और ईपीसीए का गठन पयाावरण की क् वाजलटी सुरजित करन ेऔर सुधारने और राष्ट रीय रािधानी िेत्र में पयाावरणीय प्रदषूण को जनवाररत और जनयंजत्रत करने के उदे्दश् य के साथ दकया गया था;

और ईपीसीए का कायाकाल 30 अगस्ट् त, 2019 को समाप् त हो गया ह;ै अत: अब केन्द रीय सरकार, पयाावरण (संरिण) अजधजनयम, 1986 (1986 का 29) (जिसे इस अजधसूिना में इसके पश् िात उक् त अजधजनयम कहा गया ह)ै की धारा 3 की उपधारा (1) और उपधारा (3) द्वारा प्रदत् त िजियों का प्रयोग करते हुए और पयाावरण, वन और िलवाय ुपररवतान मतं्रालय में भारत सरकार की अजधसूिना सं.5120 (अ), तारीख 3 अक् तूबर, 2018 का, उन बातों के जसवाय अजधक्ांत करत ेहुए, जिन्द हें ऐसे अजधक्मण से पूवा दकया गया ह ै या करन ेका लोप दकया गया ह,ै एतद्द्वारा जनम् नजलजखत व् यजियों से युक् त पयाावरण प्रदषूण (जनवारण और जनयंत्रण) प्राजधकरण का पुनगाठन करती ह;ै अथाात :—

2. ईपीसीए, जनम् नजलजखत िजियों का प्रयोग करेगा और पयाावरण की क् वाजलटी की संरिा और सुधार के जलए तथा पयाावरणीय प्रदषूण के जनवारण, जनयंत्रण और उपिमन के जलए जनम् नजलजखत कृत् य करेगा, अथाात् — (क) दकसी प्राजधकारी के आदिे के अजतक्मण से संबंजधत पररवाद की बाबत या जनम् नजलजखत से संबंजधत जवजनर्ददष्ट ट उपायों के जलए जनदिे िारी करने के जलए उक् त अजधजनयम की धारा 5 के अधीन िजियों का प्रयोग करेगा —
(i) पयाावरण के जवजभन्द न आयामों के संबंध में उसकी क् वाजलटी के जलए मानक;
(ii) जवजभ न्द न स्रोतों से पयाावरणीय प्रदषूकों के उत् सिान या जनस्ट् सारण के जलए मानक;

