PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2861] ubZ fnYyh] lkseokj] fnlEcj 5] 2016@vxzgk;.k 14] 1938 No. 2861] NEW DELHI, MONDAY DECEMBER 5, 2016/AGRAHAYANA 14, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 5 ᳰदस᭥बर, 2016 का.आ. 3645(अ).—महारा᭬ ᮝ रा᭔ य मᱶ मंुबई मᱶ संजय गांधी रा᭬ ᮝीय उ᳒ान, बोरीवली के चारᲂ ओर के ᭃेᮢ को पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ घोिषत करन ेके िलए एक भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 229(अ) तारीख 22 जनवरी, 2016 ᳇ारा उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसूचना अंतᳶव᳥ ह,ै उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमिᮢत करते ᱟए एक ᮧाᱨप अिधसूचना ᮧकािशत कᳱ गई थी ;

और उᲦ राजपᮢ, िजसमᱶ उ᭍ त अिधसूचना अंतᳶव᭬ ट ह,ै कᳱ ᮧितयां जनता को 22 जनवरी, 2016 को उपल᭣ध करा दी गई थᱭ ;

और के᭠ᮤीय सरकार ᳇ारा ᮧा᭡ त ᮧाᱨप अिधसूचना के ᮧ᭜ यु᭜ तर मᱶ सभी ᭪ यि᭍ तयेां और पणधाᳯरयᲂ से ᮧा᭡ त आᭃेपᲂ और सुझावᲂ पर स᭥यᲦः िवचार ᳰकया गया ह ै;

और संजय गांधी रा᭬ ᮝीय उ᳒ान (िजसे इसमᱶ इसके प᭫ चात् रा᭬ ᮝीय उ᳒ान कहा गया ह)ै मंुबई महानगर मᱶ िघरा ᱟआ एक िविश᭬ ट पयाᭅवास ह ैऔर यह महारा᭬ ᮝ के ठाणे और मंुबई िजले के बीच उ᭜ तर 19o 8.8" से 19o 21" अᭃांश और पवूᭅ 72o 53" से 72o 58" देशांतरᲂ के बीच अवि᭭ थ त ह ै;

और, रा᭬ ᮝीय उ᳒ान वन᭭ पित और जीवज᭠ तु कᳱ संकटाप᭠ न ᮧजाितयᲂ का एक िनवास ᭭ थान ह ैऔर लगभग 1300 फूलᲂ के पौधᲂ कᳱ ᮧजाितयᲂ, 45 ᭭ तनधारी कᳱ ᮧजाितयᲂ, 43 सरीसृपᲂ कᳱ ᮧजाितयᲂ, 38 सांपो कᳱ ᮧजाितयᲂ, 12 उभयचरᲂ कᳱ ᮧजाितयᲂ, 300 पिᭃ यᲂ कᳱ ᮧजाितयᲂ, 150 िततिलयᲂ कᳱ ᮧजाितयᲂ का पयाᭅवास ह ै;

और, यह ᭃेᮢ ᭭ तनपायी ᮧजाित यᲂ जैसे तᱶदआु (पᱶथेरा पाडᭅस), जंगली सूअर (सुस ᭭पा.), चार सᱭगᲂ वाल े िह रण, ᭣ लैकने᭡ ड खरगोश, जंगली िब ᭨ ली (फेिलस चौस), िस यार (कैिनस औरेयस) और साही (टेटरासेरस Ფाडᳯरकोरिनस, हसैᳯᮝ᭍स इि᭠डका) के िल ए जाना जाता ह ै तथा इसमᱶ पिᭃ यᲂ कᳱ ᮧजाित यᲂ जैसे मोर (पावो ᳰᮓसटेटस), लैसर ᮕेब, पपᭅल हरैोन (अरिडया परपुरेया), ᭭ मालर इगरेट, लैसर िव सᳲलग टील, पाᳯर या काइट, बुलबुल का आ᮰य ᭭ थल ह ैऔर रा᭬ ᮝीय उ᳒ान मᱶ अनेक सरीसृप भी पाये जात ेह ᱹिज सके अंतगᭅत भारतीय कोबरा और वाइपर सांप ह ᱹ;

