कीउपियरय (1)और उपियरय (2) के खंड (v) और खंड (xiv) द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर् ेहुए,उत्तरप्रिेिरयज्र्मेंपयवार्ीअगापक्षीअभर्यरण्र्केचयरोंओरएकदकलोमीटरर्क के धवथर्यररर्क्षेत्र को पयवार्ीअगा पक्षीअभर्यरण्र् पयररधथथधर्की संवेिी जोन (धजसे इसमें इसके पश्चयर् पयररधथथधर्की संवेिीजोनकहयगर्यह)ैकेरूपमेंअधिसूधचर् करर्ी ह,ैधजसकेब्र्ौरेधनम्नयनुसयरहैं,अथयार् :-

2. पयररधथथधर्की सवंिेी जोन के धलए आचंधलक महयर्ोजनय – (1) रयज्र् सरकयर, पयररधथथधर्की संवेिी जोन के धलए रयजपत्र में अंधर्म अधिसूचनयकेप्रकयिन की र्यरीख से िो वर्ा की अवधि के भीर्र, थथयनीर् व्यधिर्ोंकेपरयमिासेऔरइस अधिसूचनयमेंसंलग्नअनुबंिोंकेसयमंजथर्सेआंचधलक महयर्ोजनय र्ैर्यर करेगी ।
(2) आचंधलकमहयर्ोजनयरयज्र्सरकयरमेंसक्षमप्रयधिकयरीद्वयरयअनुमोदिर्होगी।
(3) रयज्र् सरकयर द्वयरय पयररधथथधर्की संवेिी जोन के धलए आचंधलक महयर्ोजनय इस र्रह, इस अधिसूचनय में धवधनर्िाष्टरूपर्थयसुसंगर्कें रीर्औररयज्र्धवधिर्ोंकेसयमंजथर्औरकें रीर्सरकयरद्वयरयजयरीमयगाधनिेिों,र्दिकोई हों,द्वयरयर्ैर्यरहोगी।
(4) आंचधलकमहयर्ोजनय,पर्यावरणीर्औरपयररधथथधर्कीधवचयरोंकोसमयकधलर्करनेकेधलएरयज्र्सरकयरकेसभी संबद्धधवभयगोंकेपरयमिासेर्रै्यरहोगी,अथयार् :--
(i) पर्यावरण;
(ii) वन औरवन्र्जीव;
(iii) कृधर्;
(iv) रयजथव;
(v) िहरीधवकयस;
(vi) पर्ाटन;
(vii) ग्रयमीणधवकयस;
(viii) नसंचयईऔरबयढ़धनर्ंत्रण;
(ix) नगरपयधलकय;
(x) पंचयर्र्ीरयज;और
(xi) लोकधनमयाणधवभयग।
(5) आंचधलकमहयर्ोजनयअनुमोदिर्धवद्यमयनभू-उपर्ोग,अवसंरचनयऔरदक्रर्यकलयपोंपरकोईधनबंिनअधिरोधपर् नहींकरेगीजबर्कदकइसअधिसूचनयमेंधवधनर्िाष्टनहोऔरआचंधलकमहयर्ोजनयसभीअवसंरचनयऔरदक्रर्यकलयपोंमें औरअधिकिक्षर्यऔरपयररधथथधर्कीअनुकूलर्यकयसंविानकरेगी।
(6) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मृिय और नमी संरक्षण, थथयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधथथधर्की और पर्यावरण से संबंधिर् ऐसे अन्र् पहलओूं, धजन पर ध्र्यन िेनय आवश्र्क ह,ै के धलए उपबंि होंग े।
(7) आंचधलक महयर्ोजनय सभी धवद्यमयनपूजयथथलों,ग्रयमोंऔरनगरीर् बंिोबथर्ों, वनों केप्रकयरऔरदकथमों, कृधर् क्षेत्रों,ऊपजयऊभूधम,हररर्क्षते्रजैसेउद्ययनऔरउसीप्रकयरकेथथयन,उद्ययन कृधर्के्षत्र,फलोियन, झीलोंऔर अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी ।
(8) आंचधलकमहयर्ोजनयथथयनीर्समुियर्ोंकीजीवकोपयजानकोसुधनधश्चर्करनेकेधलए,पयररधथथधर्कीसंवेिीजोन मेंधवकयसकोपयररधथथधर्कीअनुकूलधवकयसकेधलएधवधनर्धमर्करेगी।
(9) इसप्रकयरअनुमोदिर्आंचधलकमहयर्ोजनयइसअधिसूचनयकेउपबंिोंकेअनुसयरमयनीटरीकेअपनेकृत्र्ोंकोकरनेके धलएमयनीटरीसधमधर्केधलएएकसंिभािथर्यवेजहोगी। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
3. रयज्र् सरकयर द्वयरय दकए जयन े वयल े उपयर्-- रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करन े के धलए धनम्नधलधखर् उपयर् करेगी, अथयार् :--
