MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE ORDER New Delhi, the 3rd October, 2018 SD. 5097(E).—Whereas, by an Order of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 2266(E), dated the 20th August, 2015, the Central Government had constituted the Andaman and Nicobar Coastal Zone Management Authority for a period of three years and the term of the said Authority has since expired on 19th August, 2018: And, whereas, the Central Government is of the view that the Authority must be reconstituted: Now, therefore, in exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereinafter referred to as the said Act), the Central Government hereby constitutes the Andaman and Nicobar Coastal Zone Management Authority (hereinafter referred to as the Authority) consisting of the following persons, for a period of three years, with effect from the date of publication of this order in the Official Gazette, namely:- S. (6) Secretary (Fisheries), Andaman and Nicobar Administration or Member, eX-officio; his nominee
(7) Secretary (Tourism), Andaman and Nicobar Administration or Member, eX-officio; his nominee

2. The Authority shall have its headquarter at Port Blair. 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
3. The quorum of the meeting of the authority shall be one third of the total number of its members.
4. A member, other than an ex-officio member, shall be paid allowances as per the norms decided by the Central Government.
5. The Authority shall, for the purpose of protecting and improving the quality of the coastal environment and preventing, abating and controlling environmental pollution in the Coastal Regulation Zone areas in the Union territory of Andaman and Nicobar, shall take the following measures, namely: -
(a) the Authority shall, after receiving the application for approval of project proposal, examine the same if it is in accordance with the approved Island Coastal Regulation Zone (hereinafter referred to as ICRZ) and Integrated Islands Management Plan (hereinafter referred to as IIMPs) and within the requirements of the Island Protection Zone (hereinafter referred to as IPZ) Notification issued by the Government of India in the erstwhile Ministry of Environment and Forests vide number 8.0. 20(E), dated the 6th January, 2011 (hereinafter referred to as the said notification), and make recommendations for approval of such project to the concerned authority as specified in the said notification, within a period of sixty days from date of receipt of such application;
(b) the Authority shall regulate all developmental activities in the IPZ areas as specified in the said notification;
(c) the Authority shall be responsible for enforcing and monitoring the provisions of the said notification;
(d) the Authority shall examine the proposals received from the Union territory Administration for changes or modifications, in the classification of IPZ areas, and in the ICRZ and IIMP and make specific recommendations thereon, to the National Coastal Zone Management Authority;
(e) the Authority shall inquire into cases of alleged violation of the provisions of the said Act and the rules made thereunder; and review the cases involving violations or contraventions of the provisions of the said Act and the rules made thereunder;
(f) the Authority shall inquire or review cases of alleged violations or contraventions of the provisions of the said notification suo-moto, or on the basis of a complaint made by any individual or body or organization and take appropriate action as per the law;
(g) the Authority is authorized to file complaints under section 19 of the said Act;
(h) the Authority shall take such action as may be required under Section 10 of the said Act to verify the facts of the cases before it.
6. The Authority shall, for the purpose of maintaining transparency in its functioning, create a dedicated website and post on information relating to its function, including the agenda, minutes of the meetings, decisions taken, in each meetings, recommendation for matters on violations and contraventions of the said notification and the actions taken on such violations and contraventions, court matters, including the orders of the courts and the approved ICRZ and IIMPs of the Union territory of Andaman and Nicobar.
