वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना संखर्ांक का.आ. 734(अ), तारीख 12 फरवरी, 2025 के अधीन भारत के रािपत्र, असाधारण में एक प्ररूप अजधसूचना प्रकाजित की गई थी, जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करन ेवाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उि रािपत्र अजधसूचना की प्रजतर्ां िनता को तारीख 12 फरवरी, 2025 को उपलब्ध करा िी गई थी; और, उि प्ररूप अजधसूचना की बाबत व्यजिर्ों और पणधाररर्ों से कोई आक्षेप, रिप्पणी और सुझाव प्राप्त नहीं हुए; और, रूपी भाबा वन्र्िीव अभर्ारण्र् 503 वगा दकलोमीिर के क्षेत्र में फैला हुआ ह ैऔर जहमाचल प्रिेि के दकन्नौर जिले के जनचार उप-जवभाग में जस्ट्थत ह।ै र्ह ऊपरी सतलुि घािी में 31º 35′ और 31º 45′ उत्तरी अक्षांिों और 77º 49′ और 78º 07′ पूवी ििेांतरों के बीच फैला हुआ ह।ै दकन्नौर जिल ेका मुखर्ालर् रेकॉन्ग जपर्ो (कल्पा) अभर्ारण्र् के पूवी जहस्ट्से में लगभग 40 दकलोमीिर की िरूी पर जस्ट्थत ह;ै स.ं 4556] नई दिल्ली, EXTRAORDINARY [PART II—SEC. 3(ii)] और, रूपी भाबा वन्र्िीव अभर्ारण्र् पजिम और उत्तर में धौलाधार पवातमाला के श्रीखंड पवातों और िजक्षण में सतलुि निी के बीच जस्ट्थत ह।ै इस अभर्ारण्र् को जहमाचल प्रििे सरकार द्वारा अजधसूचना संखर्ा एफएफई- बीएफ(6)II/2005-11 तारीख 07 िून, 2013 के अधीन वन्र्िीव अभर्ारण्र् का ििाा दिर्ा गर्ा था। और, रूपी-भाबा वन्र्िीव अभर्ारण्र् को मध्र् जहमालर् में जस्ट्थत होन ेऔर जोन 2 बी (पजिमी जहमालर्) के िीवनी क्षेत्र की पुजष्ट करने का जविेषाजधकार प्राप्त ह।ै रूपी-भाबा वन्र्िीव अभर्ारण्र् ग्रेि जहमालर्न राष्ट्रीर् उद्यान और जपन वैली राष्ट्रीर् उद्यान के साथ जमलकर संरजक्षत क्षेत्र संिाल का एक सतत् और सघन खंड बनाता ह ैऔर पजिमी जहमालर् िीवमंडल ररिवा में गरठत होन ेके जलए उपर्ुि ह ैऔर (गासान और गैस्ट्िन 1992) एच.पी. वन्र् िीवन पररर्ोिना-III जवश्व धरोहर स्ट्थल के रूप में घोजषत होन ेके जलए उपर्िु ह।ै और, र्ह अभर्ारण्र् अपने जविाल अल्पाइन चरागाहों और घास के मैिानों के जलए िाना िाता ह।ै सामान्र् धारणा र्ह ह ैदक र्हााँ घन ेिेविार, काली और चौडी पत्ती वाल ेिंगल (2000 मीिर और उससे अजधक) हैं, और ऊाँ चाई (2800 मीिर और उससे अजधक) पर िेविार-स्ट्प्रूस के संर्ोिन और बााँस की झाजडर्ााँ बहुतार्त में हैं। अल्पाइन क्षेत्र 3500 मीिर से ऊपर की ऊाँ चाई से आरंभ होता ह;ै और, रूपी भाबा वन्र्िीव अभर्ारण्र् प्रकृजत प्रेजमर्ों को मध्र् जहमालर् के सबसे संुिर मनोरम िृर्ों में से एक प्रिान करता ह ैऔर इसमें साहजसक साधकों के आनंि के जलए रैककंग मागों, पवात चोरिर्ों और ऊंचे िरों की बडी संखर्ा ह।ै अभर्ारण्र् के भीतर पंद्रह से अजधक चोरिर्ां हैं िो 5000 मीिर से अजधक ऊंचाई पर हैं। सबसे ऊंची चोिी (5914 मीिर) पूवी सीमा पर जचदकम धार पर ह।ै पांडोश्वर चोिी (5806 मीिर) िसूरी सबसे ऊंची चोिी ह ैऔर दकन्नौर जिले का एक बहुत ही महत्वपूणा भौगोजलक स्ट्थल ह।ै उत्तरी सीमा पर तीन ऊंचे पवातीर् िरे हैं, जिनके नाम, िकरौग खांगो (5100 मीिर), जनजमष खांगो (4890 मीिर) और तारी खांगो (4865 मीिर) हैं, िो सभी रूपी- भाबा वन्र्िीव अभर्ारण्र् को लाहौल और स्ट्पीजत जिल े के स्ट्पीजत उप-मंडल के जपन वैली राष्ट्रीर् उद्यान से िोडत ेहैं। और, रूपी-भाबा वन्र्िीव अभर्ारण्र् का अल्पाइन क्षेत्र औषधीर् िडी-बूरिर्ों में प्रचुर मात्रा में ह,ै और स्ट्थानीर् समुिार् इन पौधों को इकट्ठा करके और बेचकर अपनी आर् में वृजि करते हैं। प्रचुर मात्रा में एकत्र की गई सबसे महत्वपूणा िडी-बूरिर्ााँ हैं कारू (जपक्रोररजा कुरूआ), पारिि (एकोजनिम हिेरोफाइलम) बनफ्सा (जवर्ोला कैनेसेंस), कुथ (डोलोजमर्ा कॉस्ट्िस) मुिाकबाला (वेलेररर्ाना वाजलची), ररवाडा चीनी (रर्ूम इमोडी), बैंकाक्री (पोडोदफलम इमोडी) आदि। आर्ुवेदिक िवाओं के जलए इस अभर्ारण्र् के अल्पाइन चरागाहों में पाई िाने वाली सभी िडी-बूरिर्ााँ अत्र्जधक आर्थाक मलू्र् और महत्व की हैं। और, अभर्ारण्र् में प्रमुख पाई िाने वाली प्रमुख पिु प्रिाजतर्ााँ हैं कस्ट्तरूी मृग (मोस्ट्चस मोजस्ट्चफेरस), गोरल (नेमोरहडेस गोरल), भरल (स्ट्र्डूोइस नार्र), सीरो ( कैपररसोजनस सुमाते्रजन्सस), जहमालर्न थार (हजेमत्रगस िेम्लाजहकस), जहमालर्न नेवला (मसु्ट्िेला जसररजबका)), जहम तेंिआु (अनजसर्ा अनजसर्ा), सामान्र् तेंिआु (पेंथेरा पाडास)), तेंिआु जबल्ली (फेजलस बेंगालेंजसस), लाल लोमडी (वुल्प्स वल्प्स), छोिी कमीर उडन ेवाली जगलहरी (हाइलोपेिेस दफजम्िएिस), एजिर्ाई काला भालू (उरस जथबेिानस), पजिमी रैगोपैन (रैगोपैन मलेानोसेफालस), चीर्र तीतर (कैरेस वाजलची), जहमालर्न मोनाल (लोफोफोरस इम्पेिेनस), जहमालर्न जग्रफॉन (जिप्स जहमालर्ेंजसस), वुडकॉक इत् र्ादि हैं। और, रूपी भाबा वन्र्िीव अभर्ारण्र् में प्रमुख पुष्प प्रिाजतर्ााँ हैं िैसे दक िाउन ओक (के्वरकस सेमीकार्पाफोजलर्ा), स्ट्प्रूस (जपका जस्ट्मजथर्ाना), िेविार (एबीस पपडं्रो), जचलगोसा (पीनस िेरार्डार्ाना), मेपल (एसर पेंिापोजमकम), राख र्ा िैतून (फै्रजक्सनस जैन्थोजक्सलोइड्स), एलनस नाइरिडा, बेतलूा एनोइड्स, बक्सस वाजलजचर्ाना, कॉनास एसपी, गलुाबी रोडोडेंड्रोन, बबेररस प्रिाजत आिेजमजसर्ा वल्गेररस, इंजडगोफेरा, डैफ्ने ओजलओइड्स, लोनीसेरा ऑगजस्ट्िफोजलर्ा, एफडेरा िेरार्डार्ाना, प्लैक्रान्थस एसपी., वोइला सेपेन्स, क्रू्प्रेस प्रिाजत., िुजनपरेस इंजडका आदि। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 और, इस अजधसूचना के परैा 1 में जवजनर्िाष्ट संरजक्षत क्षेत्र के चारों ओर पाररजस्ट्थजतक, पर्ाावरणीर् और िैव जवजवधता के िजृष्टकोण से पाररजस्ट्थजतकी संवेिी िोन के रूप में क्षेत्र, जवस्ट्तार और सीमा को संरजक्षत और सुरजक्षत रखना आवर्क ह ै और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों और उद्योगों की श्रेजणर्ों के प्रचालन और प्रसंस्ट्करण को प्रजतजसि करना आवर्क ह;ै अतः अब , पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) तथा (xiv) एवं उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत, केन्द्रीर् सरकार जहमाचल प्रिेि राज्र् के दकन्नौर जिले में रूपी भामा वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर िून्र् से लेकर 3.45 दकलोमीिर के जवस्ट्ताररत क्षेत्र को रूपी भामा के अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन ( जिसे इसके पिात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह ै) के रूप में अजधसूजचत करती है, जिसका ब्र्ौरा जनम्नजलजखत ह,ै अथाात्: -

