1778(अ), तारीख 30 जून, 2015 ᳇ारा उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उᲦ अिधसूचना से युᲦ राजपᮢ कᳱ ᮧितयां जनता को, उपल᭣ध करा दी गई थᱭ, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करते ᱟए एक ᮧाᱨप अिधसूचना ᮧकािशत कᳱ गई थी;
और, पूवᲃᲦ अिधसूचना से युᲦ राजपᮢ कᳱ ᮧितयां 30 जून, 2015 को जनता के िलए उपल᭣ध करा दी गई थᱭ;
और, उᲦ ᮧाᱨप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुᭃावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक ᱨप से िवचार ᳰकया गया;
कथलौर-कुशािलया व᭠ यजीव अभयार᭛य रावी नदी के तट पर ि᭭ थत ह ैऔर गरुदासपुर से 30 ᳰकलोमीटर तथा दीनानगर-नरोटजयमल ᳲसह रोड पर दीनानगर से 15 ᳰकलोमीटर दरू ह ै;
और, पंजाब सरकार ने अपनी अिधसूचना सं. 34/4/2007/एफटी-5/6088, तारीख 22 जून, 2007 ᳇ारा िजला गुरदासपुर मᱶ कथलौर कुशािलया के सरकार सरंिᭃत 758.40 हे टेयर ᭃेᮢ को व᭠ यजीव अभयार᭛य घोिषत ᳰकया ह ैऔर कथलौर-कुशािलया व᭠ यजीव अभयार᭛य के िनदᱷशांक उपाबंध I के ᱨप मᱶ संलᲨ ह ै। और, इस ᭃेᮢ कᳱ वन᭭ पित मु य वृᭃ ᮧजाितयां जैसे ᳰक सरक᭛ डा, काही, शीशम, ᳰककर, आंवला, तूत, आम, अजुᭅन, जामुन, कांटेदार बांस और डे᭛ᮟोकैलमस, आᳰद ह ᱹ;
और, यह ᭃेᮢ कई जीवजंतᲐु और पिᭃयᲂ के आ᮰य के तौर पर जाना जाता ह ै । मु य जीवजंतु ᮧजाितयां हॉग िडयर, मंुजक, सांभर, चीतल, नीलगाय, बनलैा सूअर, िसयार, साल और पᭃी जैसे तीतर, तोता, बाज, चील और िग ह ᱹ;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, कथलौर-कुशािलया व᭠ यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) और उपधारा (3) के खंड (v) और खंड (xiv) के साथ पᳯठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, पंजाब रा᭔ य मᱶ कथलौर-कुशािलया व᭠ यजीव अभयार᭛य कᳱ सीमा से 100 मीटर तक के िव᭭ ताᳯरत ᭃेᮢ को कथलौर-कुशािलया व᭠ यजीव अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:--
1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन 193.0 हे टेयर के ᭃेᮢ मᱶ समािव᭬ ट कथलौर-कुशािलया व᭠ यजीव अभयार᭛य कᳱ सीमा से 100 मीटर तक िव᭭ ताᳯरत होगा ।
(2) कथलौर-कुशािलया व᭠ यजीव अभयार᭛य के भौितक ᱨप से दो भाग ह,ᱹ ᮧ᭜ येक भाग के अᭃांश और देशांतर िन᭥ नानुसार ह:ᱹ कथलौर:-पाᳯरि᭭थितक संवेदी जोन पूवᭅ-उ᭜ तर (उपाबंध II मानिचᮢ के िनदᱷश िब᭠ द ु सं. बी) कᳱ ओर 32º16’19.298" उᱫर अᭃांश और 75º27’55.507" पूवᭅ देशा᭠तर ; पि᳟म (उपाबंध II मानिचᮢ के िनदᱷश िब᭠ द ुसं. जे) कᳱ ओर 32º15’48.025" उ᭜ तर अᭃांश तथा 75º25’52.182" पवूᭅ देशा᭠तर ; उᱫर (उपाबंध II मानिचᮢ के िनदᱷश िब᭠ द ु सं. ए) कᳱ ओर 32º16’32.87" उᱫर अᭃांश और 75º26’25.226" पूवᭅ देशा᭠तर और दिᭃण (उपाबंध II मानिचᮢ के िनदᱷश िब᭠ द ुसं. डी) कᳱ ओर 32º14’46.068" उᱫर अᭃांश तथा 75º26’56.5" पूवᭅ देशा᭠तर से िघरा ᱟआ ह ै। कुशािलया: - पाᳯरि᭭थितक संवेदी जोन पूवᭅ (उपाबंध II मानिचᮢ के िनदᱷश िब᭠ द ु सं. ई) कᳱ ओर 32º13’12.247" उᱫर अᭃांश और 75º25’11.468" पूवᭅ देशा᭠तर ; पि᳟म-दिᭃण (उपाबंध II मानिचᮢ के िनदᱷश िब᭠ द ु सं. एफ) कᳱ ओर 32º12’19.731" उ᭜ तर अᭃांश तथा 75º24’32.523" पूवᭅ देशा᭠तर ; उᱫर (उपाबंध II मानिचᮢ के िनदᱷश िब᭠ द ुसं. एच) कᳱ ओर 32º13’23.458" उᱫर अᭃांश और 75º24’41.964" पूवᭅ देशा᭠तर और दिᭃण पि᭫ चम (उपाबंध II मानिचᮢ के िनदᱷश िब᭠ द ुसं. जी) कᳱ ओर 32º12’30.352" उᱫर अᭃांश तथा 75º24’0.07" पूवᭅ देशा᭠तर से िघरा ᱟआ ह ै।
(3) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का मानिचᮢ अᭃांश और देशा᭠तर के साथ उपाबंध II के ᱨप मᱶ उपाब ह ै।
(4) कथलौर-कुशािलया व᭠यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन के भीतर आन ेवाले 14 ᮕामᲂ कᳱ सूची उनके अᭃांश और देशांतर सिहत ᮧमुख िब᭠दᲐु के साथ उपाबंध III के ᱨप मᱶ उपाब ह ै।
2. पाᳯरि᭭थितक संवदेी जोन के िलए आचंिलक महायोजना –(1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित मᱶ राज् य सरकार तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, इसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक िवचारᲂ को समाकिलत करन ेके िलए िन᭥ निलिखत सभी संब रा᭔ य सरकार के िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण;

