PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2817] ubZ fnYyh] cq/okj] uoEcj 30] 2016@vxzgk;.k 9] 1938 No. 2817] NEW DELHI, WEDNESDAY, NOVEMBER 30, 2016/ AGRAHAYANA 9, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय अिधसचूना नई ᳰद᭨ली, 30 uoEcj] 2016 का.आ. 3596(अ).—भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना स.ं 1450 (अ) तारीख 1 जून, 2015, उन सभी ᳞िᲦयᲂ स,े िजनके उसस ेᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसचूना अंतᳶव᳥ ह,ै उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत करते ᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी; और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर कᱶ ᮤीय सरकार ᳇ारा स᭥यक् ᱧप से िवचार ᳰकया गया; पाखल व᭠ यजीव अभयार᭛ य 17°42.5’ और 18°10’ उᱫर अᭃांश तथा 79°55’ और 80°10’ पूवᭅ दशेांतर के बीच मᱶ अवि᭭थत ह ैऔर जो मुयत: तेलंगाना के वारंगल (दिᭃण) ᮧभाग और वारंगल (उᱫर) ᮧभाग के भीतर आता ह ैऔर यह ᮓमश: इटरनगरम व᭠यजीव अभयार᭛य और ᳰक᳖रासनी व᭠यजीव अभयार᭛य (ख᭥म िजले) ये प᭠ᮤह और तीस ᳰकलोमीटर कᳱ दरूी पर अवि᭭थत ह ै; और, त᭜कालीन संयुᲦ आंᮥ ᮧदशे रा᭔य के ᮧाचीनतम अभयार᭛यᲂ मᱶ से पाखल व᭠यजीव अभयार᭛य एक ह,ै अभयार᭛य का नामकरण पाखल झील (नमभूिम), के नाम पर ᳰकया गया ह,ै जो ᭭थानीय लोगᲂ के िलए ᳲसचाई का 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ᳫोत ह ैऔर ऐितहािसक पैतृक संपिᱫ स ेभी भरपूर ह,ै इसका सि᳖माᭅण 1323 ई. के दौरान काकाितय राजवंश का राजा ᮧताप ᱧᮤ ᳇ारा कराया गया था ; और, पाखल व᭠यजीव अभयार᭛य ‘6बी’ जैव-भौगोिलक ᭃेᮢ, अथाᭅत् िडकैन ᮧाय᳇ीप (6) के ᮧमुख पठार मᱶ आता ह ै और गोदावरी घाटी के वन के िव᭭ततृ भ-ूभाग का एक भाग भी ह,ै जो उसके उᱫर पूवᭅ मᱶ इटरनगरम व᭠यजीव अभयार᭛य और उस अभयार᭛य के दिᭃण पूवᭅ मᱶ ᳰक᳖ेरासानी व᭠यजीव अभयार᭛य मᱶ समािहत ह;ै और, उस अभयार᭛य मᱶ सामा᭠यत: टᳶमनेलीय टोमेनटोसा, एनोजेइसस लेटीफोिलया, बो᭭वेिलया सेरैटा, डाय᭭पायरस मेकैयनोसाइलेगन, ᭭टरयूलीया यूरे᭠स, मधुका इंिडका, डलैबेरिजया पᱹᳯटकुलेटा, ओिडना वोिडयर, जैिलया डोबैिᮩफोरिमस, लोरोजाइलोन ᭭वाटेिनया, लेजर᭭ᮝोिमया पैरवी᭢लोरा, लेटैनथस कोिलनस, सोयिमडा फेᮩी᭢यूगा, टेरिमनैिलया बैवेᳯरका, टᳶमनैिलया चे᳞ूबा, अकेशीया सुबᮤा, अभयार᭛य के ᳲचटागुडा ख᭛डᲂ मᱶ िवशेष ᱧप से िव᭭तृत बै᭥बू ᮩैस िजसमᱶ डᱶᮟोकैलेमस एᮝीटस और बै᭥बुसा उर᭛डीनैसी भी ह ै; और, पाखल व᭠यजीव अभयार᭛य मᱶ िविभ᳖ ᮧकार के संकटाप᳖ ᮧजाितयाँ, जैसे बाघ (पᱹथरा ᳯटगᳯरस), भारतीय गौर, तᱶदआु (पᱶथरा पारडस), तᱶदआु िब᭨ली (परीयोनीलरस बᱹगलेनिसस), रीछ (मेलोसस यूᳯरिसनस), लकड़बघा (हायना हायना), जंगली कुᱫा (काउन अ᭨पाइनस), भेिड़या (कैिनस लपस पि᭨लपेस), िसयार (कैिनस औरेस), लोमड़ी (वु᭨पेस बᱹगलेनिसस), सांभर (ᱧसा यूिनकलर), चीतल (एिसस एिसस), चौᳲसघा िहरन (टेटरािसरस Ფाडरीकॉरिनस), ᳲचकारा, नीलगाय (बोसलेफस ᮝागोकेमलस), अजगर (पायथन मॉलूरस), िवशाल िगलहरी (पैटाओᳯर᭭टा ᳰफली᭡पᱹिसस) और उड़ने वाली िगलहरी शरण िलए ᱟए ह ै; और, पाखल व᭠यजीव अभयार᭛य दो जल िनकास पितयᲂ के िलए जलागमन का भाग बनाता ह,ै एक जल िनकास पित लखनावारम झील से होकर गोदावरी नदी मᱶ िमलता ह ैऔर दसूरा पाखल झील और पाखल नदी (ख᭥माम िजले कᳱ मु᳖ेᱧ नदी) से होत ेᱟए कृ᭬णा नदी मᱶ िमलता ह ै; और, अब इस अभयार᭛य के चारᲂ ओर के ᭃेᮢ का पᳯर रᭃण और सरंᭃण करना आव᭫ यक ह ैतथा िज सकᳱ सीमाᲐ को इस अिध सूचना के पैरा 1 मᱶ पाखल व᭠ यजीव अभयार᭛ य के चारᲂ ओर पाᳯर ि᭭ थ तक संवेदी जोन के ᱧप मᱶ िव िन ᳸द ᭬ ट ᳰक या गया ह ैऔर पयाᭅवरण कᳱ दिृ᭬ ट से उ᳒ोगᲂ या उ᳒ोगᲂ के वगᭅ को तथा उनकᳱ संᳰᮓ याᲐ और ᮧᳰᮓ याᲐ को उ त पाᳯर ि᭭ थ तक संवेदी