PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 3078] ubZ fnYyh] cq/okj] fnlEcj 28] 2016@ikS"k 7] 1938 No. 3078] NEW DELHI, WEDNESDAY, DECEMBER 28, 2016/PAUSA 7, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय अिधसचूना नई ᳰद᭨ली, 27 ᳰदस᭥बर, 2016 का.आ. 4205(अ).—भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. 1777(अ) तारीख 30 जून, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसूचना अंतᳶव᳥ है, उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत करते ᱟए एक ᮧा:प अिधसूचना ᮧकािशत कᳱ गई थी;
और, उᲦ ᮧाᱧप अिधसूचना कᳱ ᮧितयां 30 जून, 2015 को जनता को उपल᭣ध करा दी गई थी;
और, उᲦ ᮧाᱧप अिधसूचना के ᮧ᭜युᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ पर कᱶ ᮤीय सरकार ᳇ारा स᭥यक् :i से िवचार ᳰकया गया;
महारा᭬ ᮝ सरकार ने अपनी राजपᮢ अिधसचूना मᱶ सं. ड᭣ लू एल पी – 10.07/सी.आर. 297 /एफ-1, तारीख 27 ᳰदसंबर, 2007 ᳇ारा महारा᭬ ᮝ रा᭔ य मᱶ िन᭥ निलिखत रा᭬ ᮝीय उ᳒ानᲂ और अभयार᭛यᲂ से िमलकर बनने वाले मेलघाट बाघ आरिᭃती को व᭠ यजीव (संरᭃण) अिधिनयम, 1972 कᳱ धारा 38 (फ) के उपबंधᲂ के अधीन मह᭜ वपूणᭅ पयाᭅवास को 1500.49 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ घोिषत ᳰकया ह ैअथाᭅत्:-
(i) गूगामल रा᭬ ᮝीय उ᳒ान (36128.06 हेटयेर), िजला अमरावती,
(ii) वन व᭠ यजीव अभयार᭛य (21100.70 हेटेयर), िजला अमरावती,
(iii) मेलघाट व᭠ यजीव अभयार᭛य (78875.24 हेटेयर), िजला अमरावती,
(iv) नरनाला व᭠ यजीव अभयार᭛य (1235.07 हेटेयर), िजला अकोला, और
(v) अंबाववाᭅ व᭠ यजीव अभयार᭛य (12711.42 हेटयेर), िजला बुलधाना ;
और, महारा᭬ ᮝ सरकार ने अपनी राजपᮢ अिधसचूना मᱶ सं. ड᭣ लू एल पी – 10-10/सीपी 139 /एफ-1, तारीख 29 िसतंबर, 2010 ᳇ारा व᭠ यजीव (संरᭃण) अिधिनयम, 1972 कᳱ धारा 38 (वी) के अधीन 1268.03 वगᭅ ᳰकलोमीटर (920.65 वगᭅ ᳰकलोमीटर वन ᭃेᮢ और 347.38 वगᭅ ᳰकलोमीटर गैर वन ᭃेᮢ) को मेलघाट बाघ आरिᭃती को म᭟यवतᱮ ᭃेᮢ के ᱧप मᱶ घोिषत ᳰकया है;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, इस ᭃेᮢ मᱶ ᮧािणयᲂ और वन᭭ पितयᲂ कᳱ िविवधता ह ैतथा इसमᱶ 42 बाघᲂ (पᱹथरा ᳯटगᳯरस), तᱶदआु (पᱹथरा पारडस), जंगली भᱹसा (बॉस गौरस), रीछ (मैलुरसस युरिसनस), वन आउलैट (हेटरोलोस िबिलिवटी) जैसे बड़ी सं या मᱶ व᭠ य ᮧाणी पाये जाते ह ᱹतथा बाघ आरिᭃती के वनᲂ मᱶ िविवधता और समृता है तथा उ᭠ हᱶ चᱹिपयन और सेठ के वगᱮकरण के अनुसार समूह 5 – उप समूह – 5क – दिᭃणी उ᭬ ण कᳯटबंधीय शु᭬ क पणᭅपाती वन के ᱧप मᱶ वगᱮकृत ᳰकया गया है ;
