PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2818] ubZ fnYyh] cq/okj] uoEcj 30] 2016@vxzgk;.k 9] 1938 No. 2818] NEW DELHI, WEDNESDAY, NOVEMBER 30, 2016/AGRAHAYANA 9, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ली, 29 नव᭥ बर, 2016 का.आ. 3597(अ).—भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का. आ. 2080 (अ) तारीख 27 जुलाई, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसूचना अंतᳶव᳥ है, उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करते ᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;
और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक ᱧप से िवचार ᳰकया गया;
और, तखनी-रहमापुर व᭠ यजीव अभयार᭛य िजला होिशयारपुर, पंजाब के मेह᭠ ᮕोवल ᮕाम मᱶ अवि᭭ थत ह,ै होिशयापुर-मेह᭠ ᮕोवल मागᭅ पंजाब के होिशयारपुर से 15 ᳰकलोमीटर कᳱ दरूी पर ह ैऔर यह 382 हे टेयर के ᭃेᮢ से िघरा ᱟआ है तथा अभयार᭛य िशवािलक जैव िविवधता का ᮧितिनिध᭜ व करता ह ैऔर इसका बᱟत अिधक पाᳯरि᭭ थितकᳱय और जैिवक मह᭜ व है ;
और, चᱹिपयन और सेठ के वन वगᱮकरण के अनुसार, संरिᭃत ᭃेᮢ मᱶ उ᭜ तरी शु᭬ क िमि᮰त पणᭅपाती वन ᮧकार के अधीन वन हᱹ और खैर, शीशम, अजुᭅन, आम, सीᳯरस, ᳰफ स, नीम और फलाही आᳰद वृᭃᲂ कᳱ ᮧमुख ᮧजाितयां ह ᱹ;
और, ᭃेᮢ पशुᲐ तथा पिᭃयᲂ के िविभ᭠ न ᮧकारᲂ के िनवाᭅह के िलए जाना जाता है । जीवᲂ कᳱ ᮧमुख ᮧजाितयां सांभर, पाढ़ा, मंुजक, जंगली िब᭨ ली, िसयार, काला ने᭡ पड खरगोश, नेवला, तᱶदआु (ᮧवासी), साल, अजगर, कोबरा, धािमन, मॉनीटर िछपकली, लाल जंगली मुरगा और कलीज फेजे᭠ ट आᳰद हᱹ ;
और, पाᳯरि᭭थितक और पयाᭅवरणीय दिृ᭬ ट से पाᳯरि᭭ थितक संवेदी जोन के ᱨप मᱶ तखनी-रहमापुर व᭠ यजीव अभयार᭛य के संरिᭃत ᭃेᮢ, िजसका िव᭭ तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᭬ ट ह,ᱹ को संरिᭃत और सुरिᭃत करना आव᭫ यक ह ैतथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ के ᮧचालन या ᮧसं᭭करण या उ᳒ोगᲂ के वगᲄ का ᮧचालन और ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह ै;
अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] शिᲦयᲂ का ᮧयोग करते ᱟए, पंजाब रा᭔ य मᱶ तखनी-रहमापुर व᭠ यजीव अभयार᭛य कᳱ सीमा से 100 मीटर तक के िव᭭ ताᳯरत ᭃेᮢ को तखनी-रहमापुर व᭠ यजीव अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत् :--
1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाए-ं-(1) पाᳯरि᭭ थितक संवेदी जोन, पंजाब रा᭔ य मᱶ तखनी-रहमापुर व᭠ यजीव अभयार᭛य के चारᲂ ओर कᳱ सीमा से 100 मीटर के ᭃेᮢ तक िव᭭ ताᳯरत ह।ै
(2) पाᳯरि᭭थितक संवेदी जोन पूवᭅ (मानिचᮢ के िनदᱷश िब᭠ द ुसं.ख) कᳱ ओर 310 39' 32.971''उ. अᭃांश और 750 56' 39.883'' पू. दशेा᭠तर ; पि᳟म (मानिचᮢ के िनदᱷश िब᭠ द ुसं. ङ) कᳱ ओर 310 39' 20.796'' उ. अᭃांश तथा 750 54' 56.366'' पू. दशेा᭠तर ; उᱫर (मानिचᮢ के िनदᱷश िब᭠ द ुसं. क) कᳱ ओर 310 40' 26.925'' उ. अᭃांश और 750 55' 42.07'' पू. दशेा᭠तर और दिᭃण-पि᭫ चम (मानिचᮢ के िनदᱷश िब᭠ द ुसं. घ) कᳱ ओर 310 38' 48.816'' उ. अᭃांश तथा 750 55' 20.236'' पू. दशेा᭠तर से िघरा ᱟआ ह।ै
(3) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का मानिचᮢ, इसके अᭃांश और दशेा᭠तर और संरिᭃत ᭃेᮢ के िनदᱷशांकᲂ के साथ उपाबधं I के ᱨप मᱶ उपाब ह ै।
(4) पाᳯरि᭭थितक संवेदी जोन के भीतर आन ेवाले ᮕामᲂ कᳱ सूची ᮧमुख िब᭠ दᲐु पर उनके अᭃांश और देशांतर सिहत उपाबधं II के ᱨप मᱶ उपाब ह ै।
2. पाᳯरि᭭थितक संवदेी जोन के िलए आचंिलक महायोजना –(1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित से रा᭔ य सरकार तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश का िसांत, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, इसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक िवचारᲂ को समेᳰकत करने के िलए संब रा᭔ य सरकार के िवभागᲂ के िन᭥ निलिखत सभी परामशᭅ से तैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;
(v) नगरपािलका ;
(vi) राज᭭ व ;
(vii) कृिष ; और
(viii) पंजाब रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ।
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार से िविन᳸द᭬ ट न हो और आचंिलक महायोजना मᱶ सभी अवसंरचना के िवकास तथा ᳰᮓयाकलापᲂ को और अिधक दᭃ और पाᳯरि᭭थितक अनुकूल ᱧप मᱶ ᮓमगिणत हᲂगे ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान उपासना ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भिूम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोघान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(8) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं0 25, 29, 33, और 38 के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोग;