जोन मᱶ ᮧितिष करना आव᭫ यक ह;ै अतः, अब, कᱶ ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत] पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2), के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, तेलंगाना रा᭔य मᱶ पाखल व᭠ यजीव अभयार᭛ य कᳱ सीमा स े0 (पाᳯरि᭭थितक संवेदी जोन शू᭠य पाखल व᭠यजीव अभयार᭛य कᳱ सीमा के साथ उᱫर-पूवᱮ छोर जो इटरनगरम व᭠यजीव अभयार᭛य कᳱ सीमा के समीप कᳱ ओर ह)ै स े10 ᳰकलोमीटर तक के ᭃेᮢ को, पाखल व᭠ यजीव अभयार᭛ य ‘पाᳯरि᭭थितक संवेदी जोन’ (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसके ᭣यौरे िन᳜िलिखत ह,ै अथाᭅत:्
1. पाᳯरि᭭थितक सवंदेी जोन का िव᭭तार और उसकᳱ सीमाए-ं-(1) पाᳯरि᭭ थितक संवेदी जोन तेलंगाना के वारंगल िजले मᱶ 965.71 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ िव᭭तृत ह ैऔर िजसके अंतगᭅत वारंगल िजले मᱶ 11 मंडल अथाᭅत् मुलुगू, नेलाबे᭨ली, नरसंपत, कानापुर, गुदरू, कोयागुडा, चे᳖ारावपेट, महबुबाद, केसमुदरम, गोᳲबदरावपेट, तडवई के 108 ᮕाम सि᭥मिलत ह ै। ¹Hkkx IIµ[k.M 3(ii) ] Hkkjr dk jkti=k % vlk/kj.k 3
(2) पाᳯरि᭭थितक संवेदी जोन पाखल व᭠यजीव अभयार᭛य कᳱ सीमा स ेशू᭠य ᳰकलोमीटर स ेदस ᳰकलोमीटर तक के ᭃेᮢ मᱶ ह ै।
(3) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का वणᭅन उपाबधं I के ᱧप मᱶ संलᲨ ह ैऔर ᮕामᲂ कᳱ सूची उपाबधं II मᱶ दी गई ह ै।
(4) अᭃांश और दशेांतर रेखा के साथ-साथ पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का मानिचᮢ उपाबधं III के ᱧप मᱶ इस अिधसूचना के साथ संलᲨ ह ै।
2. पाᳯरि᭭थितक सवंदेी जोन के िलए आचंिलक महायोजना—(1) पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय लोगᲂ से आंचिलक महायोजना, इस अिधसूचना मᱶ िविन᳸द᳥ रीित के अनुसार तैयार ᳰक जायेगी और पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित मᱶ रा᭔ य सरकार तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(2) आचंिलक महायोजना, इसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक िवचारᲂ को समेᳰकत करन ेके िलए संब रा᭔ य सरकार के िवभागᲂ के िन᭥ निलिखत सभी परामशᭅ से तैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;
(v) कृिष ;
(vi) नगरपािलका ;
(vii) राज᭭ व ;
(viii) लोक िनमाᭅण िवभाग;
(ix) आंᮥ ᮧदशे रा᭔य ᮧदषूण िनयंᮢण बोडᭅ ;
(x) जल संसाधन ;
(xi) ᳲसचाई;
(xii) बागवानी ; और
(xiii) पंचायती राज, ᮕामीण िवकास ।
(3) आंचिलक महायोजना सभी ᮧ᭭तािवत ᮕाम बि᭭तयᲂ, शहरी बि᭭तयᲂ, िव᳒मान पूजा ᭭ थलᲂ, मनोरंजन महᱬव सिहत सां᭭कृितक महᱬव के ᭃेᮢᲂ ,वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जसै े उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी और ऐसे ᭃेᮢᲂ को ᭭प᳥ ᱨप से नशे के साथ आंचिलक महायोजना मᱶ िनधाᭅᳯरत ᳰकया जाएगा।
(4) आंचिलक महायोजना अनमुोᳰदत िव᳒मान भ-ूउपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलाप मᱶ अिधक ᮧभावी और पाᳯरि᭭ थितक अनकूुल कारक होगी ।
(5) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण स ेसंबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(7) आंचिलक महायोजना इस अिधसूचना के ᮧावधानᲂ के जᳯरये कायᲄ कᳱ मानीटरी के जाने के िलए मानीटरी सिमित को एक संदभᭅ मᱶ द᭭तावेज तैयार करना होगा।