और, यह बाघ आरिᭃती जैसे तापी, गडगा, िसपना और वन मह᭜वपूणᭅ नᳰदयᲂ का जल ᮕहण ᭃेᮢ ह ैऔर इसमᱶ आᳰदवािसयᲂ कᳱ बᱟत आबादी आᳰदवासी ᮕामᲂ मᱶ रहती है;
और, मेलघाट बाघ आरिᭃती के म᭟यवतᱮ ᭃेᮢ को उसके व᭠ य ᮧािणयᲂ या उसके पयाᭅवरण को समृ और िवकिसत करने कᳱ दिृ᭬ ट से पाᳯरि᭭ थितक और पयाᭅवरणीय दिृ᭬ ट से संरिᭃत करने के िलए परीिᭃत करने कᳱ अपेᭃा है;
और, पूवᲃ त वᳶणत रा᭬ ᮝीय उ᳒ानᲂ और अभयार᭛यᲂ जो मेलघाट बाघ आरिᭃती का गठन करते ह,ᱹ ᳰक मानव पयाᭅवास और चालू िवकास ᳰᮓयाकलापᲂ से अित िनकटता उिचत सुरᭃोपायᲂ और ऐसे ᳰᮓयाकलापᲂ पर समुिचत िनयंᮢण कᳱ अपेᭃाᲐ को आव᭫ यक बनाती ह;ै और, अब इस अभयार᭛य के चारᲂ ओर के ᭃेᮢ का पᳯर रᭃण और संरᭃण करना आव᭫ यक ह ै तथा िज सकᳱ सीमाᲐ को इस अिध सूचना के पैरा 1 मᱶ मेलघाट बाघ आरिᭃती के चारᲂ ओर पाᳯर ि᭭ थ तक संवेदी जोन के ᱧप मᱶ िव िन ᳸द ᭬ ट ᳰक या गया ह ैऔर पयाᭅवरण कᳱ दिृ᭬ ट से उ᳒ोगᲂ या उ᳒ोगᲂ के वगᭅ को तथा उनकᳱ संᳰᮓ याᲐ और ᮧᳰᮓ याᲐ को उ त पाᳯर ि᭭ थ तक संवेदी जोन मᱶ ᮧितिष करना आव᭫ यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) के साथ पᳯठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, महारा᭬ ᮝ रा᭔ य मᱶ मेलघाट बाघ आरिᭃती कᳱ सीमा से 10 ᳰक लोमीटर तक के िव᭭ ताᳯरत ᭃेᮢ को गूगामल रा᭬ ᮝीय उ᳒ान, मेलघाट अभयार᭛य, वन अभयार᭛य, अंबाववाᭅ अभयार᭛य और नरनाला अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानसुार ह,ै अथाᭅत् :-
1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाए.ं—(1) पाᳯरि᭭थितक संवेदी जोन 126803.67 हे टेयर के ᭃेᮢ मᱶ
2.2 ᳰकलोमीटर से 14.85 ᳰकलोमीटर तक के साथ मेलाघाट बाघ आरिᭃती कᳱ सीमा मᱶ फैला ᱟआ ह ै। यह िव᭭तार महारा᳦ रा᭔य के िलए लागू ᳰकया गया ह ै । म᭟य ᮧदशे रा᭔य कᳱ िनकटवतᱮ सीमा कᳱ दिᭃण-पि᳟म ᳰदशा कᳱ ओर शू᭠य मᱶ उ᭨लेख ᳰकया ह ै िजसमᱶ ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के अलग-अलग संबंिधत रा᭔य के साथ िवचार मᱶ रखा जाएगा। पाᳯरि᭭थितक संवेदी जोन तालुकᲂ मᱶ आवᳯरत ᮕामᲂ अथाᭅत्, धारणी, िचकलधारा, िचकाली, मोटाला, खमगांव, अकोट, बुलधाना, और अमरावती, अकोला और बुलधाना िजलᲂ मᱶ संᮕामपुर ह ै।
(2) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का िव वरण उपाबंध I मᱶ ᳰद या गया है ।
(3) िनदᱷशांकᲂ के मुय िब᭠दᲐु के साथ पाᳯरि᭭थितक संवेदी जोन के भीतर आने वाले ᮕामᲂ कᳱ सूची उपाबंध-II के ᱧप मᱶ उपाब ह ै।
(4) पाᳯरि᭭थितक संवेदी जोन का मानिच ᮢ इस अिधसूचना के उपाबधं III पर उपाब ह।ै
(5) पाᳯरि᭭ थितक संवेदी जोन मᱶ वन और गैर वन ᭃेᮢ दोनᲂ नीचे ᳰदए गए िववरणᲂ के अनुसार सि᭥ मिलत हᱹ :