(ii) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद;
(iii) वषाᭅ जल संचयन; और
(iv) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण िश᭨पी भी ह,ᱹ परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोतᲂ -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो पयᭅटन महायोजना का भाग ᱨप मᱶ िन᳜िलिखत हᲂगे। (ख) पयᭅटन महायोजना पयᭅटन िवभाग, पंजाब सरकार ᳇ारा राज᭭ व और वन िवभाग, पंजाब सरकार के परामशᭅ से तैयार होगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा जारी (समय-समय पर यथा संशोिधत) मागᭅिनदशेᲂ के अनुसार होगा िजसमᱶ पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व ᳰदया जाएगा और पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और ᳯरसोटᭅ के नए संिनमाᭅण अनु᭄ात नहᱭ हᲂगे ।
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थलᲂ - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाए ंतैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए पंजाब रा᭔ य सरकार का पयाᭅवरण िवभाग, वाय ु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िसांत और िविनयम तयैार करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य पंजाब सरकार का पयाᭅवरण िवभाग, वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, जल (ᮧदषूण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाए ंतैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना जी.एस. आर 343 (अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधया ंआवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होन ेऔर रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होन ेतक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
4. पाᳯरि᭭थितक संवदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰकए जाने वाल े ᳰᮓयाकलापᲂ कᳱ सचूी - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂग,े अथाᭅत् :-- सारणी ᮓम सं. ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
(1) वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां । (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िसवाय ᮧितिष हᲂगी ;
(ख) माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गोᳲवदरामन िथᱧमूलपाद बनाम भारत सरकार के मामल ेमᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामल ेमᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के कठोर अनुसरण का ᮧचालन होगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(2) आरा मीलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक सवंेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(3) जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक सवंेदी जोन के भीतर ᳰकसी नए और ᮧदषूण काᳯरत करने वाल े िव᳒मान उ᳒ोगᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(4) ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(5) जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(6) नई बृहत जल िव᳒ुत पᳯरयोजनाᲐ कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(7) ᭡ लाि᭭ टक के थैलᲂ का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(8) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(9) संिनमाᭅण ᳰᮓयाकलाप । ᭭ थानीय िनवािसयᲂ कᳱ घरेलू आव᭫ यकताᲐ, िजसके अंतगᭅत पैरा 3 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलाप भी ह,ᱹ के िसवाय, पाᳯरि᭭थितक सवंेदी जोन के भीतर ᳰकसी ᮧकार के नए संिनमाᭅण अनु᭄ात नहᱭ हᲂगे । ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोगᲂ से संबंिधत सि᭠ नमाᭅण ᳰᮓयाकलाप कᳱ दशा मᱶ, इसे िविनयिमत ᳰकया जाएगा और ᭠ यूनतम पर रखा जाएगा । िविनयिमत ᳰᮓयाकलाप
(10) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई, संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार िविनयिमत होगी ।
(11) होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी ᳞वसाय के िलए आवास के सबंंध मᱶ संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर या पाᳯरि᭭थितक सवंेदी जोन कᳱ सीमा तक, जो भी िनकट हो, के भीतर ही नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ :
पर᭠तु व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक सवंेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱧप होगा ।
(12) पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वाय ु गु᭣बारᲂ आᳰद ᳇ारा अभयार᭛य ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(13) संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक सवेंदी जोन जो भी िनकट हो कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ अनुमित दी जाएगी । पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ स ेसंबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित स ेही ᭠ यूनतम पर रखे जाएगंे । (ख) इसके अितᳯरᲦ पाᳯरि᭭थितक संवेदी जोन से परे, सदभािवक ᭭ थानीय आव᭫ यकताᲐ के िलए संिनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे।
(14) कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(15) वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू-जल संचयन भी ह ै। (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पवूᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह ै। (ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा । (घ) ᳰकसी ᮲ोत जल, िजसके अंतगᭅत कृिष भी ह,ै के संदषूण या ᮧदषूण को रोकने के िलए सभी उपाय ᳰकए जाएगं े।
(16) िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण । भूिमगत केबलᲂ को ᮧो᭜ साहन दनेा ।
(17) होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(18) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण । उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनुसार हᲂगे ।
(19) रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
(20) िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(21) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(22) वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(23) वायु (᭟ विन सिहत) और यािनक ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(24) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
(25) ᮧदषूण काᳯरत न करने वाल ेलघु उ᳒ोग । पाᳯरि᭭ थितक सवंेदी जोन मᱶ दशेीय माल से उ᭜पादᲂ का उ᭜पादन करने वाले गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत दशेीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालत ेह,ᱹ अनु᭄ात ᳰकए जाएगंे ।
(26) वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(27) सुरᭃा बलᲂ के कᱹप । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(28) नए का᭬ ठ आधाᳯरत उ᳒ोग । पाᳯरि᭭ थितक सवंेदी जोन के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना अनु᭄ात नहᱭ होगी:
परंतु पाᳯरि᭭ थितक संवेदी जोन मᱶ 100 ᮧितशत आयाितत का᭬ ठ ᭭ टाक उपभोग करने वाले नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना कᳱ जा सकेगी ।
(29) पाᳯरि᭭ थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के िलए, पयᭅटकᲂ के अ᭭थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल कुटीर, जैस े तंब,ू लकड़ी के घर आᳰद । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(30) ठोस अपिश᳥ ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(31) पाᳯरि᭭थितक-पयᭅटन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । सवंᳶधत ᳰᮓयाकलाप
(32) डयेरी, डयेरी उ᳒ोग और म᭜ ᭭ य उ᳒ोग के साथ ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी गितिविधयां । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(33) वषाᭅ जल संचयन । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
(34) जैिवक खेती । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
(35) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
(36) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(37) वान᭭ पितक बाड़। लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(38) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह ᱹ। सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
(39) कृिष वािनकᳱ। सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।

5. पाᳯरि᭭थितक संवदेी जोन मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :- (क) मु य वन संरᭃक (व᭠ यजीव), पंजाब सरकार - अ᭟यᭃ;
(ख) ᮕामीण िवकास और पंचायत िवभाग का ᮧितिनिध, पंजाब सरकार – सद᭭ य;