2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, ᭃेᮢ कᳱ ᮰ेणी वन᭭ पित तटवतᱮ वनᲂ से पि᭫ च मी उप-उ᭬ णकᳯटबंधी पवᭅती वनᲂ तक और रा᭬ ᮝीय उ᳒ान मᱶ चᱹिपयन और सेठ ᳇ारा भारतीय वनᲂ के ᮧकार का संशोिध त वगᱮकरण के अनुसार, दिᭃ णी-उ᭬ णकᳯटबंधी आᮤᭅ िमि᮰ त पणᭅपाती वन और पि᭫ च मी उप-उ᭬ णकᳯटबंधी पवᭅती वन और कुछ वृᭃ ᮧजाितयाँ ह ैिजसमᱶ टेकटोना ᮕᱹिड़ स, ᮝमनीिलया टोमᱹटोसा, आᳰकया कटेचू, अडीना कोरडीफोिलया, मीतरागयान परवीफलोरा, पेᮝोकरपस मरसिपयम, होलररेहना ᲍टीडयसᱶᮝीका, बूटी मोनो᭭ पᭅमा और िडयोसपयोरस मैलनऑ᭍ सीलन आᳰद ह;ै और, संजय गांधी रा᭬ ᮝीय उ᳒ान के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करन ेको ᮧितिष᳍ करना आव᭫यक ह;ै अतः, इसिलए, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1) और उपधारा (2) के खंड (v) और खंड

(xiv) तथा उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, महारा᭬ ᮝ मᱶ संजय गांधी रा᭬ ᮝीय उ᳒ान कᳱ सीमा से 100 मीटर से 4 ᳰकलोमीटर तक के िव᭭ तार के ᭃेᮢ को संजय गांधी रा᭬ ᮝीय उ᳒ान पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:--

1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाएं.—(1) पाᳯरि᭭थितक संवेदी जोन संजय गांधी रा᭬ ᮝीय उ᳒ान कᳱ सीमा से 100 मीटर से 4 ᳰकलोमीटर तक के िव᭭ तार मᱶ 59.456 वगᭅ ᭃेᮢ मᱶ फैला ᱟआ ह ैऔर पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का वणᭅन उपाबधं I मᱶ ᳰदया गया ह ै।

(2) पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ इसके अᭃांश और देशा᭠ तर के साथ उपाबधं II के ᱨप मᱶ सि᭥ मिलत ह।ै

(3) पाᳯरि᭭थितक संवेदी जोन मᱶ आन ेवाल ेᮕामᲂ कᳱ सूची उपाबधं III के ᱨप मᱶ सि᭥ मिलत ह ै।

2. पाᳯरि᭭थितक संवदेी जोन के िलए आचंिलक महायोजना.—(1) रा᭔य सरकार, पाᳯरि᭭थितक संवेदी जोन के िलए राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल᭏ न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।

(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।

(3) रा᭔य सरकार ᳇ारा पाᳯरि᭭थितक संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित मᱶ, इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।

(4) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करन ेके िलए रा᭔ य सरकार के सभी संब᳍ िवभागᲂ के परामशᭅ से तयैार होगी, अथाᭅत्:--

(i) पयाᭅवरण ;

(ii) वन ;

(iii) शहरी िवकास ;

(iv) पयᭅटन ;

(v) नगरपािलका ;

(vi) राज᭭ व ;

(vii) कृिष ;

(viii) महारा᳦ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ;

(ix) ᳲसचाई ;

(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।

(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलᲐू, िजन पर ᭟यान देना आव᭫यक ह,ै के िलए उपबंध हᲂगे ।

(7) आंचिलक महायोजना सभी िव᳒मान एवं ᮧ᭭ तािवत पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलो᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।

(8) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।

3. रा᭔य सरकार ᳇ारा ᳰकए जान े वाल े उपाय.—रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन े के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--

(1) भू-उपयोग - पाᳯरि᭭थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :

परंत ुपाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, िजसके अंतगᭅत संल᭏ न नगरᲂ कᳱ िवकास योजना मᱶ िवकास खंडᲂ के ᮧवगᭅ मᱶ सि᭥ मिलत भूिमयां ह,ᱹ मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं0 10, 16, 22, 32 और 35 के सामन ेसूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत ्:--

(i) पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭थायी आवासन के िलए पाᳯरि᭭थितक अनुकूल आरामगाह जैसे टᱹट, लकड़ी के मकान आᳰद ;

(ii) िव᳒मान सड़कᲂ को चौड़ा करना, नई सड़कᲂ और अ᭠ य अवसरंचना संकमᲄ जैसे मंुबई मेᮝो रेल आᳰद का िनमाᭅण ;

(iii) नागᳯरक सुिवधाᲐ का पुनᱧᭅ᳍ार और बढ़ोतरी और उ᭠ नयन, िजसके अंतगᭅत जल आपूᳶत और भंडारण तथा अ᭠ य नागᳯरक सुिवधाᲐ के िलए अवसरंचना का सृजन सि᭥ मिलत ह,ै िजसके अंतगᭅत िव᳒मान पारेषण लाइनᲂ, दसूसंचार टावरᲂ आᳰद मᱶ बढ़ोतरी और उ᭠ नयन तथा नए भूिमगत पारेषण केबलᲂ और संचार केबलᲂ आᳰद कᳱ ᭭ थापना सि᭥ मिलत ह ै;

(iv) ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग ;

