PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 59] ubZ fnYyh] eaxyokj] tuojh 10] 2017@ikS"k 20] 1938 No. 59] NEW DELHI, TUESDAY, JANUARY 10, 2017/PAUSA 20, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 9 जनवरी, 2017 का.आ. 68(अ).—भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का. आ. 1948 (अ) तारीख 17 जुलाई, 2015 ᳇ारा उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उᲦ अिधसूचना मᱶ अंतᳶव᳥ राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ध करा दी गई थᱭ साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत करते ᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;
और, ᳰकसी भी पणधाᳯरयᲂ से उᲦ अिधसूचना के उᱫर मᱶ कोई आᭃपे और सुझाव ᮧा᳙ नहᱭ ᱟए थ;े खपरवास व᭠ यजीव अभयार᭛ य लगभग 83 हे टेयर कᳱ आᮤᭅभूिम (ᳰद᭨ ली के पि᭫ चम कᳱ ओर लगभग 80 ᳰकलोमीटर) हᳯरयाणा रा᭔ य मᱶ ि᭭थत है इसमᱶ ᮧवासी पिᭃयᲂ कᳱ बड़ी सं या और ᳰक᭭ मᱶ आकृ᭬ ट होती हᱹ, ये लगभग ᳲभदवास व᭠ यजीव अभयार᭛य से 1.5 ᳰकलोमीटर कᳱ दरूी पर ि᭭ थत है ;
और, खपरवास व᭠ यजीव अभयार᭛ य ये अिव-ᮧािणयᲂ अथाᭅत् ओᳯरयंटल हनी बुजाडᭅ, ᭣ लैक काइट, लाल िसर वाले िग, िशकारा, बड़ा िच᭜ तीदार गᱨड़, बूᳯटड वारबलᭅर, क᭭ टᭅड लाकᭅ , ᮕेलाग गूज, ᱨडी शैलडक, िच᭜ तीदार िब᭨ ड बᱫख, फेᱧजीनस पोचाडᭅ, ᮕेट इरᮕेट, पीला िबटन, लाल बैट᭨ ड लैपᳲवग, पᱶᳯटड ᭭ टोकᭅ , वूली ने ड ᭭ टाकᭅ , ᮕे ᮩे᭭ टेड िᮧिनया, ला᳴फग कबूतर, पीले पैर वाला हरा कबूतर, लाल गदᭅन वाला बाज़, छोटा ᮧेᳯटनकाल, पीले पैर वाला गुल, सफेद वैगटेल, नीला ᮣोट, पाइड बुशाडᭅ, ᳲसद गौरैया, ᭣ लैक ᮨᱹकोिलन, रेड वेि᭠ टड बुलबुल, ᭣ लैक ᳲवगड ि᭭ ट᭨ ट, डनिलन, बरान उ᭨लू, ओᳯरयंटल वाइट आई के िलए मह᭜ वपूणᭅ ह;ै और, खपरवास व᭠ यजीव अभयार᭛ य अपनी वन᭭ पितयᲂ अथाᭅत् अकोरस कलामस, ए᭨ यूम िसपा, कैरम कोपᳯटकम, नीरयम ओडोरम, ᳯरयूवोि᭨ फया सरपनटाइन, अमारफोफा᭨ स कᱹपानुलाटस, एि ल᭡ टा अलवा, ओरोसाइलम इंिडकम, केनािबस साितवा, डायोसपाइरोस मेलनोजाइनोल, केिसया ᳰफसटुला, डालᮩेिजया िससू, मᱹथा ि᭭ पकटा, ि᭭ ᮝकनोस मु सावोिमका, मा᳷टिनया अनुवा, ᳰफ स लोमेरेटा, पाइनस रो सबुघᱮ, ᳲसबोपोगेन मा᳷टनी, साइटरस मेिडका, अलोई बारबेिडिनसस, ᳲजजर आᳰफसेनेल, ᮝाइबुलेस टैᳯरसटᳯेरस आᳰद के िलए मह᭜ वपूणᭅ ह;ै और, खपरवास व᭠ यजीव अभयार᭛ य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह ै;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) के साथ पᳯठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, हᳯरयाणा रा᭔ य मᱶ खपरवास व᭠ यजीव अभयार᭛ य कᳱ सीमा से 100 मीटर तक के िव᭭ ताᳯरत ᭃेᮢ को खपरवास व᭠ यजीव अभयार᭛ य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत् :--
1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाए-ं-(1) पाᳯरि᭭थितक संवेदी जोन खपरवास व᭠ यजीव अभयार᭛य कᳱ सीमा के चारᲂ ओर 100 मीटर तक के ᭃेᮢ मᱶ लगभग 38 हे टेयर ᭃेᮢ से िमलकर बना है ।
(2) पाᳯरि᭭थितक संवेदी जोन पूवᭅ कᳱ ओर (मानिचᮢ कᳱ िनदᱷश ᳲबद ुसं या 6) 28º33’56.215" उ0 अᭃांश और 76º32’1.406" पूवᭅ दशेांतर, पि᭫ चम कᳱ ओर (मानिचᮢ कᳱ िनदᱷश ᳲबद ुसं या 1) 28º33’50.439" उ0 अᭃांश और 76º31’14.189" पूवᭅ देशांतर; उᱫर कᳱ ओर (मानिचᮢ कᳱ िनदᱷश ᳲबद ु सं या 8) 28º34’13.555" उ0 अᭃांश और 76º31’39.458" पूवᭅ देशांतर; और दिᭃण कᳱ ओर (मानिचᮢ कᳱ िनदᱷश ᳲबद ुसं या 3) 28º33’28.596" उ0 अᭃांश और 76º31’35.075" पूवᭅ देशांतर से िघरा ᱟआ ह ै।
