PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 599] ubZ fnYyh] eaxyokj] iQjojh 28] 2017@iQkYxqu 9] 1938 No. 599] NEW DELHI, TUESDAY, FEBRUARY 28, 2017/PHALGUNA 9, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ली, 21 फरवरी, 2017 (लोनार व᭠ यजीव अ᭤ यार᭛ य) का.आ. 668(अ).—ᮧाᱧप अिधसूचना, भारत के राजपᮢ, असाधारण, मᱶ भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 3126 (अ), तारीख 20 नवंबर, 2015, को ᮧकािशत कᳱ गई थी, िजसमᱶ उन सभी ᳞िᲦयᲂ से िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको भारत के राजपᮢ मᱶ ᮧकािशत अिधसूचना कᳱ ᮧितया ं जनता को उपल᭣ध कराई गई थᱭ, साठ ᳰदन कᳱ समाि᳙ के पूवᭅ आᭃेप और सुझाव आमंिᮢत ᳰकए गए थे;
और, कᱶ ᮤीय सरकार ᳇ारा उᲦ ᮧाᱧप अिधसूचना के ᮧ᭜युᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर स᭥यक् ᱨप से िवचार ᳰकया गया;
और, लोनार व᭠ यजीव अभयार᭛ य महारा᭬ ᮝ रा᭔य के बु᭨डाना मᱶ लोनार मंथा रा᭔य राजमागᭅ सं. 171 के दािहन ेओर अवि᭭थत ह ै और 3.83 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ ह;ै और, लोनार व᭠यजीव अभयार᭛य कᳱ सीमा महारा᭬ ᮝ रा᭔य के बु᭨डाना मᱶ ि᭭थत उᱫर अᭃांश 19° 58´ 40” से 19° 58´ 42” और पूवᭅ दशेांतर 76° 31´ 45” से 76° 31´ 56” के बीच ि᭭थत ह;ै और, लोनार व᭠यजीव अभयार᭛य पाᳯरि᭭थितक दिृ᳥ से मह᭜वपूणᭅ ह ैजो डेᲥन ᮧाय᳇ीप के 6 बी कᱶ ᮤीय पठार के जैिवक ᮧावधानᲂ का ᮧितिनिध᭜व करता ह ैऔर मौसमी ᮧभाव के कारण लोनार झील बसाि᭨टक चᲵान से िनᳶमत तीसरी झील ह;ै और, व᭠ यजीव अभयार᭛ य मᱶ िविवध ᮧकार के जीव-जंतुᲐ और वन᭭पितयᲂ के अनेक पयाᭅवास ह ᱹऔर इस अभयार᭛य कᳱ मुय वन᭭पितयᲂ मᱶ साग (टेटोना ᮕंिडस), लᱶडी (लगेर᭭टरवेिमया पावᱮ᭢लोरा), टे᭥भुनी (ᳰदओ᭭᭡ᮬोस मेलानोसयलᲂ), अंजन, शंखपु-शिप (एवॉ᭨वुलस ए᭨सीिनइ᭙स), अशोका, बहडेा, बफूल, बेल, चंदन (संतालम ए᭨बम), धावड़ा(अनोगेइससूस लाितफोिलया), हीवर सलाई (बो᭭वेिलया सेररता), आइन(टमᱮनािलया इिलपᳯटका), तारवाद(सीना ऑᳯरयूलता) और पलास(᭣यूटी मोनो᭭पमाᭅ) और जीव-ज᭠तुᲐ कᳱ एक िविवधता तᱶदआु(पᱶथेरा पाडᭅस), लकड़बघा(᳭ैना ᳭ैना), भेिड़या(कैिनस लुपुस पैि᭨लपेस), जंगली िब᭨ली(फेिलस चूस), बंदर(रेसस मकके),(मᲥा मुलᱫा), िगलहरी आᳰद ह;ᱹ और, लोनार अभयार᭛य के भीतर एक झील लोनार झील के ᱨप मᱶ जानी जाती ह ैजो बेसा᭨ट चᲵान से गᳯठत उ᭨का ᮧभाव के कारण तीसरी सबसे बड़ी झील ह ैऔर यह ᭭थान भू-ᱧपा᭜मक दिृ᳥ से मह᭜वपूणᭅ ह ैऔर शोधकताᭅᲐ को इसके िवरचना के संबंध मᱶ शोध करने के िलए आकᳶषत करता है;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, लोनार व᭠यजीव अभयार᭛य भारतीय पुरात᭜व सवᱷᭃण ᳇ारा पुराताि᭜वक ᭭मारकᲂ मᱶ पहचाना जाता ह ैजो ऐितहािसक मंᳰदरᲂ के ᱧप मᱶ ह;ᱹ और, लोनार व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ कᳱ सीमा 100 मीटर तक, पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, महारा᭬ ᮝ रा᭔य मᱶ लोनार व᭠ यजीव अभयार᭛य कᳱ सीमा से 100 मीटर तक के िव᭭ तार तक के ᭃेᮢ को लोनार व᭠ यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत् :--
1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाए-ं-(1) पाᳯरि᭭थितक संवेदी जोन लोनार व᭠यजीव अभयार᭛य कᳱ सीमा के चारᲂ ओर 100 मीटर तक कᳱ सीमा से 1.92 वगᭅ ᳰकलोमीटर ᭃेᮢ तक फैला ᱟआ ह ैऔर ऐसे जोन कᳱ सीमा का वणᭅन उपाबधं–I मᱶ ᳰद या गया है ।
(2) पाᳯरि᭭थितक संवेदी जोन महारा᭬ ᮝ के बु᭨डाना िजला के 1 ᮕाम तक फैला ᱟआ है ।
(3) पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत आने वाले ᮕाम के नाम के साथ मुय िब᭠दᲐु के िनदᱷशांक उपाबंध-II के ᱧप मᱶ उपाब ह ै।
(4) लोनार व᭠यजीव अभयार᭛य और इसके पाᳯरि᭭थितक संवेदी जोन के भू-िनदᱷशांकᲂ के साथ मानिचᮢ उपाबधं-III और III-क के ᱧप मᱶ उपाब ह ै।
2. पाᳯरि᭭थितक संवदेी जोन के िलए आचंिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजनᲂ के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, और इस इस अिधसूचना मᱶ यथा िव िन ᳸द ᭬ ट रीित के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा इसके ᮧभावी ᱧप से कायाᭅ᭠वयन हतेु अनुमोᳰदत होगी ।
(3) ऐसी आंचिलक महायोजना अिधसूचना िविन᳸द᳥ अनुबंध के अनुᱨप तैयार होगी और िजसमᱶ पयाᭅवरणीय िनिहताथᭅ सि᭥मिलत ह।ै
