boundary of Painganga Wildlife Sanctuary and the boundary description of the such Zone is given in Annexure I.
(2) The Eco-sensitive Zone is spread across 39 villages in Yavatmal and Painganga Districts in Mahashtra.
The list of the villages with co-ordinates of prominent points is appended as Annexure II.
(3) The map of the Eco-sensitive Zone along with latitude and longitude is appended as Annexure III.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.

(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(ix) Maharashtra State Pollution Control Board;
(x) Irrigation; and
(xi) Public Works Department;
for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 10, 17,23,32 and 35 in column (2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc.
for eco-friendly tourism activities,
(ii) Widening and strengthening of existing roads and construction of new roads.
(iii) Small scale industries not causing pollution,
(iv) Rainwater harvesting, and
(v) Cottage industries including village industries, convenience stores and local amenities:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that State Government shall correct any error appearing in the land records within the Eco-sensitive Zone, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government to prohibit development activities at or near these areas in such a manner as which are detrimental to such areas.
(3) Eco-Tourism.- (a) The activity relating to eco-tourism within the Eco-sensitive Zone shall be as per Eco- Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism, Government of Maharashtra in consultation with Department of Revenue and Forests, Government of Maharashtra.
(c) The activities of eco-tourism shall be regulated as under, namely:-
(i) all new eco-tourism activities or expansion of existing eco-tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Painganga Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities;
Provided that beyond the distance of one kilometer from the boundary of the Protected Areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in predefined and designated areas for Eco-tourism facilities as per Tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and rules made thereunder.

(7) Air pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016, as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and nonbiodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone
(10) Bio-medical waste.- The bio-medical waste in the Eco-sensitive Zone shall be disposed of as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic .- The vehicular movement shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Ministry of Environment, Forests and Climate Change, Monitoring Committee shall monitor compliance of vehicular movement the rules and regulations under the relevant Acts and made thereunder.
(12) Industrial Units .-
(a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based Industries set up as per the Law.
(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-sensitive zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below, namely:- TABLE S.N. (b) The mining operations shall strictly be in accordance with the interim order of the Hon’ble Supreme Court dated 04th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and order of the Hon’ble Supreme Court dated 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
5. Establishment of new major hydroelectric projects and irrigation projects.
Prohibited (except as otherwise provided) as per applicable laws.
6. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
7. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
8. New wood based industry. Establishment of new wood based industry shall not be permitted within the limits of Eco-sensitive Zone:
Provided the existing wood-based industry may continue as per law
9. Establishment of large-scale commercial livestock and poultry farms by firms, corporates, companies.
Prohibited (except as otherwise provided) as per applicable laws. However, initiatives on a small-scale by the local farmers are permitted.
Regulated Activities
10. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area except for accommodation for temporary occupation of tourists related to Ecofriendly tourism activities.
11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer.
Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in subparagraph (1) of paragraph 3:
(b) Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any.
(c) Beyond one kilometre upto the extent of Eco- Sensitive Zone, construction for bone fide local needs shall be allowed and other construction 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] activities and construction and augmentation of civic amenities shall be regulated as per the Zonal Master Plan.
12. Undertaking activities related to tourism like over-flying the Sanctuary area by aircraft, hot-air balloons, etc.
Regulated (except as otherwise provided) as per applicable laws.
13. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
(c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed.
14. Commercial water resources. including ground water harvesting.
(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land;
(b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority;
(c) no sale of surface water or ground water shall be permitted;
(d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
15. Erection of electrical cables and telecommunication towers.
Promote underground cabling
16. Fencing of existing premises of hotels and lodges.
Regulated as per applicable laws.
17. Widening and strengthening of existing roads.
Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
18. Movement of vehicular traffic at night. Regulated for commercial purpose, as per applicable laws.
19. Protection of hill slopes and river banks. Regulated as per applicable laws.
20. Discharge of treated effluents in natural water bodies or land area.
Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
21. Extraction of ground water. Regulated as per applicable laws.
22. Commercial Sign boards and hoardings. Regulated as per applicable laws.
23. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Ecosensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
24. Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated as per applicable laws.

5. Monitoring Committee:-
(1) The Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-
(a) District Collector, Yavatmal - Chairman;
(b) representative of District Collector, Nanded - Member;
(c) Chief Executive Officer, Zilla Panchayat, Yavatmal - Member
(d) a representative of Non-governmental Organizations working in the field of environment (including heritage conservation) to be nominated by the Government of Maharashtra– Member;
(e) one expert in the area of ecology and environment to be nominated by the Government of Maharashtra - Member;
(f) Member-Secretary/Member of the Maharashtra State Biodiversity Board – Member;
(f) Regional Officer, Maharashtra State Pollution Control Board, - Member;
(g) Town Planning Officer Yavatmal- Member;
(h) Deputy Conservator of Forests, Pusad Forest Division –Member Secretary
6. Terms of Reference:
(1) The Monitoring Committee shall monitor the compliance of the provisions of Notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September,
25. Introduction of exotic species. Regulated as per applicable laws.
26. Air and vehicular pollution. Regulated as per applicable laws.
27. Noise pollution. Regulated as per applicable laws.
28. Solid Waste Management. Regulated as per applicable laws.
29. Use of polythene bags by shopkeepers. Regulated as per applicable laws.
30. Drastic Change of Agriculture systems. Regulated as per applicable laws.
Promoted Activities
31. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
However, excessive expansion of some of these activities should be regulated as per, master plan.
32. Rain water harvesting. Shall be actively promoted.
33. Organic farming. Shall be actively promoted.
34. Adoption of green technology for all activities.
Shall be actively promoted.
35. Cottage industries including village artisans, etc.
Shall be actively promoted.
36. Use of renewable energy sources. Bio gas, solar light etc to be promoted
37. Skill Development. Shall be actively promoted.
38. Agro-forestry. Shall be actively promoted.
39. Environmental Awareness. Shall be actively promoted.
40. Community Nature Reserves. Shall be actively promoted in conformity with MOEF&CC and National Tiger Conservation Authority Guidelines.
24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(4) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended Annexure IV .
(7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
