PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 60] ubZ fnYyh] eaxyokj] tuojh 10] 2017@ikS"k 20] 1938 No. 60] NEW DELHI, TUESDAY, JANUARY 10, 2017/PAUSA 20, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ली, 4 जनवरी, 2017 का.आ. 69(अ).—भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. 2045 (अ) तारीख 27 जुलाई, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसूचना अंतᳶव᳥ ह,ै जनता को उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत करते ᱟए एक ᮧाᱨप अिधसूचना ᮧकािशत कᳱ गई थी;
और, ᮧाᱨप अिधसूचना के ᮧ᭜युᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर कᱶ ᮤीय सरकार ᳇ारा स᭥यक् ᱨप से िवचार ᳰकया गया;
च᭛ डीगढ़ संघ रा᭔ यᭃेᮢ के नगर पᭃी अभयार᭛य का पाᳯरि᭭ थितक, ᮧािणजातीय, वन᭭ पतीय, आकृितिव᭄ानी, ᮧाकृितक और भू- वै᭄ािनक मह᭜ व ह ैऔर व᭠ यजीव और इसके पयाᭅवरण के संरᭃण, ᮧजनन और िवकास के ᮧयोजन के िलए इस ᭃेᮢ को च᭛ डीगढ़ ᮧशासन कᳱ अिधसूचना सं. 18/1/48-एचआईआई(4)-98 तारीख 3 िसत᭥बर, 1998 ᳇ारा इसके कुल ᭃेᮢ 2.90 हे टेयर के साथ व᭠ यजीव अभयार᭛य के ᱨप मᱶ अिधसूिचत ᳰकया गया था । और, व᭠यजीव कᳱ िविवधता मᱶ जैसे रोज़ ᳳरग तोता (िप᭭टाकुला करमारी), ᮕे धनेश (ओिसकेरोस बायरोसᮝीस), घरेलू गौरैया (पासर डोमेसᳯटकस), सामा᭠य मैना (एᮓᳱडोथेरस ᳯᮝसᳯटस), भारतीय कोयल (इयूडायनामस ᭭कोलोपैकेस), लाल वᱶडेड बुलबुल (पायकोनोनोटस कैफर), नीला रॉक कबूतर (कोल᭥बा िलिवया), ᭭टारᳲलग होप (ᮨेिगलपस वᳯरस), ᳳरग बᱫख (᭭ᮝ᭡ेटोपेिलया कैिपकोला), ᮕीन बी इटर (मेरोपस ओᳯरए᭠टेिलस), ᭭पोटेड आउलेट (एथेन बरमा), बᱹगनी सनबडᭅ (िसनेरस एिशयाᳯटकस), भारतीय ᮕे नेवला (हरपेसटेस इडवारिडस) और ᮧचुर िविभ᳖ सरीसृप पाये जाते ह;ᱹ और, इस अभयार᭛य के चारᲂ ओर के ᭃेᮢ का पᳯर रᭃण और संरᭃण करना आव᭫ यक ह ै तथा िज सकᳱ सीमाᲐ को इस अिध सूचना के पैरा 1 मᱶ नगर पᭃी अभयार᭛य के चारᲂ ओर पाᳯर ि᭭ थ तक संवेदी जोन के ᱨप मᱶ िव िन ᳸द ᭬ ट ᳰक या गया ह ैऔर पयाᭅवरण कᳱ दिृ᭬ ट से उ᳒ोगᲂ या उ᳒ोगᲂ के वगᭅ को तथा उनकᳱ संᳰᮓ याᲐ और ᮧᳰᮓ याᲐ को उ त पाᳯर ि᭭ थ तक संवेदी जोन मᱶ ᮧितिष करना आव᭫ यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] शिᲦयᲂ का ᮧयोग करते ᱟए, च᭛ डीगढ़ संघ रा᭔ यᭃेᮢ मᱶ नगर पᭃी अभयार᭛य कᳱ सीमा से 80 से 125 मीटर तक के िव᭭ ताᳯरत ᭃेᮢ को नगर पᭃी अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानसुार ह,ै अथाᭅत् :--
1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाए-ं-(i) पाᳯरि᭭ थितक संवेदी जोन, नगर पᭃी अभयार᭛य कᳱ सीमा से 80 से 125 मीटर के ᭃेᮢ तक िव᭭ ताᳯरत है जो लगभग 12.2 हे टेयर के ᭃेᮢ से िमलकर बना है । पाᳯरि᭭ थितक संवेदी जोन कᳱ सीमा का िववरण उपाबधं I के ᱨप मᱶ उपाब ह ै।
(ii) पाᳯरि᭭ थितक संवेदी जोन पूवᭅ कᳱ ओर (उपाबंध I मानिचᮢ के ᳲबद ुसं या I) 30043'43.5''उᱫर अᭃांश और 76046'58.1'' पूवᭅ दशेा᭠तर; पि᳟म कᳱ ओर (उपाबंध I मानिचᮢ के ᳲबद ुसं. क) 30043'43.4''उᱫर अᭃांश और 76046'35.9'' पूवᭅ दशेा᭠तर; उᱫर कᳱ ओर (उपाबंध I मानिचᮢ के ᳲबद ु सं. छ) 30043'52.4'' उᱫर अᭃांश और 760 46'50.2'' पूवᭅ दशेा᭠तर और दिᭃण कᳱ ओर (उपाबंध I मानिचᮢ के ᳲबद ुसं. ठ) 300 43'34.3'' उᱫर अᭃांश और 76046'42.9'' पूवᭅ दशेा᭠तर से िघरा ᱟआ है ।
(iii) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का मानिचᮢ, इसके अᭃांश और दशेा᭠तर के साथ उपाबधं II के ᱨप मᱶ उपाब ह ै।
(iv) पाᳯरि᭭थितक संवेदी जोन के िनदᱷशांक इसके अᭃांश और दशेा᭠ तर के साथ उपाबधं III के ᱨप मᱶ उपाब ह ै।
(v) पाᳯरि᭭ थितक संवेदी जोन के अंतगᭅत आने वाले गृहᲂ/भवनᲂ कᳱ सूची उपाबंध IV के ᱨप मᱶ उपाब ह ै।
2. पाᳯरि᭭थितक संवदेी जोन के िलए आचंिलक महायोजना–(1) संघ रा᭔ यᭃेᮢ कᳱ सरकार पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से, एक आंचिलक महायोजना तैयार करेगा ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी।
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आंचिलक महायोजना, संघ रा᭔ यᭃेᮢ सरकार ᳇ारा इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित मᱶ तथा सुसंगत कᱶ ᮤीय और संघ रा᭔ यᭃेᮢ कᳱ िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार कᳱ जाएगी ।