(4) पाᳯरि᭭ थितक संवेदी जोन के िलए आंचिलक महायोजना को रा᭔ य सरकार ᳇ारा इस अिधसूचना मᱶ िविन᳸द᭬ ट रीित मᱶ और सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िसांतᲂ, यᳰद कोई हो, के अनुसार भी तैयार ᳰकया जाएगा A
(5) आचंिलक महायोजना संबंिध त रा᭔ य िव भागᲂ के साथ परामशᭅ से पयाᭅवरणीय और पाᳯर ि᭭ थ ित क िव चारणᲂ को उसमᱶ एकᳱकृत करने के िल ए तैयार कᳱ जाएगी, अथाᭅत्:--
(i) पयाᭅवरण;
(ii) वन और व᭠यजीव;
(iii) कृिष;
(iv) राज᭭ व;
(v) नगर िवकास;
(vi) पयᭅटन;
(vii) ᮕामीण िवकास;
(viii) ᳲसचाई और बाढ़ िनयᮢण;
(ix) नगरपािलका;
(x) पंचायती राज; और

(6) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचिंलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(7) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलुᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(8) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(9) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
(10) इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के संबंध मᱶ कायᲄ के संपादन के िलए मानीटरी सिमित के िलए आंचिलक महायोजना एक िनदᱷश द᭭तावेज होगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा:
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं0. 10, 21, 25, 33 और सं. 34 के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत्:-
(i) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद;
(ii) िव ᳒ मान सड़कᲂ को चौड़ा करना और सुदढ़ृ करना;
(iii) ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग;
(iv) वषाᭅ जल संचय; और
(v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधा भंडार और ᭭थानीय सुख-सुिवधाएं आᳰद सि᭥मिलत ह:ै परंतु यह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात ् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन:वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत - आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पयᭅटन महायोजना, पयᭅटन िवभाग, ᳇ारा रा᭔य सरकार के पयाᭅवरण और वन िवभाग के परामशᭅ से, तैयार कᳱ जाएगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय लोनार व᭠यजीव अभयार᭛य कᳱ सीमा से 100 मीटर के भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अनु᭄ात नहᱭ होगा;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाए ं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण – पयाᭅवरण (संरᭃण) अिधिनयम 1986 के अधीन ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 के उपबंधᲂ के अनुसार पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟विन ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या महारा᳦ रा᭔य िनयंᮢण बोडᭅ िविनयमᲂ को कायाᭅि᭠वत करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, रा᭔य सरकार के पयाᭅवरण िवभाग वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार वायु ᮧदषूण के िनयंᮢण के िलए मागᭅदशᭅक िसांत और िविनयम तैयार करᱶगे ।
(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मागᭅदशᭅक िसांतᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 नगरपािलका ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाए ंतैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा ।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) ᭡लाि᭭टक अपिश᳥ ᮧबधंन: - पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(12) िनमाᭅण और िव᭟वंस अपिश᳥ ᮧबधंन: - पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना जी.एस.आर. 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(13) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधया ं आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होन ेऔर रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होन ेतक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी।
(14) औ᳒ोिग क ईकाईया ं–(i) पाᳯरि᭭थितक संवेदी जोन के भीतर नए का᳧ आधाᳯरत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा िविध के अनुसार ᭭थािपत िव᳒मान का᳧ आधाᳯरत उ᳒ोगᲂ के िसवाए नहᱭ दी जाएगी |
(ii) ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वायु या मृदा ᮧदषूण काᳯरत करने वाले ᳰकसी नए उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा नहᱭ दी जाएगी |