2. पाᳯरि᭭थितक संवदेी जोन के िलए आचंिलक महायोजना –
(1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजनᲂ के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, और इस इस अिधसूचना मᱶ यथा िव िन ᳸द ᭬ ट रीित के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आंचिलक महायोजना अिधसूचना मᱶ िविन᳸द᳥ शतᭅ के अनुᱨप तैयार होगा और पयाᭅवरणीय िनिहताथᭅ सि᭥मिलत ह।ै ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आंचिलक महायोजना को रा᭔ य सरकार ᳇ारा इस अिधसूचना मᱶ िविन᳸द᭬ ट रीित मᱶ और सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िसांतᲂ, यᳰद कोई हो के अनुसार भी तैयार ᳰकया जाएगा ।
(4) मेलघाट वन आरिᭃती का म᭟यवतᱮ ᭃेᮢ पाᳯरि᭭ थितक संवेदी जोन का एक भाग ह,ै म᭟यवतᱮ ᭃेᮢ से संबंिधत बाघ आरिᭃती पᳯरयोजना पर भी आंचिलक महायोजना तैयार करने के दौरान िवचार ᳰकया जाएगा ।
(5) आचंिलक महायोजना संबंिध त रा᭔ य िव भागᲂ के साथ परामशᭅ से पयाᭅवरणीय और पाᳯर ि᭭ थ ित क िव चारणᲂ को उसमᱶ एकᳱकृत करने के िल ए तैयार कᳱ जाएगी, अथाᭅत्:--
(i) पयाᭅवरण;
(ii) वन और व᭠यजीव;
(iii) कृिष ;
(iv) राज᭭ व;
(v) नगर िवकास;
(vi) पयᭅटन;
(vii) ᮕामीण िवकास;
(viii) ᳲसचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका;
(x) पंचायती राज; और
(xi) लोक िन माᭅण िव भाग।
(6) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हᲂ और आचंिलक महायोजना मᱶ सभी अवसंरचना ᳰᮓयाकलापᲂ मᱶ दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(7) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जलाशयᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभर ᮧबंधन, भूजल ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(8) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भिूम, हᳯरत ᭃेᮢ जैसे पाकᲃ और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलो᳒ानᲂ, झीलᲂ और अ᭠य जलाशयᲂ का सीमांकन करेगी; आंचिलक महायोजना के मानिचᮢ ᳇ारा िव᳒मान और ᮧ᭭तािवत भूिम के उपयोग का िववरण ᳰकया जाएगा ।
(9) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।
(10) आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के संबंध मᱶ अपने कायᲄ के बाहर ले जाने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय.—रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, िनगरानी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद 9, 15, 21, 29 और 32 के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद;
(ii) िव ᳒ मान सड़कᲂ को चौड़ा करना और सुदढ़ृ करना तथा नई सड़कᲂ का संि᭠ ᭧न माणᭅ;