(3) अᭃांश और देशा᭠तर के साथ पाᳯरि᭭थितक संवेदी जोन का मानिच ᮢ उपाबधं I पर उपाब ह ै।
(4) पाᳯरि᭭थितक संवेदी जोन के िनदᱷशांक और खपरवास व᭠ यजीव अभयार᭛य के अᭃांश और दशेांतर के साथ उपाबधं-II पर उपाब ह ᱹ।
(5) वह ᮕाम िजनके ᭃेᮢ या भाग पाᳯरि᭭थितक संवेदी जोन के भीतर आ रह े ह,ᱹ सूरजगढ़, चुछकवास, खेतावास और िबलोचपुरा उपाबंध-III पर उपाब ह ै।
2. पाᳯरि᭭थितक संवदेी जोन के िलए आचंिलक महायोजना –(1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजनᲂ के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, और इस इस अिधसूचना मᱶ यथा िव िन ᳸द ष् ट रीित मᱶ तथा सुसंगत कᱶ ᮤीय और रा᭔ य िव िध यᲂ और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िस ांतᲂ, यᳰद कोई हᲂ, के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना को रा᭔य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत ᳰकया जाएगा ।
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित मᱶ रा᭔ य सरकार तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आचंिलक महायोजना संबंिध त रा᭔ य िव भागᲂ के साथ परामशᭅ से पयाᭅवरणीय और पाᳯर ि᭭ थ ित क िव चारणᲂ को उसमᱶ एकᳱकृत करने के िल ए तैयार कᳱ जाएगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;
(v) नगरपािलका ;
(vi) राज᭭ व ;
(vii) कृिष ; और
(viii) हᳯरयाणा रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ।
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हᲂ और आचंिलक महायोजना मᱶ सभी अवसंरचना ᳰᮓयाकलापᲂ मᱶ दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, पैरा 5 के अधीन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ
(2) के अधीन मद सं0 25, सं0 34, और सं. 39 के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग,
(ii) वषाᭅ जल संचय, और
(iii) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण द᭭ तकार भी ह ᱹ:
परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और भारत के संिव धान के अनु᭒ छेद 244 तथा त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू- उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो आंचिलक महायोजना का भाग ᱨप मᱶ िन᳜िलिखत ᱨप मᱶ हᲂगे । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, हᳯरयाणा सरकार ᳇ारा राज᭭ व और वन िवभाग, पंजाब सरकार के परामशᭅ से तैयार होगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा ;

(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर होटल और ᳯरसोटᭅ के नए संिनमाᭅण लागू िनयमᲂ के अनुसार िविनयिमत हᲂगे ।
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थलᲂ - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाए ंतैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ के अनुसार पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, 2000 अंतगᭅत तैयार करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा--
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, समय-समय पर संशोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ.
