PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2935] ubZ fnYyh] cq/okj] fnlEcj 14] 2016@vxzgk;.k 23] 1938 No. 2935] NEW DELHI, WEDNESDAY, DECEMBER 14, 2016/AGRAHAYANA 23, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 13 ᳰदस᭥बर, 2016 का.आ. 4027(अ).—भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का. आ. 1244 (अ) तारीख 29 माचᭅ, 2016, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसूचना अतंᳶव᳥ ह,ै उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करते ᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी; और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुᭃावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक ᱧप से िवचार ᳰकया गया; बांधवगढ़ रा᳦ीय उ᳒ान और पानपाथा व᭠यजीव अभयार᭛य, म᭟य ᮧदशे मᱶ अवि᭭थत ह ैऔर दोनᲂ संरिᭃत ᭃेᮢ बांधवगढ़ ᳞ाᮖ आरिᭃती (िजसे इसमᱶ इसके प᳟ात् ᳞ाᮖ आरिᭃती कहा गया ह)ै का कोर ᭃेᮢ गᳯठत करते हᱹ िजसका िव᭭तार 716.903 वगᭅ ᳰकलोमीटर ᭃेᮢ तक फैला ᱟआ ह ै; और, बांधवगढ़ ᳞ाᮖ आरिᭃती 1536.938 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ ह ै जो 716.903 वगᭅ ᳰकलोमीटर ᳞ाᮖ आरिᭃती का कोर ᭃेᮢ ह ैऔर 820.035 वगᭅ ᳰकलोमीटर म᭟यवतᱮ ᭃेᮢ ह ै; और, ᳞ाᮖ आरिᭃती मᱶ 373 फूलदार पादप कᳱ ᮧजाितयां, ᭭तनधाᳯरयᲂ कᳱ 35 ᮧजाितया,ं पᭃी कᳱ 238 ᮧजाितयां और िततिलयᲂ कᳱ 111 ᮧजाितयां अिभिलिखत ह ै; और, ᳞ाᮖ आरिᭃती और आसपास के ᭃेᮢ व᭠यजीव के अंतगᭅत दलुᭅभ लु᳙ᮧाय और संकट मᱶ ᮧजाितयᲂ जैसे सांभर (करवस यूिनकलर िनगरा), रीछ (मेटरसस यूरिसनस), तᱶदआु (पᱶथरा पारडस), चौᳲसगा मृग (टेटराकेरस Ფािᮟकॉरिनस), िचᱫीदार लकड़बघा (हयैना हयैना), भारतीय जंगली कुᱫा (कॉन अलपाइनस), भारतीय साल (मेिनस ᮓािसकौडाटा), बाघ (पᱹथरा ᳯटगᳯरस), जंगली भᱹसा (बॉस गौरस) का वास ह ै; और, ᳞ाᮖ आरिᭃती और आसपास के ᭃेᮢ मᱶ दलुᭅभ लु᳙ᮧाय और संकट मᱶ वन᭭पित कᳱ ᮧजाितयᲂ मᱶ बीजा/बीजसल (पेटरोकॉरपस मसᭅिपयम), भीरा/भीरहा (लोरोजाइलोन ᭭वीटोिनयो) सि᭥मिलत ह ै; 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, ᳞ाᮖ आरिᭃती और आसपास के ᭃेᮢ मᱶ दलुᭅभ लु᳙ᮧाय और संकट मᱶ पिᭃयᲂ कᳱ ᮧजाितयᲂ मᱶ एिशयन वुिलनेक (िसकोिनया), लेसर एडजटᱹक ᭭ᮝोक (लेपटोि᭡टलोस जावािनकस), कॉमन पोचाडᭅ (यैथया फᳯरना), सरस ᮓाने (ᮕस ए᭠टीगोन)े, ᭣लैक-हडेेड इिबस (ᮣेसᳰकओरिनस मेलानोसेफालुस), ᮕे-हडेेड इिबस (ᮣेसᳰकओरिनस मेलानोसेफालुस), ᮕेट ᭭टोन पलोवर (बीच िथक-Უᳱ) (साकस मैगिनरो᭭टᳯरस), ᳯरवर टनᭅ (᭭टेरना औरनाᳯटया), एलेलᮟीन पैराᳰकट (᭡सीᲵाकुला यूपाᳯᮝया), पाइड कुको (लामेटोर जैकोिबनस), मालाबार पाइड धनेश (ए᭠थाराकोकेरोस कोरोनाटस), रेड-हडेेड (᳴कग) िग (सारकोिजपस कालवस), इंिडयन (लॉग-िबलड) िग (िज᭡स इि᭠डकस), ᭪हाइट-र᭥पड िग (िज᭡स बᱶगालेनिसस) सि᭥मिलत ह ै; और, बांधवगढ़ रा᳦ीय उ᳒ान और पानपाथा व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, बांधवगढ़ रा᳦ीय उ᳒ान और पानपाथा व᭠यजीव अभयार᭛य, जो बांधवगढ़ ᳞ाᮖ आरिᭃती का कोर ᭃेᮢ गᳯठत करते ह,ᱹ कᳱ सीमा से 2 ᳰकलोमीटर तक के िव᭭ ताᳯरत ᭃेᮢ को बांधवगढ़ रा᳦ीय उ᳒ान और पानपाथा व᭠यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसिूचत करती है, िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:--
1. पाᳯरि᭭थितक सवंेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) बांधवगढ़ रा᳦ीय उ᳒ान और पानपाथा व᭠यजीव अभयार᭛य जो बांधवगढ़ ᳞ाᮖ आरिᭃती का कोर ᭃेᮢ गᳯठत करता ह,ै कᳱ सीमा स े2 ᳰकलोमीटर तक िव᭭ताᳯरत पाᳯरि᭭थितक संवेदी जोन 1030.382 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ है। पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का वणᭅन और कोर ᭃेᮢ के िनदᱷशांक उपाबंध I के ᱧप मᱶ उपाब ह ै।
(2) पाᳯरि᭭थितक संवेदी जोन 1030.382 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ ह ै। िजसमᱶ म᭟य ᮧदेश रा᭔य के तीन िजलᲂ अथाᭅत् उमᳯरया, कटनी और शहडोल के 132 ᮕाम शािमल हᱹ।
(3) पाᳯरि᭭थितक संवेदी जोन का मानिच ᮢ अᭃांश और दशेा᭠तर का साथ उपाबंध II के ᱧप मᱶ उपाब ह ै।
(4) पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत आने वाले ᮕामᲂ कᳱ सूची ᮧमुख िब᭠दᲐु के साथ उपाबधं III के ᱧप मᱶ उपाब ह ै।
2. पाᳯरि᭭थितक सवंेदी जोन के िलए आचंिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पाᳯरि᭭थतक पयᭅटन ;
(v) नगरपािलका ;
(vi) राज᭭ व ;
(vii) कृिष ;