1. पाररजस्ट्थजतकी सवंिेी िोन का जवस्ट्तार और सीमाएं.-

(1) पाररजस्ट्थजतकी संवेिी िोन रूपी भाबा वन्र्िीव अभर्ारण्र् की सीमा के आसपास 0 दकलोमीिर से 3.45 दकलोमीिर तक फैला हुआ ह ैऔर पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल लगभग 85.53 वगा दकलोमीिर ह।ै रिप्पण: रूपी-भाबा वन्र्िीव अभर्ारण्र् तीन तरफ़ से पूवा में जलप्पा-असरंग वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन के साथ अपनी सीमाएाँ साझा करता ह।ै उत्तर की ओर, र्ह जपन वैली राष्ट्रीर् उद्यान के पाररजस्ट्थजतकी संवेिी िोन के साथ-साथ पाका की सीमा पर भी ह।ै उत्तर-पजिमी तरफ़, अभर्ारण्र् ग्रेि जहमालर्न राष्ट्रीर् उद्यान से सिा हुआ ह।ै इसजलए, रूपी- भाबा वन्र्िीव अभर्ारण्र् के इन तीनों तरफ़ कोई पाररजस्ट्थजतकी संवेिी िोन नहीं ह।ै

(2) पाररजस्ट्थजतकी संवेिी िोन का सीमा जववरण उपाबंध-I के रूप में संलग्न ह ै।

(3) रूपी भाबा वन्र्िीव अभर्ारण्र् के आसपास के पाररजस्ट्थजतकी संवेिी िोन के मानजचत्र उपाबंध- IIक, उपाबंध IIख, उपाबंध IIग और उपाबंध IIघ के रूप में सलंग्र ह।ै

(4) रूपी भाबा वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा पर भू-जनिेिांक उपाबंध -III में संलग्न हैं।

(5) पाररजस्ट्थजतकी संवेिी िोन के अधीन आने वाल ेगांवों की सूची उपाबंध-IV में संलग्न ह ै

(6) क्षेत्र में मौिूि वनस्ट्पजतर्ों, िीवों और िलुाभ, लुप्तप्रार् और संकिापन प्रिाजतर्ों की जवस्ट्तृत सूची उपाबंध-V में संलग्न हैं।

2. पाररजस्ट्थजतकी सवंिेी िोन के जलए आचंजलक महार्ोिना.-

(1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए, स्ट्थानीर् व्यजिर्ों के परामिा से और इस अजधसूचना में दिए गए अनुबंधों का पालन करत ेहुए, रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वषा की अवजध के भीतर राज्र् सरकार के सक्षम प्राजधकारी के अनुमोिन के जलए एक आंचजलक महार्ोिना तैर्ार करेगी।

(2) पाररजस्ट्थजतकी संवेिी िोन के जलए क्षेत्रीर् महार्ोिना राज्र् सरकार द्वारा इस अजधसूचना में जवजनर्िाष्ट कें द्र एवं राज् र् सरकार के संगत जवजधर्ों के अनुरूप केन्द्रीर् एवं राज्र् जवजधर्ों तथा केन्द्रीर् सरकार द्वारा िारी मागाििाक जसिांत, र्दि कोई हों, के अनरुूप तैर्ार की िाएगी। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(3) आंचजलक महार्ोिना राज्र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार दकर्ा िाएगा, तादक उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् पहलुओं को एकीकृत दकर्ा िा सके:- i. पर्ाावरण; ii. वन एवं वन्र्िीव; iii. कृजष; iv. रािस्ट्व; v. िहरी जवकास; vi. पर्ािन; vii. ग्रामीण जवकास; viii. पसंचाई और बाढ़ जनर्ंत्रण; ix. पंचार्ती राि; x. नगर पाजलका; और xi. जहमाचल प्रिेि राज्र् प्रिषूण जनर्ंत्रण बोडा