(8) यह आव᭫यक समझा जाता ह ैᳰक, इस अिधसूचना के ᮧावधानᲂ को ᮧभावी करने मᱶ के᭠ᮤ सरकार और रा᭔य सरकार, अ᭠य उपायᲂ को िन᳸द᳥ करेगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय— रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग—पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के िलए ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा : परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भिूम के ᱨपांतरण के ᭭वाभािवक िवकास के कारण मानीटरी सिमित कᳱ िसफाᳯरश पर अनुमित दी जा सकती ह ैऔर रा᭔य सरकार के पूवᭅ अनुमोदन के साथ, केवल ᭭थानीय उ᭜प᳖ होने वाल ेिनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए कᳱ मौजूदा ᭭थानीय आबादी और इकाई संया 9,10,16,29 और 32 मᱶ सूचीब गितिविधयᲂ सिहत, वषाᭅ जल संचय, कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग भी ह,ᱹ िव᳒मान सड़कᲂ को चौड़ा तथा मजबूत करना और नई सड़कᲂ का संिनमाᭅण करना ,ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग आवासीय जᱨरतᲂ, ᭭तंभ के ᱨप मᱶ िन᳸द᳥ (2) पैरा 3 मᱶ सारणी कᳱ: परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा : परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करन ेके प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सचूना दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजसस ेहᳯरत ᭃेᮢ मᱶ जैस ेवन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अन᭜ु पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएगें ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके सरंᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएगें ।
(3) पयᭅटन /पाᳯरि᭭थितक पयᭅटन.- (क) सभी नए पाᳯरि᭭थितक पयᭅटन गितिविधयᲂ या पाᳯरि᭭थितक संवेदी जोन के भीतर मौजूदा पयᭅटन गितिविधयᲂ कᳱ िव᭭तार पाᳯरि᭭थितक सवेंदी जोन ᭃेᮢ के िलए पयᭅटन महायोजना के अनुसार होगी। (ख) पयᭅटन महायोजना पयᭅटन िवभाग, सरकार ᳇ारा राज᭭ व और वन िवभाग, सरकार के परामशᭅ से तैयार होगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ करेगा। ¹Hkkx IIµ[k.M 3(ii) ] Hkkjr dk jkti=k % vlk/kj.k 5 (घ) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के संबंिधत पयᭅटकᲂ के अ᭭ थायी िनवास के िलए आवासन के िसवाय पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और ᳯरसाटᭅ के नए संिनमाᭅण अ᭤यार᭛य कᳱ सीमा के 1 ᳰकलोमीटर के भीतर अनु᭄ात नहᱭ हᲂगे । परंतु व᭠यजीव अभयार᭛य कᳱ सीमा के 1 ᳰकलोमीटर के परे पाᳯरि᭭ थितक संवेदी जोन के िव᭭तार तक नए होटलᲂ और ᳯरसाटᲄ कᳱ ᭭थापना को पाᳯरि᭭ थितक अनुकूल पयᭅटन सुिवधाᲐ के िलए पूवᭅ िनि᳟त और नामिन᳸द᳥ ᭃेᮢᲂ मᱶ और पयᭅटन महायोजना के अनुसार अनु᭄ात ᳰकया जाएगा ।
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय तथा रा᭬ ᮝीय ᭪ याᮖ सरंᭃण ᮧािधकरण, ᳇ारा जारी (समय-समय पर यथा संशोिधत) मागᭅिनदशेᲂ के अनुसार होगा िजसमᱶ पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व ᳰदया जाएगा और पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा ;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगक िवरासत —पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थलᲂ—पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाए ंतैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(7) वाय ुᮧदषूण —पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जल (ᮧदषूण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ — ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाए ंतैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा ।
