And whereas, the Central Government, in exercise of the powers conferred by Section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838(E) dated 05.12.2008 and amended vide G.S.R. 950(E) dated 03.12.2010, G.S.R 15(E) dated 12.01.2011, G.S.R 756(E) dated 12.10.2011, G.S.R. 778(E) dated 16.12.2013 and G.S.R. 26(E) dated
16.01.2014 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels.
And whereas, in exercise of the powers conferred by Section 14 of the National Highway Act, 1956 (48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central Government by notification of the Government of India vide S.O. No. 1313(E) dated 03.06.2010 authorized the Concessionaire M/s Gujarat Pratibha Johnson OMT – 2 Private Limited, Mehsana, Gujarat for levying and collecting fee on mechanical vehicles for the use of the stretch from Porbandar – Bhiladi – Jetpur section from km 1.960 to km 117.600 (including the bypass from km 72.200 to km 80.150) on National Highway No. 8B in the State of Gujarat on OMT basis on and from the Date of Commercial Operation declared ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 by the Authority and till the termination date as specified in the Agreement superseding the Notifications published vide S.O. No. 1183(E) dated 18.07.2007 and S.O. No. 2268(E) dated 25.09.2008.
And whereas, the OMT Concession Agreement was foreclosed on account of termination of OMT Concession Agreement by the Authority on 26.10.2013.Consequent upon termination of OMT Concession Agreement, NHAI is continuing the user fee collection as per provisions in Concession Agreement/Fee Notification dated 03.06.2010. However, w.e.f. date of publication of this fee notification, NHAI shall collect user fee as per provisions under this fee notification.
Now, therefore, in exercise of the powers conferred by Section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), and in supersession of the notification number S.O. 1313 (E) dated 03.06.2010, except as respects things done or omitted to be done before such supersession, the Central Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for total equivalent road length of 125.064 km [including 106.954 km road and 1841 m of structures (having length more than 60m) with equivalent length of 18.11 km] for use of the four and more lane sections (hereinafter referred to as “base rate”) and at one and one half times the base rate for bypasses having an aggregate length of 7.795 km (excluding 155 m of structures having length more than 60 m) costing each Bypass Rupees Ten Crore or more of the stretch from km 1.040 to km 117.600 ( including the bypass from km 72.200 to km 80.150) on National Highway No. 8B in the State of Gujarat on the Type of Vehicles specified in column (1) of the Table 1 below and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:— TABLE 1 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees)

The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 225.00 (Rupees Two Hundred Twenty Five only) for the year 2014-15, and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
5. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle.
7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle
8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rules.
9. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules.
10. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the sections and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
11. The present value of Capital Cost of the Project is [Rs. 256.91 Crore (for influence length of Vanana Toll Plaza) + Rs. 418.43 Crore (for influence length of Dhumiyani Toll Plaza) =] Rs. 675.34 Crore (Rupee Six Hundred Seventy Five crore and Thirty Four lakh only). The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
