PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 397] ubZ fnYyh] eaxyokj] iQjojh 14] 2017@ek?k 25] 1938 No. 397] NEW DELHI, TUESDAY, FEBRUARY 14, 2017/MAGHA 25, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 13 फरवरी, 2017 का.आ. 436(अ).—भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का. आ. 3548(अ) तारीख 30 ᳰदस᭥बर, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसूचना अंतᳶव᳥ है, उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करते ᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;
और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक ᱧप से िवचार ᳰकया गया;
िछलिछला व᭠ यजीव अभयार᭛य, हᳯरयाणा रा᭔ य मᱶ ि᭭ थ त है िजसका ᭃेᮢफल लगभग 29 हेटेयर ह,ै यह एक आᮤᭅ भूिम है, जो शीतकालीन ᮧवासी पᭃी आकृ᭬ ट करता ह ैऔर उपजाऊ कृिष भूिम से िघ रा ᱟआ है;
और, अभयार᭛ य भूिमवासी और उड़ने वाले पिᭃ यᲂ आदशᭅ पयाᭅवास ᮧदान करता ह ै और पीफाउल, ᮕे तीतर (परिडस परिडस), काला तीतर (मेलनᲂपरिडस नाइजर), सामा᭠य बᱫख, ᳳरग बᱫख (᭭ᮝे᭡टोपेिलया कैपीकॉल), ᮩाहमनी मैना(सतुरिनअ पगोᮤमु), सामा᭠य मैना (अᳰᮓडोथेसᭅ ᳯᮝि᭭टस), बबलर, ᭣लू रोिबन(लुि᭭चिनया ᮩुननेआ), ᮝी पाई, गौरैया (पा᭭सेर डोमेि᭭टकस), कौवा गौरेया(सᱶᮝो᭡स साइनᱶिसस), गाम- बगुला(बुबुलकस इिबस), करिछया बगुला(एगरेटा गरजेता), पᲂड हॉनᭅ(अरडेओला ᭭पा), पैडी बडᭅ(अरडेओला ᭭पा), सामा᭠य टील (अनास ᮓेका), शोवेलर (᭭पैटुला ᭭पा), ि᭭ ट ᭨ ट, मलाडᭅ (अनास ᭡लेटयरहनैचोस), पोचडᭅ (अयथय फेᳯरन) , का᭥ ब डक इ᭜ याᳰद मु य पᭃी ᮧजाितयां ह ᱹतथा उपरो त के अितᳯरᲦ, अभयार᭛ य मᱶ नीलगाय (बोसेलाफ़ुस ᮝेगोकेमेलुस), जंगली खरगोश (लेपस ᭭पा), िछपकली और सांपᲂ कᳱ िविभ ᭠ न ᮧजाितयां पायी जाती ह;ै और, वन कᳱ संरचना और िवतरण मᱶ जलवायु कᳱ दशा के कारण िभ ᭠ नता पाई जाती ह,ै वन के ᮧकार िमि᮰ त पणᭅपाती वन और ᭃेᮢ मᱶ युकिल᭡टस (युकिल᭡टस लोबलेस) और बेर के वृᭃ पाए जाते हᱹ, इनके अितᳯर त वन᭭ पित ᮧजाितयां जैसे कᳱकर (अकेिशया ᭭पा), 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] नीम (अज़ᳰदराचता इंिडका), बरगद (ᳰफस ᭭पा), पीपल (ᳰफस रेिलिजओसा), जामुन (᭭यजयिगम कुमीनी) और बेलप᭜ थर (ऐगले मामᱷलॉस) भी पाए जाते ह;ै और, िछलिछला व᭠ यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ का ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᭟द करना आव᭫यक है ;
अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) के साथ पᳯठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, हᳯरयाणा रा᭔ य मᱶ िछलिछला व᭠ यजीव अभयार᭛य कᳱ सीमा से चारᲂ ओर 80 मीटर तक के िव᭭ताᳯरत ᭃेᮢ को िछलिछला व᭠ यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत् :--
1. पाᳯरि᭭थितक सवंदेी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन लगभग 19 हे टेयर के ᭃेᮢ मᱶ समािव᭬ ट िछलिछला व᭠ यजीव अभयार᭛य के संरिᭃ त ᭃेᮢ कᳱ सीमा से 80 मीटर तक िव᭭ताᳯरत होगा।
(2) पाᳯरि᭭थितक संवेदी जोन पूवᭅ (उपाबंध I मानिचᮢ कᳱ ᳲबद ुस ं4) कᳱ ओर 29056'15.173'' उ. अᭃांश और 76041'8.969'' पूवᭅ दशेांतर; पि᳟म कᳱ ओर (उपाबंध I मानिचᮢ के िब᭠ द ुसं.8) 29056'24.139'' उᱫर अᭃांश तथा 760 40'36.352'' पूवᭅ दशेांतर;
उ᭜ तर कᳱ ओर (उपाबंध I मानिचᮢ के िब᭠ द ुसं. 1) 290 56'30.074'' उ᭜ तर अᭃांश और 76040'47.789'' पूवᭅ दशेां᭠ तर और दिᭃ ण कᳱ ओर (उपाबंध I मानिचᮢ के िब᭠ द ुसं. 5 ) 29056'5.523'' उ᭜ तर अᭃांश तथा 76041'0.925'' पूवᭅ देशा᭠ तर से िघ रा ᱟआ है।
(3) अᭃांश और दशेांतर के साथ पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का मानिचᮢ उपाबधं I के ᱨप मᱶ उपाब ह ै।
(4) पाᳯरि᭭थितक संवेदी जोन के िनदᱷशांक उनके अᭃांश और दशेांतर सिहत उपाबंध II के ᱨप मᱶ उपाब ह ै।
(5) पाᳯरि᭭थितक संवेदी जोन मᱶ िजन ᮕामᲂ के ᭃेᮢ या उनका भाग आता ह ैवे ह ᱹसरसा और भैसी माजरा ।
2. पाᳯरि᭭थितक सवंेदी जोन के िलए आचंिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;
(v) नगरपािलका ;
(vi) राज᭭ व ;
(vii) कृिष ; और
(viii) हᳯरयाणा रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢ ᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण स ेसंबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए ह ᱹ पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं0 25, 36 और सं. 41 के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग;
(ii) वषाᭅ जल संचय; और
(iii) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण िश᭨पी भी ह ᱹ:
परंतु यह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत - आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष᭟द करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो आंचिलक महायोजना का भाग िन᳜िलिखत ᱨप मᱶ हᲂगे । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, हᳯरयाणा सरकार ᳇ारा राज᭭ व और वन िवभाग, हᳯरयाणा सरकार के परामशᭅ से तैयार होगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और सैरगाहᲂ के नए संिनमाᭅण अनु᭄ात नहᱭ हᲂगे ।
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ के अनुसार पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, 2000 अंतगᭅत तैयार करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं.का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना जी.एस. आर 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
4. पाᳯरि᭭थितक सवंेदी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और तीन बनाए गए िनयमᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-- सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) क. ᮧितिष ᳰᮓयाकलाप
(1) वािणि᭔यक खनन, प᭜थर उ᭜ खनन और उनको तोड़ने कᳱ इकाइयां A (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), प᭜थर उ᭜ खनन और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िसवाय नहᱭ हᲂगी ;
(ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
(2) आरा मीलᲂ कᳱ ᭭थापना A पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(3) जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ स् थापना A पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाले का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(4) ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन A लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠यथा उपबंिधत के िसवाय) ।
(5) जलावन लकड़ी का वािणि᭔यक उपयोग। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(6) नए बृहत जल िव᳒ुत पᳯरयोजना का ᭭थापना A लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠यथा उपबंिधत के िसवाय) ।
(7) ᭡ लाि᭭ टक के थैलᲂ का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(8) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(9) म᭟यम घन᭜व के फाइबर बोडᭅ/ पा᳷टकल बोडᭅ/ इकाईया ंऔर संयंᮢ कᳱ ᭭थापना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।

