And whereas, pursuant to the provision of section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with Ms MEP Chennai Bypass Toll Road Private Limited, having its registered office at 410 Boomerang, Chandivali Farm' Road, Near Chandivali Studio, Andheri East — 400 072, Maharashtra (hereinafter referred to as the “Concessionaire”), the successful bidder for bids submitted on 26.1 1.2012 for the operation and maintain of the sections taking off at kilometer 29.151 of National Highway N0 45 and merging at kilometer 13.800 of Nati'onal Highway No 4 (Chennai Bypass Phase I) and taking off at kilometer 13.800 ofNational Highway No 4 and merging at kilometer 12.600 of National Highway No 5 (Chennai Bypass Phase II) (new chainage Km 0.000 to Km 32.600, Chennai Bypass NH- 4 & 45) ‘ (hereinafter referred to as the “said section”) on Operate. Maintain and Transfer (OMT) basis.

Now, therefore, in "exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “Rules”), and in supersession of the notification of the Government of India in the Ministry of Road Transport and Highways nUmber S.O. 1321(E), dated the 11'h June. 2012, except as respects things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length of nil Kms for use of the four and more lane sections (hereinafter referred to" as “base rate”) and at the base rates specified in Table No 2 for bridges/ structure costing Rupees Fifty Crore or more and at one and one half times the base rate for bypasses costing Rupees ten Crore or more on the Type of Vehicles specified in colthri ,(1),ofthe Table 1 below. and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement:

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for noncommercial purposes and resides within a distance oftwenty kilometers from the toll plaza is Rs. 200.00 (Rupees Two Hundred only) for the year 2012-!3 and is subject to revision every year as per the provisions ofthe National Highways Fee (Determination of Rates and Collection) Rules. 2008.

5. For multiple journey on the highway section, passes shall be issued at the following rates, namely.

6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle.

7. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules. shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the eXcess load has been removed from such mechanical vehicle.

8. All definitions including category of mechanical vehicles. its permissible load. category of exempted vehicles. service road. alternative road etc. shall be as per definitions specified in the said Rule.

10. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 & 2‘ the .

actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the authority and revised annually in accordance with the rule 5 ofthe said rules and the same shall be publishedIn at least one newspape1 each1n English and vernacular language accordingly, provided that no revision shall be effected within six months.

11. The present value of capital cost of the Project to be recovered from the date of COD, is Rs.

1128.114 Crores (Rupees One Thousand One Hundred Twenty Eight Crores and Eleven Lakh Forty Thousand only) (the Capital Cost) the Capital Cost shall be recovered through present value of Concession Fee which shall be discounted at the rate of 12%. From the commercial operation date (hereinafter referred as “Day B") toll shall he collected by the Concessionaire at the applicable rates provided under the National Highways Fee (Determination of Rates and Collection) Rules. 2008. and fumr/amcndmntmiljfibid dugdflgAftcr the day on which the Capital Cost is recovered (hereinafter referred as “Day A”), the toll rates chargeable shall be reduced to 40% of rate being charged upto Day A.

In case due to any reason COD is advanced/postponed upto 90 days the Capital Cost to be recovered ‘. shall be reworked and intimated to the Concessionaire within 30 dens after actual COD by the Engineer/Independent Engineers.