(v) वषाᭅ जल संचय ; और

(vi) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण द᭭ तकार, ᭭ टोर और ᭭ थानीय सुिवधाएं ह।ै परंत ुयह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा :

परंत ुयह और भी ᳰक पाᳯरि᭭थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात ्रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी । परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंत ुयह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएंगे । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(2) ᮧाकृितक जल ᳫोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᳫोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᳍ार के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष᳍ करन ेके िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।

(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂग ेजो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, महारा᳦ सरकार ᳇ारा राज᭭ व और वन िवभाग महारा᭬ ᮝ सरकार के परामशᭅ से तैयार कᳱ जाएगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂग,े अथाᭅत ्:-

(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देत े ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा ;

(ii) पाᳯरि᭭थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संजय गांधी रा᭬ ᮝीय उ᳒ान कᳱ सीमा से एक ᳰकलोमीटर भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अन᭄ुात नहᱭ ᳰकया जाएगा ;

परंत ु संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के परे पाᳯरि᭭थितक संवेदी जोन के िव᭭ तार तक नए होटलᲂ और ᳯरसोटᲄ को पूवᭅ पᳯरभािषत और नामिन᳸द᭬ ट ᭃेᮢᲂ मᱶ आंचिलक महायोजना के अनुसार पाᳯरि᭭थितक संवेदी पयᭅटन सुिवधाᲐ के िलए अनु᭄ात ᳰकया जाएगा।

(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।

(4) नसैᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।

(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।

(6) ᭟ विन ᮧदषूण -- रा᭔ य सरकार का पयाᭅवरण िवभाग या महारा᭬ ᮝ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) के अधीन बनाए गए ᭟ विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2002 के अधीन उपदᳶशत उपबंधᲂ के अनुसरण मᱶ िविनयमᲂ को कायाᭅि᭠ वत करेगा ।

(7) वाय ुᮧदषूण -- रा᭔ य सरकार का पयाᭅवरण िवभाग या महारा᭬ ᮝ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा।

(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, जल (ᮧदषूण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।

(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा--

(i) पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, समय-समय पर संशोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1357(अ) तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ᳰकए गए थ,े के उपबंधᲂ के अनुसार ᳰकया जाएगा ;

(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶग े;

(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;

(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।

(10) जैव िचᳰक᭜ सीय अपिश᭬ ट - पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान समय-समय पर यथासंशोिधत जैव िचᳰक᭜ सा अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 343(अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत ᳰकए गए थ,े के अनुसार ᳰकया जाएगा ।

(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित सुसंगत अिधिनयमᲂ और िनयमᲂ तथा तदधीन बनाए गए िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।

(12) औ᳒ोिगक इकाईयॉ - (क) ᮧ᭭ तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर नए का᭬ ठ उ᳒ोगᲂ कᳱ ᭭ थापना िविध के अनुसार ᭭ थािपत िव᳒मान का᭬ ठ आधाᳯरत उ᳒ोगᲂ के िलए अनु᭄ात कᳱ जाएगी अ᭠ यथा नहᱭ । (ख) ᮧ᭭ तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वायु, मृदा, ध् विन ᮧदषूण उ᭜ प᭠ न करन ेवाले ᳰकसी नए उ᳒ोग कᳱ ᭭ थापना नहᱭ कᳱ जाएगी ।

4. पाᳯरि᭭थितक संवदेी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची.—पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और त᳍ीन बनाए गए िनयमᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत ्:-- सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी

(1) (2) (3) ᮧितिष᳍ ᳰᮓयाकलाप :

1. वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां । नई और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िलए, घरᲂ कᳱ मर᭥ मत हतेु या संिनमाᭅण के िलए िमᲵी को खोदने और वैयि᭍ तक उपयोग के िलए आवासन के िलए दशेी टाइलᱶ या ᲊटᲂ के िसवाय अनु᭄ात नहᱭ हᲂगी ;

िव᳒मान खानᲂ और प᭜ थर तोड़ने कᳱ इकाईयᲂ कᳱ अनु᭄ि᭡ त/पᲵे का िव᭭ तार नहᱭ ᳰकया जाएगा । यᳰद अनु᭄ि᭡ त िविभ᭠ न अिधिनयमᲂ के अधीन िव᳒मान िनयमᲂ का अितलंघन करती है तो अनु᭄ि᭡ त को समा᭡ त कर ᳰदया जाएगा । खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं.