(viii) रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ;
(ix) ᳲसचाई ; और
(x) लोक िनमाᭅण िवभाग ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢ ᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण स ेसंबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलो᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
(9) ᳞ाᮖ आरिᭃती का म᭟यवतᱮ भाग के ᱧप मᱶ पाᳯरि᭭थितक संवेदी जोन के भाग ह,ै म᭟यवतᱮ ᭃेᮢ से संबंिधत ᳞ाᮖ संरᭃण योजना आंचिलक महायोजना को तैयार करने के दौरान िवचार मᱶ ली जाएगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा : परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन के अधीन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं0 9, 16, 22, 33 और 36 के सामन ेसूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद;
(ii) िव᳒मान सड़कᲂ को चौड़ा करना, और उ᭠हᱶ सुदढृ करना;
(iii) ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग;
(iv) वषाᭅ जल संचय; और
(v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधा भ᭛डार और ᭭थानीय सुिवधाएं ह ᱹ। परंतु यह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा : परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात ् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, म᭟य ᮧदशे सरकार ᳇ारा राज᭭ व और वन िवभाग के परामशᭅ से तैयार होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे। परंतु यह ᳰक जहाँ पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर कᳱ दरूी से वहाँ िव᳒ामान ᭭थापनाᲐ का िव᭭तार आंचिलक महायोजना के अनुसार अनु᭄ात ᳰकया जाएगा : परंतु यह और ᳰक जहाँ पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक एक ᳰकलोमीटर से परे ह ैवहाँ नए होटल और ᳯरसोटᭅ का संिनमाᭅण आंचिलक महायोजना के अनुसार अनु᭄ात ᳰकया होगा ।
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, जल (ᮧदषूण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. आर 343 (अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(12) औ᳒ोिगक इकाईया ं– (क) ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर नए का᳧ आधाᳯरत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा िविध के अनुसार ᭭थािपत िव᳒मान का᳧ आधाᳯरत उ᳒ोगᲂ के िसवाए नहᱭ दी जाएगी । (ख) ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वायु, मृदा, ᭟विन ᮧदषूण काᳯरत करने वाले ᳰकसी नए उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा नहᱭ दी जाएगी ।
4. पाᳯरि᭭थितक सवंेदी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सचूी - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :- सारणी ᮓम सं. ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
1. वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां । (क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां ᮧितिष हᲂगी । तथािप, वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनान ेके िलए दशेी टाइ᭨स या टᲂ का िनमाᭅण करना िव᳒मान िविनयमᲂ के अनुसार अनु᭄ात हᲂगे । (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
2. आरा मीलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
3. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाले का िव᭭ तार अनु᭄ात नहᱭ होगा ।
4. जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
5. नए बृहत जल िव᳒ुत और ᳲसचाई पᳯरयोजना कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
6. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠यथा उपबंिधत के िसवाय) ।
7. ᮧाकृितक जल िनकायᲂ या भ-ूᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ावᭅ और ठोस अपिश᳥ᲂ का िन᭭तारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
8. नए का᳧ आधाᳯरत उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन कᳱ सीमा के भीतर नए का᭬ ठ आधाᳯर त उ᳒ोगᲂ कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा: परंतु िव ᳒ मान का᭬ ठ आधाᳯर त उ᳒ोग िविध के अनुसार जारी रह सकᱶ गे : परंतु यह और ᳰक िव᳒मान आरा मीलᲂ कᳱ अनु᭄ि᳙यᲂ का नवीकरण उनकᳱ समापन अविध के प᳟ात नहᱭ ᳰकया जाएगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िविनयिमत ᳰᮓयाकलाप
