attr'nnmrf taunt) an? afurfim WHEN“. 144(31), Hl'fl'él 28 await 2004 W, manta Wfimmg,fi%@fiwummwémmfimnfimwél MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION , 7 New Delhi, the 12th September, 2012 502170(El-jj Whereas, vide notification of the Government of India in the erstwhile Ministry of Surface " Tiéhépsn (Roads Wing) number so. 660 (E), dated the 27‘h September, 1996 and so 78(E) dated 4'11- February, 1999 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government, entrusted the stretches firom Km 3.400 — Km 75.000 (Vijayawada to Eluru section) and flom 1cm 75.000 to 1cm 395.870 (Vijayawada to Visakhap'atnam section) ofNational Highway No. 5, in the State of Andhra Pradesh, to the National Highways Authority of India ( hereinafter referred to as the “Authority”);

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereafler referred to as the “said Rules”), the Central Government hereby levies the fee at the rates specified in column (2) of the Table 1 for net road section length of 78.200 kilometer (hereinafter referred to as “base rate”) for use of the four and more lane sections on the Type of Vehicles specified in column (1) of Table 1 below, for the use of the section flom kilometer firom Km 31400 — Km 42500 (new chainage fiom kilometer 1100.694 to kilometer 1061.594) and fiom kilometer 42.500 to kilometer 81.600 (new chainage fiom kilometer 1061.594 to kilometer 1022.494) (Vijayawada to Gundugolanu) on the National Highway No. 5 in the State of Andhra Pradesh and authorises the Authority to collect, either .

through its officials or through a contractor, the said fee. namely:- TABLE 1 Base rate of fee per km for Type of Vehicles the base year 2007-2008 (in Rs.)

(1) (2) Car, Jeep, Van or Light Motor Vehicle 0 65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1 05 Bus or Truck (Two Axles)

2.20 Three-axle commercral vehicles

2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) 3 45 or Multi Axle Vehicle (MAV) (four to six axles) ' Oversized Vehicles (seven or more axles) 4 20 Notes:

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plazas for net road length specified for such Toll Plaza:

Location of Toll Plaza (chainage) Lengrh (in km) for which Fee is payable Kin/Ch. at km 1075.244 (near Village Pattipadu 39.100 in Krishna District) Kin/Ch. at km 1050.794 (near Village Kalaparu 39.100 in East Godavari District)

2. The rate of monthly pass for local personal traffic is Rs. 200.00 (rupees Two Hundred only) for the year 2012-13 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

3. For multiple journey on the highway section, passes shall be issued at the following rates, namely.

Amount Payable Maximum number of one Period ofvalidity way journeys allowed ., One and half times of the fee for Two Twenty four hours from the one way journey time ofpayment Twovthird of amount of the fee Fifty One month from date of payable for fifty sirgle journeys payment

4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

5. Mechanical vehicles which is loaded in excess ofpermissible load specified for its category under the rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

6. All definitions including categoiy of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.

7. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.

8. The fee rates shall be revised annually in accordance with the rule 5 of the said rules.

9. The estimated capital cost of the project is Rupees 365.77 crores. The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.

10. The rate of fee for the use of a section of a national highway consisting ofbypass or tunnel constructed on or after 11'“ September, 1956 but before 5‘h December, 2008, through public funded project or build, operate and transfer (annuity) project, shall be the same, as provided in sub-rule (2) and (3) for the Section of a national highway, and, shall be revised in accordance with the provisions of rule 5.

‘ ‘« Provided that notwithstanding whether the Section of the national highway or the bridge has been ' taken for further lane upgradation or not, the increase in the rate of fee for use of a Section of such national highway, permanent bridge, bypass or tunnel constructed through any public fimded project or any build, operate and transfer (annuity) project constructed before the commencement of the said rules, shall not be increased after the commencement of the National Highways Fee (Determination of Rates and Collection) Second Amendment, Rules, 2011 by more than twenty-five per cent of the rates of fee applicable immediately before such commencement and further annual increase shall in no case be more than twenty—five per cent of the rate applicable in the immediately preceding year.” [RNo.NHAI/l3013/21/02-03/CO/GC Vijayawada] ' NANDAN smon, Dy.