(11) वािणि᭔ यक हिैलका᭡ टर सेवाएं। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । ख. िविनयिमत ᳰᮓयाकलाप
(12) होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी ᳞वसाय के िलए आवास के संबंध मᱶ संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक, जो भी िनकट हो, के भीतर ही नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ :
पर᭠तु व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱧप होगा ।
(13) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ वृᭃᲂ कᳱ कोई कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
(14) संिनमाᭅण ᳰᮓयाकलाप A (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ अनुमित दी जाएगी । पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे । (ख) एक ᳰकलोमीटर से आगे और पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक वा᭭ तिवक ᭭ थानीय आव᭫ यकताᲐ के िलए संिनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे।
(15) कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(16) वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू-जल संचयन भी ह ै। (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा । (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतन े पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह ै। (ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा । (घ) ᳰकसी ᮲ोत जल, िजसके अंतगᭅत कृिष भी ह,ै के संदषूण या ᮧदषूण को रोकने के िलए सभी उपाय ᳰकए जाएंगे ।
(17) िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण । भूिमगत केबलᲂ को ᮧो᭜ साहन देना ।
(18) होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(19) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण। उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनुसार हᲂगे ।
(20) रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
(21) िवदेशी ᮧजाितयᲂ को लाना लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(22) वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(23) वायु और यािनक ᮧदषूण। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(24) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(25) ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग। पाᳯरि᭭ थितक संवेदी जोन मᱶ देशीय माल से उ᭜पादᲂ का उ᭜पादन करन ेवाले गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत देशीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालत ेह,ᱹ अनु᭄ात ᳰकए जाएंगे। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
(26) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
(27) वन उ᭜पादᲂ और गैर का᳧ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(28) सुरᭃा बलᲂ के कᱹप। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(29) नदी तलᲂ से प᭜ थरᲂ, बजरी, और बालू कᳱ िनकासी । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(30) 33 ᳰकलोवाट से ऊपर के संचरण और िवतरण ᮧणाली को िबछाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(31) नए का᭬ ठ आधाᳯरत उ᳒ोग। पाᳯरि᭭ थितक संवेदी जोन के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना अनु᭄ात नहᱭ होगी:
परंतु पाᳯरि᭭ थितक संवेदी जोन मᱶ 100 ᮧितशत आयाितत का᭬ ठ ᭭ टाक उपभोग करने वाल े नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना कᳱ जा सकेगी।
(32) पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा अभयार᭛य ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(33) पाᳯरि᭭थितक-पयᭅटन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(34) ठोस अपिश᳥ ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ग. सवंᳶध त ᳰᮓ याकलाप
(35) ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(36) वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(37) जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(38) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना A सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(39) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग A लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(40) वान᭭ पितक बाड A लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(41) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी हAᱹ सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(42) कृिष करने, िजसके अंतगᭅत बागवानी, उ᳒ान कृिष और फलᲂ उ᳒ान भी ह ै। लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे।
(43) समुदाय ᮧकृित आरिᭃत। लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे।
(44) कृिष वािनकᳱ। लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे।
(45) पयाᭅवरणीय जागᱧकता । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे।
5. पाᳯरि᭭थितक सवंदेी जोन मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत ्:- (क) उपायुᲦ, कुᱨᭃेᮢ -अ᭟यᭃ ;
(ख) अितᳯर त उपायु त, कुᱨᭃेᮢ – सद᭭ य ;
(ग) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनो (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै - सद᭭य;
का ᮧ᭜ येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए हᳯरयाणा रा᭔ य सरकार ारा नामिन᳸द᭬ ट एक ᮧितिनिध (घ) ᮧादिेशक अिधकारी, हᳯरयाणा रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ -सद᭭य ;