(ग) ᮧादिेशक कायाᭅलय, पंजाब रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ - सद᭭य;
(घ) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै का तीन वषᭅ कᳱ अविध के िलए पंजाब रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध - सद᭭य;
(ङ) पंजाब सरकार ᳇ारा तीन वषᭅ कᳱ अविध के िलए नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का एक िवशेष᭄ - सद᭭य;
(च) ᮕामीण िवकास और आवास िवभाग, पंजाब सरकार का ᮧितिनिध –सद᭭ य;
(छ) कृिष िवभाग, पंजाब सरकार का ᮧितिनिध - सद᭭य;
(ज) िजला कल टर, होिशयारपुर का ᮧितिनिध - सद᭭य;
(झ) रा᭔य जैव-िविवधता बोडᭅ का सद᭭य – सद᭭य;
(ञ) उप वन संरᭃक - सद᭭य-सिचव । िनदᱷश - िनबधंन :
(2) मानीटरी सिमित का कायᭅकाल तीन वषᭅ का होगा।
(3) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(4) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(5) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(6) मानीटरी सिमित का सद᭭य-सिचव या संब उपायु त, ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।
(7) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत े ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(8) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय जीव वाडᭅन उपाबधं III मᱶ उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।
(9) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश द ेसकेगा, जो वह ठीक समझे ।
6. इस अिधसूचना के उपबंधᲂ को ᮧभाव दनेे के िलए कᱶ ᮤीय सरकार और रा᭔ य सरकार अितᳯर त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶगे ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 29th November, 2016 S.O. 3597(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.
2080 (E), dated 27th July, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, no objections and suggestions were received from public or stakeholders in response to the draft notification;
WHEREAS, Takhni - Rehmapur Wildlife Sanctuary located near Mehngrowal village in district Hoshiarpur, Punjab is fifteen kilometres from Hoshiarpur on Hoshiarpur-Mehngrowal Road and it encompassesan area of 382 hectarearea and sanctuary represents the Shiwalik biodiversity and has great ecological and biological significance;
AND WHEREAS, the protected area, as per the forest classification of Champion and Seth, has the forests that fall under Northern Dry Mixed Deciduous Forest Type and the main tree species are Khair, Shisham, Arjun, Mango, Siris, Ficus, Neem, Phalahi, etc.;
AND WHEREAS, the area is known to support a variety of animals and birds, main faunal species are Sambar, Hog Deer, Barking Deer, Jungle Cat, Jackal, Black Napped Hare, Mongoose, Leopard (Migratory) Pangolin, Python, Cobra, Rat Snake, Monitor Lizard, Red Jungle Fowl, Kaleej Pheasant, etc.;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of the Takhni - Rehmapur Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area upto100 metres from the boundary of the Takhni - Rehmapur Wildlife Sanctuary in the State of Punjab as the Eco-sensitive Zone (hereinafter referred to asthe Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1) The Eco-sensitive Zone is an area of 100 meters all around the boundary of the Takhni – Rehmapur Wildlife Sanctuary in the State of Punjab.
(2) The Eco-sensitive Zone is bounded by 31º 39’ 32.971"N latitude and 75º 56’ 39.883"E longitude towards East(Reference point No.B of map); 31º 39’ 20.796"N latitude and 75º 54’ 56.366"E longitude towards west(Reference point No.E of map); 31º 40’ 26.925"N latitude and 75º 55’ 42.07"E longitude towards north(Reference point No.A of map) and 31º 38’ 48.816"N latitude and 75º 55’ 20.236"E longitude towards south-west (Reference point No.D of map).
(3) The map of Eco-sensitive Zone boundary together with its latitudes and longitude and co-ordinates of protected area is appended as Annexure I.
(4) The list of villages falling within the Eco-sensitive Zone alongwith their longitude and latitude at prominent points is appended as AnnexureII.