1357(अ) तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ᳰकए गए थे, के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाए ंतैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान समय-समय पर यथासंशोिधत जैव िचᳰक᭜ सा अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं.
का.आ. 343(अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत ᳰकए गए थे, के अनुसार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधया ं आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होन ेऔर रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित सुसंगत अिधिनयमᲂ और िनयमᲂ तथा तदधीन बनाए गए िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(12) औ᳒ोिगक इकाईयां –
(i) सरकारी राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन के बाद या ᮧकाशन मᱶ, पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित नहᱭ दी जाएगी। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(ii) पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण बोडᭅ के वगᱮकरण के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित दी जाएगी।
(13) पहाड़ी ढलानᲂ को संरᭃण- पहाड़ी ढलानᲂ के संरᭃण के अंतगᭅत:
क. आंचिलक महायोजना पहाड़ी ढलानᲂ पर ᭃेᮢᲂ का संकेत होगा जहां कोई िनमाᭅण कᳱ अनुमित दी जाएगी । ख. कटाव के एक उᲬ िडᮕी के साथ मौजूदा खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर कोई िनमाᭅण कᳱ अनुमित दी जाएगी।
(14). अगर यह आव᭫यक समझता ह,ै इस अिधसूचना के ᮧावधानᲂ को ᮧभावी करने मᱶ के᭠ᮤ सरकार और रा᭔य सरकार, अ᭠य उपायᲂ िन᳸द᳥ करेगा।
4. पाᳯरि᭭थितक संवदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-- सारणी ᮓम सं. ᳰᮓयाकलाप ᳯट᭡पिणया ँ
(1) (2) (3) क. ᮧितिष ᳰᮓयाकलाप :
1. वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइया ं। (क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न ेकᳱ इकाइयां ᮧितिष हᲂगी । तथािप, वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए देशी टाइ᭨स या टᲂ का िनमाᭅण करना िव᳒मान िविनयमᲂ के अनुसार अनु᭄ात हᲂगे ;
(ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
2. आरा मीलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
3. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । कोई नई या पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧदषूण फैलाने वाले उ᳒ोगᲂ के िव᭭तार कᳱ अनुमित दी जाएगी। हᳯरत या ᳡ेत कृिष आधाᳯरत लघु उ᳒ोगᲂ सिहत के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ वगᱮकरण के ᱨप मᱶ वगᱮकृत उ᳒ोगᲂ को िनयमᲂ के अनुसार िविनयिमत ᳰकया जाएगा।
4. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
5. जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
6. नए बृहत जल िव᳒ुत पᳯरयोजना का ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
7. कंपिनयᲂ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुᲐ और पो᭨ᮝी फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को पूरा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
8. अनुपचाᳯरत ठोस अपिश᭬ ट का ᮧाकृितक जल िनकायᲂ या भू-ᭃेᮢ मᱶ बिह᮲ाव । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
9. म᭟यम घन᭜व फाइबर/ पा᳷टकल बोडᭅ इकाइयᲂ/ संयंᮢᲂ कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ख. िविनयिमत ᳰᮓयाकलाप :
10. होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी ᳞वसाय के िलए आवास के संबंध मᱶ संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक, जो भी िनकट हो, के भीतर ही नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ :
पर᭠तु व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱧप होगा ।
11. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय ᭪ यि तयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण िजसके अंतगᭅत पैरा 3 मᱶ सूचीब ᳰᮓयाकलाप भी ह,ᱹ को करने के िलए अनु᭄ात ᳰकया जाएगा :
(ख) पर᭠तु यह और ᳰक ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोगᲂ से संबंिधत संिनमाᭅण ᳰᮓयाकलापᲂ को लागू िनयमᲂ और िविनयमᲂ के अनुसार, यᳰद कोई हᲂ सᭃम ᮧिधकारी कᳱ पूवᭅ अनु᭄ा से िविनयिमत ᳰकया जाएगा और ᭠ यूनतम पर रखा जाएगा । (ग) एक ᳰकलोमीटर से परे आंचिलक महायोजना के अनुसार िविनयिमत ᳰकया जाएगा।
12. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा अभयार᭛य ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
13. पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
14. वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू- जल संचयन भी है । (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा । (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह ै। (ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा । (घ) जल के संदषूण या ᮧदषूण, िजसके अंतगᭅत कृिष भी है, को रोकने के िलए सभी उपाय ᳰकए जाएंगे ।
15. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण । भूिमगत केबलᲂ को अनु᭄ात ᳰकया जा सकेगा ।
16. ट भᲵᲂ कᳱ ᭭थापना । लागू िविधयᲂ के अधीन िविनयिमत (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
17. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
18. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण । उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनुसार हᲂगे ।
19. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
20. िवदेशी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
21. वृᭃᲂ कᳱ कटाई (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
22. वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

24. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन से गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग कृिष, पु᭬ प कृिष, उ᳒ान कृिष, या कृिष आधाᳯरत उ᳒ोग दशेीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई ᮧितकूल ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात हᲂगे ।
26. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अबमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
27. वन उ᭜पादᲂ या गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. सुरᭃा बलᲂ के िशिवर । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
29. प᭜ थरᲂ, कंकरᲂ और रेत का नदी कᳱ तलहटी से संᮕहण। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
30. नए का᭬ ठ आधाᳯरत उ᳒ोग। पाᳯरि᭭ थितक संवेदी जोन के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना अनु᭄ात नहᱭ होगी:
परंतु पाᳯरि᭭ थितक संवेदी जोन मᱶ 100 ᮧितशत आयाितत का᭬ ठ ᭭ टाक उपभोग करने वाले नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना कᳱ जा सकेगी ।
31. ठोस अपिश᳥ ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
32. पाᳯरि᭭थितक पयᭅटन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ग. संवᳶधत ᳰᮓयाकलाप :
33. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
34. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
35. जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
36. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
37. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
38. वन᭭ पित बाड़ । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
39. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह।ᱹ सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
40. कृिष संᳰᮓयाएं िजसके अंतगᭅत पौधा रोपण, उ᳒ान कृिष और ओरकाडᭅस भी ह ᱹ। लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
41. कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
42. पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
5. मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :- (क) उपायु त, झᲯर —अ᭟ यᭃ;
(ख) अपर उपायु त, झᲯर —सद᭭ य;
(ग) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ का हᳯरयाणा रा᭔य सरकार ᳇ारा ᮧ᭜ येक मामले मᱶ तीन वषᭅ के िल ए नामिन᳸द᳥ एक ᮧितिनिध - —सद᭭य;
(घ) ᮧादिेशक अिध कारी, हᳯरयाणा रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ —सद᭭य;
(ङ) िजला नगर योजनाकताᭅ, झᲯर —सद᭭य;

(छ) ᮧभागीय व᭠यजीव अिधकारी, रोहतक —सद᭭य;
(ज) (झ) रा᭔य जैव िविवधता बोडᭅ का सद᭭य उप वन सं रᭃक, (ᭃेᮢीय) झᲯर वन ᮧभाग —सद᭭य;
—सद᭭य सिचव । िनदᱷश िनबंधन -
