1. (1) These rules shall be called the Export of Fresh, Frozen and Processed Fish and Fishery Products (Quality Control and inspection and Monitoring) (Amendment) Rules, 2011.
(2) They shall come into force after two months from the date of their publication in the Official Gazette.
2. In the Export of Fresh, Frozen and Processed Fish and Fishery Products (Quality Control and Inspection and Monitoring) Rules, 1995, (hereinafter referred to as the principal rules) in Para 2, relating to definitions, after sub-rule 2.22, the following sub rules shall be inserted, namely, - “2.23 — ‘Aquaculture Farm’ means the area where aquatic animals like shrimp, prawn, fish or any other aquatic life are kept under controlled conditions in ponds, pens, enclosures, coastal areas or otherwise, in saline, brackish or fresh water so as toIncrease their size or weight.
" “2.24 - ‘Hatchery’ means any premises for breeding, hatching or rearing of Finfish and Shellfish through their early life stages under controlled conditions."
“2.25 - ‘Feed Mill’ means any premises for mixing, mincing and extruding ingredients for making feed for Finfish and Shellfish.” “2.26 - ‘Feed’ means any substance or product, including additives, whether processed, partially processed or unprocessed, intended to be used for oral feeding to Finfish and Shellfish.” [WWII—E113 3(ii)] qua an m : mm s “2.27 -. ‘Registering Authority’ means any authority authorized I designated I recognized by the ‘Competent Authority’ tovregister aquaculture farms I hatcheries I feed mills / fishing vessels I freezer vessels / factory vessels I landing centers I establishments.”
3. In the principle rules, in rule 3, for the words ‘industry‘, “processor" and "establishments”, the following shall be substituted, namely,-' “establishments / landing centers I factory vessels I freezer vessels / fishing vessels / aquaculture farms / hatcheries / feed mills”.

4. in the principal rules, in rule 6, for sub-rule 6.2, the following shall be substituted, namely, - “6.2 They must comply with the requirements laid down under 4.1, 4.2 and 4.4 to 4.9, as applicable to aquaculture products.” ‘
5. ln the principal rules, in rule 6, for sub rule 6.3 the following shall be substituted, namely, - “6.3. The establishment shall procure aquaculture products only from farms registered with authorities authorized I designated by the Competent Authority."
6. In the principal rules, in rule 6, after sub-rule 6.3. the following sub rules shall be inserted namely, - “6.4, The aquaculture farm shall procure juvenile fish or crustaceans caught when juvenile only from hatcheries duly registered with the registering authority and approved and monitored by the competent authority.
6.5 The aquaculture farm and hatcheries shall procure feed only from feed mills duly registered with the registering authority and approved and monitored by the competent authority."
7. In the principal rules, in rule 9, in sub-rule 9.6 and in sub—rule 9.6.1. for the word ”establishment", wherever it occurs, the following shall be substituted, namely,- “establishment I factory vessel I hatchery I feed mill".
8. In the principal rules, in rule 11, for the words “establishments/factory vessels”, ”- wherever they occur, the following shall be substituted-namely, — “establishments I landing centers I factory vessels / freezer vessels I fishing vessels I aquaculture farms/ hatcheries I feed mills”.
9. In the principal rules, for rule 12, the following shall be substituted, namely, - “12. The competent authority may take assistance of representatives from Marine Products Export Development Authority (MPEDA) and / or any other organization, in the matter of approval of establishment I landing center I factory vessel / freezer vessels / fishing vessels / aquaculture farm I hatchery I feed mill.” Icy/a 61/1/22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART “41:12. 3(ii)]
10. In the principal rules, 1..in sub-rule 12.2, for the words ”establishments/factory vessels", wherever they occur, the following shall be substituted, namely, - “establishments /" factory vessets I freezer vessels".
11. in the principalrrules, ,in mule v1.3, :for the words “establishment/factory vessel", wherever they occur, the folloWing shail be substituted, namely, - “establishments :/ landing mnters / factory vessels / freezer vessels / fishing vessels/ aquaculture farms / hatcheries / feed mills".