(ii) वन;
(iii) नगर िवकास;
(iv) पयᭅटन;
(v) नगरपािलका;
(vi) राज᭭ व;
(vii) कृिष;
(viii) पंजाब रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ;
(ix) ᳲसचाई; और
(x) लोक िनमाᭅण िवभाग।
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ और आचंिलक महायोजना मᱶ सभी अवसंरचना और अिधक ᮧभावी और पाᳯरि᭭ थितक अनुकूल ᳰᮓयाकलाप कारक इस ᮧकार िविन᳸द᭬ ट न हो ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलुᲐ, िजन पर ᭟यान देना आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करत ेᱟए िविनयिमत करेगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान े वाल े उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन े के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुल े᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंत ुपाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं. 9, 17, 24, 33, और 38 के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत ्:-
(i) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद;
(ii) िव ᳒ मान सड़कᲂ को चौड़ा करना और सुदढ़ृ करना तथा नई सड़कᲂ का संि᳖ माणᭅ ;
(iii) ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग;
(iv) वषाᭅ जल संचय; और
(v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिव धाजनक ᭭ टोर और ᭭ थानीय सुिव धाएं भी ह,ᱹ :
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंत ु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंत ुयह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट मानीटरी सिमित के िवचार ᮧा᳙ करन े के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामल ेमᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी :
परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा :
परंत ुयह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करन ेके िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो आंचिलक महायोजना का भाग ᱨप मᱶ िन᳜िलिखत ᱨप मᱶ जाएगा । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, पंजाब सरकार ᳇ारा राज᭭ व और वन िवभाग, पंजाब सरकार के परामशᭅ से तैयार होगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂग,े अथाᭅत ्:-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथासंशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के संबंिधत पयᭅटकᲂ के अ᭭ थायी िनवास के िलए आवासन के िसवाय पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और ᳯरसोटᭅ के नए संिनमाᭅण कथलौर-कुशािलया व᭠ यजीव अभयार᭛य कᳱ सीमा के 1 ᳰकलोमीटर के भीतर अनु᭄ात नहᱭ हᲂगे ;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।
(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान कᳱ जाएगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार कᳱ जाएंगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएंगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या पंजाब रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ के अनुसार पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, 2000 के अंतगᭅत तैयार करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या पंजाब रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ — ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶग े;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट— पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. 343 (अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) ᭡लाि᭭टक अपिश᳥ ᮧबधंन: — पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(12) िनमाᭅण और िव᭟वसं अपिश᳥ ᮧबधंन: — पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.