(iii) ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग;
(iv) वषाᭅ जल संचय; और
(v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण कारीगर आᳰद सि᭥मिलत ह ै:
परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिव धान के अनु᭒ छेद 244 तथा त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट िनगरानी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ केवल एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ मेलघाट बाघ आरिᭃती कᳱ बफर जोन ᮧब᭠धन योजना के अनुसार पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत.—आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) अनकूुल पयᭅटन.—(क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, पयᭅटन महायोजना जो आंचिलक महायोजना का भाग ᱨप मᱶ ह,ै के अनुसार हᲂगे। (ख) पयᭅटन महायोजना महारा᳦ सरकार के पयᭅटन िवभाग, ᳇ारा राज᭭ व और वन िवभाग, महारा᳦ सरकार के परामशᭅ से तैयार होगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के संबंिधत पयᭅटकᲂ के अ᭭ थायी िनवास के िलए आवासन के िसवाय पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और ᳯरसोटᭅ के नए संिनमाᭅण गूगामल रा᭬ ᮝीय उ᳒ान, मेलघाट अभयार᭛य, वन अभयार᭛य, अंबाववाᭅ अभयार᭛य और नरनाला अभयार᭛य कᳱ सीमा के एक ᳰकलोमीटर के भीतर अनु᭄ात नहᱭ हᲂगे:
परंतु रा᭬ ᮝीय उ᳒ान कᳱ सीमा के एक ᳰकलोमीटर के परे पाᳯरि᭭ थितक संवेदी जोन के िव᭭तार तक नए होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना को पाᳯरि᭭ थितक अनुकूल पयᭅटन सुिवधाᲐ के िलए नामिन᳸द᳥ ᭃेᮢᲂ मᱶ और पयᭅटन महायोजना के अनुसार अनु᭄ात ᳰकया जाएगा ।
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान े तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा िनगरानी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नैसᳶगक िवरासत.—पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(5) मानव िनᳶमत िवरासत ᭭ थलᲂ.—पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाए ंतैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण.—पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या महारा᭬ ᮝ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ के अनुसार पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, 2000 अंतगᭅत तैयार करेगा ।
(7) वाय ुᮧदषूण.—पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या महारा᭬ ᮝ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण.—पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥.—ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकारी जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाए ंतैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अजैव सामᮕी ᭭वीकायᭅ रीित से पयाᭅवरणीय मᱶ ᳞यत् ᳰकया जाएगा ।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट.—पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना स.का.िन 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) ᭡लाि᭭टक अपिश᳥ ᮧबधंन.—पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना स.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(12) िनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंधन.—पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना स.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(13) यानीय पᳯरवहन.—पᳯरवहन कᳱ यानीय गितिविधया ं आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होन ेऔर रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होन ेतक, िनगरानी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
4. पाᳯरि᭭थितक संवदेी जोन मᱶ ᮧितिष या िविनयिमत, सवंᳶधत ᮧवतᭅक ᳰᮓयाकलापᲂ कᳱ सूची.—पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई सारणी मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂग,े अथाᭅत् :-- 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणीया ं
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
1. वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां । (क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां ᮧितिष हᲂगी । तथािप, वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िलए मकानᲂ के सिंनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइ᭨स या टᲂ का िनमाᭅण करना िव᳒मान िविनयमᲂ के अनुसार अनु᭄ात हᲂग े। (ख) खनन संᳰᮓयाए,ं माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामल ेमᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामल े मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
2. आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक सवंेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
3. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना A पाᳯरि᭭थितक सवंेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाले का िव᭭ तार अनु᭄ात नहᱭ होगा ।