2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;

(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Punjab State Pollution Control Board, for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land Use.-Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 25, 29, 33 and 38 specified under column (2) of the Table in paragraph 4, namely:-
(i) small scale industries not causing pollution;
(ii) eco-friendly cottages for temporary occupation of tourists, such as tents; wooden houses, etc. for eco-friendly tourism activities;
(iii) rainwater harvesting; and
(iv) cottage industries including village artisans, etc.:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Punjab in consultation with Department of Revenue and Forests, Government of Punjab.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment, Forests and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4)Natural heritage.-All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and be preserved and plan be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plans shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of Punjab shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981)and the rules made thereunder.
(7) Air pollution.- The Environment Department of Punjab shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981)and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974)and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
4. List of activities prohibited, regulated or promoted within the Eco-sensitive Zone.-All activities in the Ecosensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986)and be regulated in the manner specified in the Table below, namely:— ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13 TABLE Sl. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall prohibited except for the domestic needs of bona fide local residents.
(b) The mining operations shall strictly be in accordance to the orders of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N.Godavarman Thirumulpad Vs.
Union of India in Writ Petition (Civil) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs.
Union of India in Writ Petition (Civil) No.435 of 2012.
2. Setting up of saw mills. No new and expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of existing polluting industries shall be permitted within the Eco-sensitive Zone.
4. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of new major hydroelectric projects. Prohibited (except as otherwise provided) as per applicable laws.
7. Uses of plastic carry bags. Prohibited (except as otherwise provided) as per applicable laws.
8. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
9. Construction activities. No new construction of any kind shall be permitted within the Eco-sensitive Zone, except for the domestic needs of local residents including the activities listed in sub-paragraph (1) of paragraph 3. In case of the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum.
B. Regulated Activities:
10. Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
11. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometer or up to the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Tourism Master Plan.
12. Undertaking activities related to tourism like overflying the sanctuary area by hot-air balloons, etc.
Regulated under applicable laws.

13. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any.
(b) Beyond one kilometer upto the extent of Eco-sensitive Zone, construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per the Zonal Master Plan.
14. Drastic change of agriculture system. Regulated under applicable laws.
15. Commercial water resources including ground water harvesting.
(a)The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
16. Erection of electrical cables and telecommunication towers.
Underground cabling to be promoted.
17. Fencing of existing premises of hotels and lodges. Regulated under applicable laws.
18. Widening and strengthening of existing roads and construction of new roads.
Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
19. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws.
20. Introduction of exotic species. Regulated under applicable laws.
21. Protection of hill slopes and river banks. Regulated under applicable laws.
22. Commercial sign boards and hoardings. Regulated under applicable laws.
23. Air (including noise) and vehicular pollution. Regulated under applicable laws.
24. Discharge of treated effluents in natural water bodies or land area.
Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
25. Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone which do not cause any adverse impact on environment shall be permitted.
26. Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
27. Security Forces Camp. Regulated under applicable laws.
28. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone:
Provided that new wood based industry may be set up in the Eco-sensitive using 100% imported wood stock.
29. Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc. for ecofriendly tourism activities Regulated under applicable laws.
30. Solid Waste Management. Regulated under applicable laws.

5. Eco-sensitive Zone Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(a) the Chief Conservator of Forests (Wildlife), Government of Punjab —Chairman;
(b) representative of Department of Rural Development and Panchayat, Government of Punjab- Member;
(c) Regional Office, Punjab State Pollution Control Board —Member;
(d) one representative of Non-governmental Organisations working in the field of environment to be nominated by the Government of Punjab for three years —Member;
(e) one expert in the area of ecology and environment to be nominated by the Government of Punjab for a term of three years —Member;
(f) representative of Department of Rural Development and Housing Department, Government of Punjab —Member;
(g) representative of Agricultural, Government of Punjab —Member;
(h) representative of District Collector of Hoshiarpur —Member;
(i) Member State Bio Diversity Board —Member; and
(j) Deputy Conservator of Forest —Member-Secretary.
Terms of reference:
(2) The tenure of the Monitoring Committee is for three years.
(3) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(4) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(5) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(6) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s)shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(7) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(8) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State as per pro forma appended at Annexure III .
(9) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