का. िन. 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(13) यानीय यातायात— पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंग ेऔर आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(14) औ᳒ोिग क इकाइया ं— (क) पाᳯरि᭭थितक संवेदी जोन के भीतर नए का᳧ आधाᳯरत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा िविध के अनुसार ᭭थािपत िव᳒मान का᳧ आधाᳯरत उ᳒ोगᲂ के िसवाए नहᱭ दी जाएगी | 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वायु या मृदा ᮧदषूण काᳯरत करने वाले ᳰकसी नए उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा नहᱭ दी जाएगी |
4. पाᳯरि᭭थितक सवंदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सचूी - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के उपबंधᲂ ᳇ारा शािसत हᲂग ेऔर नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂग,े अथाᭅत् :-- सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) क. ᮧितिष ᳰᮓयाकलाप :
1 वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़न ेकᳱ इकाइयां । (क) सभी नए और िव᳒मान खनन (लघ ुऔर वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न ेकᳱ इकाइयां ᮧितिष हᲂगी । तथािप, वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेल ू आव᭫यकताᲐ के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए देशी टाइ᭨स या टᲂ का िनमाᭅण करना िव᳒मान िविनयमᲂ के अनुसार अनु᭄ात हᲂग े। (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामल ेमᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा । 2 आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा । 3 जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करन ेवाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाल ेका िव᭭ तार अनु᭄ात नहᱭ होगा । 4 ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । 5 जलावन लकड़ी का वािणि᭔यक उपयोग । लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । 6 नए बृहत जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापना । लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । 7 ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । 8 कंपिनयᲂ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुᲐ और पो᭨ᮝी फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को परूा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 ख. िविनयिमत ᳰᮓयाकलाप :
9 होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना। पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक इनमᱶ जो भी िनकट ह,ै नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे। पर᭠त ुव᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनᱨुप होगा । वािणि᭔यक पाᳯरि᭭थितक पयᭅटन के साथ "व᭠यजीव िनवास मᱶ गरै वािनकᳱ ᳰᮓयाकलापᲂ के िलए ᳰदशा-िनदᱷशᲂ" के अनुसार जारी एफ.