(4) आंचिलक महायोजना, इसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक िवचारᲂ को समाकिलत करने के िलए िन᭥ निलिखत सभी संब संघ रा᭔ यᭃेᮢ कᳱ सरकार के िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण;
(ii) वन;
(iii) नगर िवकास;
(iv) पयᭅटन;
(v) नगरपािलका;
(vi) राज᭭ व;
(vii) कृिष;
(viii) चंडीगढ़ ᮧदषूण िनयंᮢण सिमित;
(ix) ᳲसचाई; और
(x) लोक िनमाᭅण िवभाग।
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ और आचंिलक महायोजना मᱶ सभी अवसंरचना और अिधक ᮧभावी और पाᳯरि᭭ थितक अनुकूल ᳰᮓयाकलाप कारक इस ᮧकार िविन᳸द᭬ ट न हो ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलुᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।
3. सघं रा᭔ यᭃेᮢ कᳱ सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- संघ रा᭔ यᭃेᮢ कᳱ सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के िलए ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, पैरा 5 के अधीन मानीटरी सिमित कᳱ िसफाᳯरश पर और संघ रा᭔ यᭃेᮢ कᳱ सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन ᮓम सं. 19, 22, 30 और 36 के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद;
(ii) ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोग;
(iii) वषाᭅ जल संचयन; और
(iv) कृिष वािनकᳱ, िजसके अंतगᭅत बागवानी, उ᳒ान कृिष और फलो᳒ान भी ह।ᱹ परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा:
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ पाई जाने वाली कोई ᮢुᳯट मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना दनेी होगी:
परंतु यह भी ᳰक उपयुᭅᲦ ᮢुᳯट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा :
परंतु यह भी ᳰक हᳯरत ᭃेᮢ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल-᮲ोत -- आंचिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुननᭅवीकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट ऐसे िवकास ᳰᮓयाकलापᲂ को जो ऐसे ᭃेᮢᲂ के िलए हािनकारक हᲂ, ᮧितिष करने के िलए मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, पयᭅटन महायोजना के अनुसार हᲂगे, जो आंचिलक महायोजना का भाग ᱨप हᲂगे । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, संघ रा᭔ यᭃेᮢ कᳱ सरकार के पयᭅटन िवभाग ᳇ारा राज᭭ व और वन िवभाग, संघ रा᭔ यᭃेᮢ कᳱ सरकार के परामशᭅ से तैयार होगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा जारी (समय-समय पर यथा संशोिधत) मागᭅिनदशेᲂ के अनुसार होगा िजसमᱶ पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व ᳰदया जाएगा और पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा ;
(ii) पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और ᳯरसोटᭅ के नए संिनमाᭅण अनु᭄ात नहᱭ हᲂगे । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया जाएगी ।
(4) नैसᳶगक िवरासत – पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाᲐ, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ पᳯररिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।
(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ और अहातᲂ कᳱ पहचान कᳱ जाएगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर उनके संरᭃण कᳱ योजनाए ंतैयार कᳱ जाएंगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएंगी ।
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए चंडीगढ़ संघ रा᭔ यᭃेᮢ ᮧदषूण िनयंᮢण सिमित ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ के अनुसार पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, 2000 के अंतगᭅत तैयार करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए चंडीगढ़ संघ रा᭔ यᭃेᮢ ᮧदषूण िनयंᮢण सिमित वाय ु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांत और िविनयम तयैार करेगा ।