(1) भ-ूउपर्ोग-(क)पयररधथथधर्की संवेिी जोन में वनों, उद्ययन-कृधर् क्षेत्रों, कृधर् क्षेत्रों, आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्हर् दकए गए पयकों और खुल ेथथयनों कय वृहि वयधणधज्र्क र्य वृहिआवयसीर्कयम्पलैक्स औद्योधगक दक्रर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय: परंर् ुपयररधथथधर्की संवेिी जोन के भीर्र भयग(क)में धवधनर्िाष्टप्रर्ोजनसे धभन्नप्रर्ोजनके धलएकृधर्औरअन्र् भूधमकय संपररवर्ान मयनीटरी सधमधर् की धसफयररि पर और र्थयलयगूक्षेत्रीर्नगरर्ोजनयअधिधनर्मर्थयकेन्रीर्/रयज्र् सरकयरकेअन्र्धनर्मोंर्थयधवधनर्मोंकेअिीनसक्षमप्रयधिकयरी के पूवा अनुमोिन से, र्थयइसअधिसूचनयकेउपबंिों द्वयरयथथयनीर् धनवयधसर्ों कीधनम्नधलधखर् आवयसीर् आवश्र्कर्यओं को पूरय करन ेके धलएअनजु्ञयर्दकर्यजयएगय,जैसेदक:-
(i)पयररधथथधर्कीअनुकूलपर्ाटनदक्रर्यकलयपोंसेसंबंधिर्पर्ाटकोंकेअथथयर्ीअधिभोग केधलएपयररधथथधर्कीअनुकूलकुटीरजैसेटैंट,कयष्ठगृह;
(ii)धवद्यमयन सड़कों को चौड़य करनय और उन्हें सुिढृ करनय र्थय नई सड़कों कय संधनमयाण;
(iii) प्रिरू्ण उत्पन्न न करने वयल ेलघ ुउद्योग;
(iv)वर्या जल संचर्;और
(v)कुटीर उद्योगोंधजसकेअंर्गार्ग्रयमीणउद्योग,सुधवियजनकथटोरऔरथथयनीर्सुख-सुधवियएंसधम्मधलर्हैं: परंर् ुर्ह औरदक क्षेत्रीर्नगरर्ोजनयअधिधनर्मऔरअन्र्धनर्मोंऔरधवधनर्मोंकेअिीनरयज्र् सरकयर के पूवा अनुमोिन र्थय संधवियन के अनुच्छेि 244 और र्त्समर् प्रवृत्त धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै वयधणधज्र्क र्य उद्योग धवकयस दक्रर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय: परंर् ुर्ह भी दक पयररधथथधर्की संवेिी जोन के भीर्र भू-अधभलेखों में प्रकटहोनेवयली कोई तु्ररट, मयनीटरी सधमधर् के धवचयर प्रयप्त करन ेके पश्चयर् रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमल ेमें एक बयर संिोधिर् होगी और उि तु्ररट के संिोिन की संसूचनय कें रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को िीजयएगी । परंर् ुर्ह भी दक उपर्ुाि तु्ररट कीपररिुधद्ध में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू-उपर्ोग कय पररवर्ान सधम्मधलर् नहीं होगय । (ख)वनरोपणऔरप्रयकृधर्कवयसजीणोद्धयरदक्रर्यकलयपोंवयलेअनप्रर्ुक्र्र्यअनुत्पयिककृधर्क्षेत्रोंमेंपुन:वनीकरणकरने केप्रर्यसदकएजयएंगे।
(2)प्रयकृधर्कजलस्रोर्ों--आचंधलकमहयर्ोजनय मेंसभीप्रयकृधर्कजलस्रोर्ोंकीपहचयनकीजयएगीऔरउनकेसंरक्षण और पुनरुद्भूर्करण के धलए र्ोजनय सधम्मधलर् होगीऔर रयज्र् सरकयर द्वयरय ऐसे क्षेत्रों पर र्य उनके धनकट धवकयस दक्रर्यकलयपप्रधर्धर्द्धकरनेकेधलएऐसीरीधर्सेमयगाधनिेिर्रै्यरदकएजयएंगे।