सं. 610/2011 व᭠यजीव ᳰदनांक 15-03.2011 ᳇ारा पयाᭅवरण और वन मंᮢालय (व᭠यजीव ᮧभाग), नई ᳰद᭨ली और रा᳦ीय बाघ संरᭃण ᮧािधकरण के ᳰदशा िनदᱷशᲂ (यᳰद लाग ूहो) के साथ िविनयिमत ᳰकया जाएगा । 10 संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक इनमᱶ जो भी िनकट ह,ै के भीतर ᳰकसी भी ᮧकार का नया वािणि᭔ यक संिनमाᭅण अनु᭄ात नहᱭ होगा:
परंत ु᭭ थानीय ᭪ यि तयᲂ को अपने आवासीय उपयोग, िजसके अंतगᭅत पैरा 3 के उपपैरा (1) मᱶ सूचीब ᳰᮓयाकलाप भी ह,ᱹ के िलए अपनी भूिम पर संिनमाᭅण करन ेकᳱ अनुमित होगी । (ख) पर᭠त,ु ᮧदषूण उ᭜ प᭠ न न करन ेवाल ेलघु उ᳒ोगᲂ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िनयम या िविनयम, यᳰद कोई लाग ू हᲂ, के अनुसार सᭃम ᮧािधकारी से पूवᭅ अनुमित ᮧा᭡ त करने के प᭫ चात ् अनु᭄ात हᲂग े। (ग) पर᭠तु, जहाँ पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा एक ᳰकलोमीटर से ᭔यादा ह ैतो वहाँ, एक ᳰकलोमीटर के प᭫ चात ्और पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक ᭭ थानीय ᭪ यि तयᲂ कᳱ सावी आव᭫ यकता के िलए संिनमाᭅण ᳰᮓयाकलाप तथा संिनमाᭅण और नागᳯरक सुिवधाᲐ कᳱ वृि आचंिलक महायोजना के अनुᱨप हᲂगे । 11 ᭟विन ᮧदषूण । पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या पंजाब रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ के अनुसार पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, 2000 अंतगᭅत तैयार करेगा । 12 वृᭃᲂ कᳱ कटाई। (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳰक᭠ही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी । 13 कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 14 वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू-जल संचयन भी ह ै। (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेल ूखपत के िलए जल का िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा । (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह ै। (ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा । (घ) जल के संदषूण या ᮧदषूण, िजसके अंतगᭅत कृिष भी ह,ै को रोकन े के िलए सभी उपाय ᳰकए जाएंग े। 15 िव᳒ुत और दरूसंचार टावरᲂ और िबछाई गई केबलᲂ और अ᭠य बुिनयादी ढाँचᲂ का पᳯरिनमाᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । भूिमगत केबलᲂ को ᮧो᭜ साहन देना । 16 नागᳯरक सुिवधाᲐ सिहत बुिनयादी ढांचे । लाग ूिविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे। 17 िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण । लाग ूिविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे। 18 रािᮢ मᱶ यािनक यातायात का संचलन । लाग ू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे । 19 िवदेशी ᮧजाितयᲂ को लाना । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। 20 पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। 21 वािणि᭔ यक साइनबोडᭅ और होᳺडग । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। 22 वायु और यािनक ᮧदषूण । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। 23 ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अबमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा । 24 ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन से गरै ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत देशीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालत ेह,ᱹ अनु᭄ात ᳰकए जाएंग े। 25 वन उ᭜पादᲂ और गैर का᳧ वन उ᭜पादᲂ का संᮕहण । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। 26 सुरᭃा बलᲂ के कᱹप । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। 27 नए का᭬ ठ आधाᳯरत उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन कᳱ सीमाᲐ के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰकया जाएगा :
परंतु िव᳒मान का᭬ ठ आधाᳯरत उ᳒ोग तब तक जारी रह सकᱶ गे जब तक ᳰक उ᭠ हᱶ त᭜ समय ᮧवृ᭜ त ᳰकसी िविध के अधीन ᮧितिष न ᳰकया जाए । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 28 पाᳯरि᭭ थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के िलए, पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल कुटीर, जैसे तंबू, लकड़ी के घर आᳰद । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। 29 ᭡ लाि᭭ टक के थलैᲂ का उपयोग । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। 30 खुले कुआ, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ सती से मानीटरी कᳱ जाएगी। 31 ठोस अपिश᭬ ट ᮧबंधन । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। ग. सवंᳶधत ᳰᮓयाकलाप :