4. पाᳯरि᭭थितक संवदेी जोन मᱶ ᮧितिष या िविनयिमत ᳰᮓयाकलापᲂ कᳱ सचूी - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-- सारणी ᮓम सं. ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
1. वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइया ं। (क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न े कᳱ इकाइया ं वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िसवाय नहᱭ हᲂगी िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संि᳖माᭅण या मर᭥मत के िलए भूिम को खोदना और मकान बनाने के िलए दशेी टाइलᲂ का िनमाᭅण भी सि᭥मिलत ह;ै (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के सवᭅदा अनुसरण मᱶ होगी ।
2. आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
3. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠यथा उपबंिधत के िसवाय) ।
4. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । कोई नई या पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧदषूण फैलाने वाले उ᳒ोगᲂ के िव᭭तार कᳱ अनुमित दी जाएगी। हᳯरत या ᳡ेत कृिष आधाᳯरत लघु उ᳒ोगᲂ सिहत के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ वगᱮकरण के ᱨप मᱶ वगᱮकृत उ᳒ोगᲂ को िनयमᲂ के अनुसार िविनयिमत ᳰकया जाएगा।
5. नई बृहत ताप और जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
6. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
7. जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।

9. कंपिनयᲂ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुᲐ और पो᭨ᮝी फामᲄ कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । िविनयिमत ᳰᮓयाकलाप
10. होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी ᳞वसाय के िलए आवास के संबंध मᱶ पाᳯरि᭭थितक संवेदी जोन के भीतर ही नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ:
तथािप, व᭠य जीव अभयार᭛य कᳱ सीमा से एक ᳰक.मी. से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार लागू मागᭅदशᭅक िसांतᲂ पयᭅटन महायोजना के अनुᱧप होगा ।
11. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ अनुमित दी जाएगी । पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे । (ख) एक ᳰकलोमीटर से आगे आंचिलक महायोजना के अनुᱨप हᲂगे।
12. ᮝेᳲ᭠चग ᮕाउंड । नए ᮝेᳲ᭠ चग ᮕाउंड कᳱ ᭭ थापना ᮧितिष ह ै । पुराने ᮝेᳲ᭠ चग ᮕाउंड को लागू िविधयᲂ के अनुसार िविनयिमत ᳰकया जाएगा ।
13. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा रा᳦ीय उ᳒ान ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत(अन् यथा उपबंिधत के िसवाय) हᲂगे ।
14. वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू- जल संचयन भी है । (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा । (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह ै। (ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा । (घ) ᳰकसी ᮲ोत जल, िजसके अंतगᭅत कृिष भी ह,ै के संदषूण या ᮧदषूण को रोकने के िलए सभी उपाय ᳰकए जाएंगे ।
15. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण। जब तक आंचिलक महायोजना के अधीन अनु᭄ात न ᳰकया जाए जब तक 1 से 10 मीटर के पहाड़ी ढलानᲂ पर और ᳰकसी नदी तट और ᮧाकृितक नाले से 100 मीटर तक कोई संि᭠ न माᭅण ᳰᮓयाकलाप नहᱭ ᳰकया जाएगा।
16. वायु और यािनक ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
17. ᭟ विन ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

19. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी । (ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ कᳱ दशा कायᭅयोजना मᱶ ᳰदए गए िववरण का अनुसरण ᳰकया जाएगा ।
20. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण ।
(i) 33 केवी के ऊपर पारेषण लाइनᲂ और िवतरण लाइनᲂ को िबछाना।
(ii) ᮕामᲂ और ᮕामीण ᭃेᮢᲂ के िलए केबल जहाँ िबजली नहᱭ ह ैवहाँ नया िबजली और केबल उ᭜थापन के िलए अनु᭄ात ᳰकया जाएगा ।
(iii) िव᳒मान िव᳒ुत लाइनᲂ का संवधᭅन और नवीनीकरण को अनु᭄ात ᳰकया जाएगा ।
(iv) भूिमगत केबल लगाने को बढ़ावा ᳰदया जाएगा।
21. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना । उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠यूनीकरण उपाय यथा लागू अनुसार हᲂगᱶ।
22. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । पाᳯरि᭭थितक संवेदी जोन के भीतर व᭠यजीव के अबाध चलन को अनु᭄ात करने के िलए होटलᲂ या अ᭠य वािणि᭔यक ᭭थापनᲂ को कांटेदार तार से उनकᳱ संपिᱫयᲂ कᳱ बाड़ नहᱭ लगाई जाएगी और कोई भी बाड़ एक मीटर से अिधक कᳱ नहᱭ होगी तथा इस अनुबंध का अनुपालन न करने वाली िव᳒मान बाड़ को आंचिलक महायोजना मᱶ उि᭨लिखत समय सीमाᲐ के अनुसार उपांतᳯरत ᳰकया जाएगा ।
23. वन उ᭜पादᲂ और गैर का᳧ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
24. िवदेशी ᮧजाितयᲂ को लाना लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन मᱶ दशेीय माल से उ᭜पादᲂ का उ᭜पादन करने वाले गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत दशेीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात ᳰकए जाएंगे ।
26. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । झील मᱶ शािमल होने के िलए, पानी कᳱ धारा के िम᮰ण से िनपटाने, आंिशक ᱨप से अपिश᳥ को रोकने से िनपटान के िलए ᳰकए जाने वाले ᮧयास। उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
27. वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. ठोस अपिश᳥ ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
29. कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । संवᳶधत ᳰᮓयाकलाप
30. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन। सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
31. जैिवक कृिष। सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।

5. पाᳯरि᭭थितक संवदेी जोन मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, महारा᳦ रा᭔य के अ᭠तगᭅत आने वाली पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन तीन वषᭅ कᳱ अविध के िलए करती है, जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत्:—
(i) कल टर, बु᭨डाना अ᭟ यᭃ;
(ii) महारा᭬ ᮝ सरकार के पयाᭅवरण िवभाग का ᮧितिनिध, सद᭭य;
(iii) महारा᭬ ᮝ सरकार के राज᭭व िवभाग का ᮧितिनिध, सद᭭य;
(iv) ᭃेᮢीय अिधकारी, महारा᳦ रा᭔य ᮧदषूण िनयंᮢण बोडᭅ सद᭭य;
(v) पाᳯर ि᭭ थ ित क और पयाᭅवरण के ᭃेᮢ मᱶ महारा᭬ ᮝ रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक िवशेष᭄ सद᭭य;
(vi) सद᭭य सिचव / सद᭭य, रा᭔य जैव िविवधता बोडᭅ सद᭭य;
(vii) पयाᭅवरण (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ का महारा᭬ ᮝ रा᭔य सरकार ᳇ारा ᮧ᭜ येक मामले मᱶ तीन वषᭅ कᳱ अविध के िल ए नामिन᳸द᳥ एक ᮧितिनिध - सद᭭य;
(viii) ᭔ये᳧ नगर योजना अिध कारी , बु᭨डाना सद᭭य;
(ix) उप वन संरᭃक, बु᭨डाना (ᭃेᮢीय) सद᭭य सिचव। िनदᱷश शतᱷ - (1) मानीटरी सिमित कᳱ अविध इस अिधसूचना के जारी होने कᳱ तारीख से तीन वषᭅ कᳱ अविध के िलए होगी।
(2) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 21 st February, 2017 (Lonar Wildlife Sanctuary) S.O. 668(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3126(E), dated 20 th November, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
AND WHEREAS, the Lonar Wildlife Sanctuary situated on the right side of Lonar Mantha State Highway No. 171 in Buldana district, Maharashtra is spread over an area of 3.83 sq. km;
AND WHEREAS, the boundary of Lonar Wildlife Sanctuary situated in the Buldana District of Maharashtra lies between North latitude 19° 58´ 40” to 19° 58´ 42” and East longitude 76° 31´ 45” to 76°” 31´ 56”;
12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the Lonar Wildlife Sanctuary is ecologically significant which represent biotic provision 6B Central Plateau of the Deccan Peninsula and Lonar Lake is the third biggest Lake formed in basaltic rock due to meteorite impact;
AND WHEREAS, the Wildlife Sanctuary has a varied habitat having diverse fauna and flora Major flora of this sanctuary includes Sag (Tectona grandis), Lendi (Lagerstroemia parviflora ), Tembhurni (Diospyros melanoxylon) Anjan, Shankhapu-shpi (Evolvulus alsinoides) Ashoka, Beheda, Babhul, Bel, Chandan (Santalum album), Dhawada (Anogeissus latifolia), Hiwar Salai (Boswellia serrata ), Ain (Terminalia elliptica), Tarwad (Senna auriculata ) and Palas (Butea monosperma), and a variety of fauna such as Leopard (Panthera pardus), Hyaena (Hyaena hyaena), Wolf (Canis lupus pallipes), Jungle Cat (Felis chaus), Monkey (Rhesus Macaque) (Macaca mulatta), squirrel;