(2) मानीटरी सिमित का कायᭅकाल तीन (3) वषᭅ का होगा।
(3) मािन टरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(4) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आन ेवाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(5) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण, और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(6) मानीटरी सिमित का सद᭭य-सिचव या संब कलटर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा।
(7) मानीटरी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 11 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 9th January, 2017 S.O. 68(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.1948 (E), dated the 17th July, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, no objections and suggestions received from stakeholders in response to the draft notification;
WHEREAS, the Khaparwas Wildlife Sanctuary is of about 83 hectares situated in the State of Haryana, a wetland (about 80 kilometers from West of Delhi) attracts a large number and variety of migratory birds, and at a distance of about 1.5 kilometers from the Bhindawas Wildlife Sanctuary;
AND WHEREAS, the Khaparwas Wildlife Sanctuary is important and known for its Avi-fauna i.e. Oriental honey buzzard, Black kite, Red headed vulture, Shikra, Greater spotted eagle, Booted warbler, crested lark, Graylag goose, Ruddy Shelduck, Spot-wbilled Duck, Ferruginous Pochard, Great ergret, yellow bitten, Red-wattled lapwing, Painted stork, Woolly necked stork, Grey breasted Prinia, Laughing dove, Yello-footed green pigeon, Red-necked falcon, Small pratincole, Yellow legged gull, White wagtail, Blue throat, Pied buschat, Sind sparrow, Black Francolin, Red vented bulbul, Black winged stilt, Dunlin, Barn owl, Oriental white eye;
AND WHEREAS, the Khaparwas Wildlife Sanctuary is important for its flora i.e. Acorus calamus, Allium cepa, Carum copticum, Nerium odorum, Reauwolfia serpentine, Amarphophallus Campanulatus, Eclipta alba, Oroxylum indicum, Cannabis sativa, Diospyros melanoxylon, Cassia fistula, Dalbergia sissoo, Mentha spicata, Strychnos muxvomica, Martynia annua, Ficus glomerata, Pinus roxburghii, Cymbopogon martini, Citrus medica, Aloe barbadensis, Ginger officinale, Tribulus terrestris etc.;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of the Khaparwas Wildlife Sanctuary as Ecosensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause
(xiv) of sub- section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies upto 100 meters around the Khaparwas Wildlife Sanctuary in the State of Haryana as “Khaparwas Wildlife Sanctuary Eco-sensitive Zone” (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is upto 100 meters all around the boundary of the protected area of the Khaparwas Wildlife Sanctuary comprising an area of 38 hectares approximately.
(2) The Eco-sensitive Zone is bounded by 28º33’56.215"N latitude and 76º32’1.406"E longitude towards East (Reference point No.6 of map); 28º33’50.439"N latitude and 76º31’14.189"E longitude towards west (Reference point No.1 of map); 28º34’13.555"N latitude and 76º31’39.458"E longitude towards north (Reference point No.8 of map) and 28º33’28.596"N latitude and 76º31’35.075"E longitude towards south (Reference point No.3 of map).
(3) The map of Eco-sensitive Zone boundary together with its latitude and longitude is appended as Annexure I.
(4) The coordinates of Eco-sensitive Zone and the Khaparwas Wildlife Sanctuary with its latitude and longitude is appended as Annexure II .

(5) The villages whose area or parts thereof falling within the Eco-sensitive Zone are, Surajgarh, Chuchhakwas, Khetawas and Bilochpura is appended as Annexure III .