(4) िब तक इस अजधसूचना में ऐसा जवजनर्िाष्ट न हो, तब तक आंचजलक महार्ोिना में जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन नहीं अजधरोजपत दकर्ा िाएगा तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्रर्ाकलापों में सुधार करके उन्ह ेअजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान ेकी व्यवस्ट्था की िाएगी।

(5) आंचजलक महार्ोिना, में वनरजहत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मिृा और नमी के संरक्षण, स्ट्थानीर् िनता की आवर्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्र् पहलुओं का उपबंध दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवर्क ह ै।

(6) आंचजलक महार्ोिना में सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, कृजष क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्र् िल जनकार्ों की सीमा, सहार्क मानजचत्रों के साथ जिनमें जवद्यमान तथा प्रस्ट्ताजवत भू-उपर्ोग जविेषताओं के ब्र्ौरों का जनधाारण दकर्ा िाएगा।

(7) आंचजलक महार्ोिना में पाररजस्ट्थजतकी-संवेिी िोन के जवकास का जवजनर्जमत दकर्ा िार्ेगा और परैा 4 की सारणी में दिर् े गर्े प्रजतजषि और जवजनर्जमत दक्रर्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट् थानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित दकर्ा िाएगा और उसे संवधान दकर्ा िार्ेगा।

(8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी ।

(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना, इस अजधसूचना के उपबंधों के अनुसार मॉनीिरी के अपन ेकार्ों को पूरा करन े के जलए मॉनीिरी सजमजत के जलए संिभा िस्ट्तावेि होगा।

(10) आंचजलक महार्ोिना की तैर्ारी और अनुमोिन तक, कोई भी नई जवकासात्मक दक्रर्ाकलापों पैरा 6 के उप-पैरा (1) और

(2) में जवजनर्िाष्ट उपबंधों द्वारा जनर्ंजत्रत दकर्े िाएंगे ।

3. राज्र् सरकार द्वारा उठाए िान ेवाल ेउपार्. - राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेगी, अथाात:् - [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

1. भूजम उपर्ोग.- (क) पाररजस्ट्थजतकी संवेिी िोन में मनोरंिन प्रर्ोिनों के जलए जचजन्हत वन, बागवानी क्षेत्र, कृजष क्षेत्र, पाका और खुले स्ट्थान का उपर्ोग वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक दक्रर्ाकलापों के जलए नहीं दकर्ा िाएगा र्ा उन्हें क्षेत्रों में पररवर्तात नहीं दकर्ा िाएगा: परंत ुऊपर भाग (क) में जवजनर्िाष्ट उद्देर्ों के अजतररि अन्र् उद्देर्ों के जलए पाररजस्ट्थजतकी संवेिी िोन के भीतर कृजष और अन्र् भूजम के संपररवतान की अनुज्ञा मॉनीिरी सजमजत की जसफाररि पर और क्षेत्रीर् नगर जनर्ोिन अजधजनर्म और कें द्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से िी िा सकती ह,ै िैसा दक लाग ूहो और इस अजधसूचना के उपबंधों के अनुसार, स्ट्थानीर् जनवाजसर्ों की आवासीर् आवर्कताओं को परूा करन ेऔर जनम्नजलजखत दक्रर्ाकलापों के जलए- i. जवद्यमान सडकों का चौडीकरण और सुिढृ़ीकरण तथा नई सडकों का जनमााण; ii. बुजनर्ािी ढांचे और नागररक सुजवधाओं का जनमााण और नवीनीकरण; iii. प्रिषूण न फैलान ेवाले लघ ुउद्योग; iv. कुिीर उद्योग एवं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ािन में सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और v. अनुच्छेि 4 में दिए गए दक्रर्ाकलापों का संवधान दकर्ा गर्ा: परंत ुर्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म और राज्र् सरकार के अन्र् जनर्मों एवं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना एवं संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनुमजत नहीं होगी: परंत ुर्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के अधीन आन ेवाली भूजम के अजभलेखों में हुई दकसी तु्ररि को, मॉनीिरी सजमजत के जवचार प्राप्त करन ेके पिात,् राज्र् सरकार द्वारा प्रत्र्ेक मामल ेमें एक बार सुधारा िाएगा और उि तु्ररि को सुधारन ेकी सूचना कें द्रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी: परंत ुर्ह भी दक उपर्ुाि तु्ररि को सुधारन ेमें, इस उप-परैा में र्था उपबंजधत के जसवार्, दकसी भी ििा में भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा: (ख) अनुप्रर्िु र्ा अनुत् पािक कृजष क्षेत्रों में वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों से पनु: वनीकरण दकए िाने के प्रर्ास दकए िाएगंे।

2. प्राकृजतक िल जनकार्.- सभी प्राकृजतक झरनों के िलग्रहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और पनुरुिार के जलए र्ोिनाएं आंचजलक महार्ोिना में सजम्मजलत की िाएगंी और राज्र् सरकार द्वारा मागाििाक जसिांत इस प्रकार तैर्ार दकए िाएंगे दक इन क्षेत्रों में र्ा उसके पास ऐसी जवकास दक्रर्ाकलापों पर रोक लगाई िा सके िो इन क्षेत्रों के जलए हाजनकारक हैं।

3. पर्ािन र्ा पाररजस्ट्थजतकी पर्ािन.- (क) पाररजस्ट्थजतकी-संवेिी िोन में सभी नए पाररजस्ट्थजतकी पर्ािन दक्रर्ाकलाप र्ा जवद्यमान पर्ािन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी-संवेिी िोन संबंधी पर्ािन महार्ोिना के अनुसार अनुमत होगा। (ख) पाररजस्ट्थजतकी पर्ािन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा से पर्ािन जवभाग द्वारा बनार्ी िाएगी। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ग) पर्ािन महार्ोिना आंचजलक महार्ोिना एक घिक के रूप में होगी। (घ) पर्ािन महार्ोिना पाररजस्ट्थजतकी-संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ािन संबंधी दक्रर्ाकलाप जनम् नानुसार जवजनर्जमत दकए िाएंग,े अथाात:्-

(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीिर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक, इनमें से िो भी अजधक जनकि हो: दकसी होिल र्ा ररिॉिा का नर्ा सजन्नमााण र्ा व्यापाररक प्रजतष्ठान अनुमत नहीं दकर्ा िाएगा, परंत ुर्ह, पाररजस्ट्थजतकी पर्ािन सुजवधाओं के जलए संरजक्षत क्षेत्र की सीमा से एक दकलोमीिर की िरूी से परे पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक पूवा पररभाजषत और अजभजहत क्षेत्रों में पर्ािन महार्ोिना के अनुसार, नए होिलों और ररिॉिा की स्ट्थापना और व्यापाररक प्रजतष्ठान अनुमत होगी;

