'660 (E) dated the 27th September, 1996, SO 78 (E), dated the 4"1 February, 1999 and SO 239 (E), dated the 24th March, 1998 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretches from Km

3.400 — Km 75.000 (Vijayawada — Eluru section), Km 75.000 — Km 395.870 (Vijayawada — Visakhapatnam section) and Km 354.775 — Km 434.150 (Chilakaluripet — Vijayawada section) of National Highway Number —5 in the State of Andhra Pradesh, to the National Highways Authority of India (hereinafter referred to as the “Authority”);

And whereas, in exercise of the powers conferred by section 7 of the National Highway Act 1956 (48 of 1956) read with National Highways (Fees for the Use of National Highways Section and Permanent Bridge - Public Funded Project) Rules, 1997, National Highways (Rate of Fee) Rules, 1997 and National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central Government by notification of the Government of India authorized the Authority for levying and collecting fee on mechanical vehicles for the use of stretch Vide 5.0. No. 2170 (E) dated 12th September, 2012 for the stretch from km. 3.400 to km. 42.500 (new chainage from km 1100.694 to km 1061.594) and from krn 42.500 to km 81.600 (new chainage from km 1061.594 to km 1022.494) on National Highway No. 5 in the State of Andhra Pradesh.

And whereas, pursuant to the provision of section-14 of the National Highways Authority of India Act (68 of 1988) the Authority has entered into an Agreement (hereinafter referred to as said Agreement) with M/s Vijayawada Gundugolanu Road Project Pvt.

Ltd., having its registered office at 2"d Floor, Centric Plaza, Plot No. 8, Pocket 4, Sector 11, Dwarka, New Delhi - 110 075, India (hereinafter referred 'to as the “Concessionaire”), the successful bidder for bids submitted on 24'h January, 2012 for the development of six laning of Vijayawada - Gundugolanu Section from Km 27.600 — Km

81.600 ( new chainage Km 1076.480 - Km 1022.480) including six lane Hanuman Junction bypass and four lane Vijayawada bypass taking off at Km 27.600 ( new chainage Km 1076.480) and merging at Km 422.800 ( new chainage Km 1112.044) of the National Highway number 5 and Operation and Maintenance thereof (hereinafter referred to as the “said section”) in the state of Andhra Pradesh on Design, Build, Finance, Operate and Transfer (DBFOT) basis;

Now, therefore, in exercise of the powers. conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5m December, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011 and G.S.R. 756 (E) dated 12th October, 2011 (hereinafter referred to as the “Rules”), and in supersession of the notification bearing No. 5.0. 2170 (E) dated 12th September, 2012 except as respects things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the Agreement entered into between the Authority and the THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section for use of the four and more lane sections (hereinafter referred to as “base rate") and at the base rates specified in the Table No. 2 for bridges/structures costing Rupees Fifty Crore or more and at one and half times the base rate for bypasses costing Rupees ten crore or more on the Type of Vehicles specified in Table 1 and 2 below and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement.

4. As regards bridges & bypasses costing Rs. Fifty crore or more and costing Rs. 10 crore or more respectively as specified in note 2 & 3 above, the fee levied shall be due and payable only after completion of such bypasses & structures.

5. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 200.00 (Rupees Two Hundred only) for the year 2012—13 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

6. For multiple journeys on the highway section, passes shall be issued at the following rates, namely.

7. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

8. Mechanical vehicles which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

9. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.

10. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.

11. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 & 2, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within six months and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
