1. oI FHTT AT, FFT T=HA MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 19th September, 2022 S.0. 4361(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the ershwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14% September, 2006 (hereafter in this notification referred to as the said notification), the Central Govemnment on considering it necessary or expedient so to do for the purposes of the said Act hereby constitutes the State Level Environment Impact Assessment Authority, Odisha (hereafter in this notification referred to as the Authority, Odisha) comprising of following Members, namely: - 1 Shri Sisir Kumar Ratho, Indian Forest Services (Retired Principal Chairman;

2. The Chairman and Members of the Authority, Odisha shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.

3. The Authority, Odisha shall exercise such powers and follow such procedures as enumerated in the said notification.

4. The Authority, Odisha shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted for the State of Odisha (hereafter in this notification referred to as SEAC, Odisha) by this notification.

5. To assist the Authority, Odisha, the Central Government in consultation with the State Government of Odisha, hereby constitutes the SEAC for the State of Odisha comprising of the following Members, namely: - 1 Shri Sashi Paul, Indian Forest Services (Retired Principal Chief Chairman;

6. The Chairman and Members of the SEAC, Odisha shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.

7. In order to avoid any conflict of interest, -

(i) the Chairman and Members of the Authority, Odisha and SEAC, Odisha,-

(a) shall declare to which consulting organisation they have been associated with and also the project proponents;

(b) shall not undertake any consultation or associate with preparation of Environment Impact Assessment (EIA) and Environment Management Plan for a project, which is to be appraised by the Authority, Odisha and the SEAC, Odisha during their tenure, and

(i) if in the past five years, the Chairman or any of the Members of the Authority, Odisha and SEAC, Odisha have provided consultancy services or conducted EIA studies for any project proponent, in that event they shall recuse themselves from the meetings of the Authority, Odisha and SEAC, Odisha in the process of appraisal of any project being proposed by such proponents.

8. The SEAC, Odisha shall exercise such powers and follow such procedures as enumerated in the said notification.

9. The SEAC, Odisha shall function on the principle of collective responsibility and the Chairman shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.

10. The State Government of Odisha shall notify an agency to act as Secretariat for the Authority, Odisha and the SEAC, Odisha and the said Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all their statutory functions.

11. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority, Odisha and the Chairman and Members of the SEAC, Odisha shall be paid in accordance with the applicable rules of the State Government of Odisha.