(v) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट— पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना जी.एस. आर 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय यातायात—पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएगें और आंचिलक महायोजना के तैयार होन े और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होन ेतक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(12) औ᳒ोिग क ईकाइया ं– (क) ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ नए का᭬ ठ आधाᳯर त उ᳒ोगᲂ कᳱ ᭭ थापना को िस वाए िव िध के अनुसार ᭭ थािप त िव ᳒ मान का᭬ ठ आधाᳯर त उ᳒ोगᲂ के अनु᭄ात नहᱭ ᳰक या जाएगा । (ख) जल, वायु, मृदा, ᭟ विन ᮧदषूण काᳯर त करने वाल े ᳰक सी नए उ᳒ोग कᳱ ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा ।
(13) पहाड़ी ढलानᲂ को सरंᭃण- क. आंचिलक महायोजना पहाड़ी ढलानᲂ पर ᭃेᮢᲂ का संकेत होगा जहां कोई िनमाᭅण कᳱ अनुमित दी जाएगी । ख. कटाव के एक उᲬ िडᮕी के साथ मौजूदा खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर कोई िनमाᭅण कᳱ अनुमित दी जाएगी।
(14). अगर यह आव᭫यक समझता ह,ै इस अिधसूचना के ᮧावधानᲂ को ᮧभावी करने मᱶ के᭠ᮤ सरकार और रा᭔य सरकार, अ᭠य उपायᲂ िन᳸द᳥ करेगा ।

1. वािणि᭔यक खनन । (क) नए खनन (लघु और वृहत खिनज), प᭜थर कᳱ खदानᲂ और उनको तोड़न े कᳱ इकाइयां गृहᲂ के संिनमाणᭅ या मर᭥ मत के िलए पृ᭝ वी कᳱ खुदाई या दशेी टाइलᲂ के िविनमाणᭅ या ᭪ यैि तक उपायᲂ के िलए आवासन के िलए टᲂ के संदभᭅ मᱶ वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िसवाय ᮧितिस हᲂगी ; (ख) खनन संᳰᮓयाए,ं माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के अनुसरण मᱶ सवᭅथा हᲂगे।
2. नए उ᳒ोगᲂ के कारण ᮧदषूण (जल, वायु, िमᲵी, शोर, आᳰद) कᳱ ᭭थापना। कोई नई या पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ मᱶ ᮧदषूण फैलान े वाले उ᳒ोगᲂ के िव᭭तार कᳱ अनुमित दी जाएगी। ᮕीन या ᳡ते कृिष आधाᳯरत लघु उ᳒ोगᲂ सिहत सीपीसीबी वगᱮकरण मᱶ के ᱨप मᱶ वगᱮकृत उ᳒ोगᲂ, िनयमᲂ के अनुसार िविनयिमत ᳰकया जाएगा।
3. नए बृहत जल िव᳒ुत पᳯरयोजना का ᭭थापना A लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
4. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन A लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
5. ᮧाकृितक जल िनकायᲂ का भूिम ᭃेᮢᲂ मᱶ अनुपचाᳯरत बिह᮲ावᭅ का िन᭭तारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
6. कंपिनयᲂ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़ े पैमाने पर वािणि᭔यक पशुᲐ और पो᭨ᮝी फामᲄ कᳱ ᭭थापना। िनिष ᭭थानीय जᱨरतᲂ को पूरा करने के िलए छोड़कर लागू कानूनᲂ के अनसुार (के ᱨप मᱶ अ᭠यथा ᮧदान को छोड़कर)।
7. आरा मीलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई या िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा । िविनयिमत ᳰᮓयाकलाप
8. होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी ᳞वसाय के िलए आवास के संबंध मᱶ सरंिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक, जो भी िनकट हो, के भीतर ही नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अन᭄ुात ᳰकया जाएगा अ᭠यथा नहᱭ : 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पर᭠तु व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर स े परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱧप होगा ।
9. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ रा᳦ीय पाकᭅ कᳱ सीमा से 1 ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार के नए वािण᭔यक संिनमाᭅण को अनु᭄ात नहᱭ ᳰकया जाएगा: परंतु ᭭ थानीय ᭪ यि तयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण िजसके अंतगᭅत पैरा 3 मᱶ सचूीब ᳰᮓयाकलाप भी ह,ᱹ को करन ेके िलए अनु᭄ात ᳰकया जाएगा । (ख) ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोगᲂ से संबंिधत संिनमाᭅण कायᭅकलापᲂ को लागू िनयमᲂ और िविनयमᲂ के अनुसार, यᳰद कोई हᲂ सᭃम ᮧिधकारी कᳱ पूवᭅ अनु᭄ा स े िविनयिमत ᳰकया जाएगा और ᭠ यूनतम पर रखा जाएगा । (ग) पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनसुार हᲂगे ।