32 ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । लाग ूिविधयᲂ के अधीन अनु᭄ात हᲂग े। 33 वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । 34 जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । 35 सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । 36 नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । लाग ूिविधयᲂ के अधीन अनु᭄ात हᲂग े। 37 वान᭭ पितक बाड । लाग ूिविधयᲂ के अधीन अनु᭄ात हᲂग े। 38 कुटीर उ᳒ोग िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह।ᱹ सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । 39 पयाᭅवरणीय जागᱨकता । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । 40 कौशल िवकास । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । 41 सामुदाियक ᮧकृित भंडार। सᳰᮓय ᱨप से पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय और रा᳦ीय बाघ संरᭃण ᮧािधकरण के ᳰदशा िनदᱷशᲂ को बढ़ावा ᳰदया जाएगा ।
5. पाᳯरि᭭थितक संवदेी जोन मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन कᳱ ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत ्:-
(i) मु य वन संरᭃक (व᭠ यजीव), पंजाब सरकार - अ᭟यᭃ ;
(ii) ᮕामीण िवकास और पंचायत िवभाग का ᮧितिनिध, पंजाब सरकार – सद᭭ य ;
(iii) ᮧादेिशक कायाᭅलय, पंजाब रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ – सद᭭ य ;
(iv) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करन ेवाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै का तीन वषᭅ कᳱ अविध के िलए पंजाब रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध - सद᭭य;
(v) पंजाब सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए एक िवशेष᭄ – सद᭭ य;

(vi) ᮕामीण िवकास और आवास िवभाग, पंजाब सरकार का ᮧितिनिध - सद᭭य;
(vii) पंजाब रा᭔य जैव-िविवधता बोडᭅ का सद᭭य - सद᭭य;
(viii) कृिष िवभाग, पंजाब सरकार का ᮧितिनिध - सद᭭य;
(ix) िजला कले टर, गरुदासपुर का ᮧितिनिध - सद᭭य;
(x) ᮧभागीय वन अिधकारी (लोकᮧािधकारी का ᮧभारी) – सद᭭य-सिचव ।
6. िनदᱷश िनबधंन
(1) सिमित का कायᭅकाल अिधसूचना जारी होन ेकᳱ तारीख से तीन वषᭅ कᳱ अविध के िलए ᳰकया जाएगा।
(2) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।

(4) इस अिधसूचना के पैरा 4 के अधीन यथािविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंत ुपाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(5) मानीटरी सिमित का सद᭭य-सिचव या संब कलटर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱧ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा ।
(6) मानीटरी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहत ेᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠यजीव वाडᭅन को उपाबधं IV मᱶ उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭ततु करेगी ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । [फा. सं. 25/35/2014-ईएसजेड/आरई] डॉ. टी. चांदनी, वै᭄ािनक ‘जी’ MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 27th December, 2016 S.O. 4204(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section(ii), vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 1778 (E), dated the 30th June, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the aforesaid notification were made available to the public on the 30th June, 2015.
AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
AND WHEREAS, the Kathlaur-Kushalia Wildlife Sanctuary falls on the river bed of Ravi River and located about 30 kilometres from Gurdaspur and 15 kilometres from Dinanagar on Dinanagar-Narot Jaimal Singh Road;
AND WHEREAS, the Government of Punjab, vide its notification No.34/4/2007/Ft-5/6088, dated the 22nd June, 2007 declared 758.40 hectares area of Government Protected Forests of Kathlaur-Kushalia as Wildlife Sanctuary in the district Gurdaspur and the co-ordinates of Kathlaur-Kushalia Wildlife Sanctuary is appended as Annexure-I.
AND WHEREAS, the vegetation of this area comprises of main tree species like Sarkanda, Kahi, Shisham, Kikkar, Amla, Toot, Mango, Arjun, Jamun, Bambusabambos and Dendrocalamus etc.;
AND WHEREAS, the area is known to support a variety of animals and birds and the main faunal species are Hog Deer, Barking Deer, Sambar, Chital, Nilgai, Wild Boar, Python, Pangolin and birds like Partridges, Parrots, Hawk eagle and vultures;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of the Kathlaur-Kushalia Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1), clause (v) and clause
(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area upto 100 metres all around the boundary of the Kathlaur - Kushalia Wildlife Sanctuary in the State of Punjab as the Kathlaur-Kushalia Wildlife Sanctuary Eco-sensitive Zone(hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:— 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
1. Extent and boundaries of Eco-sensitive Zone.-(1)The extent of Eco-sensitive Zone is an area of 100 metres all around the boundary of the Kathlaur-Kushalia Wildlife Sanctuary comprising an area of
193.0 hectares approximately.
