And whereas, the Central Government, in exercise of the powers conferred by Section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838 (E) dated the 5th Dec, 2008, and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October,2011 and G.S.R 778 (E) dated 16th December, 2013 and G.S.R 26(E) dated 16th January,2014 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels;

Now, therefore, in exercise of the powers conferred by Section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended ¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 5 from time to time (hereinafter referred to as the “said Rules”), and in supersession of the notification bearing No. S.O.

454(E), dated the 16th March, 2012 as amended vide Sl. No. 20 of fee notification bearing S.O. No. 896 (E) dated

26.03.2014, the Central Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for net road section length of 57.50 km {including 54.982 km road and 2.518 Km. of structure (having length more than 60 m) with equivalent length of 25.18 Km. } (hereinafter referred to as “base rate”) for use of the four and more lane sections on the Type of Vehicles specified in column (1) of Table 1 below and 1.5 times the base rate for a bypass having a length of

2.6 Km. (from Km. 184.260 to Km. 186.860) under the project of Four Laning of Phulparash to Forbesganj section from Km 148.550 to Km 208.650, new chainage (Design Chainage, Km. 145.646 to Km. 230.000) of NH-57 in the State of Bihar and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:- Type of vehicle Base rate of fee per Km. for the base year 2007-08 (in Rupees)

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for net road length specified for such Toll Plaza:

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometre from the toll plaza is Rs. 225.00 (Rupees Two Hundred Twenty Five only) for the year 2014-15 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

5. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.

9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.

10. Based on the Base rate of fee per Km. for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.

11. The estimated capital cost of the project is Rupees 999.00 Crore. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost; the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules. A total of Rs. 15.72 Crore has been recovered from the user fee realized till 31.03.2014 ALKESH SHARMA, Jt. Secy.