(ii) पाररजस्ट्थजतकी-संवेिी िोन के अन्िर सभी नए पर्ािन दक्रर्ाकलापों र्ा जवद्यमान पर्ािन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी मागाििाक जसिांतों तथा पाररजस्ट्थजतकी पर्ािन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाल ेराष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ािन संबंधी मागाििाक जसिांतों (समर्-समर् पर र्था संिोजधत) के अनुसार होगा;

(iii) िब तक आंचजलक महार्ोिना के अनुमोिन नहीं जमल िाता, तब तक पर्ािन के जवकास और जवद्यमान पर्ािन दक्रर्ाकलापों के जवस्ट्तार को स्ट्थल-जवजिष्ट संवीक्षा और मॉनीिरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन में दकसी नर्े होिल र्ा ररिािा र्ा वाजणजज्र्क प्रजतष्ठान के संजनमााण की अनुज्ञा नहीं िी िाएगी।

4. प्राकृजतक जवरासत- पाररजस्ट्थजतकी-संवेिी िोन के अधीन आन ेवाले बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पूल ररिवा क्षेत्र, िलै संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एवं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

5. मानव जनर्मात जवरासत स्ट्थल- पाररजस्ट्थजतकी संवेिी िोन में इमारतें, ढांचा, वास्ट् तुजिल और सांस्ट्कृजतक महत्व की इमारतों, संरचनाओं, कलाकृजतर्ों, क्षेत्रों और पररसरों की पहचान की िाएगी और उनके संरक्षण के जलए जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रूप में तैर्ार की िाएगी।

6. ध्वजन प्रिषूण.- पाररजस्ट्थजतक संवेिी िोन में ध्वजन प्रिषूण की रोकथाम और जनर्ंत्रण, ध्वजन प्रिषूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 और उसके संिोधनों के उपबंधों के अनुसरण में दकर्ा िाएगा।

7. वार् ुप्रिषूण.- पाररजस्ट्थजतकी संवेिी िोन में वार्ु प्रिषूण का जनवारण और जनर्ंत्रण वार्ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण (संरक्षण ) अजधजनर्म 1686 और उसके अधीन बनाए गए जनर्मों के उपबंधों अनुसार दकर्ा िाएगा।

8. बजहःस्रावों का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण; - िल (प्रिषूण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और पर्ाावरण (संरक्षण) अजधजनर्म 1686 और उसके अधीन बनाए गए जनर्मों के उपबंधों अनुसार दकर्ा िाएगा।

9. ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपिान और प्रबंधन जनम्नानसुार होगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपिान और प्रबन्धन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना संखर्ा का.आ. 1357 (अ), तारीख 8 अप्रलै, 2016 के अधीन प्रकाजित ठोस अपजिष् ि [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 प्रबंधन जनर्म, 2016, समर् -समर् पर र्था संसोजधत उपबंधों अनुसार दकर्ा िाएगा; अकाबाजनक सामग्री का जनपिान पर्ाावरणीर् रीजत में पाररजस्ट्थजतकी संवेिी िोन से बाहर अजभज्ञात स्ट्थल पर दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनजु्ञात दकर्ा िार्ेगा।

10. िवै-जचदकत्सा अपजिष्ट.- िैव-जचदकत्सा अपजिष्ट प्रबंधन जनम्नानुसार होगा:- क. पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपिान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना संखर्ा सा.का.जन. 343 (अ), तारीख 28 माचा, 2016 के अधीन प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016, समर् -समर् पर र्था संसोजधत उपबंधों के अनुसार दकर्ा िाएगा।; ख. पाररजस्ट्थजतकी संवेिी िोन में अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुमत दकर्ा िार्ेगा।

11. प्लाजस्ट्िक अपजिष्ट प्रबधंन .- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्िक अपजिष्ट का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर् -समर् पर र्था संसोजधत अजधसूचना संखर्ा सा.का.जन. 340 (अ), तारीख 18 माचा, 2016, के अधीन प्रकाजित प्लाजस्ट्िक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा।

12. जनमााण और जवध्वसं अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी-संवेिी िोन में सजन्नमााण और जवध्वंस अपजिष्ट का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर् -समर् पर र्था संसोजधत अजधसूचना संखर्ा सा.का.जन. 317 (अ), तारीख 29 माचा, 2016 के अधीन प्रकाजित सजन्नमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

13. ई-अपजिष्ट.- पाररजस्ट्थजतकी-संवेिी िोन में ई–अपजिष्ट का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित और समर् -समर् पर र्था संसोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों अनुसार दकर्ा िाएगा।

14. वाहनों का आवागमन.- वाहनों के आवागमन को पर्ाावरणीर् अनुकूल रीजत से जवजनर्जमत दकर्ा िाएगा और इस संबंध में जवजिष्ट उपाबंध आंचजलक महार्ोिना में सजम्मजलत दकए िाएंगे और िब तक आंचजलक महार्ोिना तैर्ार नहीं हो िाता और राज्र् सरकार में सक्षम प्राजधकारी द्वारा अनुमोदित नहीं हो िाता, तब तक मॉनीिरी सजमजत संबंजधत अजधजनर्मों और उनके अधीन बनाए गए जवजधर्ों और जवजनर्मों के अधीन वाहनों के आवागमन के अनुपालन की मॉनीिरी दक िाएगी।

15. वाहन प्रिषूण.- वाहन प्रिषूण की रोकथाम और जनर्ंत्रण लाग ूजवजधर्ों के अनुपालन में दकर्ा िाएगा और स्ट्वच्छ ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे।

16. औद्योजगक इकाइर्ााँ.- (क) इस अजधसूचना के आजधकाररक रािपत्र में प्रकािन पर र्ा उसके पिात्, पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई भी नर्ा प्रिषूणकारी उद्योग स्ट्थाजपत करने की अनुमजत नहीं िी िाएगी; ग. केन्द्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016, समर् -समर् पर र्था संसोजधत िारी मागाििाक जसिान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी-संवेिी िोन के भीतर केवल गरै-प्रिषूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रिषूणकारी उद्योगों को बढ़ावा दिर्ा िाएगा।

17. पहाडी ढलानों का सरंक्षण.- पहाडी ढलानों का संरक्षण जनम्नानसुार होगा:- क. आंचजलक महार्ोिना में पहाडी ढलानों पर जस्ट्थत क्षेत्रों को ििाार्ा िाएगा िहां दकसी जनमााण की अनुज्ञा नहीं होगी; ख. मौिूिा खडी पहाडी ढलानों र्ा अत्र्जधक किाव वाली ढलानों पर जनमााण की अनुज्ञा नहीं िी िाएगी। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