(2) The Kathlaur – Kushalia Wildlife Sanctuary has physically two parts, the latitude and longitude for each part is as:
Kathlaur.- The Eco-sensitive Zone is bounded by 32º16’19.298"N latitude and 75º27’55.507"E longitude towards East-North (Reference point No. B of Annexure II map); 32º15’48.025"N latitude and 75º25’52.182"E longitude towards west (Reference point No. J of Annexure II map); 32º16’32.87"N latitude and 75º26’25.226"E longitude towards north (Reference point No. A of Annexure II map) and 32º14’46.068"N latitude and 75º26’56.5"E longitude towards south (Reference point No. D of Annexure II map).
Kushalia.- The Eco-sensitive Zone is bounded by 32º13’12.247"N latitude and 75º25’11.468"E longitude towards East (Reference point No. E of Annexure II map); 32º12’19.731"N latitude and 75º24’32.523"E longitude towards west-south (Reference point No. F of Annexure II map); 32º13’23.458"N latitude and 75º24’41.964"E longitude towards north (Reference point No. H of Annexure II map) and 32º12’30.352"N latitude and 75º24’0.07"E longitude towards south-west (Reference point No. G of Annexure II map).
(3) The map of Eco-sensitive Zone boundary together with its latitudes and longitudes is appended as Annexure II .
(4) The list of 14 villages falling within the Kathlaur-Kushalia Wildlife Sanctuary Eco-sensitive Zone along with their longitudes and latitudes at prominent points is appended as Annexure III.
2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The State Government shall prepare the Zonal Master Plan for the Eco-sensitive Zone in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The State Government shall prepare the Zonal Master Plan in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Punjab State Pollution Control Board;
(ix) Irrigation; and
(x) Public Work Department, for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green areas, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Ecofriendly development and livelihood security of local communities.
3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use. - Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 9, 17, 24, 33, and 38 in column (2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities,
(ii) Widening and strengthening of existing roads and construction of new roads,
(iii) Small scale industries not causing pollution,
(iv) Rainwater harvesting, and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas as per buffer zone management plan of the Melghat Tiger Reserve.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.
(3) Eco-tourism.-(a) The activity relating to tourism within the Eco-sensitive Zone shall be in accordance with the Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-tourism Master Plan shall be prepared by the Department of Tourism, Government of Punjab in consultation with Department of Revenue and Forests, Government of Punjab.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change with emphasis on eco-tourism, eco-education and eco- 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Kathlaur-Kushlia Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities:
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc.
shall be identified, preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification in the Official Gazette and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification in the Official Gazette and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Punjab State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government or Punjab State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder. If required, standards may be made more stringent for protection of environment.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein.
(9) Disposal of Solid wastes. - (i) the solid waste in Eco-sensitive Zone shall be disposed of in accordance with the provisions of the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016, as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into bio-degradable and nonbio-degradable components;
(iii) the bio-degradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Ecosensitive Zone.
(10) Disposal of bio-medical waste.- The bio-medical waste in the Eco-sensitive Zone shall be disposed of in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Plastic Waste Management:- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management:- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 Environment, Forest and Climate Change vide notification number G.S.R 317 (E), dated the 29th March, 2016, as amended from time to time.
(13) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Act and the rules and regulations made thereunder.
(14) Industrial Units- (a) No establishment of new wood based Industries within the proposed Ecosensitive zone shall be permitted except the existing wood based Industries set up as per the Law.
(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-sensitive zone shall be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.-All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- TABLE Sl. (b) The mining operations shall strictly be in accordance with the orders of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and order of the Hon’ble Supreme Court dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of
2012.
2. Setting up of saw mills. No new and expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of existing polluting industries shall be permitted within the Ecosensitive Zone.
4. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per law.