(3)पर्ाटन–(क)पयररधथथधर्की संवेिी जोन के भीर्र पर्ाटन संबंिी दक्रर्यकलयप, जोपर्ाटनमहयर्ोजनयकेअनुसयरहोंगे, आंचधलक महयर्ोजनय कय भयग रूपमें होंगे। (ख) पयररधथथधर्की संवेिी जोन के लिए पर्ाटन महयर्ोजनय पर्ाटन धवभयग, सरकयर द्वयरय रयज्र् सरकयर के वन और पर्यावरणधवभयगकेपरयमिासेर्ैर्यरहोगी। (ग)पर्ाटनमहयर्ोजनयआंचधलकमहयर्ोजनयकेएकघटककेरूपमेंहोगी। (घ)पर्ाटनसंबंिीदक्रर्यकलयपधनम्नधलधखर्केअिीनधवधनर्धमर्होंग,ेअथयार् :-
(i) पयवार्ीअगयापक्षीअभर्यरण्र्कीसीमयसे1दकलोमीटरकेभीर्रर्यपयररधथथधर्कीसंवेिीजोनकेधवथर्यरर्क,जोभी धनकटहो,दकसीहोटलर्यररसोटाकयनर्यसंधन्नमयाणअनुज्ञयर्नहींदकर्यजयएगय।बिर्े,वन्र्जीवअभर्यरण्र्कीसीमयसे एक दकलोमीटरकी िरूी से परे पयररधथथधर्की संवेिीजोन के धवथर्यर र्कनए होटलोंऔर ररसोटोंकी थथयपनय पर्ाटन II (ii) 5 महयर्ोजनय केअनुसयरपयररधथथधर्कीपर्ाटन सुधवियओं के धलएपूवासीमयंदकर्औरपियधभधहर्क्षेत्रोंमें हीअनुज्ञयर्की जयएगी;
(ii)पयररधथथधर्की संवेिी जोन के भीर्र सभी नए पर्ाटन दक्रर्यकलयपों र्य धवद्यमयन पर्ाटन दक्रर्यकलयपों कय धवथर्यर कें रीर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् के मयगाििाक धसद्धयंर्ों के द्वयरय र्थय रयष्रीर् व्र्यघ्र स संरक्षण प्रयधिकरण, द्वयरय जयरी पयररधथथधर्की पर्ाटन (समर्-समर् पर र्थय संिोधिर्) मयगाििाक धसद्धयंर्ों के अनुसयर, पयररधथथधर्की पर्ाटन,पयररधथथधर्की धिक्षय और पयररधथथधर्की धवकयस को महत्व िेर्ेहुए पयररधथथधर्की संवेिी जोन की वहन क्षमर्य के अध्र्र्न पर आियररर् होगय;
(iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयने र्क, पर्ाटन के धलए धवकयस और धवद्यमयन पर्ाटन दक्रर्यकलयपों के धवथर्यर को वयथर्धवक थथल धवधनर्िाष्ट संवीक्षय र्थय धनगरयनी सधमधर् की धसफयररि पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य होगय ।
(4)नैसर्गाक धवरयसर् -- पयररधथथधर्की संवेिी जोन में महत्वपूणा नैसर्गाक धवरयसर् के सभी थथलों जैसेसभी जीन कोि आरधक्षर् के्षत्र, िैल धवरचनयएं, जल प्रपयर्ों, झरनों, घयटी मयगों, उपवनों, गुफयए,ं थथलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और उन्हें संरधक्षर् दकर्य जयएगय र्थय उनकी सुरक्षय और संरक्षय के धलए इस अधिसूचनय के अंधर्म प्रकयिन की र्यरीख से छह मयस के भीर्र, उपर्ुि र्ोजनय बनयएगी और ऐसी र्ोजनय आंचधलकमहयर्ोजनय कय भयग होगय ।
(5)मयनव धनर्मार् धवरयसर्थथल-पयररधथथधर्की संवेिी जोन मेंभवनों, संरचनयओं, धिल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंथकृधर्क महत्व के क्षेत्रोंकी पहचयन कीजयएगीऔर इस अधिसूचनय केरयजपत्रमें प्रकयिन की र्यरीख से छह मयह के भीर्रधवरयसर्संरक्षणर्ोजनय उनके संरक्षण केधलएर्ैर्यर कीजयएगी र्थय आंचधलक महयर्ोजनय केभयगरुपमेंहोंगी ।
(6) ध्वधन प्रिरू्ण - पयररधथथधर्की संवेिी जोन में ध्वधन प्रिरू्ण धनवयरणऔर धनर्ंत्रण पर्यावरण (संरक्षण)अधिधनर्म, 1986केअिीनध्वधनप्रिरू्ण(धवधनर्मनऔरधनर्ंत्रण)धनर्म2000केउपबंिोंकेअनुसयरदकर्यजयएगय ।
