52.7 दक.मी. का खण्ड जो िाष्ट्रीय िाजमार्ग -6 पि एक ओि हधल्िया पत्तन को औि िसूिी ओि कोलाघाट को जोड़ता ह,ै भाितीय िाष्ट्रीय िाजमार्ग प्राधिकिण (धजसे इसमें इसके पिात प्राधिकिण संिर्भगत दकया ह)ै को सौंपा ह;ै औि यतः, कें द्रीय सिकाि न,े िाष्ट रीय िाजमार्ग शुल्क (ििों का अविािण औि संग्रहण) धनयम, 2008 के धनयम (3) के साथ परित िाष्ट रीय िाजमार्ग अधिधनयम, 1956 (1956 का 48) की िािा 7 द्वािा प्रित्त शधियों का प्रयोर् किते हुए भाित सिकाि की अधिसूचना का.आ. संख्या 115(अ) तािीख 09 जनविी, 2013 द्वािा, धजसमें अधिसूचना का.आ. संख्या 896(अ) तािीख 26.03.2014 की क्रम संख् या 84 द्वािा द्वािा यंशोिन दकया र्या ह,ै प्राधिकिण को पधिम बंर्ाल िाज्य में िाष्ट्रीय िाजमार्ग संख्या - 41 की सड़क की धनवल लंबाई 52.70 दक.मी.
के धलए यांधत्रक वाहनों पि शुल्क उिग्रहीत औि संग्रहीत किने हतेु प्राधिकृत दकया ह।ै औि यतः, प्राधिकिण ने, भाितीय िाष्ट रीय िाजमार्ग प्राधिकिण अधिधनयम, 1988 (1988 का 68) की िािा 14 के प्राविान के अनसुिण में, पधिम बंर्ाल िाज्य में िाष्ट्रीय िाजमार्ग 41 के कोलाघाट हधल्िया सेक् शन (0.000 दकमी से 52.080 दकमी तक) के प्रचालन औि अनुिक्षण हते ु 31.01.2017 को प्रस्तुत बोली के धलए 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] प्रचालन, अनुिक्षण औि हस्तांतिण (ओएमटी) आिाि पि मैसेसग ईर्लिीप कोलाघाट हधल्िया ओएमटी प्रोजेक्ट प्राइवेट धलधमटेड धजसका पंजीकृत कायागलय बी.के.- सखं्या 758, संख्या 16, प्लॉट- संख्या-59, चोपिा कोटग के धनकट, उल्हासनर्ि, 3 िाणे- 421003, धजला िाणे (महािाष्ट्र) में ह ै(धजस ेइसमें इसके पिात उि किाि संिर्भगत दकया र्या ह)ै, के साथ किाि दकया हशै , अतः अब, कें द्रीय सिकाि, िाष्ट्रीय िाजमार्ग शुल्क (ििों का अविािण औि संग्रहण) धनयम, 2008, धजस े सा.का.धन. 838(अ), तािीख 5 दिसम्बि, 2008, द्वािा प्रकाधशत दकया र्या था तथा बोली प्रस्तुत किने की तािीख तक इसमें दकए र्ए संशोिनों सधहत (धजस ेइसमें इसके पश् चात ‘’धनयम’’ संिर्भगत दकया र्या ह)ै के धनयम 3 के साथ परित िाष्ट्रीय िाजमार्ग अधिधनयम, 1956 (1956 का 48) की िािा 8-क द्वािा प्रित्त शधियों का प्रयोर् कित े हुए औि अधिसूचना संख्या का.आ. 115(अ), तािीख 09 जनविी, 2013 धजसमें शुल्क अधिसूचना का.आ. 896(अ) तािीख 26 माचग, 2014 की क्रम संख्या 84 द्वािा संशोिन दकया र्या ह,ै का अधिक्रमण किते हुए, धसवाय उन बातों के जो ऐस ेअधिक्रमण से पूवग कि ली र्ईं हैं या किने स ेलोप किा िी र्ईं हैं, उि खंड के अनिुक्षण, प्रबंि औि प्रचालन में धनधहत व् यय, धनवेधशत पंूजी पि ब्याज, युधियुि प्रत्यार्म, यातायात का िवाब तथा प्राधिकिण एवं रियायतग्राही के बीच हुए उि किाि की अवधि को ध्यान में िखते हुए एतिद्वािा अधिसूधचत किती ह ैदक सारिणी 1 में धवधनर्िगष्ट ट यांधत्रक वाहनों पि सड़क खंड की धनवल लंबाई 50.484 दक.मी. 3. धजस व्यधि का अपना यांधत्रक वाहन, रै्ि-वाधणधज्यक प्रयोजनों के धलए पंजीकृत हुआ हो औि वह टोल प्लाजा से बीस दकलोमीटि तक की ििूी में ही िहता हो, उसके धलए विग 2017-18 के धलए माधसक पास की िि 245.00/- रूपए (िो सौ पैतालीस रूपए मात्र) होर्ी औि िाष्ट्रीय िाजमार्ग शुल्क (ििों का अविािण औि संग्रहण) धनयम, 2008 के उपबंिों के अनुसाि उसमें प्रत्येक विग संशोिन दकया जायेर्ा ।
4. िाजमार्ग खण्ड पि बहुयात्रा प हतेु पास धनम्नधलधखत ििों पि जािी दकया जाएर्ा, अथागत ः संिेय िाधश अनुज्ञात एकतिफा यात्रा प की अधिकतम संख्या धवधिमान्यता की अवधि एकतिफा यात्रा के धलए शलु्क का डेढ़ र्ुना िो संिाय के समय से चैबीस घंटे पचास औि उससे अधिक एकल यात्रा प के धलए संिेय शुल्क की िाधश का िो-धतहाई पचास या अधिक संिाय की तािीख से एक मास
5. धजस धजले में शुल्क प्लाजा पड़ता ह ैउस धजले में पंजीकृत वाधणधज्यक वाहन (िाष्ट्रीय पिधमट के अिीन चल िह े वाहनों को छोड़कि) के धलए शुल्क उस शे्रणी के धलए वाहन के धलए धनिागरित शुल्क का 50% होर्ा बशते दक ऐसे वाधणधज्यक वाहनों के उपयोर् के धलए कोई सर्वगस िोड अथवा वैकधल्पक सड़क उपलब्ि न हो । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
6. जो यांधत्रक वाहन अपनी शे्रणी के धलए धनिागरित अनजु्ञेय भाि की अपेक्षा अधिक भाि स ेलिा हुआ होर्ा उसके चालक अथवा माधलक अथवा प्रभािी व्यधि को ऐसे अधिक भाि से लि ेहुए वाहन को िाष्ट्रीय िाजमार्ग में प्रवेश किाने के धलए शुल्क संग्रहण एजेंसी को ऐसी शे्रणी के यांधत्रक वाहनों के धलए लार् ूशुल्क के िस रु्ना के बिाबि शुल्क का भुर्तान किना होर्ा औि उस ेिाजमार्ग खण्ड का उपयोर् किने की तब तक अनुमधत नहीं होर्ी जब तक दक ऐसे यांधत्रक वाहन से अधिक भाि को हटा नहीं दिया जाता।
