And whereas, in exercise of powers conferred by section 7 of National Highways Act, 1956 (48 of 1956) read with Rule (3) of National Highway Fee (Determination of Rules and Collection) Rules, 2008, the Central Government by notification of Government of India authorized Authority for levying and collecting fee on mechanical vehicles for the use of following four-laned stretches:

25.07.2016 And whereas, pursuant to the provision of section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority entered into an agreement with M/s. Jhansi Orai Tollway Pvt. Ltd. (the Concessionaire) on
05.02.2013 and in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 & its amendment and in supersession of the notification number S.O. No. 2836(E), dated 19.12.2011 & S.O. No. 422(E) dated 21.02.2013 except as respect things done or omitted to be done before such supersession, the Central Government, vide notification No. S.O. 2021 (E) dated 05.07.2013, authorized the Concessionaire for development of Jhansi Orai section from Km 90.300 to Km 225.713 o f NH-25 in the state of Uttar Pradesh on Operate, Maintain and Transfer (OMT) basis;
And whereas, the Commercial Operation Date was not declared and OMT Concession Agreement has been terminated on 03.03.2014 by the Authority and therefore, the notification No. S.O. 2021(E), dated 05.07.2013 was not implemented;
And whereas, pursuant to the provisions of section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an agreement (hereinafter referred to as the “said agreement”) on 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

Prakash Asphaltings and Toll Highways (India) Limited, having its registered office at 76, Mall Road, Mhow, District Indore, Madhya Pradesh, 433441 (hereinafter referred to as the “Concessionaire”), for the bid received on 03.02.2016, for the Operation and Maintenance of the Jhansi Orai section from Km 90.300 to Km
225.713 o f NH-25 ( N e w N H - 2 7 ) (hereinafter referred to as the “said section”) on Operate, Maintain and Transfer (OMT) basis;
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011, G.S.R 778(E) dated 16th December, 2013, G.S.R. 26(E) dated 16th January, 2014 and G.S.R. 831(E) dated 21st November, 2014, GSR 02(E) dated 29 th December, 2014 and G.S.R. 220(E) dated 23 rd March, 2015 (hereinafter referred to as the “said Rules”) and in supersession of the notification number S.O. No. 2836(E) dated 19.12.2011, S.O. No. 1470(E) dated 21.04.2016, S.O. No. 422(E) dated 21.02.2013, S.O.
No. 2524 dated 25.07.2016 & S.O. 2021 (E) dated 05.07.2013 except as respect things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section of the said national highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said agreement between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said four lane section on the Type of Vehicles specified in column (1) at the rate specified in columns (2) (hereinafter referred to as “base rate”) of Table 1 below for net road length of 74.236 km & 0.4816 km of structure (having more than 60 m length) with equivalent length of 4.816 km and at one and one half times the base rate for 60.695 km (Inclusive of incomplete length of 850m) length of bypass costing Rupees Ten crore or more and authorizes the said Concessionaire to collect and retain the said fees on and from the date of commercial operation declared by the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the said agreement;

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the toll plaza is Rs. 235.00 (Rupees Two Hundred and Thirty Five 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] only) for the year 2016-17, which is subject to revision every year as per the provisions of the National Highways Fee(Determination of Rates and Collection) Rules, 2008.
5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
7. A mechanical vehicle which is loaded in excess of permissible load specified for its category under sub-rule (2) of rule 4, shall not be permitted to use the National Highway or crossing the toll plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in charge of a mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle under sub-rule (2) of Rule 4.
8. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.
9. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules.
10. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the Concessionaire and thereafter revised annually in accordance with the rule 5 of the said Rules and provisions of the Concession Agreement and will be published; provided, however, that such revision shall not be effected until a period of 6 (six) months from the date of preceding revision of fee.
11. The present value of Capital Cost of the project to be recovered from the (probable) date of COD (10.09.2016) is Rs. 910.62 Crore (Rupees Nine Hundred and Ten Crore and Sixty Two lakh). From the Commercial Operation Date (COD) toll shall be collected by the Concessionaire at the applicable rates provided under the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R. 838(E), dated 5th December, 2008 and further amendments till bid due date. After the day on which the Capital Cost is recovered, the user fee chargeable shall be reduced to 40% of the rates being charged. In case, due to any reason, COD is advanced/ postponed upto 90 days, the Capital cost to be recovered shall be reworked and intimated to the Concessionaire within 30 days after actual COD, by the Engineer/ Independent Engineers.