(7) वयर् ुप्रिरू्ण-- पयररधथथधर्की संवेिी जोन में, वयर्ु प्रिरू्ण धनवयरणऔर धनर्ंत्रण वयर् ु(प्रिरू्ण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981(1981 कय 14) औरउसकेअिीनबनयएगएधनर्मों के उपबंिों के अनुसरण में दकर्यजयएगय ।
(8) बधहस्रयव कय धनथसयरण--पयररधथथधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनथसयरण, जल (प्रिरू्ण धनवयरण र्थय धनर्ंत्रण) अधिधनर्म, 1974 (1974 कय 6)औरउसकेअिीनबनयएगएधनर्मों के उपबंिों के अनुसयर होगय ।
(9)ठोस अपधिष्ट-- ठोस अपधिष्टों कय धनपटयनऔरप्रबंिन धनम्नधलधखर् रूप में होगयः- (क)पयररधथथधर्की संवेिी जोन में ठोसअपधिष्ट धनपटयनऔरप्रबंिनठोसअपधिष्टप्रबंिन धनर्म,2016,जो भयरर्सरकयर के पर्यावरण,वनऔरजलवयर्ु पररवर्ानमंत्रयलर्कीअधिसूचनय सं.कय.आ.1357(अ)र्यरीख 8अप्रलै,2016द्वयरयप्रकयधिर्दकएगएथे, केउपबंिोंके अनुसयरदकर्यजयएगय ;औरअकयबाधनक सयमग्री कय धनपटयनपयररधथथधर्की संवेिी जोनकेबयहरपहचयन दकएगएथथलपर दकसी पर्यावरणीर् थवीकृर् रीधर् में होगय; (ख) पयररधथथधर्कीसंवेिीजोनकेभीर्रठोसअपधिष्टोंकेसुरधक्षर्औरपर्यावरणीर्ध्वधनप्रबंिन (ईएसएम) की पहचयनकीगईर्कनीकोंकेउपर्ोगकीधवद्यमयनधनर्मोंऔरधवधनर्मोंकेअनुरूपिीजयसकेगी।
(10) जैवधचदकत्सीर्अपधिष्ट-जैवधचदकत्सीर्अपधिष्टप्रबंिनधनम्नधलधखर् रूप में होगयः— (क) पयररधथथधर्की संवेिी जोन में जैव धचदकत्सीर् अपधिष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. सय.कय.धन 343(अ) र्यरीख 28 मयचा, 2016 द्वयरय प्रकयधिर् जैव धचदकत्सीर् अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय । (ख) पयररधथथधर्की संवेिी जोन के अिीन जैव-धचदकत्सय अपधिष्टों के सुरधक्षर् और पर्यावरणीर् ध्वधन प्रबंिन (ईएसएम)कीपहचयनकीगईर्कनीकोंकेउपर्ोगकीधवद्यमयनधनर्मोंऔरधवधनर्मोंकेअनुरूपअनुमधर्िीजय सकेगी।
(11)र्यनीर्र्यर्यर्यर्: - पररवहन कय र्यनीर् संचलन आवयस के अनुकूल रीधर्में धवधनर्धमर् होगय और इस संबंि में आंचधलक महयर्ोजनय में धवधनर्िाष्ट उपबंि समयधवष्ट दकए जयएंग ेऔर आंचधलक महयर्ोजनय के र्ैर्यर होने औररयज्र् सरकयरकेसक्षमप्रयधिकयरीद्वयरय अनुमोदिर् होने र्क, मयनीटरी सधमधर् सुसंगर्अधिधनर्मोंर्थयर्ििीनबनयएगए धनर्मों और धवधनर्मों के अिीन र्यनीर् संचलन के अनुपयलन को मयनीटर करेगी । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(ii) पयररधथथधर्कीसंवेिीजोनमेंकें रीर्प्रिरू्णधनर्ंत्रणबोडाद्वयरयफरवरी,2016मेंजयरीदिियधनिेिोंमेंकेवगीकरण केअनुसयरकेवलगैर-प्रिरू्णकयरीउद्योगोंकोअनुमधर्िीजयएगी,जबर्कदकइसअधिसूचनयमेंअन्र्थयधवधनर्िाष्ट नहो।

9. संधनमयाणदक्रर्यकलयप। (क)संरधक्षर्क्षेत्रकीएकदकलोमीटरकीसीमयकेभीर्रदकसीभी प्रकयर के नए वयधणधज्र्क संधनमयाण को अनुज्ञयर् नहीं दकर्य जयएगय: परंर्ु थथयनीर् लोगों को पैरय 3 के उप पैरय (1) में सूचीबद्ध दक्रर्यकलयपोंसधहर्उनकेआवयसीर्उपर्ोगकेधलएउनकीभूधम मेंसंधनमयाणकरनेकीअनुमधर्िीजयएगी। ऐसे लघु उद्योगों जो प्रिरू्ण उत्पन्न नहीं करर्े हैं, से संबंधिर् संधनमयाण दक्रर्यकलयप धवधनर्धमर् दकएजयएंगेऔरलयगू धनर्मों और धवधनर्मों, र्दिकोई हों, केअनुसयरसक्षमप्रयधिकयरी की पूवाअनुमधर्सेहीन्र्ूनर्मपररखेजयएंगे। (ख)एक दकलोमीटरसेआगेऔरपयररधथथधर्कीसंवेिीजोनकी सीमयर्कवयथर्धवकथथयनीर्आवश्र्कर्यओंकेधलएसंधनमयाणकी अनुज्ञय िी जयएगी और अन्र् वयधणधज्र्क संधनमयाण दक्रर्यकलयप आंचधलकमहयर्ोजनयकेअनुरूपहोंगे।