4. जलावन लकड़ी का वािणि᭔यक उपयोग A लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
5. नए बृहत जल िव᳒ुत पᳯरयोजना का ᭭थापना A लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
6. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन A लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
7. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण A लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । िविनयिमत ᳰᮓयाकलाप
8. नए का᭬ ठ आधाᳯर त उपयोग A पाᳯरि᭭ थितक सवंेदी जोन कᳱ सीमाᲐ के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰकया जाएगा :
परंतु नई लकड़ी आधाᳯरत उ᳒ोग 100% आयाितत का᳧ भ᭛डार का उपयोग कर पाᳯरि᭭थितक सवंेदी जोन मᱶ ᭭थािपत ᳰकया जाएगा ।
9. पाᳯरि᭭थितक पयᭅटन के िलए होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना A पाᳯरि᭭ थितक के अनुकूल पयᭅटन ᳰᮓयाकलापᲂ से सबंंिधत पयᭅटकᲂ के िलए अ᭭थायी आवास के िसवाए संरिᭃत ᭃेᮢᲂ कᳱ सीमा के एक ᳰकलोमीटर के भीतर नए वािण᭔यक होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना अनु᭄ात नही होगी :
पंरतु एक ᳰकलोमीटर से परे और पाᳯरि᭭ थितक सवंेदी जोन के िव᭭ तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ के िव᭭ तार पयᭅटन महायोजना और रा᭬ ᮝीय बाघ संरᭃण ᮧािधकरण के ᳰदशा-िनदᱷशᲂ के अनुᱨप हᲂगे ।
10. संिनमाᭅण ᳰᮓयाकलाप A संरिᭃत ᭃेᮢᲂ कᳱ सीमा स ेएक ᳰकलोमीटर के भीतर ᳰकसी नए वािण᭔यक संिनमाᭅण को अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय ᭪ यि तयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण िजसके अंतगᭅत पैरा 3 के उपपैरा (1) मᱶ सूचीब ᳰᮓयाकलाप भी ह,ᱹ को करने के िलए अनु᭄ात ᳰकया जाएगा । (ख) एक ᳰकलोमीटर से परे पाᳯरि᭭ थितक सवंेदी जोन के िव᭭ तार तक सावपवूᭅक ᭭ थानीय आव᭫ यकताᲐ के िलए संिनमाᭅण को अनु᭄ात ᳰकया जाएगा और अ᭠ य वािण᭔यक सिंनमाᭅण कायᭅकलापᲂ को आंचिलक महायोजना स᭥मुख अनुसार अनु᭄ात ᳰकया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
11. वृᭃᲂ कᳱ कटाई A (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
12. वािणि᭔यक जल ससंाधन िजसके अंतगᭅत भू-जल संचयन भी है A (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और दशेी खपत के िलए जल का िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा । (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए सबंंिधत िविनयामक ᮧािधकरण पवूᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह।ै (ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा । (घ) जल के संदषूण या ᮧदषूण, िजसके अंतगᭅत कृिष भी ह,ै को रोकने के िलए सभी उपाय ᳰकए जाएगंे ।
13. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण A भूिमगत केबलᲂ को बढ़ावा ᳰदया जाएगा।
14. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना A लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
15. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण A उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लाग ू अनुसार हᲂगे ।
16. रािᮢ मᱶ यािनक यातायात का संचलन A लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
17. िवदशेी ᮧजाितयᲂ को लाना लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
18. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण A लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
19. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण A उपचाᳯरत अपिश᳥ᲂ के पुन:चᮓण और पुन:ᮧयोग के िलए ᮧयास ᳰकया जाएगा। पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
20. वािणि᭔ यक सूचनापᲵ और होᳺडग A लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
21. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग A पाᳯरि᭭ थितक संवदेी जोन से गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग कृिष, पु᭬ प कृिष, उ᳒ान कृिष, या कृिष आधाᳯरत उ᳒ोग दशेीय माल स े औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई ᮧितकूल ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात हᲂगे ।
22. वन उ᭜पादᲂ और गैर-का᳧ वन उ᭜पादᲂ (एन टी एफ पी) का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
23. वायु और यािनक ᮧदषूण A लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
24. होटलᲂ और लॉजᲂ के पᳯरसरᲂ मᱶ बाड़ लगाना A लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. ठोस अपिश᭬ ट ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
26. पोिलथीन बैगᲂ का उपयोग A लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. पयᭅटन स े सबंंिधत ᳰᮓयाकलाप जैस े गमᭅ वाय ु गु᭣बारᲂ, हलेीका᭡टर, ᮟोन, आᳰद ᳇ारा पाᳯरि᭭थितक सवंेदी जोन ᭃेᮢ के ऊपर स ेउड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । सवंᳶधत ᳰᮓयाकलाप