10. ᮧदषूण उ᭜प᳖ न करन े वाले लघु उ᳒ोग A पाᳯरि᭭ थितक संवेदी जोन से गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष, पु᭬ प कृिष, कृिष उ᳒ान या कृिष आधाᳯरत उ᳒ोग, जो दशेीय माल स े औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन करत ेह ᱹऔर जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते ह,ᱹ को अनु᭄ात ᳰकया जाएगा ।
11. ट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
12. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनमुित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार िविनयिमत होगी ।
13. वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
14. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । भूिमगत केबलᲂ को ᮧो᭜ साहन दनेा ।
15. नागᳯरक सुिवधाᲐ सिहत बुिनयादी ढांचे । कानूनᲂ, िनयमᲂ और िविनयमन और उपल᭣ध शमन उपायᲂ को ᳰदशािनदᱷशᲂ के अनुसार लागू ᳰकया जाएगा ।
16. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय लागू ᳰकए गए अनुसार ᳰकए जाएगें ।

18. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
19. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
20. ᭭थानीय समुदायᲂ ᳇ारा लाई जा रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । ᭭थानीय लोगᲂ के उपयोग के िलए लागू काननू के तहत अनुमित दी जाएगी।
21. ᮧाकृितक जलाशयᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत ᳰकया जाएगा ।
22. सतह और भूिमगत जल कᳱ िनकासी के वािणि᭔यक । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
23. ओपन कुए,ं कुए ं आᳰद बोर कृिष या अ᭠य उपयोग के िलए । िविनयिमत और गितिविध सती स ेउपयुᲦ ᮧािधकारी ᳇ारा िनगरानी कᳱ जानी चािहए ।
24. ठोस अपिश᳥ ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
26. पाᳯरि᭭थितक-पयᭅटन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ग. सवंᳶधत ᳰᮓयाकलाप
29. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।

33. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । जैव गैस, सौर ᮧकाश आᳰद को बढावा दनेा होगा ।
34. कृिष वािनकᳱ। सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
35. कौशल िवकास । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
36. उार भूिम / वन / आवास कᳱ बहाली । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
37. पयाᭅवरणीय जागᱨकता । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।

6. िनदᱷश िनबधंन
(1) पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(2) मानीटरी सिमित कᳱ अविध तीन वषᭅ कᳱ होगी ।

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ुपाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 30th November, 2016 S.O. 3596(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 1450(E), dated the 1st June 2015 inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; And whereas, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government. WHEREAS, the Pakhal Wildlife Sanctuary is located between latitude 17° 42.5’ and 18° 10’ North and between longitude 79° 55’ and 80° 10’ East and mostly falls within Warangal (South) Division and Warangal (North) Division in the State of Telangana and it is located at a distance of fifteen and thirty kilometers from the Eturnagaram Wildlife Sanctuary and Kinnerasani Wildlife Sanctuary (Khammam Dist.) respectively; AND WHEREAS, the