10. प्रयकृधर्क जल धनकयर्ों र्य भू क्षेत्र में बधहस्रयाव और ठोस अपधिष्टों कय धनथसयरण। लयगूधवधिर्ोंकेअिीनधवधनर्धमर्होंगे।

22. होटलोंऔरलॉजकेधवद्यमयनपररसरोंमेंबयड़ लगयनय। लयगूधवधिर्ोंकेअिीनधवधनर्धमर्होंगे। वन्यजीवों के लिबााध संचिि को अिुज्ञात करिे के लिए पयररधथथधर्कीसंवेिीजोन केभीर्रहोटलोंर्यअन्र्वयधणधज्र्क थथयपनअपनीसंपधत्तर्ोंमेंकयंटेियरर्यरनहींलगयएंगेऔरकोई और कोई भी बयड एक मीटर से अधिक ऊंची नहीं होगी। इस अनुबंिकयअनुपयलननकरनेवयलीधवद्यमयनबयड़कोआंचधलक महयर्ोजनय में उधल्लधखर् समर् सीमयओं के अनुसयर उपयंर्ररर् दकर्यजयएगय।
23. कृधर्प्रणयधलर्ोंमेंभयरीपररवर्ान। लयगूधवधिर्ोंकेअिीनधवधनर्धमर्होंगे।
24. रयधत्रमेंर्यधनकर्यर्यर्यर्कयसंचलन। लयगूधवधिर्ोंकेअिीनधवधनर्धमर्होंगे।
25. वयधणधज्र्कसयइनबोडा और होर्डंग। लयगूधवधिर्ोंकेअिीनधवधनर्धमर्होंगे।
26. प्रिरू्ण उत्पन्नन करने वयले लघु उद्योग। पयररधथथधर्की संवेिी जोनस ेगैर प्रिरू्ण, गैर पररसंकटमर्, लघ ु और सेवय उद्योग, कृधर्,पुष्पकृधर्, कृधर् उद्ययनर्य कृधर् आियररर् उद्योग, जोमेंििेीर्मयलसेऔद्योधगकउत्पयिोंकयउत्पयिनकरर्े हैंऔरजोपर्यावरण पर कोई धवपरीर् प्रभयव नहीं डयलर्े हैं,को अनुज्ञयर्दकर्यजयएगय।
27. वन उत्पयिों और गैर कयष्ठ वन उत्पयिों कय संग्रहण। लयगूधवधिर्ोंकेअिीनधवधनर्धमर्होंगे।
28. रेककंगऔरकैनपंग। लयगूधवधिर्ोंकेअिीनधवधनर्धमर्होंगे।
29. पहयड़ीढयलोंऔरनिीर्टोंकयसंरक्षण। जबर्कआंचधलकमहयर्ोजनय केअिीनअनुज्ञयर्न दकर्यजयए जबर्क1से10मीटरकेपहयड़ीढलयनोंपरऔरदकसीनिीर्ट औरप्रयकृधर्कनयलेसे100मीटरर्ककोईसंधन्नमयाणदक्रर्यकलयप नहींदकर्यजयएगय।

A number of territorial birds of Indian origin stay here the year round; breeding of Saras, Crane and the Rare Black Necked Stork have been recorded in the Sanctuary and as regards biodiversity of this Sanctuary, the flora of this area is represented by Semi arid vegetation outside it, and a typical aquatic vegetation of the lake in plains of North India. The Parvati Arga Bird Sanctuary situated in Gonda District of Uttar Pradesh is spread over an area of about
10.84 sq km. AND WHEREAS, The Parvati Arga Bird Sanctuary is an avian population of the bird sanctuary here comprises a mix of approximately 35 species of resident as well as migratory birds. The birds migrate across Himalayas from Tibet, China, Europe and Siberia during winters. Some of these birds fly over 5000 km and above 8500 meters high to reach here. 37.5 sq kms from the boundary of the Parvati Arga Bird Sanctuary in Gonda District of Uttar Pradesh State.
(2) The boundary description of Parvati Arga Bird Sanctuary and its Eco-sensitive Zone is given in Annexure-I.
(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-II and Annexure-II A.
(4) The Geo-coordinates of Parvati Arga Bird Sanctuary and its Eco-sensitive Zone is given in Annexure- III and Annexure-III-A.
(5) The list of five villages falling within the Eco-sensitive Zone is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of the final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. II (ii) 17
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal ;
(x) Panchayati Raj ; and
(xi) Public Works Department.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure ecofriendly development and livelihood security of local communities.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of the final notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of the final notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:-
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities;
(ii) widening and strengthening of existing roads and construction of new roads;
(iii) small scale industries not causing pollution;
(iv) rainwater harvesting; and
(v) cottage industries including village industries, convenience stores and local amenities: 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism - (a) All new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within one kilometer from the boundary of the Parvati Arga Bird Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer: provided that beyond the distance of one kilometer from the boundary of the Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within the Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation within six months from the date of publication of final notification in the official Gazatte and such plan shall from part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared within six months from the date of publication of final notification in the official Gazatte and such plan shall from part of the Zonal Master Plan.
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 . II (ii) 19
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder .
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the water (Prevention control of pollution ) Act, 1974 (6 of 1974) and the made thereunder.