29. वषाᭅ जल संचयन । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाए ।

31. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना A सᳰᮓ य ᱨप स ेबढावा ᳰदया जाए ।

33. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग A जैव गैस, सौर ᮧकाश आᳰद को बढावा दनेा होगा ।

35. पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाए ।
36. कौशल िवकास । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाए ।
5. िनगरानी सिमित.— (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी िनगरानी के िलए एक िनगरानी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :- (क) कल टर, अमरावती अ᭟ यᭃ;
(ख) कल टर, अकोला का ᮧितिनिध सद᭭य;
(ग) कल टर, बुलधाना का ᮧितिनिध सद᭭य;
(घ) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ का महारा᭬ ᮝ रा᭔य सरकार ᳇ारा ᮧ᭜ येक मामले मᱶ तीन वषᭅ के िल ए नामिन᳸द᳥ एक ᮧितिनिध - सद᭭य;
(ङ) ᮧादिेशक अिधकारी, महारा᭬ ᮝ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ, सद᭭य;
(च) ᭃेᮢ का ᭔ ये᭬ ठ क᭭बा योजनाकार सद᭭य;
(छ) पयाᭅवरण िवभाग, महारा᭬ ᮝ सरकार का एक ᮧितिनिध सद᭭य;
(ज) पाᳯर ि᭭ थ ित क और पयाᭅवरण के ᭃेᮢ मᱶ रा᭔य के याती ᮧा᳙ ᮧित᳧ान या िव᳡िव᳒ालय से महारा᭬ ᮝ रा᭔य सरकार ᳇ारा ᮧ᭜ येक मामले मᱶ तीन वषᭅ के िल ए नामिन᳸द᳥ एक िवशेष᭄ सद᭭य;
(झ) महारा᳦ रा᭔य जैव िविवधता बोडᭅ का सद᭭य सिचव / सद᭭य सद᭭य;
(ञ) उप वन संरᭃक, पि᭫ चमी मेलघाट ᮧभाग सद᭭य;
(ट) उप वन संरᭃक, अकोट व᭠ यजीव ᮧभाग सद᭭य;
(ठ) उप वन संरᭃक, अकोला ᮧभाग सद᭭य;
(ड) उप वन संरᭃक, बुलधाना ᮧभाग सद᭭य;
(ढ) ᭃेᮢ िनदेशक, मेलघाट बाघ आरिᭃती का ᮧितिनिध (ण) उप वन संरᭃक, पूवᱮ मेलघाट ᮧभाग - सद᭭य-सिचव । सद᭭य;
िनदᱷश िनबंधन
(1) मािन टरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी और िनगरानी सिमित कᳱ अविध तीन वषᭅ कᳱ होगी ।

