PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 3046] ubZ fnYyh] 'kqØokj] fnlEcj 23] 2016@ikS"k 2] 1938 No. 3046] NEW DELHI, FRIDAY, DECEMBER 23, 2016/PAUSA 2, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ ली, 23 ᳰदस᭥ बर, 2016 का.आ. 4162(अ).—कᱶ ᮤीय सरकार ने भारत सरकार के पयाᭅवरण और वन मंᮢ ालय कᳱ अिधसूचना सं. का.आ. 19(अ), तारीख 6 जनवरी, 2016 (िजसे इसमᱶ इसके प᭫ चात् उ त अिधसूचना कहा गया ह)ै ᳇ारा तटीय ᭃेᮢᲂ को तटीय िविनयमन खंड के ᱨप मᱶ घोिषत ᳰकया था और उ त खंड मᱶ उ᳒ोगᲂ कᳱ ᭭ थापना करन ेतथा उनके िव᭭ तार, सᳰंᮓयाᲐ तथा ᮧसं᭭ करणᲂ पर िनबᲈधन अिधरोिपत ᳰकए थे ; और महारा᭬ ᮝ सरकार ने महारा᭬ ᮝ तटीय ᭃेᮢ ᮧबंध ᮧािधकरण से अनुरोध ᳰकया ह ैᳰक वह उ त अिधसचूना, 2011 मᱶ िवशेष उपबंध समािव᭬ ट करे, िजससे ᳰक म᭥ु बई मᱶ इ᭠ द ू6 िम᭨ स भूिम पर ‘डा. बाबा साहबे अ᭥ बेडकर ᭭ मारक’ का िवकास ᳰकया जा सके ; और इस मु ेकᳱ महारा᭬ ᮝ तटीय ᭃेᮢ ᮧबंध ᮧािधकरण ᳇ारा उसकᳱ 23 अᮧलै, 2011 को ᱟई बैठक मᱶ पहले समीᭃा कᳱ गई थी और उ त अिधसूचना, 2011 मᱶ संशोधन करने कᳱ िसफाᳯरश कᳱ थी ; और रा᭬ ᮝीय तटीय ᭃेᮢ ᮧबंध ᮧािधकरण ने 16 जुलाई, 2012 को ᱟई अपनी बैठक मᱶ इस िवषय कᳱ समीᭃा कᳱ और उ त ᮧािधकरण न े िवचार-िवमशᭅ करन ेके प᭫ चात् उ त अिधसूचना, 2011 मᱶ संशोधन कᳱ िसफाᳯरश करने का िविन᭫ चय ᳰकया ; और कᱶ ᮤीय सरकार कᳱ यह राय ह ैᳰक उ त अिधसूचना का संशोधन ᳰकया जाना चािहए ; और पयाᭅवरण (सरंᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (4) के उपबंध को ᭟ यान मᱶ रखते ᱟए, कᱶ ᮤीय सरकार कᳱ यह राय ह ैᳰक उ त अिधसचूना का सशंोधन करन ेके िलए उ त िनयम के िनयम 5 के उपिनयम (3) के खंड (क) के अधीन सूचना कᳱ अपेᭃा स ेअिभमु त करना लोकिहत मᱶ ह ै; 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अत: अब, कᱶ ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और उपिनयम (4) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1) और उपधारा (2) के खंड (v) ᳇ारा ᮧद᭜ त शि तयᲂ का ᮧयोग करत ेᱟए पूवᲃ त अिधसचूना मᱶ िन᭥ निलिखत संशोधन करती ह,ै अथाᭅत् :-- उ त तटीय िविनयमन खंड कᳱ अिधसूचना, 2011 के पैरा 8 के उपपैरा ‘‘(v) ऐसे ᭃेᮢ िजन पर िवशेष ᭟ यान दनेे कᳱ आव᭫ यकता है,-’’ मᱶ ‘‘1.ऐस ेसीआरजेड ᭃेᮢ, जो ᮕेटर मु᭥ बई के नगरपािलका के अिधकार ᭃेᮢ मᱶ आता ह’ै’ शीषᭅक के अधीन, ‘‘(iii) सीआरजेड-II ᭃेᮢᲂ मᱶ-’’ उपशीषᭅक के अधीन, मद (ज) के प᭫ चात ्िन᭥ निलिखत मद अतं:᭭ थािपत कᳱ जाएगी, अथाᭅत ्:-- ‘‘(झ) इ᭠ द ू6 िम᭨ स भिूम पर मु᭥ बई मᱶ भारत र᭜ न डा. बाबा साहबे अ᭥ बेडकर के स᭥मान मᱶ ᭭ मारक के संिनमाᭅण को लागू नगर और ᮕाम योजना िविनयम के अनुसार औ᳒ोिगक उपयोग स े᭭ मारक के सिंनमाᭅण के िलए भ ूउपयोग मᱶ पᳯरवतᭅन करने को अनु᭄ात ᳰकया जाएगा ।’’ [फा. सं. 19-11/2012-आईए-III ] अᱧण कुमार मेहता, संयु त सिचव ᳯट᭡ पण.—मूल अिधसूचना, भारत के राजपᮢ, असाधारण, भाग II , खंड 3, उपखंड (ii) मᱶ अिधसूचना सं. का.आ. 19(अ), तारीख 6 जनवरी, 2011 ᳇ारा ᮧकािशत कᳱ गई थी और त᭜ प᭫ चात् उसमᱶ िन᭥ निलिखत संशोधन ᳰकए गए :--

9. का.आ. 1212 (अ), तारीख 22 माचᭅ, 2016 । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 23rd December, 2016 S.O. 4162(E).—Whereas, by the notification of the Government of India in the Ministry of Environment and Forests vide number S.O.19(E), dated the 6th January, 2011 (hereinafter referred to as the said notification), the Central Government declared coastal stretches as Coastal Regulation Zone, and restrictions were imposed on setting up and expansion of industries, operations and processes in the said zone; And whereas, the State Government of Maharashtra has requested the Maharashtra Coastal Zone Management Authority to incorporate special provisions in the said notification, 2011 to enable development of ‘Memorial of Dr. Babasaheb Ambedkar’ on Indu 6 Mills land in Mumbai; And whereas, the issue was earlier examined by the Maharashtra Coastal Zone Management Authority in its meeting held on the 23th April, 2011 and recommended for amendment to the said notification, 2011; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 And whereas, the National Coastal Zone Management Authority examined the matter in its meeting held on 16th July, 2012 and the said Authority, after deliberation, decided to recommend the amendment to the said notification, 2011; And whereas, the Central Government is of the opinion that the said notification should be amended; And whereas, the Central Government, having regard to provision of sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, is of the opinion that it is in public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rules for amending the said notification; Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule(3) and sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendment in the aforesaid notification, namely:- In the said Coastal Regulation Zone, Notification, 2011, in paragraph 8, in sub-paragraph “V. Areas requiring special consideration,-”, under the heading “1. CRZ areas falling within municipal limits of the Greater Mumbai.”, under the sub-heading “(iii) In CRZ-II areas-”, after item (h), the following item shall be inserted, namely:- “(i) Construction of Memorial in the honour of Bharat Ratna Dr. Babasaheb Ambedkar in Mumbai on Indu 6 Mills land shall be allowed with change in land use from industrial to construction of Memorial in accordance with the applicable Town and Country Planning Regulations”.