(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाए ंतैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थलᲂ पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा। पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. 343(अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय यातायात- पᳯरवहन कᳱ यानीय गितिविधया ंआवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होन ेऔर रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होन ेतक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
4. पाᳯरि᭭थितक संवदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰकए जाने वाल े ᳰᮓयाकलापᲂ कᳱ सचूी - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीच ेदी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 सारणी ᮓम सं. ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) क. ᮧितिष ᳰᮓयाकलाप :
(1) वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां । (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइया ंवा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िसवाय नहᱭ हᲂगी ;
(ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
(2) आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(3) जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर ᳰकसी नए और ᮧदषूण काᳯरत करने वाले िव᳒मान उ᳒ोगᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(4) ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष हᲂगे ।
(5) जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष हᲂगे ।
(6) ᭡ लाि᭭ टक के थैलᲂ का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष हᲂगे ।
(7) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष हᲂगे ।
(8) म᭟यम घन᭜व फाइबर/ पा᳷टकल बोडᭅ इकाइयᲂ/ संयंᮢᲂ कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष हᲂगे ।
(9) भूिम उपयोग पैटनᭅ का पᳯरवतᭅन । लागू िविधयᲂ के अनुसार ᮧितिष हᲂगे ।
(10) वािणि᭔ यक जल ᮲ोत िजसके अ᭠तगᭅत भू- जल संचयन भी ह ै। पाᳯरि᭭ थितक संवेदी जोन मᱶ ᮧाकृितक जल ᮲ोतᲂ के वािणि᭔ यक उपयोग िजसके अंतगᭅत भू-जल भी है, को ᮧितिष ᳰकया जाएगा । जल के संदषूण या ᮧदषूण के िनवारण के िलए सभी उपाय ᳰकये जाएंगे ।
(11) होटलᲂ और लॉजᲂ कᳱ बाड़ लगाना । पाᳯरि᭭ थितक संवेदी जोन मᱶ होटलᲂ और लॉजᲂ के पᳯरसर कᳱ बाड़ लगाना ᮧितिष होगा ।
(12) िवदेशी ᮧजाितयᲂ को लाना । नगर पᭃी अभयार᭛य के पाᳯरि᭭ थितक संवेदी जोन मᱶ िवदशेी ᮧजाितयᲂ को लाना ᮧितिष होगा।
(13) आितशबाजी/पटाखᲂ का उपयोग । नगर पᭃी अभयार᭛य के पाᳯरि᭭ थितक संवेदी जोन मᱶ आितशबाजी/पटाखᲂ का उपयोग ᮧितिष होगा। ख. िविनयिमत ᳰᮓयाकलाप :
(14) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई, संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार िविनयिमत होगी ।
(15) नई उ᭒ च वो᭨ टता पारेषण लाइनᲂ का पᳯरिनमाᭅण ।
(i) नगर पᭃी अभयार᭛य के पाᳯरि᭭ थितक संवेदी जोन मᱶ उ᭒ च वो᭨ टता पारेषण लाइनᲂ का िबछाना ᮧितिष होगा ।
(ii) नये िव᳒ुत केबलᲂ के पᳯरिनमाᭅण को पाᳯरि᭭ थितक संवेदी ᮧबंध योजना के अनुसार िविनयिमत ᳰकया जाएगा ।
(iii) भूगत केिबलᲂ के िबछाने का संवधᭅन ᳰकया जाएगा ।
(16) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण । यथा लागू उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपायᲂ के साथ ᳰकया जाएगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(17) वायु (िजसके अ᭠तगᭅत ᭟ विन भी है) और यािनक ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(18) वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(19) पाᳯरि᭭ थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के िलए, पयᭅटकᲂ के अ᭭ थायी आवासन हतेु पाᳯरि᭭ थितक अनुकूल कुटीर, जैसे तंबू, लकड़ी के घर आᳰद । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(20) ᭭ ᮝीट लाइटᲂ का पᳯरिनमाᭅण। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(21) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करने और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन ᳰकया जाएगा ।
(22) ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन मᱶ दशेीय माल से उ᭜ पादᲂ का उ᭜ पादन करने वाल े गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत ऐसे उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात ᳰकए जाएगंे ।