9. होटल और िव᮰ाम ᭭थलᲂ का वािणि᭔यक ᭭थापन । पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे। परंतु, जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा ह ै वहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना और रा᭬ ᮝीय व् याᮖ संरᭃण ᮧािधकरण के अनुसार होगा।
10. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे रोप-वे, गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा रा᳦ीय उ᳒ान ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
11. सि᳖माᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै के भीतर ᳰकसी भी ᮧकार का नया वािणि᭔ यक संिनमाᭅण अनु᭄ात नहᱭ होगा: परंतु ᭭ थानीय ᭪ यि तयᲂ को अपने आवासीय उपयोग, िजसके अंतगᭅत पैरा 3 के उपपैरा (1) मᱶ सूचीब ᳰᮓयाकलाप भी ह,ᱹ के िलए अपनी भूिम पर संिनमाᭅण करने कᳱ अनुमित होगी । ᮧदषूण उ᭜ प᭠ न न करने वाले लघु उ᳒ोगᲂ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िनयम या िविनयम, यᳰद कोई लागू हᲂ, के अनुसार सᭃम ᮧािधकारी से पूवᭅ अनुमित ᮧा᭡ त करने के प᭫ चात् अनु᭄ात हᲂगे । (ख) पर᭠तु, जहा ँपाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा ह ै तो वहाँ, एक ᳰकलोमीटर के प᭫ चात ्और पाᳯरि᭭थितक संवेदी जोन के िव᭭ तार तक ᭭ थानीय ᭪ यि तयᲂ कᳱ सावी आव᭫ यकता के िलए संिनमाᭅण अनु᭄ात होगा तथा अ᭠ य वािणि᭔ यक संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे ।
12. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी । (ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ कᳱ दशा मᱶ कायᭅयोजना िनदᱷशᲂ का पालन ᳰकया जाएगा ।
13. वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू-जल संचयन भी ह ै। (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का िन᭬कषᭅण सतही और भूिमगत जल अनु᭄ात होगा । (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह ै। (ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा । (घ) जल के संदषूण या ᮧदषूण, िजसके अंतगᭅत कृिष भी ह,ै को रोकने के िलए सभी उपाय ᳰकए जाएंगे ।
14. िव᳒ुत केबलᲂ, और दरूसंचार टावरᲂ का पᳯरिनमाᭅण ।
(i) ᮕामᲂ और ᮕामीण ᭃेᮢᲂ के िलए केबल जहाँ िबजली नहᱭ ह ैवहाँ नया िबजली और केबल उ᭜थापन के िलए अनु᭄ात ᳰकया जाएगा ।
(ii) िव᳒मान िव᳒ुत लाइनᲂ का संवधᭅन और नवीनीकरण को अनु᭄ात ᳰकया जाएगा ।
(iii) भूिमगत केबल लगाने को बढ़ावा ᳰदया जाएगा।
15. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना ।
(i) लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(ii) व᭠यजीव कᳱ ᭭वतंᮢ आवाजाही कᳱ रीित अनु᭄ात कᳱ जाएगी।
(iii) ᭭थापनᲂ मे िव᳒मान बाड़ लगाना िजनका उपरोᲦ शतᲄ के साथ अनुपालन नहᱭ ᳰकया गया ह,ै उ᭠हᱶ अि᭠तम अिधसूचना कᳱ तारीख से छह माह के भीतर आव᭫यकताᲐ को पूरा करने के िलए हटाया या उपांतᳯरत ᳰकया जाएगा ।
16. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना। यथा लागू उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपायᲂ के साथ ᳰकया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
17. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
18. िवदेशी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
19. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
20. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अबमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
21. वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
22. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन मᱶ देशीय माल से उ᭜पादᲂ का उ᭜पादन करने वाले गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत औ᳒ोिगक ऐसे उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात ᳰकए जाएंगे ।
23. वन उ᭜पादᲂ और गैर का᳧ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
24. वायु और यानीय ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. कृिष ᮧणली मᱶ ᮧबल पᳯरवतᭅन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
26. खाई -᭭थल । कोई नई खाई ᭭थािपत नहᱭ कᳱ जाएगी । परंतु, यह ᳰक िव᳒मान खाई ᭭थल का ᮧचालन इस शतᭅ के अधीन ᳰकया जाएगा ᳰक खुले मᱶ अिᲨ जलाने कᳱ अनुमित न हो |
27. डेयरी ᳰᮓयाकलाप और पशु पालन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. ᭡लाि᭭टक के थैलᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
29. बकरी पालन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