(iii) उन िेत्रों का जनबंधन, जिनमें कोई उद्योग, उद्योगों के वगा की संदक्याएं या प्रसंस्ट् करण या प्रसंस्ट् करण नहीं िलाए िाएंगे या कुछ रिोपायों के अधीन रहते हुए िलाए िाएंगे;
(iv) ऐसी दघुाटनाओं के जनवारण के जलए प्रदक्या और रिोपाय, जिनसे पयाावरण प्रदषूण हो सकता ह ैऔर ऐसी दघुाटनाओं के जलए उपिारी कृत् य;
(v) पररसंकटमय पदाथों के संभालन के जलए प्रदक्या और रिोपाय। (ख) ऊपर वर्णणत जवषयों को स्ट् वप्रेरणा या पयाावरण के िेत्र में काया कर रह े दकसी व् यजिक, प्रजतजनजध जनकाय या संगठन द्वारा दकए गए पररवाद के आधार पर उठाने की िजि होगी और ऐसे पररवाद कोई उद्योग, संदक्या या प्रसंस्ट् करण िला रह ेदकसी व् यजिक, संघ, कंपनी, पजललक उपक्म या स्ट् थानीय जनकाय के जवरूद्ध हो सकें गे।
3. ईपीसीए, वाहन प्रदषूण का जनयंत्रण करने के जलए यानों द्वारा जवजनर्ददष्ट ट उत् सिान मानकों की अनुपालना सुजनजित करने के जलए सभी आवश् यक कदम उठाएगा, जिनके अंतगात यानों के प्रदषूण की िांि के जलए उपस्ट् कर का उजित अंििोधन, ईंधन क् वाजलटी मानकों का अनुपालन सुजनजित करना, यातायात जनयोिन और प्रबंधन के जलए जनगरानी और समन्द वय करने का काया िाजमल ह।ै
4. ईपीसीए को जवजनर्ददष्ट ट पररवेिी ध् वजन मानकों का अनुरिण सुजनजित करने के जलए उक् त अजधजनयम की धारा 5 के अधीन जनदिे दनेे की िजि होगी, जिसके अंतगात ध् वजन का उत् सिान करने वाले दकसी उद्योग, प्रसंस्ट् करण या संदक्या पर पाबंदी लगाना या जनबंजधत करना सजम्मजलत ह।ै
5. ईपीसीए, राष्ट रीय रािधानी िेत्र से संबंजधत पयाावरणीय िैसे मुद्दों पर, िो उसे कें रीय सरकार द्वारा जवजनर्ददष्ट ट दकए िाएं, कारावाई करेगा।
6. ईपीसीए, इस आदिे के पैरा 2 के अधीन की िाने वाली कोई कारावाई की बाबत उक् त अजधजनयम की धारा 10 के अधीन प्रवेि, जनरीिण, तलािी और अजभग्रहण करने की िजियों का प्रयोग करेगा।
7. ईपीसीए, इस आदिे के पैरा 2 के अधीन की िाने वाली कोई कारावाई की बाबत उक् त अजधजनयम की धारा 11 के अधीन नमूना लेने की िजि का प्रयोग करेगा।
8. ईपीसीए, उक् त अजधजनयम के अधीन अपराधों के जवरूद्ध पररवाद करने के जलए और इस आदिे के पैरा 2 के अधीन उसके द्वारा िारी दकए गए जनदिेों की अनुपालना न करने के जलए उक् त अजधजनयम की धारा 19 के अधीन िजियों का प्रयोग करेगा।
9. ईपीसीए को राष्ट रीय रािधानी िेत्र योिना बोडा अजधजनयम, 1985 (1985 का 2) की धारा 2 के खंड (ि) में यथापररभाजषत राष्ट रीय रािधानी िेत्र पर अजध काररता होगी।
10. ईपीसीए की पूवागामी िजियों और कृत् य, संपूणात: कें रीय सरकार के अधीिण और जनयंत्रण के अधीन होंगे।
11. ईपीसीए का कायाकाल 30 मािा, 2020 तक होगा।
12. ईपीसीए, अपने दक्याकलापों के बारे में एक प्रगजत ररपोटा महीने में एक बार कें रीय सरकार को दगेा।
13. ईपीसीए का मुख् यालय राष्ट रीय रािधानी िेत्र में होगा।
14. सदस्ट् य सजिव, अध् यि के अनुमोदन से ईपीसीए की बैठकें आयोजित करेगा।
15. ईपीसीए की बैठक आयोजित करने और दकसी जनणाय तक पहुिंने के जलए इसके सदस्ट् यों के एक-जतहाई की न्द यूनतम गणपूर्णत होगी।
16. ईपीसीए की ओर से सभी पत्रािार, अध् यि के अनुमोदन से सदस्ट् य सजिव के माध् यम से अथवा इस प्रयोिन से जवजिष्ट ट रूप से प्राजधकृत दकसी अजधकारी के माध् यम से दकया िाएगा। [फा.सं. क् यू-18011/13/2000-सीपीए(पाटा.)] अरजवन्द द कुमार नौरटयाल, संयुक् त सजिव 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE ORDER New Delhi, the 27th January, 2020 S.O. 382(E).— Whereas in pursuance of the order dated the 7th January, 1998 of the Hon’ble Supreme Court in Writ Petition (C) No. 13029 of 1985, the Central Government constituted the Environment Pollution (Prevention and Control) Authority (hereafter in this notification referred to as the ‘EPCA’), vide notification of the Government of India, in the erstwhile Ministry of Environment and Forests, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 93(E), dated the 29th January, 1998 and this notification was superseded vide notification of the Government of India, in the Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 5120(E), dated the 3rd October, 2018;
And whereas, the EPCA was constituted with the objective of protecting and improving the quality of the environment and preventing and controlling the environmental pollution in the National Capital Region;
And whereas, the EPCA is assisting the Hon’ble Supreme Court in various environment related matters in the National Capital Region in terms of the aforesaid notification number S.O. 5120(E), dated the 3rd October, 2018;
And whereas, the tenure of the EPCA was extended from time to time by the Central Government and lastly it was extended up to the 30th August, 2019 vide notification of the Government of India, in the Ministry of Environment, Forests and Climate Change, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 2522(E), dated the 15th July, 2019;
And whereas, the tenure of the EPCA expired on the 30th August, 2019;
Now, therefore, in exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the said Act), and in supersession of the notification of the Government of India, in the Ministry of Environment, Forest and Climate change number S.O. 5120(E), dated 3rd October, 2018, except as respects things done or omitted to be done before such supersession, the Central Government hereby re-constitutes the Environment Pollution (Prevention and Control) Authority, consisting of the following persons, namely:—