(च) हᳯरयाणा सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का एक िवशेष᭄ -सद᭭य;
(छ) ᮧभागीय व᭠यजीव अिधकारी, पंचकुला – द᭭य ;
(ज) रा᭔य जैव-िविवधता बोडᭅ का सद᭭य -सद᭭य ;
(झ) उप वन संरᭃक (ᭃेᮢीय), कुᱨᭃेᮢ -सद᭭य सिचव। िनदᱷश िनबधंन
(1) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(2) मानीटरी सिमित का कायᭅकाल तीन वषᭅ का होगा।
(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(5) मानीटरी सिमित का सद᭭य-सिचव या संब उपायु त, ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।
(6) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपन ेिवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ रा᭔ य के मु य व᭠ यजीव वाडᭅन को अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ उपाबधं III पर उपाब ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।
(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपन ेकृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदशे द ेसकेगा, जो वह ठीक समझे ।
6. इस अिधसूचना के उपबंधᲂ को ᮧभाव दनेे के िलए कᱶ ᮤीय सरकार और रा᭔ य सरकार अितᳯर त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶ गे ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 13th February, 2017 S.O. 436(E).—Whereas, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 11 3548(E), dated the 30th December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, no comments, objections and suggestions received from persons and stakeholders in response to the draft notification;
Whereas, the Chhilchhila Wildlife Sanctuary is situated in the State of Haryana which is about 29 hectares in area, is a wetland, which attracts winter migratory birds and surrounded by fertile agriculture lands;
And Whereas, the sanctuary provides an ideal habitat for ground dweller and flying birds and peafowls, Grey Partridge (Perdix perdix), Black Partridge (Melanoperdix niger), Common Dove, Ring Dove (Streptopelia capicola), Brahamani Mayna (Sturnia pagodarum), Common Mayna (Acridotheres tristis), Bubbler, Blue Robin (Luscinia brunnea), Tree pie, Sparrows (Passer domesticus), Crow Pheasant (Centropus sinensis), Cattle Egrets (Bubulcus ibis), Little Egrets (Egretta garzetta), Pond Heron (Ardeola sp.), Paddy Bird (Ardeola sp.), Common Teal (Anas crecca) , Shoveller (Spatulla sp.), Stilt, Mallard (Anas platyrhynchos), Poachard (Aythya ferina), Comb Duck etc. are the main birds species and besides the above Neelgai (Boselaphus tragocamelus), Wild Hare (Lepus sp.) , Lizard and different species of snakes are found in the sanctuary;
And whereas, the composition and distribution of the forest vary due to the climatic condition, type of forest is mixed deciduous forest and there are plantation of Eucalyptus (Eucalyptus globules) and Ber in the area and besides these plants species like Kikar (Acacia sp.), Neem (Azadirachta indica), Bargat (Ficus sp.), Pipal (Ficus religiosa), Jamun (Syzygium cumini) and Belpathar (Aegle marmelos) are also found;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of the Chhilchhila Wildlife Sanctuary as Ecosensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause
(xiv) of sub- section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent 80 meters all around the boundary of the Chhilchhila Wildlife Sanctuary in the State of Haryana as the Chhilchhila Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.—(1) The Eco-sensitive Zone is upto 80 meters from the boundary of the protected areas of the Chhilchhila Wildlife Sanctuary comprising an area of 19 hectares approximately.