(23) पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा रा᳦ीय उ᳒ान ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(24) संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ अनुमित दी जाएगी । पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे । (ख) इसके अितᳯरᲦ पाᳯरि᭭थितक संवेदी जोन से परे, सदभािवक ᭭ थानीय आव᭫ यकताᲐ के िलए संिनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे।
(25) मोबाइल टावर का पᳯरिनमाᭅण। नगर पᭃी अभयार᭛य के पाᳯरि᭭ थितक संवेदी जोन मᱶ मोबाइल टावरᲂ का पᳯरिनमाᭅण ᮧितिष होगा ।
(26) होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ को अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ सीमा के एक ᳰकलोमीटर के भीतर कोई नया वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे । पर᭠तु पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा से एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱨप होगा ।
(27) ठोस अपिश᳥ ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(28) पाᳯरि᭭थितक-पयᭅटन ᳰᮓयाकलाप । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ग. संवᳶधत ᳰᮓयाकलाप :
(29) डयेरी, डयेरी उ᳒ोग और म᭜ ᭭ य उ᳒ोग के साथ ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी गितिविधया ं। िविधयᲂ के अनुसार अनु᭄ात हᲂगे ।
(30) वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(31) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । िविधयᲂ के अनुसार अनु᭄ात हᲂगे ।
(32) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।

(34) समुदाय ᮧकृित आरिᭃत । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(35) वान᭭ पितक बाड़। िविधयᲂ के अनुसार अनु᭄ात हᲂगे ।
(36) कृिष वािनकᳱ, िजसके अंतगᭅत बागवानी, उ᳒ान कृिष और फलो᳒ान भी ह।ᱹ लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(37) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह ᱹ। सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(38) पयाᭅवरणीय जागᱨकता । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(39) कौशल िवकास । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
5. पाᳯरि᭭थितक संवदेी जोन मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करती है, जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-
(i) मुय व᭠यजीव वाडᭅन, चंडीगढ़ संघ रा᭔ यᭃेᮢ —अ᭟यᭃ;
(ii) मु य वा᭭ तुकार, चंडीगढ़, संघ रा᭔ यᭃेᮢ —सद᭭ य;
(iii) मु य इंजीिनयर, चंडीगढ़ संघ रा᭔ यᭃेᮢ —सद᭭ य;
(iv) मु य इंजीिनयर, नगर िनगम, चंडीगढ़, संघ रा᭔ यᭃेᮢ —सद᭭य;
(v) िनदशेक नगर िवकास, चंडीगढ़, संघ रा᭔ यᭃेᮢ —सद᭭य;
(vi) सद᭭ य-सिचव, चंडीगढ़ ᮧदषूण िनयंᮢण सिमित, चंडीगढ़, संघ रा᭔ यᭃेᮢ —सद᭭ य;
(vii) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ मᱶ से चंडीगढ़ संघ रा᭔ यᭃेᮢ कᳱ सरकार ᳇ारा तीन वषᭅ कᳱ अविध के िलए नामिन᳸द᳥ ᮧितिनिध -सद᭭ य;
(viii) चंडीगढ़ संघ रा᭔ यᭃेᮢ कᳱ सरकार ᳇ारा पाᳯरि᭭ थितक और पयाᭅवरण के ᭃेᮢ का एक िवशेष᭄ िजसे तीन वषᭅ कᳱ अविध के िलए नामिन᳸द᭬ ट ᳰकया जाएगा - सद᭭ य; और
(ix) रा᭔य जैव िविवधता बोडᭅ का सद᭭य -सद᭭ य;
(x) उप वन संरᭃक – सद᭭य-सिचव । िनदᱷश िनबंधन
(1) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(2) मानीटरी सिमित का कायᭅकाल तीन वषᭅ का होगा।
(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(4) इस अिधसूचना के पैरा 4 के अधीन यथािविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(5) मानीटरी सिमित का सद᭭य-सिचव या संब कलटर या संबंिधत उप वन संरᭃक (व᭠ यजीव) ऐसे ᳞िᲦ के िवᱧ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।
(6) मानीटरी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक रा᭔ य के मु य व᭠ यजीव वाडᭅन को अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ उपाबधं V मᱶ उपबंिधत ᱨप मᱶ उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।
(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश द ेसकेगा, जो वह ठीक समझे ।