4. पाररजस्ट्थजतकी सवंिेी िोन के अधीन जनजषि र्ा जवजनर्जमत की िान ेवाली दक्रर्ाकलापों की सचूी.- पाररजस्ट्थजतकी-संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपाबंधों और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 (र्ा नवीनतम अजधसूचना) और वन (संरक्षण) अजधजनर्म 1980 (1980 का 69), सजहत अन्र् लाग ू जवजधर्ों सजहत उसके अधीन बनाए गए जनर्मों द्वारा िाजसत होंगी और भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म 1972 (53 का) 1972), और उसमें दकए गए संिोधन और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत से जवजनर्जमत दकए िाएंगे, अथाात्:- सारणी क्र. स.ं दक्रर्ाकलाप रिप्पजणर्ााँ क. प्रजतजषि दक्रर्ाकलाप

1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघषाण इकाईर्ााँ । क. पाररजस्ट्थजतकी-संवेिी िोन के अधीन वास्ट्तजवक रूप से रहन े वाले स्ट्थानीर् जनवाजसर्ों की घरेल ू आवर्कताओं, जिसमें मकानों के जनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत ह,ै के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघषाण इकाइर्ां तत्काल प्रभाव से प्रजतजषि होंगी; ख. खनन कार्ा माननीर् उच्चतम-न्र्ार्ालर् के तारीख 4 अगस्ट्त, 2006 का मामला, िी. एन. गोिावमान जथरुमुलपाि बनाम भारत संघ, 1995 का डब्ल्र्पूी(सी) संखर्ांक 202, तारीख 21 अप्रलै, 2014 का मामला गोवा फाउंडेिन बनाम भारत संघ, 2012 का डब्ल्र्ूपी(सी) संखर्ा 435 और 28 अप्रैल, 2023 के आिेिों के अनसुार दकए िाएंगे।

2. प्रिषूण उत्पन्न करन े वाले उद्योगों की स्ट्थापना (िल, वार्,ु मृिा, ध्वजन, आदि)। पाररजस्ट्थजतकी संवेिी िोन में प्रिषूणकारी उद्योगों के नए र्ा जवस्ट्तार की अनुमजत नहीं िी िाएगी।

3. प्रमुख िलजवदु्यत पररर्ोिना की स्ट्थापना। प्रजतजषि।

4. दकसी भी खतरनाक पिाथा का उपर्ोग, उत्पािन र्ा प्रसंस्ट्करण। (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई भी खतरनाक अपजिष्ट उपचार सुजवधा स्ट्थाजपत नहीं की िाएगी (ख) पाररजस्ट्थजतकी संवेिी िोन के अंिर उत्पन्न सभी खतरनाक अपजिष्ट को पाररजस्ट्थजतकी संवेिी िोन के बाहर ल ेिार्ा िाएगा। पाररजस्ट्थजतकी संवेिी िोन के बाहर उत्पन्न दकसी भी खतरनाक अपजिष्ट को पाररजस्ट्थजतकी संवेिी िोन के अंिर संभालने, संसाजधत करने र्ा उपचाररत करने की अनुमजत नहीं िी िाएगी। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9

5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षेत्र में अनुपचाररत अपजिष्टों का जनवाहन। प्रजतजषि।

6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई आरा जमलों र्ा मौिूिा आरा जमलों के जवस्ट्तार की अनुमजत नहीं िी िाएगी।

7. ईंि भट्टों की स्ट्थापना। प्रजतजषि।

8. पॉजलथीन र्ा प्लाजस्ट्िक बैग का उपर्ोग। प्रजतजषि।

9. िलाऊ लकडी का व्यावसाजर्क उपर्ोग। प्रजतजषि।

10. पर्ािन से संबंजधत अन्र् दक्रर्ाकलाप िैसे पाररजस्ट्थजतकी संवेिी िोन के ऊपर गमा हवा के गुब्बारे, हलेीकॉप्िर, ड्रोन, माइक्रोलाइट्स आदि द्वारा उडान भरना। प्रजतजषि। 11 र्ांजत्रक साधनों द्वारा मछली पकडना। प्रजतजषि। ख. जवजनर्जमत दक्रर्ाकलाप

12. होिलों और ररसॉिों की व्यावसाजर्क स्ट्थापना। संरजक्षत क्षेत्र की सीमा के एक दकलोमीिर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकितम हो, दकसी भी नए वाजणजज्र्क होिल और ररसॉिा की अनुमजत नहीं िी िाएगी, जसवार् पाररजस्ट्थजतकी-पर्ािन दक्रर्ाकलापों के जलए छोिे अस्ट्थार्ी ढांचों के: परंतु संरजक्षत क्षेत्र की सीमा से एक दकलोमीिर से आग े र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकितम हो, सभी नई पर्ािन दक्रर्ाकलापों र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार, पर्ािन मास्ट्िर प्लान और लागू मागाििान जसिांतों के अनुरूप होगा।

13. जनमााण दक्रर्ाकलापों। क. संरजक्षत क्षेत्र की सीमा से एक दकलोमीिर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकितम हो, दकसी भी प्रकार के नए वाजणजज्र्क जनमााण की अनुमजत नहीं िी िाएगी: परंत ु दक, स्ट्थानीर् लोगों को स्ट्थानीर् जनवाजसर्ों की आवासीर् आवर्कताओं को परूा करने के जलए भवन उप-जनर्मों के अनुसार पैरा 3 के उप-पैरा (1) में सूचीबि दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम पर जनमााण कार्ा करने की अनुमजत होगी: परंत ुप्रिषूण न फैलाने वाले लघु उद्योगों से संबंजधत जनमााण दक्रर्ाकलाप को लागू जनर्मों और जवजनर्मों, र्दि कोई हो, के अनुसार सक्षम 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] प्राजधकारी से पूवा अनुमजत लेकर जवजनर्जमत दकर्ा िाएगा और न्र्ूनतम रखा िाएगा। ख. एक दकलोमीिर से आगे इसे आंचजलक महार्ोिना के अनुसार जवजनर्जमत दकर्ा िाएगा।

14. लघ ुपैमाने के गरै-प्रिषूणकारी उद्योग। फरवरी, 2016 में केन्द्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों के वगीकरण के अनुसार गैर-प्रिषूणकारी उद्योग, िैसा दक समर्-समर् पर संिोजधत दकर्ा गर्ा ह,ै और पाररजस्ट्थजतकी संवेिी िोन से स्ट्वििेी सामजग्रर्ों से उत्पाि बनाने वाले गैर-खतरनाक, लघ ु एवं सेवा उद्योग, कृजष, पुष्प-कृजष, बागवानी र्ा कृजष- आधाररत उद्योग को अनुमजत िी िाएगी।