Pakhal Wildlife Sanctuary is one of the oldest wildlife sanctuaries in the erstwhile State of united Andhra Pradesh and the Sanctuary is named after the Pakhal lake (wetland), which is the source of irrigation for local people and also has rich historical heritage as it was constructed by King Pratapa Rudra of Kakatiya Dynasty during 1323 AD; AND WHEREAS, the Pakhal Wildlife Sanctuary falls in the ‘6B’ Bio-geographical region i.e., Central plateau of Deccan peninsula (6) and is also a part of the large tract of the Godavari valley forests which comprise of the Eturnagaram Wildlife Sanctuary in its North East and Kinnerasani Wildlife Sanctuary in the South-East of the Sanctuary; AND WHEREAS, the plant species commonly found in the Sanctuary are: Terminalia tomentosa, Anogeissus latifolia, Boswellia serrata, Diospyros melanoxylon, Sterculia urens, Maduca indica, Dalbergia panticulata, Odina wodier, Xylia dolabriformis, Chloroxylon swietenia, Lagerstromia parviflora, Cleistanthus collinus, Soymida febrifuga, Terminalia ballerica, Terminalia chebula, Acacia subdra, extensive bamboo brakes consisting of Dendrocalamus strictus and Bambusa arundinacea also occur in the Sanctuary especially in Chintaguda blocks; AND WHEREAS, the Pakhal Wildlife Sanctuary harbours many endangered species such as the Tiger (Panthera tigris), Indian Gaur, Leopard (Panthera pardus), Leopard cat (Prionailurus bengalensis), Sloth Bear (Melursus ursinus), Hyeana (Hyaena hyaena), Wild Dog (Cuon alpines), Wolf (Canis lupus pallipes), Jackal (Canis aureus), Fox (Vulpes bengalensis), Sambar (Rusa unicolor), Cheetal (Axis axis), Four-horned Antelope (Tetracerus quadricornis), Chinkara, Nilgai (Boselaphus tragocamelus), Python (Python molurus), Giant Squirrel (Petaurista philippensis), and Flying Squirrel; ¹Hkkx IIµ[k.M 3(ii) ] Hkkjr dk jkti=k % vlk/kj.k 19 AND WHEREAS, the Pakhal Wildlife Sanctuary forms part of the catchment for two drainage systems, one drainage system joins River Godavari through Lakhnavaram lake and the other joins River Krishna through the Pakhal Lake and the River Pakhal (River Munneru in Khammam district) and adjoins the boundary of the Etrunagaram Wildlife Sanctuary along North-Eastern boundary; Now, therefore, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub – section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area from zero (the Eco-sensitive Zone is zero towards the North-Eastern end along the boundary of the Pakhal Wildlife Sanctuary which adjoins the boundary of the Etrunagaram Wildlife Sanctuary) to 10 kilometres from the boundary of the Pakhal Wildlife Sanctuary in the State of Telangana as Pakhal Wildlife Sanctuary Eco-sensitive Zone (hereinafter called as a Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundary of Eco-sensitive Zone.-(1) The Eco-sensitive Zone is spread over an area of 965.71 square kilometres in Warangal District of the State of Telangana and includes 108 villages of 11 Mandals viz. Mulugu, Nallabelly, Narsampet, Kanapur, Gudur, Kothaguda, Chennaraopet, Mahabubad, Kesamudram, Govindaraopet, Tadvai in Warangal District.