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत िनगरानी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(5) िनगरानी सिमित का सद᭭य-सिचव या संब कलटर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा।
(6) िनगरानी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) िनगरानी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠यजीव वाडᭅन को उपाबंध IV मᱶ उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।
(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय िनगरानी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश द ेसकेगा, जो वह ठीक समझे ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । [फा. सं. 25/45/2014-ईएसजेड/आरई] डॉ. टी. चांदनी, वै᭄ािनक ‘जी’ MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 27th December, 2016 S.O. 4205(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 1777(E), dated 30th June 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
WHEREAS, Government of Maharashtra vide its Gazette notification No.WLP-10.07/C.R.297/F-1, dated the 27th December, 2007, has declared 1500.49 square kilometer area of Melghat Tiger Reserve as critical tiger habitat under the provisions of section 38 (V) of Wildlife (Protection) Act, 1972 comprising of the following National Parks and Sanctuaries in the State of Maharashtra namely:-
(i) Gugamal National Park (36128.06 ha), District Amravati,
(ii) Wan Wildlife Sanctuary (21100.70 ha), District Amravati,
(iii) Melghat Wildlife Sanctuary (78875.24 ha), District Amravati,
(iv) Narnala Wildlife Sanctuary (1235.07 ha), District Akola and
(v) Ambabarwa Wildlife Sanctuary (12711.42 ha), District Buldhana;
AND WHEREAS, the Government of Maharashtra vide its Gazette notification No. WLP-10-10/CP-139/F-1, Dated the 29th September, 2010, declared 1268.03 square kilometers (920.65 square kilometers forest area and 347.38 square kilometer non forest area) as a buffer zone of Melghat Tiger Reserve, under section 38 (V) of the Wildlife (Protection) Act, 1972;
AND WHEREAS, the area has a very high faunal and floral diversity and supports large number of wild animals with habitat of 42 Tigers (Panthera tigris), Leopard (Panthera pardus), Bison (Bos gaurus), Sloth Bear (Melursus ursinus), Forest owlet (Heteroglaux blewitti) and that the forests of the Tiger Reserve are varied and rich and are classified as Group-5 – Sub-Group 5A-Southern Tropical Dry deciduous forest as per Champion and Seth classification;
AND WHEREAS, the tiger reserve area is catchment of important rivers such as the Tapti, the Gadga, the Sipna, and the Wan and has tribal villages having major population of tribals;
18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the buffer zone of Melghat Tiger Reserve is required to be conserved from ecological and environmental point of view, to protect, propagate and develop wildlife therein or its environment;
AND WHEREAS, the extremely close vicinity of the above-mentioned National Parks and Sanctuaries which constitute the critical tiger habitat of Melghat Tiger Reserve to human habitation and ongoing developmental activities, necessitate the requirement of proper safeguards and control over such activities;
AND WHEREAS, it is necessary to conserve and protect the buffer area the extent and boundaries of which is specified in paragraph 1 of this notification around the critical tiger habitat of Melghat Tiger Reserve as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries, or class of industries and their operations or processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of up to 10 kilometers from the boundary of Gugamal National Park, Melghat Sanctuary, Wan Sanctuary, Ambabarwa Sanctuary and Narnala Sanctuary in the state of Maharashtra as the Melaghat Tiger Reserve Eco-Sensitive zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.—(1) The Eco-Sensitive Zone is spread over an area of 126803.67 hectares with an extent from 2.2 kilometres to 14.85 kilometres from the boundary of Melghat Tiger Reserve. These extents are applicable for Maharashtra State. Zero extent is mentioned towards the boundary adjoining the state of Madhya Pradesh at South-West direction for which separate proposal of Eco-Sensitive Zone shall be taken into consideration with the concerned state. The Eco Sensitive Zone covers villages in Talukas namely, Dharni, Chikhaldara, Chikali, Motala, Khamgaon, Akot, Buldhana, and Sangrampur in the districts of Amravati, Akola and Buldhana.
(2) The boundary description of the Eco-Sensitive Zone is given in Annexure I.
(3) The list of the villages falling within the Eco-sensitive Zone along with co-ordinates of the prominent points is annexed as Annexure II.
(4) The map of the Eco-sensitive Zone is annexed to this notification as Annexure III.
(5) The Eco-sensitive Zone includes both forest and non-forest areas as per details given below:

2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for consideration and approval of the State Government.
(2) The Zonal Master Plan so prepared shall commensurate with the stipulation specified in the Notification and include the environmental implications.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this Notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) As the buffer zone of the Melghat Tiger Reserve is part of the Eco-sensitive Zone, the Tiger Conservation Plan relating to the buffer zone shall be followed during the preparation of the Zonal Master Plan.
(5) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:
i. Environment, ii. Forest and Wildlife, iii. Agriculture, iv. Revenue, v. Urban Development, ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 vi. Tourism, vii. Rural Development, viii. Irrigation and Flood Control, ix. Municipal x. Panchayati Raj xi. Public Works Department,
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification.
3. Measures to be taken by State Government.—The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.—Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 9, 15, 21, 29, and 32 in column
(2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities,
(ii) Widening and strengthening of existing roads and construction of new roads,
(iii) Small scale industries not causing pollution,
(iv) Rainwater harvesting, and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas as per buffer zone management plan of the Melghat Tiger Reserve.
(2) Natural Springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.