7. यांधत्रक वाहनों की शे्रणी, उनके धलए अनुज्ञेय भाि, छूट-प्राप्त वाहनों की शे्रणी, सर्वगस िोड, वैकधल्पक सड़क आदि सधहत सभी परिभािाए ंधनयमों में धवधनर्िगष्ट परिभािा प के अनसुाि होंर्ी ।
8. उि धनयमों के धनयम 12 के अनुसाि, उपयोर्कताग प की जानकािी के धलए शुल्क की ििों को प्रिर्शगत दकया जाएर्ा ।
9. ऊपि सारिणी-1 में यथा – उधल्लधखत आिाि विग 2007-08 के धलए प्रधत दकलोमीटि शुल्क की आिाि िि के आिाि पि, यांधत्रक वाहनों के धलए जान ेवाल ेवास्तधवक शुल्क औि कटौधतयों की र्णना प्राधिकिण द्वािा की जाएर्ी। प्राधिकिण द्वािा उसे रियायतग्राही के माध्यम से अंगे्रज़ी औि स्थानीय भािा के कम-से-कम एक-एक समाचाि पत्र में प्रकाधशत किवाया जाएर्ा औि इसके तत्पिात उि धनयमों के धनयम 5 औि रियायत किाि के प्राविानों के अनसुाि उसमें वार्िगक तौि पि संशोिन दकया जाएर्ा औि ओएमटी रियायतग्राही के माध्यम से प्रकाधशत किवाया जाएर्ा, पिंतु शतग यह ह ैदक शुल्क में धपछली बाि दकए र्ए संशोिन दक तािीख से 6 (छ) महीने दक अवधि के भीति कोई संशोिन नही दकया जाएर्ा।
10. 01.07.2017 के अनसुाि, वाधणधज्यक प्रचालन दक तािीख स ेपरियोजना की वसूल की जान ेवाली पंूजीर्त लार्त का वतगमान मूल् य 449.12* (चाि सौ उनंचास किोड़ बािह लाख रुपये मात्र) ह।ै वाधणधज्यक प्रचालन (सीओडी) की तािीख स,े टोल का संग्रहण रियायतग्राही द्वािा िाष्ट्रीय िाजमार्ग शुल्क (ििों का अविािण औि संग्रहण) धनयम, 2008 तथा बोली की धनयत तािीख तक उसमें दकए र्ए संशोिनों के अिीन िी र्ई व्यवस्था के अनुसाि, लार् ूििों पि दकया जाएर्ा। पंूजीर्त लार्त की वसूली रियायत शुल्क के माध्यम से वाधणधज्यक प्रचालन की तािीख को एन वी पी को प्राप् त किन ेहतेु 12% प्रधतविग की िि से छूट िते ेहुए की जाएर्ी। परियोजना की वाधणधज्यक प्रचालन की अनंधतम तािीख 01.07.2017 ह।ै धजस दिन पंूजीर्त लार्त की वसूली हो जाएर्ी उस दिन से धलए जान ेवाल ेप्रयोिा शुल्क की ििों को घटाकि 40% कि दिया जाएर्ा। रियायत शुल्क को भी िये िाधश से घटाकि 40% कि दिया जाएर्ा तथा खंड 21.1.1 के अनुसाि 10% की वार्िगक वधृि भी लार् ूहोर्ी। *रटप्पणी: धजसमें, िा िा – 41 के अंत में चनैेज 52.080 से 53.472 तक िानीचक पि आिओबी-सह- फ़्लाइओवि (धनमागणािीन) पि धवचाि कित े समय आिओबी-सह-फ़्लाइओवि की लार्त को जोड़त े हुए संशोधित शुल्क अधिसूचना जािी किने के समय भािािाप्रा द्वािा दकए जा िह ेआिओबी-सह-फ़्लाइओवि के धनमागण कायग पूिा हो जाने पि, अलर् से संशोिन दकया जाएर्ा । [फा. स.ं भािािाप्रा/13013/सीओ/17-18/जीसी- कोलाघाट-हधल्िया (ओएमटी)] िधक्षता िास, संयुक् त सधचव II (ii) 5 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 26th July, 2017 S.O. 2341(E).—Whereas, vide notification of the Government of India in the erstwhile Ministry of Surface Transport ( Roads Wing), number S.O. 581(E), dated the 21 st June, 2001, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the
52.7 Km. stretch of National Highway No. 41 connecting Haldia Port on one end and Kolaghat on NH-6 on other end in the state of West Bengal to the National Highways Authority of India (hereinafter referred to as the Authority) ;
And Whereas, in exercise of the powers conferred by section 7 of the National Highways Act 1956(48 of 1956) read with the Rule (3) of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the Central Government by notification of the government of India vide S.O. No.
115 (E) dated 09 th January, 2013 and amended vide Sl. No. 84 of S.O. No. 896 (E) dated 26.03.2014 notification has authorized Authority for levying and collecting fee on mechanical vehicles for net road length of 52.70 Km. of National Highway number 41 in the State of West Bengal.
And Whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an agreement (hereinafter referred to as said agreement) on 09.05.2017 with M/s Eagledeep Kolaghat Haldia OMT Project Private Ltd having its registered office at B.K. No. 758, No. -16, Plot No. 59, Near Chopra Court, Ulhasnagar, 3 Thane-421003, District Thane (Maharashtra) (hereinafter referred to as the “Concessionaire”), for bids submitted on
31.01.2017 for the Operation and Maintenance of Kolaghat Haldia section (from km 0.000 to km 52.080) of NH-41 in the state of West Bengal (hereinafter referred to as the “said section”) on Operation, Maintenance & Transfer (OMT) basis;
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and its amendment till bid submission date (hereinafter referred to as the “Rules”), (hereinafter referred to as the “Rules”) and in supersession of the notifications number S.O. 115(E) dated 09 th January, 2013 as amended vide Sl. No. 84 of fee notification S.O. No. 896(E) dated 26 th March, 2014 except as respect things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles, specified in Table 1 for net road section length of 50.484 km. {excluding 1.596 Km of structure (having length more than 60 m) with equivalent length of 15.96 km} (hereinafter referred to as “base rate”) for use of the four and more lane sections on the Type of Vehicles specified in column (1) of Table 1 below and authorizes the said Concessionaire to collect and retain the fee for the use of the said section on and from the date of commercial operation declared by the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the Agreement;

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plazas for the distance specified for each such Toll Plaza:

2. In addition to the above, the fee levied and collected hereunder for the permanent bridge (s) and /or Structures, as the case may be, having length of 60m or more as specified below shall be due and payable at the following Toll Plaza(s):

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 245.00 (Rupees Two Hundred and Forty-five only) for the year 2017-18, which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
7. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.
8. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules.
9. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the Concessionaire and thereafter revised and got published annually through the OMT Concessionaire in accordance with the Rule 5 of the said Rules and provisions of the Concession Agreement, and will be published; provided, however, that no revision shall be effected within a period of 6 (six) months from the date of the preceding revision of Fee.
10. The Present Value of Capital Cost of the project to be recovered from the date of COD is Rs. 449.12* Crore (Rupees four hundred forty-nine crore and twelve lakh only) as on 01.07.2017. From the Commercial Operation Date (COD) toll shall be collected by the Concessionaire at the applicable rates provided under the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and further amendments till bid due date. The Capital Cost shall be recovered through Concession Fee by discounting @ 12% per annum to arrive at NPV as on the date of commercial operation (COD). The tentative COD for the project is 01.07.2017.
After the day on which the Capital Cost is recovered the toll rates chargeable shall be reduced to 40% of the rate being charged. The Concession Fee shall also be reduced to 40% of the amount payable and annual increment of 10% as per Clause 21.1.1 shall be applicable.
*Note: Which will be revised separately on completion of construction of ROB cum Flyover being taken up by NHAI at the time of issuance of the revised toll notification by adding the cost of ROB cum Flyover at the time of considering the ROB cum Flyover at Ranichak (under Construction) at Chainages from 52.080 to 53.472 at the end of NH-41.