5. Commercial use of firewood. Prohibited (except as otherwise provided) as per law.
6. Establishment of new major hydroelectric projects.
Prohibited (except as otherwise provided) as per law.
7. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per law.

8. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
B. Regulated Activities:
9. Establishment of hotels and resorts No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometre or up to the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Eco- Tourism Master Plan.
Commercial eco-tourism establishments is to be regulated strictly in accordance with ''The guidelines for taking non forestry activities in Wild life habitats" issued vide F.No.610/2011 WL dated 15-03.2011 by the Ministry of Environment and Forest (WL Division), New Delhi and National Tiger Conservation Authority guidelines (if applicable).
10. Construction activities
(a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer.
Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
(b) Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any.
(c) Beyond one kilometre upto the extent of Eco- Sensitive Zone, construction for bone fide local needs shall be allowed and other construction activities and construction and augmentation of civic amenities shall be regulated as per the Zonal Master Plan.
11. Noise pollution The Environment Department of the State Government or State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

12. Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.
13. Drastic change of agriculture system. Regulated under applicable laws.
14. Commercial water resources including ground water harvesting.
(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
15. Erection of electrical and communication towers and laying of cables and other infrastructures Regulated under applicable law. Underground cabling may be promoted.
16. Infrastructure including civic amenities Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
17. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws.
19. Introduction of exotic species. Regulated under applicable laws.
20. Protection of hill slopes and river banks. Regulated under applicable laws.
21. Commercial sign boards and hoardings. Regulated under applicable laws.
22. Air and vehicular pollution. Regulated under applicable laws.
23. Discharge of treated effluents in natural water bodies or land area.
Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
24. Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Ecosensitive Zone which do not cause any adverse impact on environment shall be permitted.

25. Collection of Forest produce or Non- Timber Forest Produce.

26. Security Forces Camp. Regulated under applicable laws.
27. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Ecosensitive Zone:
Provided that new wood based industry may be set up in the Eco-sensitive using only imported wood stock.
28. Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses and other cottages for eco-friendly tourism activities.

29. Use of plastic bags Regulated under applicable laws.
30. Open Well, Bore Well etc. for agriculture or other usage Regulated and the activity should be strictly monitored by the appropriate authority.
31. Solid Waste Management. Regulated under applicable laws C. Promoted Activities:
32. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming and fisheries.
Permitted under applicable laws.
33. Rain water harvesting. Shall be actively promoted.
34. Organic farming. Shall be actively promoted.
35. Adoption of green technology for all activities.
Shall be actively promoted.
36. Use of renewable energy sources. Permitted under applicable laws.
37. Vegetative fencing. Permitted under applicable laws.
38. Cottage industries including village artisans.
Shall be actively promoted.
39. Environmental Awareness Shall be actively promoted.
40. Skill Development Shall be actively promoted.
41. Community Nature Reserves. Shall be actively promoted in conformity with MOEF&CC and National Tiger Conservation Authority Guidelines.
5. Monitoring Committee and terms of Reference.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-
(i) The Chief Conservator of Forests (Wildlife), Government of Punjab – Chairman;
(ii) Representative Department of Rural Development and Panchayat, Government of Punjab- Member;
(iii) Regional Office, Punjab State Pollution Control Board -Member;
(iv) One representative of Non-Governmental Organisations’ working in the field of environment to be nominated by the Government of Punjab for a period of three years in each case – Member;

(v) One expert in the area of the ecology to be nominated by the Government of Punjab for a term of three years in each case - Member;
(vi) Representative Department of Rural Development and Housing Department, Government of Punjab – Member;
(vii) Member of the Punjab State Biodiversity Board –Member;
(viii) Representative of Agricultural, Government of Punjab –Member;
(ix) Representative of District Collector of Gurdaspur - Member;
(x) Divisional Forest Officer (In-charge of Protected Area) – Member-Secretary.
6. Terms of Reference:
(1) The tenure of the Committee shall be for a period of three years from the date of issue of the notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India, Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Chief Conservator of Forests (Wildlife) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wild Life Warden of the State per proforma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