15. पेडों की किाई। क. राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन, सरकारी, रािस्ट्व र्ा जनिी भूजम पर वृक्षों की किाई नहीं की िाएगी। ख. वृक्षों की किाई संबंजधत कें द्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी ।

16. वन उत्पािों और गैर काष्ठ वन उत्पािों का संग्रहण । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

17. जवदु्यत और संचार िॉवर लगान,े तार-जबछाने तथा अन्र् बुजनर्ािी ढांचे की व्यवस्ट्था । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा (भूजमगत केबल जबछाने को बढ़ावा दिर्ा िा सकेगा)।

18. नागररक सुजवधाओं सजहत बुजनर्ािी ढांचा। लाग ू जवजधर्ों, जनर्मों और जवजनर्मों और उपलब्ध मागाििाक जसिांतों के अनुसार िमन का उपार् दकर्ा िाएगा।

19. जवद्यमान सडकों को चौडा करना, उन्हें सुिढृ बनाना और नई सडकों का जनमााण। लाग ू जवजधर्ों, जनर्मों और जवजनर्मों और उपलब्ध मागाििाक जसिांतों के अनुसार िमन का उपार् दकर्ा िाएगा।

20. पहाडी ढलानों और निी तिों का संरक्षण। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा।

21. राजत्र में वाहन र्ातार्ात का संचलन । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा।

22. स्ट्थानीर् िनता द्वारा अपनार्ी िा रही वतामान कृजष और बागवानी पिजतर्ों के साथ डेर्ररर्ां, िगु्ध उत्पािन, िल कृजष और मत्स्ट्र् पालन। स्ट्थानीर् िनता के प्रर्ोग के जलए लाग ूजवजधर्ों के अधीन अनुमत होंगे।

23. फमों, जनगम और कंपजनर्ों द्वारा बडे पैमाने पर वाजणजज्र्क पिुओं और कुक्कुि फामों की स्ट्थापना । स्ट्थानीर् आवर्कताओं को पूरा करने के अजतररि जवजधर्ों के अधीन जवजनर्जमत।

24. कृजष र्ा अन्र् उपर्ोग के जलए खुला कुआाँ, बोरवेल आदि। जवजनर्जमत दकर्ा िाना और सक्षम प्राजधकारी द्वारा दक्रर्ाकलापों की कडाई से मॉनीिरी की िानी चाजहए। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11

25. प्राकृजतक िल जनकार्ों र्ा भू -के्षत्र में उपचाररत अपजिष्ट िल र्ा बजहस्रााव का जनस्ट्सारण । िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा िाएगा। उपचाररत अपजिष्ट िल के पुनचाक्रण और पुन:उपर्ोग के प्रर्ास दकए िाएंगे और उपचाररत अपजिष्ट िल र्ा बजहस्रााव का जनस्ट्सरण लाग ू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा।

5.मॉनीिरी सजमजत. - कें द्रीर् सरकार इस अजधसूचना के उपबंधों के प्रभावी मॉनीिरी के जलए एक मॉनीिरी सजमजत का गठन करती ह ैजिसमें जनम्नजलजखत सजम्मजलत होंग,े अथाात.्- क्र.स.ं मॉनीिरी सजमजत के घिक पि का नाम

(3) पर्ाावरण के क्षेत्र में कार्ा करने वाल े गैर सरकारी संगठनों (जिसके अधीन जवरासत संरक्षण भी ह)ै का तीन वषा की अवजध के जलए समर्- समर् पर जहमाचल प्रिेि राज्र् सरकार द्वारा नामजनर्िाष्ट एक प्रजतजनजध सिस्ट्र्;

(4) कार्ाकारी अजभर्ंता, जहमाचल प्रिेि प्रिषूण जनर्ंत्रण बोडा, क्षते्र का अजधकार रखने वाले। सिस्ट्र्, पिेन;

(5) क्षेत्र की अजधकाररता रखन ेवाला उप-जवभागीर् मजिस्ट्रेि। सिस्ट्र्, पिेन;

(6) राज्र् सरकार द्वारा नामजनर्िाष्ट पर्ािन जवभाग का एक जविेषज्ञ। सिस्ट्र्, पिेन;

(7) दकसी प्रजतजष्ठत राज्र् जवश्वजवद्यालर् र्ा संस्ट्थान से पाररजस्ट्थजतकी और पर्ाावरण में एक जविेषज्ञ को प्रत्र्ेक तीन वषा के पिात ् जहमाचल प्रिेि राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा। सिस्ट्र्; और

(8) वन संरक्षक, वन्र्िीव प्रभाग, सराहन सिस्ट्र्-सजचव,पिेन ।

6. जनगरानी सजमजत के कार्ा.- (1) पाररजस्ट्थजतकी-संवेिी िोन में भारत सरकार के तत् कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना सं. का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची के अधीन सजम्मजलत दक्रर्ाकलापों और इस अजधसूचना के पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजषि दक्रर्ाकलापों के जसवार् आन ेवाले ऐसे दक्रर्ाकलापों की ििा में वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं पर आधाररत मॉनीिरी सजमजत द्वारा संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त लेने के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िाष्ट की िाएगी।

(2) इस अजधसूचना के परैा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजषि दक्रर्ाकलापों के जसवार् भारत सरकार के तत् कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना सं. का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची के अधीन ऐसे दक्रर्ाकलापों जिन्ह ेसजम्मजलत नहीं दकर्ा गर्ा ह ैऔर पाररजस्ट्थजतकी संवेिी िोन में आत ेह ैऐसे दक्रर्ाकलापों की वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर मॉनीिरी सजमजत द्वारा संवीक्षा की िाएगी और उसे संबि जवजनर्ामक प्राजधकरणों को जवजनर्िाष्ट दकर्ा िाएगा ।

(3) मॉनीिरी सजमजत का सिस्ट्र्-सजचव र्ा उपार्ुक् त र्ा उपार्ुि ऐसे व्यजि के जवरूि, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता ह,ै पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन फाइल िार्र करन ेके जलए सक्षम होगा।

(4) मॉनीिरी सजमजत सम्बि जवभागों के प्रजतजनजधर्ों र्ा जविेषज्ञों, औद्योजगक संगमों के प्रजतजनजधर्ों र्ा सम्बि पणधाररर्ों को, प्रत्र्ेक मामल ेमे आवर्कता के अनुसार, अपने जवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।