2. The EPCA shall exercise the following powers and discharge the following functions for protecting and improving the quality of the environment and preventing, controlling and abating environmental pollution, namely: —
(a) the powers under section 5 of the said Act for issuing directions in respect of complaints relating to the violation of an order by any authority or measure specified pertaining to—
(i) standards for the quality of the environment in its various aspects;
(ii) standards for emission or discharge of environmental pollutants from various sources;
(iii) restriction of areas in which any industries, operations or processes of class of industries or process shall not be carried out or shall be carried out subject to certain safeguards;
(iv) procedures and safeguards for the prevention of accidents which may cause environmental pollution and remedial measures for such accidents;
(v) procedures and safeguards for the handling of hazardous substances.
(b) the power to take up matters as mentioned above, suo-motu, or on the basis of complaints made by any individual, representative body or organisation functioning in the field of environment and such complaints may be against any individual, association, company, public undertaking or local body carrying on any industry, operation or process.
3. The EPCA shall, for controlling vehicular pollution, take all necessary steps to ensure compliance of specified emission standards by vehicles including proper calibration of the equipment for testing vehicular pollution, ensuring compliance of fuel quality standards, monitoring and coordinating action for traffic planning and management.
4. The EPCA shall, for ensuring maintenance of the prescribed ambient noise standards, have the power to issue directions under section 5 of the said Act, including banning or restricting any industry, process or operation emitting noise.
5. The EPCA shall deal with environmental issues pertaining to the National Capital Region which may be referred to it by the Central Government.
6. The EPCA shall exercise the powers of entry, inspection, search and seizure under section 10 of the said Act, in respect of any action to be taken under paragraph 2.
7. The EPCA shall exercise the power to take samples under section 11 of the said Act, in respect of any action to be taken under paragraph 2.
8. The EPCA shall exercise the powers under section 19 of the said Act, for making complaints against offences under the said Act and for non-compliance of directions issued by it under paragraph 2.
9. The EPCA shall have jurisdiction over the National Capital Region as defined in clause (f) of section 2 of the National Capital Region Planning Board Act, 1985 (2 of 1985).
10. The foregoing powers and functions of the EPCA shall be subject to the supervision and control of the Central Government.

11. The tenure of the EPCA shall be till the 30th March, 2020.
12. The EPCA shall furnish a progress report about its activities once in a month to the Central Government.
13. The EPCA shall have its headquarters in the National Capital Region.
14. The Member Secretary shall organise meetings of the EPCA with the approval of the Chairman.
15. A minimum quorum of one third of the members shall be observed for holding a meeting of the EPCA and for arriving at any decision.
16. All correspondence on behalf of the EPCA may be made with the approval of Chairman through the Member Secretary or through any officer specifically authorised in this behalf.