(2) The extent of Eco-sensitive Zone ranges from zero kilometer to ten kilometers from the boundary of the Pakhal Wildlife Sanctuary.
(3) The boundary description of the Eco-sensitive Zone is appended as Annexure I and the list of villages are given in Annexure-II.
(4) The map of Eco-sensitive Zone boundary together with latitudes –longitudes is appended with this notification as Annexure III.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) For the purpose of the Eco-sensitive Zone, the State Government shall prepare, in consultation with local people, a Zonal Master Plan, within a period of two years from the date of publication of the final notification in the Official Gazette, for consideration and approval of the Ministry of Environment and Forest and Climate Change and the Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(2) The Zonal Master Plan shall be prepared with due involvement of all concerned Local Self Governments and the concerned State Departments such as:
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;

(vi) Municipal;
(vii) Revenue;
(viii) Public Works Department;
(ix) Andhra Pradesh State Pollution Control Board;
(x) Water Resources;

(xiii) Panchayati Raj, Rural Development; for integrating environmental and ecological considerations into it.
(3) The Zonal Master Plan shall inter alia demarcate all the existing and proposed village settlements, urban settlements, worshipping places, areas of cultural value including recreational value, types and kinds of forests, agricultural areas, fertile lands, green areas, horticultural areas, orchards, lakes and other water bodies and such areas shall be clearly defined in the Zonal Master Plan along with maps.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and Eco-friendly.
(5) The Zonal Master Plan shall regulate the development in the Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carryings out its functions of monitoring vide provisions of this notification.
(8) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification
3. Measures to be taken by the State Government.-
(1) Landuse.- Change of land use of forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes into areas for commercial or industrial related development activities shall not be permitted in the Eco-sensitive Zone:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, only to meet the residential needs of the local residents arising due to the natural growth of existing local population and including the activities listed at item numbers 9,10,16,29 and 32, relating to rainwater harvesting, cottage industries including village artisans, etc. and small scale industries not causing pollution, widening of roads and construction activity for residential needs, civic amenities and infrastructure respectively, as specified in column
(2) of the Table in para 3:
Provided further that no change in use of land from tribal usage to non-tribal usage shall be permitted without the prior approval of the State Government and without compliance of the provisions of the law for the ¹Hkkx IIµ[k.M 3(ii) ] Hkkjr dk jkti=k % vlk/kj.k 21 time being in force including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such area
(3) Tourism/Eco-tourism.-
(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within one k.m. from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer. However, beyond the distance of one k.m. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Ecotourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on Eco-tourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up as part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution. - Regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with
(7) Air Pollution.- Regulations for the control of air pollution in the Eco-sensitive Zone as per the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) shall be complied with.
(8) Discharge of effluents.- The discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and rules made thereunder.
(9) Solid Wastes.- Disposal of solid wastes shall be as under:-
(i) The solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time.
(ii) The local authorities shall draw up plans for the segregation of solid wastes into biodegradable and nonbiodegradable components.
(iii) The biodegradable material shall be recycled preferably through composting or vermiculture.
(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(v) No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Ecosensitive Zone.