30. ठोस अपिश᳥ ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
31. पाᳯरि᭭थितक-पयᭅटन ᳰᮓयाकलाप । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । संवᳶधत ᳰᮓयाकलाप
32. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी गितिविधयां । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
33. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
34. जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
35. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
36. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह।ᱹ सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
37. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । बायो गैस, सोलर लाइट आᳰद का बढ़ावा ᳰदया जाए ।
38. पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
39. कौशल िवकास । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
40. कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
41. समुदाय ᮧकृित भंडार । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
5. मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-
(i) ᮧभागीय आयुᲦ, शाहडोल -अ᭟यᭃ;
(ii) ᮧभागीय आयुᲦ, जबलपुर -सद᭭य;
(iii) िजला कलेटर, उमᳯरया -सद᭭य;
(iv) िजला कलेटर, शाहडोल -सद᭭य;
(v) िजला कलेटर, कटनी -सद᭭य;

(xiv) म᭟यᮧदशे सरकार ᳇ारा नामिन᳸द᭬ ट ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए पाᳯरि᭭थितक और पयाᭅवरण ᭃेᮢ का एक िवशेष᭄ -सद᭭य;
(xv) रा᭔य जैव-िविवधता बोडᭅ का सद᭭य -सद᭭य;
(xvi) ᭃेᮢ िनदशेक, बांधवगढ़ ᳞ाᮖ आरिᭃती, उमᳯरया- सद᭭य-सिचव।
6. िनदᱷश शत ᱸ–
(i) मािन टरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(ii) सिमित कᳱ अविध तीन वषᭅ होगी ।

(v) मानीटरी सिमित का सद᭭य-सिचव या संब कलटर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 (1986 का 29) के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।
(vi) मानीटरी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । [फा. स.ं 25/178/2015-ईएसजेड/आरई] डॉ. टी. चांदनी, वै᭄ािनक ‘जी’ MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 13th December, 2016 S.O. 4027(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 1244 (E), dated the 29th March, 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government; AND WHEREAS, the Bandhavgarh National Park and Panpatha Wildlife Sanctuary are located in Umaria district in the State of Madhya Pradesh and both the Protected Areas together constitute the core area of the Bandhavgarh Tiger Reserve (hereinafter referred to as Tiger Reserve) which is spread over 716.903 square kilometres; AND WHEREAS, the Bandhavgarh Tiger Reserve is spread over an area of 1536.938 square kilometres of which 716.903 square kilometres is core area of the Tiger Reserve and 820.035 square kilometres is the buffer area; AND WHEREAS, 373 species of flowering plants, 35 species of mammals, 238 species of birds and 111 species of butterflies have been recorded from the Tiger Reserve; AND WHEREAS, the tiger reserve and the adjoining area is home to wildlife comprising rare endangered and threatened species of Sambar (Cervus unicolor nigra), sloth Bear (Metursus ursinus), Leoprad (Panthera pardus), Fourhorned antelope (Tetracerus quadricornis), Striped Hyaena (Hyaena hyaena), Indian Wild Dog (Cuon alpines), Indian Pangolin (Manis crassicaudata), Tiger (Panthera tigris), Indian bison (Bos gaurus); AND WHEREAS, the Tiger Reserve and the adjoining area is having rare endangered and threatened species of flora including Beeja/Beejasal (Pterocarpus marsupium), Bhirra/Bhirha (Chloroxylon swietenio). AND WHEREAS, the Tiger Reserve and the adjoining area comprises rare endangered and threatened species of birds including Asian woolyneck (ciconia), Lesser Adjutant Stork (Leptoptilos javanicus), Common Pochard (Aythya farina), Sarus Crane (Grus Antigone), Black-headed Ibis (Threskiornis melanocephalus), Grey-headed Ibis (Threskiornis melanocephalus), Great Stone Plover(Beach Thick-Knee) (Esacus magnirostris), River Tern (Sterna aurantia), Alexandrine Parakeet (Psittacula eupatria), Pied Cucko (Clamator jacobinus), Malabar pied hornbill (Anthracoceros coronatus), Red-headed (king) Vulture (Sarcogyps calvus), Indian (long-billed) Vulture (Gyps indicus), White-rumped Vulture (Gyps bengalensis); ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the Bandhavgarh National Park and Panpatha Wildlife Sanctuary, which together constitute the core area of the Tiger Reserve, as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area up to an extent of two kilometers from the boundary of Bandhavgarh National Park and Panpatha Wildlife Sanctuary as Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of 1030.382 square kilometre with an extent of up to two kilometers from the boundary of Bandhavgarh National Park and Panpatha Wildlife Sanctuary and the co-ordinates of core area and the boundary description of the Eco-sensitive Zone is appended as Annexure-I.
(2) The Eco-sensitive Zone is spread over an area of 1030.382 square kilometres which includes 132 villages in three Districts viz. Umaria, Katni and Shahdol of the Madhya Pradesh State.
(3) The map of the Eco-sensitive Zone along with latitude and longitude is appended as Annexure II.
(4) The list of the villages falling within the Eco-sensitive Zone along with co-ordinates of prominent points is appended as Annexure III.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Eco-tourism;
(v) Municipal ;
(vi) Revenue ;
(vii) Agriculture ;
(viii) State Pollution Control Board;
(ix) Irrigation;
(x) Public Works Department; for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone as to ensure eco-friendly development for livelihood security of local communities.
(9) As the buffer zone of the Tiger Reserve is part of the Eco-sensitive Zone, the Tiger Conservation plan relating to the buffer zone shall also be taken into consideration during preparation of the Zonal Master Plan. 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 9,16,22,33 and 36 in column (2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities;
(ii) widening and strengthening of existing roads and construction of new roads;
(iii) small scale industries not causing pollution;
(iv) rainwater harvesting; and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) The activity relating to eco-tourism within the Eco-sensitive Zone shall be as per tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Madhya Pradesh in consultation with Department of Revenue and Forests, Government of Madhya Pradesh.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometre from the boundary of the Tiger Reserve except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Ecosensitive Zone, the extension of existing establishments may be allowed in accordance with the Zonal Master Plan:
Provided further that beyond one kilometer upto the extent of the Eco-sensitive Zone construction of new hotels and resorts may be permitted as per Zonal Master Plan.
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:- TABLE S. (a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with reference to in the Eco-sensitive except for the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal use.
(b) The mining operations shall strictly be in accordance with the interim order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon’ble Supreme Court dated the 21st April, 2014 in the matter of 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
5. Establishment of new major hydroelectric projects and irrigation projects. Prohibited (except as otherwise provided) as per applicable laws.
6. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
7. Discharge of untreated effluents and solid waste in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
8. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone:
Provided that the existing wood-based industry may continue as per law:
Provided further that the renewal of licenses of existing saw mills shall not be done on their expiry period. Regulated activities
9. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities. However, beyond one kilometer and upto the extent of the Eco-sensitive Zone all new tourism activities or expansions of existing activities would in conformity and Tourism Master Plan and National Tiger Conservation Authority guidelines.
10. Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons. Prohibited (except as otherwise provided) as per applicable laws.
11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer.
Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any.
(b) Beyond one kilometer upto the extent of Eco- Sensitive Zone, construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per the Zonal Master Plan.
12. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
(c) In case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed.
13. Commercial water resources including ground water harvesting.
(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) Extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
14. Erection of electrical cables and telecommunication towers.
(i) Erection of New electric poles and cables to be permitted only for villages/areas where there is no electricity.
(ii) Augmentation/renovation of Existing electric lines is permitted.
(iii) Promote underground cabling.
15. Fencing of existing premises of hotels and lodges.
(i) Regulated under applicable laws.
(ii) Shall be done in a manner to allow free movement of wildlife.
(iii) Existing fencing of establishments not compliant with the above condition shall be removed or modified to meet the requirement within six months from the date of final notification.
16. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
17. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws.
18. Introduction of exotic species. Regulated under applicable laws.
19. Protection of hill slopes and river banks. Regulated under applicable laws.
20. Discharge of treated effluents in natural water bodies or land area. Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
21. Commercial sign boards and hoardings. Regulated under applicable laws.
22. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
23. Collection of Forest produce or Non- Timber Forest Produce. Regulated under applicable laws.
24. Air and vehicular pollution. Regulated under applicable laws.
25. Drastic change of agriculture systems. Regulated under applicable laws.
26. Trenching Ground. No new trenching shall be established. However, existing trenching ground will be operated subject to the condition that no open burning will be allowed.
27. Dairy activities and Cattle rearing. Regulated as per applicable laws.

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) Divisional Commissioner, Shahdol Chairman;
(ii) Divisional Commissioner, Jabalpur Member;
(iii) District Collector, Umaria Member;
(iv) District Collector, Shahdol Member;
(v) District Collector, Katni Member;
(vi) Superintending Engineer PWD, Shahdol Member;
(vii) Superintending Engineer Public Health Department, Shahdol Member;
(viii) CEO of District Panchayat, Umaria Member;
(ix) CEO of District Panchayat, Shahdol Member;
(x) CEO of District Panchayat, Katni Member;
(xi) Representative of the Town & Country Planning Department Member;
(xii) Representative of the Madhya Pradesh Pollution Member; Control Board
(xiii) One representative of Non-Governmental Organisation working in the field of environment to be nominated by the Government of Madhya Pradesh for a term of three years in each case - Member;
(xiv) One expert in the area of ecology and environment from a reputed institution of University in the State to be nominated by the Government of Madhya Pradesh for a term of three years in each case - Member;
(xv) Member State Biodiversity Board - Member
(xvi) Field Director, Bandhavgarh Tiger Reserve, Umaria Member- Secretary.
2. Terms of Reference.- (i) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(ii) The tenure of the Committee shall be three years.
29. Goat Farming. Regulated as per applicable laws.
30. Solid Waste Management. Regulated as per applicable laws.
31. Eco-tourism activities. Regulated as per applicable laws. Promoted activity
32. Ongoing agriculture and horticulture practices by local communities. Permitted under applicable laws.
33. Rain water harvesting. Shall be actively promoted.
34. Organic farming. Shall be actively promoted.
35. Adoption of green technology for all activities. Shall be actively promoted.
36. Cottage industries including village artisans, etc. Shall be actively promoted.
37. Use of renewable energy sources. Bio gas, solar light, etc. to be promoted.
38. Environmental Awareness. Shall be actively promoted.
39. Skill Development. Shall be actively promoted.
40. Agro-forestry. Shall be actively promoted.

(iii) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(iv) The activities that are not covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(v) The Member-Secretary of the Monitoring Committee or the concerned District Collector or the concerned Park in-charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(vi) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(vii) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the State Government as per proforma given in Annexure IV.
(viii) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