AND WHEREAS, a lake within the Lonar Sanctuary known as the Lonar Lake is the third largest lake formed from basaltic rock due to meteorite impact and being important from geo-morphological point of view, it attracts researchers to conduct research regarding its formation;
AND WHEREAS, Lonar Wildlife Sanctuary has historic temples which are recognized archaeological monuments by Archaeological Survey of India;
AND WHEREAS, it is necessary to conserve and protect the area upto 100 meters from the boundary of the protected area of Lonar Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view;
NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto 100 meters around the boundary of Lonar Wildlife Sanctuary in the State of Maharashtra as the Lonar Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of 1.92 square kilometres with an extent of upto 100 meters all around the boundary of Lonar Wildlife Sanctuary and the boundary description of such Zone is given in Annexure- I.
(2) The Eco-sensitive Zone is spread across 1 village falling in Buldana district of Maharashtra
(3) The name of the village falling within Eco-sensitive Zone along with co-ordinates of prominent points is appended as Annexure II.
(4) The map of the Lonar Wildlife Sanctuary and its Eco-sensitive Zone with Geo Co ordinates are appended as Annexure-III & III-A.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for consideration.
(2) The Zonal Master Plan shall be approved by the competent authority in the State Government for its effective implementation.
(3) The Zonal Master Plan so prepared shall commensurate with the stipulation specified in the Notification and include the environmental implications.
(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this Notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;

(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj; and
(xi) Public Works Department.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with supporting maps giving the details of existing and proposed land use features.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development for livelihood security of local communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 10, 21, 25, 33, and 34 in column (2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities;
(ii) Widening and strengthening of existing roads and construction of new roads;
(iii) Small scale industries not causing pollution;
(iv) Rainwater harvesting; and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan including lake shall be drawn up by the State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.

(3) Eco-Tourism.- (a) The activity relating to eco-tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism, in consultation with Department of Forests and Environment of the State Government.
(c) The activity of eco-tourism shall be regulated as under, namely:-
(i) all new eco-tourism activities or expansion of existing eco-tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within 100 metre from the boundary of the Lonar Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material shall be disposed of in an environmentally acceptable manner.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28 th March, 2016, as amended from time to time.
(11) Plastic Waste Management:- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management:- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317 (E), dated the 29 th March, 2016, as amended from time to time.