(3) Eco-Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism, Government of Maharashtra in consultation with Department of Revenue and Forests, Government of Maharashtra.
(c) The activity relating to tourism shall be as under, namely:-
(i) all new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Gugamal National Park, Melghat Sanctuary, Wan Sanctuary, Ambabarwa Sanctuary and Narnala Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities:
Provided that beyond the distance of one kilometer from the boundary of the Sanctuary till the extent of the Ecosensitive Zone, the establishment of new hotels and resorts shall be permitted only in designated areas for Eco-tourism facilities as per Tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this Notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artifacts areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein. -
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and nonbiodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material shall be disposed of in an environmentally acceptable manner.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E), dated the 29th March, 2016, as amended from time to time.
(13) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan till the Zonal Master Plan is approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be executed in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks

1. Commercial Mining, stone quarrying and crushing units.
(a) New mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for the domestic needs of bona fide local residents with reference to digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.
(b) The mining operations shall strictly be in accordance with the interim order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and order of the Hon’ble Supreme Court dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills.
No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
5. Establishment of new major hydroelectric projects. Prohibited (except as otherwise provided) as per applicable laws.
6. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
7. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
Regulated activities
8. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone:
Provided that new wood-based industry may be set up in the Eco-sensitive Zone using 100 % imported wood stock.
9. Establishment of hotels and resorts for ecotourism.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities: Provided that beyond one kilometer and upto the extent of the Eco-sensitive Zone all new tourism activities or expansions of existing activities should be in conformity with the Eco-Tourism Master Plan and National Tiger Conservation Authority guidelines.
10. Construction activities (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area:
Provided that local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3. (b) The construction activity related to small scale industries not causing pollution shall permitted, as per applicable rules and regulations, if any.

(c) Beyond one kilometer and upto the extent of Eco sensitive Zone, construction for bona fide local needs shall be permitted and other commercial

11. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thererunder.
12. Commercial water resources including ground water harvesting.
(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority;
(c) No sale/trade of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
13. Erection of electrical cables and telecommunication towers.
Promote underground cabling
14. Fencing of existing premises of hotels and lodges. Regulated under applicable laws.
15. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
16. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
17. Introduction of exotic species. Regulated under applicable laws.
18. Protection of hill slopes and river banks. Regulated under applicable laws.
19. Discharge of treated effluents in natural water bodies or land area.

The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein. -
20. Commercial Sign boards and hoardings. Regulated under applicable laws.
21. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Ecosensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
22. Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
23. Air and vehicular pollution Regulated under applicable laws.
24. Fencing premises of hotels and lodges Regulated under applicable laws.
25. Solid Waste Management Regulated under applicable laws.
26. Use of polythene bags Regulated under applicable laws.
27. Under taking other activities related to tourism like over flying the ESZ area by hot air balloon, helicopter, drones, Microlites, etc.

Promoted activities
28. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws.
29. Rain water harvesting. Shall be actively promoted.
30. Organic farming. Shall be actively promoted.

5. Monitoring Committee:-
(1) The Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(a) Collector, Amravati - Chairman
(b) representative of Collector, Akola - Member
(c) representative of Collector, Buldhana - Member
(d) a representative of Non-governmental Organizations working in the field of environment (including heritage conservation) to be nominated by the Government of Maharashtra for a term of three years in each case – Member
(e) Regional Officer, Maharashtra State Pollution Control Board - Member
(f) Senior Town Planner of the area - Member
(g) a representative of the Department of Environment, Government of Maharashtra – Member
(h) one expert in the area of ecology and environment from reputed Institution or University of the State to be nominated by the Government of Maharashtra for a term of one year in each case- Member
(i) Member-Secretary or Member, Maharashtra State Biodiversity Board - Member
(j) Deputy Conservator of Forests, West Melghat Division –Member
(k) Deputy Conservator of Forests, Akot Wildlife Division –Member
(l) Deputy Conservator of Forests, Akola Division –Member
(m) Deputy Conservator of Forests, Buldhana Division –Member
(n) Representative of Field Director, Melghat Tiger Reserve - Member
(o) Deputy Conservator of Forests, East Melghat Division –Member Secretary.
Terms of Reference:
(1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of Notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests or the Field Director, Melghat Tiger Reserve shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
31. Adoption of green technology for all activities. Shall be actively promoted.
32. Cottage industries including village artisans, etc. Shall be actively promoted.
33. Use of renewable energy sources Bio gas, solar light etc shall be promoted
34. Agro-forestry Shall be actively promoted.
35. Environmental Awareness Shall be actively promoted.
36. Skill Development Shall be actively promoted.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this Notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