(5) मॉनीिरी सजमजत प्रत्र्ेक वषा 31 माचा की जस्ट्थजत के अनसुार अपनी वार्षाक कारावाई ररपोिा राज्र् के मखुर् वन्र्िीव वाडान को, उपाबंध -VI में दिए गए प्रपत्र के अनुसार, उस वषा की 30 िून तक प्रस्ट्तुत करेगी, इस अजधसूचना के साथ संलग्न ह ै। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13

8. कोई अन् र् महत्वपूणा मामला । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 15th October 2025 S.O. 4685(E).— Whereas, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 734 (E), dated the 12th February, 2025, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; And whereas, copies of the Gazette containing the said draft notification were made available to the public on 12th February, 2025; And whereas, no objections, comments and suggestions were received from persons and stakeholders in respect of the said draft notification; [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 31 And whereas, the Rupi Bhaba Wildlife Sanctuary is spread over an area of 503 square kilometres and is located in the Nichar sub-division of Kinnaur district in Himachal Pradesh. It is situated along the Upper Sutlej valley spreading between 31°35′ and 31°45′ N latitudes and between 77°49′ and 78°07′ E longitudes. Reckong Peo (Kalpa), the headquarters of Kinnaur district lies about 40 kilometers on the eastern side of the sanctuary; And whereas, the Rupi Bhaba Wildlife Sanctuary is positioned between the Shrikhand mountains of the Dhauladhar range in the West and North and the Sutlej River in the South. The sanctuary was given the status of a Wildlife Sanctuary by the Government of Himachal Pradesh vide Notification No. FFE-B- F(6)II/2005-11 dated the 7th June, 2013; And whereas, the Rupi-Bhaba wildlife Sanctuary enjoys the privilege of being situated in the Middle Himalayas and confirm to Zone 2 B (Western Himalayas) biographic zone. The Rupi-Bhaba WildLife Sanctuary together with Great Himalayan National Park and Pin Valley National Park form a continuous and compact block of Protected area network and is suitable to be constituted into a Western Himalayan Biosphere Reserve and is a suitable are to be declared as a world heritage site (Garson and Gaston 1992) Himachal Pradesh Wild life Project-III; And whereas, the Sanctuary is known for its vast alpine pastures and meadows. The general impression is of thick Deodar, Kali and broad leaved forests (2000 meters and above), Fir-Spruce combination with bamboo dominating the under growth on higher attitude (2800 Meters and above). The alpine zone starts from above 3500 meters altitude; And whereas, the Rupi Bhaba Wildlife Sanctuary provides one of the most beautiful panoramic views of the Middle Himalayas to the nature lovers and has large members of trekking routes, mountain peaks and high passes to the delight of adventure seekers. There are more than fifteen peaks within the Sanctuary which are above 5000 meters of altitude. The highest Peak (5914 meters) is on Chikim Dhar on the eastern boundary. The Pandoswar Peak (5806 meters) is the second highest peak and a very important geographical landmark in Kinnaur District. On the northern boundary there are three high mountain passes, namely, Shakarog Khango (5100 meters), Nimish Khango (4890 meters) and Tari Khango (4865 meters), all of which connect Rupi-Bhaba Wildlife Sanctuary with Pin Valley National Park of Spiti Sub-Division of Lahaul and Spiti District; And whereas, the alpine region of the Rupi-Bhaba Wildlife Sanctuary is abundant in medicinal herbs, and the local communities supplement their income by gathering and selling these plants.The most-important herbs collected profusely are Karu (Picrorhiza Kurooa), Patish (Aconitum heterophyllum) Banafsa (Viola canescens), Kuth (Dolomiaea costus) Mushaqbala (Valeriana wallichii), Reward Chini (Rheum emodii), Bankakri (Podophyllum emodii) etc. For Ayurvedic medicines, all the herbs found in alpine pastures of this Sanctuary are of great economic value and importance; And whereas, the major faunal species found in the sanctuary are musk deer (Moschus moschiferus),goral (Nemorrhaedus goral), bharal (Pseudois nayaur), serow (Capricornis sumatraensis), Himalayan thar (Hemitragus jemlahicus), Himalayan weasel (Mustela siribica), snow leopard (Uncia uncia), common leopard (Panthera pardus), leopard cat (Felis bengalensis), red fox (Vulpes vulpes), small Kashmir flying squirrel (Hylopetes fimbriatus), Asiatic Black bear (Ursus thibetanus), Western tragopan (Tragopan melanocephalus), cheer pheasant (Catreus wallichi), Himalayan monal (Lophophorus impejanus), Himalayan griffon (Gyps himalayensis), Woodcock etc.; And whereas, the Rupi Bhaba Wildlife Sanctuary harbours key floral species such as are brown oak (Quercus semicarpifolia), spruce (Picea smithiana), fir (Abies pindrow), chilgosa (Pinus gerardiana), maple (Acer pentapomicum), ash or olive (Fraxinus xanthoxyloides), Alnus nitida, Betula anoides, Buxus wallichiana, Cornus sp., pink rhododendron, Berberis sp., Artemisia vulgaris, Indigofera, Daphne olioides, Lonicera augustifolia, Ephdera gerardiana, Plactranthus sp., Voila sepens, Cupress sp., Juniperus indica etc.; And whereas, it is necessary to conserve and protect the area, extent and boundary which is specified in paragraph 1 of this notification around the protected area as Eco-sensitive Zone from ecological, environmental 32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; Now, therefore, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment(Protection) Act 1986 (29 of 1986) read with subrule (3) of rule 5 of the Environment (Protection) Rules,1986, the Central Government hereby notifies an area extending from 0 kilometer to 3.45 kilometers from the boundary of the Rupi Bhaba Wildlife Sanctuary in Kinnaur district in the State of Himachal Pradesh as the Rupi Bhaba Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-Sensitive Zone.-

(1) The Eco-sensitive Zone extends from 0 kilometer to 3.45 kilometers around the boundary of Rupi Bhaba Wildlife Sanctuary and the area of the Eco-sensitive Zone is approximately 85.53 square kilometer.

Note: The Rupi-Bhaba Wildlife Sanctuary shares its boundaries on three sides with the Eco-Sensitive Zone of the Lippa-Asarang Wildlife Sanctuary to the east. To the north, it borders the Eco-Sensitive Zone of the Pin Valley National Park, as well as the park itself. On the north-western side, the sanctuary adjoins the Great Himalayan National Park. Therefore, there is no Eco-Sensitive Zone on these three sides of the Rupi- Bhaba Wildlife Sanctuary.

(2) The boundary description of the Eco Sensitive Zone is appended as Annexure-I.

(3) The Maps of the Eco-sensitive Zone around Rupi Bhaba Wildlife Sanctuary is appended as Annexure- II A, Annexure II B, Annexure II C and Annexure II D.