(13) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan till the Zonal Master Plan is approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(14) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed be established within ESZ vide Central Pollution Board’s categorization.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:— TABLE Sl .No. Activity Remarks

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N.
Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Ecosensitive zone shall be permitted.
The industries categorised as Green or White in the Central Pollution Control Board Classification including agro-based small scale industries shall be regulated as per regulations.
5. Establishment of new major thermal and hydro-electric projects Prohibited (except as otherwise provided) as per applicable laws.
6. Discharge of untreated effluents in natural water bodies meeting lake or land area.
Prohibited (except as otherwise provided) as per applicable laws
7. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
8. Use of Plastic bags. Prohibited (except as otherwise provided) as per applicable laws.
9. Establishment of large-scale commercial livestock and poultry farms by firms, corporates, and companies.
Prohibited (except as otherwise provided) as per applicable laws. However, initiatives on a small-scale by the local farmers are permitted.

10. Establishment of hotels and resorts for ecotourism.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Ecotourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities.
(a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any;
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
12. Trenching ground. Establishment of new trenching ground is prohibited and old trenching grounds are to be regulated under applicable laws.
13. Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons, etc.
Regulated (except as otherwise provided) as per applicable laws.
14. Commercial water resources including ground water harvesting.
(a) The extraction of surface water and ground water shall be allowed only for bona fide agricultural use and domestic consumption of the occupier of the land;
(b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority and adapting appropriate measures for rain water harvesting;
(c) no sale of surface water or ground water shall be permitted;
(d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
15. Protection of hill slopes and river banks. No construction activity unless otherwise permitted under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 and also upto 100 meters from the banks of any river, and natural nallah.
16. Air and vehicular pollution. Regulated under applicable laws.
17. Noise pollution. Regulated under applicable laws.
18. Extraction of ground water. Regulated under applicable laws.
19. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government;

(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder;
(c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed.
20. Erection of electrical cables and telecommunication towers.
(i) laying of transmission lines and distribution lines above 33 Kv
(ii) Erection of new electric cables and poles below to be permitted only for villages where there is no electricity
(iii) Augmentation/Renovation of electric and telecommunication cabling is permitted.
(iv) Promote underground cabling
21. Widening and strengthening of existing roads and construction of new roads.
Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
22. Fencing of existing premises of hotels and lodges.
Regulated under applicable laws.
In order to allow free movement of wildlife, hotels or other commercial establishments within the Eco-sensitive Zone shall not fence their properties with barbed wire and no fence shall be higher than 1 meter. Any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan.
23. Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
24. Introduction of exotic species. Regulated under applicable laws.
25. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment.
26. Discharge of treated effluents in natural water bodies or land area.
Efforts to be made to prevent mixing of treated, partially treated effluents to the water stream joining the lake.
Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
27. Commercial sign boards and hoardings. Regulated under applicable laws.
28. Solid Waste Management. Regulated under applicable laws.
29. Drastic change of agriculture systems.
Regulated under applicable laws.
Promoted Activities
30. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Shall be actively promoted.
31. Organic farming. Shall be actively promoted.
32. Adoption of green technology for all activities.
Shall be actively promoted.
33. Rain water harvesting. Shall be actively promoted.
34. Cottage industries including village artisans. Shall be actively promoted.
35. Use of renewable energy sources. Shall be actively promoted.
36. Skill development. Shall be actively promoted.
37. Agro-forestry. Shall be actively promoted.
38. Environmental awareness. Shall be actively promoted.
18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone falling in the State of Maharashtra , which shall comprise of the following namely:-
(i) Collector Buldana - Chairman.
(ii) A representative of department of Environment, Government of Maharashtra-Member
(iii) A representative of the department of revenue, Government of Maharashtra,- Member
(iv) The Regional Officer, Maharashtra State Pollution Control Board-Member
(v) One expert in the area of ecology environment to be nominated by the Government of Maharashtra –Member
(vi) Member-Secretary/Member, State Biodiversity Board - Member
(vii) A representative of Non Governmental organization working in the field of environment (including heritage conservation) to be nominated by Government of Maharashtra for three years -Member
(viii) The Senior Town Planner Officer Buldana -Member
(ix) Dy. Conservator of Forests Buldana (Territorial) -Member-Secretary Terms and Candition.- (1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal .