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture; and
(ix) Haryana State Pollution Control Board;
for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13 residential needs of local residents, and for the activities listed against serial numbers 25, 34 and 39 in column (2) of the Table in paragraph 4, namely:-
(i) Small scale industries not causing pollution,
(ii) Rainwater harvesting, and
(iii) Cottage industries including village artisans, etc.:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per the Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Haryana in consultation with the Department of Revenue and Forests, Government of Haryana.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new constructions of hotels and resorts within the Eco-sensitive Zone shall regulated as per applicable rules;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made therein.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government and the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Act and the rules and regulations made thereunder.
(12) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed be established within ESZ vide Central Pollution Board’s categorisation.
(13) Protection of Hill Slopes.- The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
14. The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 TABLE Sl. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs.
UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills. No new and expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Ecosensitive zone shall be permitted.
Industries categorised as Green or White in the CPCB Classification including agro-based small scale industries will be regulated as per regulations.
4. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of new major hydroelectric projects.
Prohibited (except as otherwise provided) as per applicable laws.
7. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
9. Setting-up of Medium Density Fibre/ Particle Board Units/ Plants.
Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities:
10. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Ecotourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

11. Construction activities (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws.
(b) Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
12. Undertaking activities related to tourism like over-flying the sanctuary area by hot-air balloons, etc.
Regulated under applicable laws.
13. Uses of plastic carry bags. Regulated (except as otherwise provided) as per applicable laws.
14. Commercial water resources including ground water harvesting.
(a)The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
15. Erection of electrical cables and telecommunication towers.
Promote underground cabling.
16. Setting-up of brick kilns. Regulated (except as otherwise provided) as per applicable laws.
17. Fencing of existing premises of hotels and lodges.
Regulated under applicable laws.
18. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
19. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
20. Introduction of exotic species. Regulated under applicable laws.
21. Felling of Trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
22. Commercial Sign boards and hoardings. Regulated under applicable laws.
23. Air and vehicular pollution. Regulated under applicable laws.
24. Protection of hill slopes and river banks. Regulated under applicable laws.

26. Discharge of treated effluents in natural water bodies or land area.
Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
27. Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
28. Security Forces Camp. Regulated under applicable laws.
29. Collection of boulders, gravel and sand from the river beds.
Regulated under applicable laws.
30. New wood based industry. No establishment of new wood based industry shall be permitted within the units of Eco-sensitive Zone:
Provided that new wood based industry may be set up in the Eco-sensitive Zone using 100% imported wood stock.
31. Solid Waste Management. Regulated under applicable laws.
32. Eco-tourism. Regulated under applicable laws.
C. Promoted Activities:
33. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming and fisheries.
Permitted under applicable laws.
34. Rain water harvesting. Shall be actively promoted.
35. Organic farming. Shall be actively promoted.
36. Adoption of green technology for all activities. Shall be actively promoted.
37. Use of renewable energy sources. Shall be actively promoted.
38. Vegetative fencing. Shall be actively promoted.
39. Cottage industries including village artisans, etc. Shall be actively promoted.
40. Agriculture operations including plantation, horticulture and orchards.
Permitted under applicable laws.
41. Agro Forestry. Promoted under applicable laws.
42. Environmental Awareness. Shall be actively promoted.
5. Eco-sensitive Zone Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(a) Deputy Commissioner, Jhajjar - Chairman;
(b) Additional Deputy Commissioner, Jhajjar -Member;
(c) a representative of Non-governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Haryana for a term of three year – Member;
(d) Regional Officer, Haryana State Pollution Control Board- Member;
(e) District Town Planner, Jhajjar - Member;
(f) one expert in the area of ecology and environment to be nominated by the Government of Haryana - Member;
(g) Divisional Wildlife Officer, Rohtak – Member;
(h) Representative of State Bio Diversity Board- Member;
(i) Deputy Conservator of Forests (Territorial) Jahajjar – Member Secretary.

(2) The tenure of the Monitoring Committee is for three years.
(3) The Monitoring Committee shall monitor the compliance of the provisions of Notification.
(4) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(5) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(6) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner (s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(7) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(8) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State as per proforma appended at Annexure IV.
(9) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