1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।

2. आरा मीलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितकᳱ संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

3. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाले का िव᭭ तार अनु᭄ात नहᱭ होगा ।

4. जल िव᳒ुत पᳯरयोजनाᲐ और ताप िव᳒ुत संयंᮢᲂ कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠यथा उपबंिधत के िसवाय) ।

5. पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन। लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠यथा उपबंिधत के िसवाय) ।

6. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) ।

7. नए का᭬ ठ आधाᳯरत उ᳒ोग । नए का᭬ ठ आधाᳯर त उ᳒ोगᲂ कᳱ ᭭ थापना को पाᳯरि᭭थितक संवेदी जोन कᳱ सीमाᲐ के भीतर अनु᭄ात नहᱭ ᳰक या जाएगा :

परंतु िव ᳒ मान का᭬ ठ आधाᳯर त उ᳒ोग तब तक जारी रह सकᱶ गे जब तक त᭜ समय ᮧवृ᭜ त ᳰक सी िव िध के अधीन उ᭠ हᱶ ᮧित िष ᳍ नहᱭ कर ᳰद या जाता ह ै।

8. नया अितᮓमण और उनका िविनयमन । सभी ᮧकार के अितᮓमणᲂ का ᮧितषेध ᳰकया जाएगा ।

9. ᳲसचाई िवभाग ᳇ारा जल ᭡लिवत ᭃेᮢᲂ को पᲵे पर दनेा । जल ᭡ लिवत ᭃेᮢᲂ मᱶ कृिष, मछली पकड़ने या ᳰक᭠ हᱭ अ᭠ य ᳰᮓयाकलापᲂ पर, जो झीलᲂ और तालाबᲂ के उपदᳶशत ᮧयोजनᲂ से संबंिधत नहᱭ हᱹ, के पᲵे पर पूणᭅ रोक होगी । िविनयिमत ᳰᮓयाकलाप

10. होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । रा᳦ीय पाकᭅ कᳱ सीमा के 1 ᳰकलोमीटर के भीतर नए वािण᭔यक होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना को िसवाए पाᳯरि᭭थितक के अनुकूल पयᭅटन ᳰᮓयाकलापᲂ से संबंिधत पयᭅटकᲂ के िलए अ᭭थायी आवास के िलए अनु᭄ात नहᱭ ᳰकया जाएगा । परंतु 1 ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ के िव᭭ तार पयᭅटन महायोजना और रा᭬ ᮝीय बाघ संरᭃण ᮧािधकरण के ᳰदशा-िनदᱷश के अनुᱨप हᲂगे ।

11. संिनमाᭅण ᳰᮓयाकलाप । पाᳯरि᭭थितक संवेदी जोन के भीतर अनुमोᳰदत िवकास योजना और महारा᭬ ᮝ ᭃेᮢीय और नगर योजना अिधिनयम के लागू िनयमᲂ और िविनयमᲂ के उपबंधᲂ के अनुसार संिनमाᭅण अन᭄ुात ᳰकया जाएगा । परंतु यह ᳰक िनमाᭅणाधीन/पुनᱧᭅ᳇ाराधीन वािणि᭔ यक भवन, िजसके अंतगᭅत समूह आवास सोसायᳯटया,ं कायाᭅलय, सूचना ᮧौ᳒ोिगकᳱ/सूचना ᮧौ᳒ोिगकᳱ समᳶथत सेवाएं, पाकᭅ , रोड़, िव᳒ुत पारेषण लाइनᱶ और केबल, दरूसंचार टावर और केबल, मल लाइनᱶ, नागᳯरक सुिवधाएं आᳰद और नई संिनमाᭅण पᳯरयोजनाएं जैसे मुंबई मेᮝो रेल शेड और नई नागᳯरक सुिवधाᲐ का सृजन जैसे जल आपूᳶत से संबंिधत अवसंरचना और सुिवधाएं तथा अवसंरचना का ओ एंड एम, अनुमोᳰदत िवकास योजना और महारा᭬ ᮝ ᮧादिेशक और नगर योजना अिधिनयम के अधीन संबंिधत ᭭ थानीय ᭭ व:सरकार ᳇ारा ᭭ वीकृत िवकास योजना के अधीन अनुमोᳰदत को पाᳯरि᭭थितक संवेदी जोन के भीतर लागू िनयमᲂ और िविनयमᲂ के अधीन रहते ᱟए अनु᭄ात ᳰकया जा सकेगा :

परंतु यह और ᳰक वािणि᭔यक पुनᳶवकास, पुनᳶनमाᭅण, िव᳒मान ढांचᲂ कᳱ मर᭥ मत, िजसके अंतगᭅत ᭭थानीय ᭭व:सरकार ᳇ारा अनुमोᳰदत िवकास योजना और महारा᭬ ᮝ ᮧादिेशक और नगर योजना अिधिनयम के अधीन ᭭ वीकृत समूह आवास सोसायᳯटयां ह,ᱹ को पाᳯरि᭭थितक संवेदी जोन के भीतर लागू िनयमᲂ और िविनयमᲂ के अधीन रहते ᱟए अनु᭄ात ᳰकया जा सकेगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोगᲂ से संबंिधत संिनमाᭅण ᳰᮓयाकलापᲂ को लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧिधकारी कᳱ पूवᭅ अनु᭄ा से अनु᭄ात ᳰकया जाएगा । अनुमोᳰदत िवकास योजना पाᳯरि᭭थितक सवेंदी जोन के संरᭃण पᳯरᮧे᭯ यᲂ को ᭟ यान मᱶ रखते ᱟए आंचिलक महायोजना के अनुसार होगी ।