(9) Solid wastes. - Disposal and management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste. – Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28 th March, 2016.
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Vehicular pollution: -Prevention and control of vehicular pollution in the Eco-sensitive Zone shall be carried out in accordance with applicable laws and effort shall be made for use of cleaner fuel for example Compressed natural gas, etc.
(13) Plastic waste management:- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.-
(14) Construction and demolition waste management:- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(15) E-waste- The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(16) Industrial units.- (i) no new polluting industries shall be permitted to be set up within the Ecosensitive Zone.
(ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in the final notification.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
4. List of activities Prohibited, Regulated and Promoted within the Eco-sensitive Zone :-All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under, and be regulated in the manner specified in the Table below, namely:- TABLE Sl. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited except for the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.
(b) The mining operations shall strictly be in accordance with the orders of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon’ble Supreme Court dated the 21 st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
5. Establishment of major hydroelectric projects. Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws Regulated activities
8. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometer and upto the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Tourism Master Plan.
9. Construction activities.
(a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of protected area or of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their residential II (ii) 21 use including the activities listed in sub-paragraph (1) of paragraph 3:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any.
(b) Beyond one kilometer upto the extent of Ecosensitive Zone, construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per the Zonal Master Plan.
10. Discharge of treated effluents and solid waste in natural water bodies or land area. Regulated under applicable laws.
11. Air and vehicular pollution. Regulated under applicable laws.
12. Establishment of large-scale commercial livestock and poultry farms by firms, corporate companies Regulated
13. Use of polythene bags. Regulated under applicable laws.
14. Undertaking activities related to tourism like over-flying the national park area by aircraft, hot-air balloons. Prohibited (except as otherwise provided) as per applicable laws.
15. Introduction of exotic species. Regulated under applicable laws.
16. Extraction of ground water. Regulated under applicable laws.
17. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government;
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder;
(c) In case of Reserve Forests and Protected Forests, the Working Plan prescriptions shall be followed.
18. Erection of electric cables Regulated under applicable laws.
19. Recycling of bio degradable material. Regulated under applicable laws.
20. Installation of electric lines. Regulated under applicable laws. Promote underground cabling.
21. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
22. Fencing of existing premises of hotels and lodges. Regulated under applicable laws. In order to allow free movement of wildlife, hotels or other commercial establishments within the Ecosensitive Zone shall not fence their properties with barbed wire and no fence shall be higher than one meter. Any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan.
23. Drastic change of agriculture systems. Regulated under applicable laws.

5. Monitoring Committee.- The Central Government within three months of this Notification, constitutes a Monitoring Committee, for effective monitoring of the provisions of the final notification, comprising of the following, namely:-
1. District Collector, Gonda Chairman;
2. An expert in the area of ecology and environment to be nominated by the Government of Uttar Pradesh for a period of one year. Member
3. One representative of non-Governmental Organization working in the field of environment including heritage conservation) to be nominated by the Government of India for a period of one year Member
4. Regional Officer, Uttar Pradesh State Pollution Control Board Member
5. Expert Ecology Member
6. Expert Biodiversity Member
7. Representative of Public Works Department, Gonda Member
8. Representative of Irrigation Department, Gonda Member

25. Sign boards and hoardings. Regulated under applicable laws.
26. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
27. Collection of non-timber forest products Regulated under applicable laws.
28. Trekking and camping. Regulated under applicable laws.
29. Protection of hill slopes and river banks. No construction activity unless otherwise permitted under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 degree and also upto 100 meters from the banks of any river, and natural nallah.
30. Solid Waste Management. Regulated under applicable laws.
31. Eco-tourism. Regulated under applicable laws.
32. Community Reserve Nature Regulated under applicable laws. Promoted activities
33. Ongoing agriculture practices, plantation and other forestry activity. Shall be actively promoted.
34. Organic farming Shall be actively promoted.
35. Adoption of green technology for all activities. Shall be actively promoted.
36. Cottage industries including village artisans. Shall be actively promoted.

6. Terms of reference: (1) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector (s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of the final notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden of the State as per proforma appended at Annexure-V.
(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and the State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal. [F.