(10) Bio-Medical Waste.- The Bio-Medical waste disposal in the Eco-sensitive Zone shall be carried in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(11) Vehicular Traffic : The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is ¹Hkkx IIµ[k.M 3(ii) ] Hkkjr dk jkti=k % vlk/kj.k 23 prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial Units.- On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed be established within Eco-sensitive Zone vide Central Pollution Board’s categorisation.
(13) Protection of Hill Slopes.-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(14). The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. Activities to be prohibited, regulated and Promoted within the Eco-sensitive Zone.- (1) All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and be regulated in accordance with tabular column given below: TABLE S. 1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
2. Setting of new industries causing pollution (Water, Air, Soil, Noise, etc.). No new or expansion of polluting industries in the Eco-sensitive zone shall be permitted. Industries categorised as Green or White in the Central Pollution Control Board classification including agro-based small scale industries, will be regulated as per regulations.
3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws
6. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies. Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
7. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. B. Regulated Activities
8. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities. (a) No new commercial construction of any kind shall ¹Hkkx IIµ[k.M 3(ii) ] Hkkjr dk jkti=k % vlk/kj.k 25 be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Ecosensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 6 as per building byelaws:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
10. Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
11. Setting up of brick kilns. Regulated (except as otherwise provided) as per applicable laws
12. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
13. Collection of Forest produce or Non-Timber Forest Produce (NTFP). Regulated under applicable laws. 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
14. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable law. Underground cabling may be promoted.
15. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
16. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
17. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated under applicable law.
18. Protection of Hill Slopes and river banks. Regulated under applicable laws.
19. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals.
21. Discharge of treated effluents in natural water bodies or land area. The discharge of treated effluent shall be regulated as per applicable laws.
22. Commercial extraction of surface and ground water. Regulated under applicable law.
23. Open Well, Bore Well etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority.
24. Solid Waste Management. Regulated under applicable laws.
25. Introduction of Exotic species. Regulated under applicable laws.
26. Eco-tourism. Regulated under applicable laws.

5. The Monitoring Committee for monitoring the Eco-sensitive Zone Notification of Pakhal Wildlife Sanctuary-
(1) The Central Government hereby constitutes the Monitoring Committee, for effective monitoring of the provisions of this Notification comprising of the following, namely:-
(a) Chief Secretary, Government of Telangana – Chairman;
(b) Chief Wildlife Warden, Government of Telangana– Member
(c) Representative of the Ministry of Environment and Forests, Member;
(d) Secretary, Department of Urban Development, Government of Telangana or his representative – Member;
(e) Secretary, Environment Department, Government of Telangana – Member;
(f) Secretary, Forest Department, Government of Telangana – Member;
(g) Secretary, Agriculture Department, Government of Telangana or his representative – Member;
(h) Secretary, Rural Development Department, Government of Telangana or his representative – Member;
(i) A representative of Non-governmental Organisation working in the field of nature conservation (including heritage conservation) to be nominated by the State Government of Telangana (for a term of one year) – Member;
(j) Representative of State Pollution Control Board – Member;
28. Commercial Sign boards and hoardings. Regulated under applicable laws. C. Promoted Activities
29. Rain water harvesting. Shall be actively promoted.
30. Organic farming. Shall be actively promoted.
31. Adoption of green technology for all activities. Shall be actively promoted.
32. Cottage industries including village artisans, etc. Shall be actively promoted.
33. Use of renewable energy. Bio gas, solar light etc. to be actively promoted.
34. Agro-Forestry. Shall be actively promoted.
35. Skill Development. Shall be actively promoted.
36. Restoration of Degraded Land/ Forests/ Habitat. Shall be actively promoted.

(k) one expert in Ecology from reputed Institution or University of the State of Telangana - Member;
(l) Concerned District Collector dealing with the Eco-sensitive Zone – Member;
(m) Member Secretary/Member of State Biodiversity Board, Member;
(n) Divisional Forest Officer (in charge of Protected Area) – Member;
(o) Director, Department of Environment – Member Secretary.
6. Terms of Reference
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee is for three (3) years.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Forest Officers shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma given in Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. ¹Hkkx IIµ[k.M 3(ii) ] Hkkjr dk jkti=k % vlk/kj.k 29
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal (NGT). [F.