12. वृᭃᲂ कᳱ कटाई । रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।

13. वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू-जल संचयन भी ह ै। सतह जल और भू-जल के िन᭬ कषᭅण को केवल भूिम के अिधभोगी के वा᭭तिवक कृिष उपयोग और घरेलू खपत के िलए अनु᭄ात ᳰकया जाएगा । औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण कᳱ पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी, िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह।ै अनुरᭃण, पुनवाᭅस और बढ़ोतरी से संबंिधत नगर िनगम/पᳯरषद ्कᳱ जलापूᳶत अवसंरचना सुिवधाᲐ के संिनमाᭅण ᳰᮓयाकलापᲂ को अनु᭄ात ᳰकया जाएगा । सतही या भू-जल का िन᭬ कषᭅ अनु᭄ात नहᱭ ᳰकया जाएगा । तथािप, बोटलीकृत जल, आ᳒ानᲂ और टᱶकरᲂ मᱶ जल लागू अपेᭃाᲐ के िलए अनु᭄ात होगा । ᳰकसी भी ᮲ोत, िजसके अंतगᭅत कृिष है, से संदषूण या जल ᮧदषूण को िनवाᳯरत करने के िलए कदम उठाए जाएंगे ।

14. पारेषण केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण । लागू िविधयᲂ के अनुसार िविनयिमत ᳰकया जाएगा । िव᳒ुत पारेषण लाइनᲂ और केबलᲂ, दरूसंचार टावरᲂ का संिनमाᭅण, बढ़ोतरी और पुनᱧᭅ᳇ार अनु᭄ात ह ै। नए भूिमगत केबलीकरण का संवधᭅन ᳰकया जाएगा ।

15. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । संजय गांधी रा᭬ ᮝीय उ᳒ान कᳱ िव᳒मान सीमा कᳱ दीवार पर ऊंची बाड लगाई जाएगी ।

16. िव᳒मान सड़कᲂ, पुलᲂ को चौड़ा करना और उ᭠हᱶ सुदढ़ृ करना, नई सड़कᲂ, लोक सुिवधाᲐ या सामुदाियक भवनᲂ का संिनमाᭅण । पाᳯरि᭭थितक संवेदी जोन के भीतर िबना ᳰकसी ᮧितकूल ᮧभाव के इन ᳰᮓयाकलापᲂ को लागू िव᳒मान िविधयᲂ के अनुसार ᳰकया जाएगा ।

17. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।

18. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

19. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

20. ᮧाकृितक जल िनकायᲂ या भूिम ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव को ᮧो᭜ सािहत ᳰकया जाएगा और गाद या ठोस अपिश᳥ का िनपटान लागू िविनयमᲂ के अनसुार होगा ।

21. वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

22. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭थितक संवेदी जोन से गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष, पु᭬ प कृिष, उ᳒ान कृिष या कृिष आधाᳯरत दशेीय माल स े औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते ह,ᱹ को अनु᭄ात ᳰकया जाएगा ।

23. वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण (एनटीएफपी) । व᭠ यजीव अ᭤ यार᭛ य या रा᭬ ᮝीय उ᳒ान कᳱ सीमा से 100 मीटर के भीतर ᳰकसी संᮕहण कᱶ ᮤ को अनु᭄ात नहᱭ ᳰकया जाएगा ।

24. वायु और यािनक ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

25. दकुानदारᲂ ᳇ारा पािलिथन बैगᲂ का उपयोग। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

26. कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

27. जलावन लकड़ी का वािणि᭔ यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠यथा उपबंिधत के िसवाय) ।

28. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा रा᭬ ᮝीय उ᳒ान ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) ।

29. ठोस अपिश᭬ ट ᮧबंधन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) ।

30. पाᳯरि᭭थितक पयᭅटन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । सवंᳶधत ᳰᮓयाकलाप

31. डेयᳯरयᲂ, डेयरी फाᳺमग, जल कृिष और म᭜ ᭭ य पालन के साथ ᭭ थानीय समदुायᲂ ᳇ारा चालू कृिष और कृिष उ᳒ान प᳍ितयां । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे।

32. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।

33. जैिवक कृिष । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।

34. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।

35. कुटीर उ᳒ोगᲂ, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधाजनक भंडार, ᭭ थानीय सुिवधाएं, लोक उपयोिगताएं और सामुदाियक भवन ह ᱹ। सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।

36. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । बायो गैस, सौर ᮧकाश आᳰद का संवधᭅन ᳰकया जाना ह ै।

37. कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।

38. कौशल िवकास । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।

39. पयाᭅवरण जागᱧकता । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।

5. मानीटरी सिमित.—(1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत ्:- (क) नगर पािलका आयु᭍ त/अपर नगर पािलका आयु᭍ त, बृह᭜ त मंुबई नगर िनगम (एमसीजीएम) अ᭟यᭃ (ख) मु᭎ य पᳯररᭃक और िनदेशक, संजय गांधी रा᭬ ᮝीय उ᳒ान सद᭭य (ग) अपर नगर पािलका आयु᭍ त, ठाणे नगर िनगम सद᭭य (घ) उप कल᭍टर, मंुबई उपनगरीय िजला सद᭭य (ङ) उप कल᭍टर, ठाण ेिजला सद᭭य (च) उप कल᭍टर, पालघर िजला सद᭭य (छ) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करन ेवाले गैर सरकारी संगठन का महारा᭬ ᮝ सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक वषᭅ के िलए नामिन᳸द᭬ ट ᳰकया जाने वाला एक ᮧितिनिध सद᭭य (ज) पᳯरि᭭थितकᳱ और पयाᭅवरण के ᭃेᮢ से महारा᭬ ᮝ सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक वषᭅ के िलए नामिन᳸द᭬ ट ᳰकया जाने वाला एक िवशेष᭄ सद᭭य (झ) ᮧादेिशक अिधकारी, महारा᭬ ᮝ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ, मंुबई/ठाण े सद᭭य (ञ) नगर योजना अिधकारी, मंुबई/ठाणे सद᭭य (ट) सहायक वन पᳯररᭃक (एलआरपी) ठाण े सद᭭य ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 (ठ) रा᭔ य जैव िविवधता बोडᭅ का सद᭭ य सद᭭य (ड) उप वन पᳯररᭃक, ठाणे वन ᮧभाग सद᭭य-सिचव

6. िनदᱷश िनबधंन :

(क) मािन टरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी । (ख) मानीटरी सिमित का कायᭅकाल तीन वषᭅ होगा । (ग) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.

1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष᳍ गितिविधयᲂ के िसवाय आन े वाल ेऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत रा᭔य ᭭तरीय पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी । (घ) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ुपाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा । (ङ) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ कल᭍टर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा । (च) मानीटरी सिमित मु᳎ᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहत ेᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी । (छ) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ उपाबधं IV मᱶ उपबंिधत ᱨप िवधान के अनुसार उ᭍ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी । (ज) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपन ेकृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे ।

7. इस अिधसूचना के उपबंधᲂ को ᮧभाव देन ेके िलए कᱶ ᮤीय सरकार और रा᭔ य सरकार अितᳯर᭍ त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶ गी ।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 5th December, 2016 S.O. 3645(E).—Whereas, a draft notification, declaring Eco-sensitive Zone around Sanjay Gandhi National Park, Borivali in Mumbai of Maharashtra State, was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 229(E), dated the 22nd January, 2016, inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said notification were made available to the public on the 22nd January, 2016;

AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;

AND WHEREAS, the Sanjay Gandhi National Park (hereinafter referred to as the National Park) is a unique habitat enclosed in the metropolis of Mumbai and is located in the Thane and Mumbai District of Maharashtra State between N 19o 8.8" to 19o 21" latitude and E 72o 53" to 72 o 58" longitudes;

AND WHEREAS the National Park is home to a number of endangered species of flora and fauna and harbours approximately 1300 species of flowering plants, 45 species of mammals, 43 species of reptiles, including 38 species of snakes, 12 species of amphibians, 300 species of birds, 150 species of butterflies;

AND WHEREAS, the area is known for mammalian species such as Leopard (Panthera pardus), Wild Boar (Sus sp), Four Horned Antelope (Tetracerus quadricornis), Blacknaped Hare, Wild Cat (Felis chaus), Jackal (Canis aureus), and Porcupine (Hystrix indica) and also harbours many bird species such as Peacock (Pavo cristatus), Lesser Grebe, Purple Heron (Ardea purpurea), Smaller Egret, Lesser Whistling Teal, Pariah Kite, Bulbul and many reptiles are also found in the National Park including snakes as Indian Cobra and Viper;

AND WHEREAS, the vegetation of the area ranges from littoral forests to western sub-tropical hill forests and as per the revised classification of Indian Forest Types by Champion and Seth, the National Park has Southern Tropical Moist Mixed Deciduous Forest and Western Sub Tropical Hill Forest and some of the tree species are Tectona grandis, Terminalia tomentosa, Acacia catechu, Adina cordifolia, Mitragyna parviflora, Pterocarpus marsupium, Holarrhena antidyssentrica, Butea monosperma, and Diospyros melanoxylon etc.;

AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the Sanjay Gandhi National Park as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW Therefore, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of 100 meters to four kilometers from the boundary of Sanjay Gandhi National Park in the State of Maharashtra as the Sanjay Gandhi National Park Eco-sensitive Zone (hereinafter after referred to as Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone.—(1) The Eco-sensitive Zone is spread over an area of

59.456 sq.km to an extent of 100 meters to four kilometers from the boundary of Sanjay Gandhi National Park and the boundary description of the Eco-sensitive Zone is given in Annexure I.

