2. और जबᳰक अ᭠ य बातᲂ के साथ, माननीय उ᭒ चतम ᭠ यायालय ने ᳯरट यािचका सं या 562/2009 तारीख 30 जुलाई, 2015 मᱶ यह िनदेश ᳰदया ᳰक त᭜ कालीन ᮧवगᭅ ‘ग’ खनन पᲵᲂ के पᲵेदार के पᭃ मᱶ िव᳒मान काननूी अनमुोदन/अनापि᭜ त नए पᲵेदारᲂ के पᭃ मᱶ अंतᳯरत हो जाएगंी और संब ᮧािधकारी, वन (सरंᭃण) अिधिनयम, 1980 के अधीन पयाᭅवरणीय अनापि᭜ त और अनमुोदन/अ᭭ थायी कायᭅ अनु᭄ा जैसे कानूनी अनुमोदनᲂ कᳱ मंजूरी के िलए शीᮖ कारᭅवाई करेगा ;
3. और जबᳰक कनाᭅटक रा᭔ य स ेसबंंिधत ᮧवगᭅ ‘ग’ लौह अय᭭ क खनन पᲵा र कर ᳰदया गया था और उ᭠ हᱶ माननीय उ᭒ चतम ᭠ यायालय के अनसुार कनाᭅटक सरकार ᳇ारा नीलाम ᳰकया गया था;
4. और जबᳰक खान मंᮢालय ने, िविध के अनसुार कनाᭅटक रा᭔ य मᱶ लौह अय᭭ क ᭣ लाकᲂ कᳱ अनापि᭜ त को शीᮖ िनबटाने के िलए पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय स ेअनुरोध ᳰकया ह;ै
5. और जबᳰक कᱶ ᮤीय सरकार, खान मंᮢालय के अनुरोध को ᭟ यान मᱶ रखते ᱟए, उन ᭪ यि तयᲂ से आᭃेप और सुझाव, िजनसे उनके ᮧभािवत होने कᳱ संभावना है, जनिहत मᱶ आमंिᮢत करने के बारे मᱶ पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के खंड (क) मᱶ िन᳸द᭬ ट सूचना कᳱ अपेᭃा से अिभमु त होकर उ त अिधसूचना को संशोिधत करती ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
6. अत:, अब, कᱶ ᮤीय सरकार, पयाᭅवरण (सरंᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (4) के साथ पᳯठत पयाᭅवरण (सरंᭃण) िनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1) और उपधारा (2) के खंड (v) ᳇ारा ᮧद᭜ त शि तयᲂ का ᮧयोग करते ᱟए, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533 (अ) तारीख 14 िसतंबर, 2006 मᱶ जनिहत मᱶ उ त िनयम 5 के उपिनयम (3) के खंड (क) मᱶ िन᳸द᭬ ट सूचना कᳱ अपᭃेा स े अिभमु त होकर िन᭥ निलिखत और सशंोधन करती ह,ै अथाᭅत् :- उ त अिधसूचना मᱶ परैा 11 के उप पैरा (2) के प᭫ चात् िन᭥ निलिखत उप पैरा अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत ्:- “(3) जहां कनाᭅटक रा᭔ य से संबंिधत लौह अय᭭ क ᭣ लाक का आबंटन ᳰकसी िविधक कायᭅवाही मᱶ या िविध के अनुसार सरकार ᳇ारा र ᳰकया जाता ह,ै वहां ऐसे लौह ᭣ लाक के संबंध मᱶ अनुद᭜ त पयाᭅवरणीय अनापि᭜ त को उस िविधमा᭠ यता अविध िजसमᱶ, इसे आरंभ मᱶ अनुद᭜ त ᳰकया गया था, के अधीन रहते ᱟए ᳰकसी ऐसे िविधक ᭪ यि त को अंतᳯरत कᳱ जाएगी िजसको ऐसा ᭣ लाक बाद मᱶ आबंᳯटत ᳰकया जाता ह ैऔर ऐस ेमामल ेमᱶ पयाᭅवरणीय अनापि᭜ त धारक स ेया संबंिधत िविनयामक ᮧािधकारी स े“अनापि᭜ त” ᮧा᭡ त करना आव᭫ यक नहᱭ होगा और संबंिधत िवशेष᭄ मू᭨ याकंन सिमित या रा᭔ य ᭭ तरीय िवशेष᭄ मू᭨ याकंन सिमित को कोई िनदᱷश नहᱭ ᳰकया जाएगा ।”; [सं. जैड-11013/54/2016-आईए-II (एम)] ᭄ानशे भारती, संयु त सिचव ᳯट᭡ पण : मलू अिधसूचना भारत के राजपᮢ, असाधारण, भाग II , खंड 3, उपखंड (ii) अिधसूचना सं. 1533(अ) तारीख 14 िसतंबर, 2006 को ᮧकािशत कᳱ गई थी और त᭜ प᭫ चात् उनमᱶ िन᭥ निलिखत ᳇ारा संशोधन ᳰकया गया :-

30. का. आ. 3518(अ), तारीख 23 नवंबर, 2016 ; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 30th December, 2016 S.O. 4241(E).—Whereas the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), regarding granting of Environmental Clearances, (hereinafter referred to as the said notification);
2. And whereas, the Hon’ble Supreme Court, in Writ Petition no. 562/2009, dated the 30th July 2015, inter-alia, directed that the existing statutory approvals/clearances in favour of the lessee of the erstwhile Category ‘C’ mining leases will be transferred in favour of the new lessees and the concerned authority will take expeditious action for the grant of the statutory approvals such as the environmental clearance and approval/Temporary Work Permission under the Forest (Conservation) Act, 1980;
3. And whereas, Category ‘C’ iron ore mining lease pertaining to the State of Karnataka, were cancelled and auctioned by the Government of Karnataka as per the direction of the Hon’ble Supreme Court;
4. And whereas, the Ministry of Mines, requested the Ministry of Environment, Forest and Climate Change to expedite the clearances of Iron Ore Blocks in Karnataka State in accordance with law;
5. And whereas, in view of the request of Ministry of Mines, the Central Government hereby amends the said notification by dispensing with the requirement of notice referred to in clause (a) of sub-rule
(3) of rule 5 of the Environment (Protection) Rules, 1986 regarding inviting objections and suggestions from persons likely to be affected thereby, in public interest;
6. Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of subsection (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the notification of the Government of India, in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 by dispensing with the requirement of notice referred to in clause (a) of sub-rule (3) of the said rule 5, in public interest, namely :– In the said notification, after sub-paragraph (2) of paragraph 11, following sub-paragraph shall be inserted, namely:- “(3) Where an allocation of iron ore block pertaining to the State of Karnataka is cancelled in any legal proceeding, or by the Government in accordance with law, the environmental clearance granted in respect of such iron block may be transferred subject to the same validity period it was initially granted, to any legal person to whom such block is subsequently allocated, and in such case, obtaining of “no objection” from either the holder of environmental clearance or from the regulatory authority concerned shall not be necessary and no reference shall be made to the Expert Appraisal Committee or the State Level Expert Appraisal Committee concerned.”; [No. Z-11013/54/2016-IA-II (M)] GYANESH BHARTI, Jt.