(2) The Eco-sensitive Zone is bounded by 29º56’15.173"N latitude and 76º41’8.969"E longitude towards east (point No.4 of Annexure I map); 29º56’24.139"N latitude and 76º40’36.352"E longitude towards west (point No.8 of Annexure I map); 29º56’30.074"N latitude and 76º40’47.789"E longitude towards north (point No.1 of Annexure I map) and 29º56’5.523"N latitude and 76º41’0.925"E longitude towards south (point No.5 of Annexure I map).
(3) The map of Eco-sensitive Zone boundary together with its latitudes and longitudes is appended as Annexure I.
(4) The coordinates of Eco-sensitive Zone with its latitude and longitude is appended as Annexure II .
(5) The villages whose area or parts thereof falling within the Eco-sensitive Zone are Sarsa and Bhainsi Majra.
2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture; and
(viii) Haryana State Pollution Control Board, for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities.
3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.—Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 26, 37 and 42 in column (2) of the Table in paragraph 4, namely:-
(i) Small scale industries not causing pollution;
(ii) Rainwater harvesting; and
(iii) Cottage industries including village artisans:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Haryana in consultation with Department of Revenue and Forests, Government of Haryana.
(c) The activity of tourism shall be regulated as under, namely.—
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the National Tiger Conservation Authority, Ministry of Environment Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.— Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
(7) Air pollution.— The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.
(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
(i) the solid waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343(E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the Competent Authority in the State Government and the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- TABLE Sl.

4. Use or production of any hazardous substances.

6. Establishment of new major hydroelectric projects.

B. Regulated Activities:
12. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometer or up to the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Tourism Master Plan.
13. Felling of trees.
(a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made there under.
14. Construction activities.
(a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in subparagraph (1) of paragraph 3:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any.
(b) Beyond one kilometer upto the extent of Eco-sensitive Zone, construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per the Zonal Master Plan.
15. Drastic change of agriculture system.
Regulated under applicable laws.
16. Commercial water resources including ground water harvesting.
(a)The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
17. Erection of electrical cables and telecommunication towers.
Promote underground cabling.
18. Fencing of existing premises of hotels and lodges.

5. Eco-sensitive Zone Monitoring Committee.—(1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(a) Deputy Commissioner, Kurukshetra - Chairman;
(b) Additional Deputy Commissioner, Kurukshetra -Member;
(c) A representative of Non-governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Haryana for a term of three year – Member;
(d) Regional Officer, Haryana State Pollution Control Boar- Member;
(e) District Town Planner, Kurukshetra - Member;
(f) One expert in the area of ecology and environment to be nominated by the Government of Haryana - Member;
(g) Divisional Wildlife Officer, Panchkula – Member;
(h) Member of State Biodiversity Board - Member
(i) Deputy Conservator of Forests (Territorial) Kurukshetra – Member-Secretary.

(i) The Monitoring Committee shall monitor the compliance of the provisions of Notification.
(ii) The tenure of the Monitoring Committee and the subject expert would be three years.
(iii) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(iv) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(v) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(vi) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(vii) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State as per pro- forma appended at Annexure III .
(viii) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