(4) Geo Coordinates on the boundary of Rupi Bhaba Wildlife Sanctuary and its Eco-sensitive zone are appended at Annexure -III.

(5) The list of villages falling under the Eco-sensitive Zone are appended as Annexure-IV.

(6) The detailed list of Flora, Fauna and Rare, Endangered, and Threatened species present in the area is appended as Annexure-V.

2. Zonal Master Plan for Eco-Sensitive Zone.-

(1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Panchayati Raj;

(xi) Himachal State Pollution Control Board

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

(10) Pending preparation and approval of the Zonal Master Plan, any new developmental activities shall be governed by provisions specified at sub-para (1) and (2) of paragraph 6.

3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely: -

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or the State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: 34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph;

(b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone;

(b) the Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests;

(c) the Tourism Master Plan shall form a component of the Zonal Master Plan;

(d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Ecosensitive Zone;

(e) the activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer;

Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Ecosensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and its amendments.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and Environment (Protection) Act, 1986 and the rules made there under these Acts. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and Environment (Protection) Act, 1986 and the rules made there under these Acts.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-

(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) Safe and Environmentally Sound Management (ESM) of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive zone.

(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:-

(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide number G.S.R. 343 (E), dated the 28th March, 2016 as amended from time to time;

(b) Safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Ecosensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.

(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units.– (a) on or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone;

(b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; 36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-Sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Environmental Impact Assessment Notification, 2006 (or the latest notification) and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Ecosensitive Zone;

(b) The mining operations shall be carried out in accordance with the orders of the Hon’ble Supreme Court, dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in W.P.(C) No.202 of 1995; dated 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in W.P.(C) No.435 of 2012; and dated the 28th April,

2023.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). No new or expansion of existing polluting industries in the Eco-sensitive Zone shall be permitted.

3. Establishment of major hydroelectric project. Prohibited.

4. Use or production or processing of any hazardous substance. a) No hazardous waste treatment facility shall be located within the Eco-sensitive Zone b) All hazardous waste generated inside the Eco-sensitive Zone shall be taken outside the Eco-sensitive Zone. No hazardous waste generated outside the Eco-sensitive Zone will be allowed to be handled, processed or treated inside the ESZ

5. Discharge of untreated effluents in natural water bodies or land area. Prohibited.

6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited.

9. Commercial use of firewood. Prohibited.

10. Undertaking other activities related to tourism like over flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Prohibited.

11. Fishing by Mechanical means. Prohibited. B. Regulated Activities

12. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Ecosensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

13. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

14. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted.

15. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

16. Collection of Forest Produce or Non-Timber Forest Produce. Regulated under applicable laws.

17. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws of underground cabling may be promoted.

18. Infrastructure including civic amenities. Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.

19. Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation with proper Environment Impact Assessment, as per applicable laws, rules and regulation and available guidelines.

20. Protection of Hill Slopes and river banks. Regulated as per the applicable laws.

21. Movement of vehicular traffic at night. Regulated as per applicable laws

22. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.

23. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies. Regulated as per applicable laws except for meeting local needs.

24. Open Well, Bore Well, etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority.

25. Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise, the discharge of treated waste water or effluent shall be regulated as per the applicable laws.

26. Eco-tourism. Regulated as per the applicable laws.

27. Commercial Sign boards and hoardings. Regulated as per the applicable laws.

28. Introduction of exotic species. Regulated as per the applicable laws.

29. Water Transportation. Regulated as per the applicable laws.

30. Fencing of existing premises and hotel. Regulated as per the applicable laws.

31. Collection of small fodder. Regulated as per the applicable laws.

32. Migratory Grazing. Regulated as per the applicable laws.

33. Fishing. Regulated as per the applicable laws.

34. Construction of Sewerage line. Regulated as per the applicable laws.

35. Grant of Nautor Land. Regulated as per the applicable laws.

36. Traditional Dwellers Rights. Regulated as per the applicable laws.

5. Monitoring Committee.- For effective monitoring of the provisions of this notification, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S.No. Constituent of the Monitoring Committee Designation

39. Organic farming. Shall be actively promoted.

40. Adoption of green technology for all activities. Shall be actively promoted.

41. Cottage industries including village artisans, etc. Shall be actively promoted.

42. Use of renewable energy and fuels. Bio-gas, solar light etc. shall be actively promoted.

43. Agro-Forestry. Shall be actively promoted.

44. Plantation of Horticulture and Herbals. Shall be actively promoted.

45. Use of eco-friendly transport. Shall be actively promoted.

46. Skill Development. Shall be actively promoted.

47. Restoration of Degraded Land or Forests or Habitat. Shall be actively promoted.

8. Conservator of Forests, Wildlife Division, Sarahan Member-Secretary, ex-officio

6. Functions of the Monitoring Committee.–

(1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification.

(2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.

(3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis.

(5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-VI, appended to this notification.

(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional Measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal. 2. EAST The Eastern boundary of the proposed Eco-sensitive zone starts from 7806’6.322’’E 31042’46.943’’N upto 7806’34.099’’E 31036’36.953’’N. Eastern sides of Eco-sensitive Zone flanked with Eco-sensitive Zone of Lippa – Asrang Wildlife Sanctuary and Katgaon Range of Kinnaur territorial Forest Division.

3. SOUTH The Southern boundary of the proposed Eco-sensitive zone starts from 77057’44.039’’E 31034’24.429’’N upto 77052’2.616’’E 31035’16.183’’N. Southern side of Eco-sensitive Zone is Nichar Range of Kinnaur territorial Forest Division.

4. WEST Starts from 77045’9.77’’E 31044’10.864’’N upto 77049’52.904’E 31035’12.306’’N. Western side of Eco-sensitive Zone is aligned with Ecosensitive Zone of Great Himalayan National Park and Sarahan Range of Rampur Territorial Forest Division B. (2) Himalayan Blue Sheep (Pseudois nayaur): Also known as Bharal or Himalayan Blue Sheep, this species is endemic to the Himalayan region and can be found in parts of Himachal Pradesh. Birds

(1) Himalayan Snowcock (Tetraogallus himalayensis): This large game bird is endemic to the western Himalayas and can be found in rocky and alpine habitats, including parts of Himachal Pradesh.

(2) Himalayan Quail (Ophrysia superciliosa): This elusive and critically endangered bird species is endemic to the western Himalayas, including parts of Himachal Pradesh. It prefers dense grasslands and shrubby habitats.

(3) Himalayan Monal (Lophophorus impejanus): The Himalayan Monal is a colorful pheasant species endemic to the western Himalayas, including parts of Himachal Pradesh.