(2) The map of the Eco-sensitive zone along with latitude and longitude is included in Annexure II.

(3) The list of the villages falling within Eco-sensitive Zone is included in Annexure III.

2. Zonal Master Plan for Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.

(2) The said Plan shall be approved by the Competent Authority in the State Government.

(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i) Environment;

(ii) Forest;

(iii) Urban Development;

(iv) Tourism;

(v) Municipal;

(vi) Revenue;

(vii) Agriculture;

(viii) Maharashtra State Pollution Control Board;

(ix) Irrigation;

(x) Public Works Department;

for integrating environmental and ecological considerations into it.

(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.

(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.

3. Measures to be taken by State Government.—The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.—Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:

Provided that the conversion of agricultural lands, including the lands included in the category of the no development zones in the Development Plan of the adjoining cities, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 10, 16, 22, 32 and 35 in column (2) of the Table in paragraph 4, namely:-

(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities;

(ii) Widening and strengthening of existing roads, construction of new roads and other infrastructure works such as Mumbai metro rail, etc.;

(iii) Renovation and augmentation and upgradation of civic amenities including creation of infrastructure for water supply and storage and other civic amenities, including augmentation and upgradation of existing transmission lines, telecommunication towers, etc and establishment of new underground transmission cables and communication cables, etc;

(iv) Small scale industries not causing pollution,

(v) Rainwater harvesting, and

(vi) Cottage industries including village industries, convenience stores, local amenities, public utility and community buildings:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or such unproductive agricultural areas.

(2) Natural Springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such areas.

(3) Tourism.—

(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per the Tourism Master Plan, which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Maharashtra in consultation with Department of Revenue and Forests, Government of Maharashtra.

(c) The activity of tourism shall be regulated as under, namely:-

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco- sensitive Zone;

(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Sanjay Gandhi National Park or the extent of Eco-sensitive Zone, whichever is nearer, except for accommodation for temporary structures for tourists related to Eco-friendly tourism activities:

Provided that beyond one kilometer from the boundary of protected area till the extent of the Ecosensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for Eco-tourism facilities as per Zonal Master Plan;

(iii) till the Zonal Master Plan is approved, development for eco-tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, water bodies, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23 conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.

(5) Man-made heritage sites.—Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

Noise pollution.—The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

(6) Air pollution.— The Environment Department of the State Government or Maharashtra State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Ecosensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(7) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.

(9) Solid wastes.—Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India, Ministry of Environment and Forests and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

(10) Bio-medical waste.— The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India, Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.

(11) Vehicular traffic .—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12) Industrial Units.—

(a) No establishment of new wood based Industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based Industries set up as per the Law.

(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986), and the rules made thereunder and be regulated in the manner specified in the Table below, namely:- 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S. Commercial Mining, stone quarrying and crushing units.

New and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited except for the domestic needs of bona fide local residents with reference to digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal use.

The license/lease of existing mines and stone crushers shall not be extended. If license violates the existing rules under different Acts, the license will be terminated The mining operations shall strictly be in accordance with the interim order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Setting up of saw mills.

No new or expansion of any existing saw mills shall be permitted within the Eco-sensitive Zone.

3.

Setting up of Industries causing water or air or soil or noise pollution No new or expansion of polluting Industries in the Eco-sensitive Zone shall be permitted

4.

Establishment of hydroelectric projects and thermal power plants Prohibited (except as otherwise provided) as per applicable laws.

5.

Use or production of any hazardous substances.

Prohibited (except as otherwise provided) as per applicable laws.

6.

Discharge of untreated effluents and solid waste in natural water bodies or land area.

Prohibited (except as otherwise provided) as per applicable laws.

7.

New wood based industry.

Establishment of new wood based industry shall not be permitted within the limits of Eco-sensitive Zone:

Provided the existing wood-based industry may continue unless prohibited under any law for the time being force

8. New encroachments and their regularization.

Encroachments of all kinds shall be prohibited.

9. Lease out of submergence areas by irrigation department.

Total ban on lease for farming, fishing or any other activity in the submergence area, not related to the stated purpose (water supply & ancillary works thereto) of the lakes and tanks.

Regulated Activities

10.

Establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted, within one kilometer of the boundary of the Protected Area or the extent of Eco-sensitive Zone whichever is nearer, except related to eco-friendly tourism activities:

Provided that beyond one km. from the boundary of the Sanjay Gandhi National Park area and up to the extent of the Eco-sensitive Zone, all new eco-tourism activities or expansion of existing activities shall be in conformity with the Zonal Master Plan.

11.

Construction activities.

Construction shall be permitted within the Eco-sensitive Zone as per the provisions of the approved Development Plan and other applicable rules and regulation under the Maharashtra Regional and Town Planning Act:

Provided that the under construction/renovation of commercial buildings including group housing societies, offices, and services such as Information Technology/Information Technology Enabled Services, Parks, Roads, Power Transmission lines and cables, Telecommunication Towers and cables, Sewage lines, civic amenities, etc., and new construction projects such as Mumbai Metro Rail Shed, and creation of new civic amenities such as water supply related infrastructure and facilities and Operation & Maintenance of infrastructure, facilities of civic amenities sanctioned by concerned Local Self Government under approved Development Plan under the Maharashtra Regional and Town Planning Act, may be permitted within ESZ subject to applicable rules and regulations.

Provided further that commercial redevelopment, reconstruction, repairs of existing structures which includes group housing societies, sanctioned by concerned Local Self Government under approved Development Plan under the Maharashtra Regional and Town Planning Act, may be allowed within Ecosensitive Zone subject to applicable rules and regulations:

Provided further that the commercial redevelopment reconstruction, repairs of existing structures which includes group housing societies, sanctioned by concerned Local Self Government under approved Development Plan under the Maharashtra Regional and Town Planning Act, may be allowed within the Ecosensitive Zone subject to applicable rules and regulations.

The construction activity related to small scale industries not causing pollution shall be permitted as per applicable rules and regulations, if any, with the prior permission from the competent authority.

The Approved Development Plan shall be in conformity with the Zonal Master Plan taking into consideration the conservation aspects of the Ecosensitive Zone.

12.

Felling of trees.

There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

13.

Commercial water resources including ground water harvesting.

The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.

Extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority:

The construction activities of water supply infrastructure facilities of Municipal Corporation/Council related to maintenance, rehabilitation and augmentation are permitted.

No extraction of surface water or ground water shall be permitted; however sale of bottled water, water in containers and tankers for the requirement as applicable shall be permitted. Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.

14.

Erection of electrical cables and telecommunication towers.

Regulated as per applicable laws.

Construction/Augmentation and renovation of Power Transmission lines and cables, Telecommunication Towers and cables is permitted. New underground cabling is promoted.

15. Fencing of existing premises of hotels and lodges.

Regulated as per applicable laws. A tall fence shall be erected over the existing boundary wall of the Sanjay Gandhi National Park.

16.

Widening and strengthening of existing roads, bridges, infrastructure and construction of new roads, public utility or community buildings.

Shall be done as per applicable laws to these activities without adverse impact within the Eco-sensitive Zone.

17. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.

18. Introduction of exotic species. Regulated as per applicable laws.

19. Protection of hill slopes and river banks. Regulated as per applicable laws.

20. Discharge of treated effluents in natural water bodies or land area.

Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes shall be in accordance with the applicable regulations 21 Commercial Sign boards and hoardings. Regulated as per applicable laws.

22. Small scale industries not causing pollution.

Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco- Sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.

Collection of Forest produce or Non- Timber Forest Produce (NTFP).

31. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

Permitted under applicable laws

32. Rain water harvesting. Shall be actively promoted.

33. Organic farming. Shall be actively promoted.

34.

Adoption of green technology for all activities.

Shall be actively promoted.

35.

Cottage industries including village industries, convenience stores, local amenities, public utility and community buildings.

Shall be actively promoted.

36.

Use of renewable energy sources. Bio gas, solar light etc. to be promoted

37. Agro-Forestry. Shall be actively promoted

38. Skill Development. Shall be actively promoted

39. Environment Awareness. Shall be actively promoted

5. Monitoring Committee.— (1) The Central Government for effective monitoring of the Ecosensitive Zone, hereby constitutes a Monitoring Committee, which shall comprise of the following, namely:-

(a) Municipal Commissioner/ Additional Municipal Commissioner, Municipal Corporation of Greater Mumbai (MCGM).

(g) One representative of Non Governmental Organisation working in the field of environment to be nominated by the Government of Maharashtra for a term of one year in each case.

(h) One expert in the area of ecology and environment to be nominated by the Government of Maharashtra - Member

(i) Regional Officer, Maharashtra State Pollution Control Board, Mumbai/Thane.

6. Terms of Reference

(a) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(b) The tenure of the Monitoring committee is for three (3) years.

(c) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.

(d) The activities that are not covered in the Schedule to the notification of the Government of India, Ministry of Environment and Forest and Climate Change number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(e) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Forest Officers shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(f) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(g) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma given in Annexure IV.

(h) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. The provisions of this notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal (NGT).