6. इस अिधसूचना के उपबंधᲂ को ᮧभावी बनाने के िलए कᱶ ᮤीय सरकार और रा᭔ य सरकार अितᳯर त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶ गी ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 4th January, 2017 S.O.69(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change vide number S.O. 2045(E), dated 27 July 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
AND WHEREAS, the City Bird Sanctuary Union territory Chandigarh has ecological, faunal, floral, geomorphological, natural and geological significance and for the purpose of protecting, propagating and developing wildlife and its environment, this area was declared as Wildlife Sanctuary vide Chandigarh Administration notification No.
18/1/48-HII(4)-98 dated 3rd September, 1998 with a total area of 2.90 hectare.
AND WHEREAS, a variety of Wildlife such as Rose ringed Parakeet (Psittacula krameri), Grey Hornbill (Ocyceros birostris), House sparrow (Passer domesticus), Common Myna (Acridotheres tristis), Indian Koel (Eudynamys scolopaceus), Red vented Bulbul (Pycnonotus cafer), Blue Rock Pigeon (Columba livia), Starling Hoopoe (Fregilupus varius), Ring Dove (Streptopelia capicola), Green bee eater (Merops orientalis), Spotted Owlet (Athene brama) Purple Sunbird (Cinnyris asiaticus), Indian Grey Mongoose (Herpestes edwardsii) and Various reptiles are found here in abundance;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of the City Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13 NOW, THEREFORE, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with subrule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 80 to 125meters from the boundary of the City Bird Sanctuary Union territory Chandigarh as the City Bird Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone (i) The Eco-sensitive Zone varies from 80 to 125 meters from the City Bird Sanctuary comprising an area of 12.0 hectares approximately. The boundary description of the Eco-sensitive Zone is appended as Annexure I.
(ii) The Eco-sensitive Zone is bounded by 30º43’43.5"N latitude and 76º46’58.1"E longitude towards East (Point No. I of Annexure I map); 30º 43’43.4"N latitude and 76º46’35.9"E longitude towards west (Point No. A of Annexure I map); 30º43’52.4"N latitude and 76º46’50.2"E longitude towards north (Point No. G of Annexure I map) and 30º43’34.3"N latitude and 76º46’42.9"E longitude towards south (Point No. L of Annexure I map).
(iii) The map of Eco-sensitive Zone boundary together with its latitude and longitude is appended as Annexure II.
(iv) The coordinates of Eco-sensitive Zone with its latitudes and longitudes are appended as Annexure III.
(v) The list of the Houses/Buildings falling within Eco-sensitive Zone is appended as Annexure IV.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The Union territory Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The said Plan shall be prepared by the Union territory Government for the Eco-sensitive Zone in such manner as is specified in this notification and also in consonance with the relevant Central and Union territory Government laws and the guidelines issued by the Central Government, if any.
(4) The said Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(ix) Chandigarh Pollution Control Committee.
(x) Irrigation; and
(xi) Public Works Department, for integrating environmental and ecological considerations into it.
(5) The said Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The said plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The said Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The said Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities.
3. Measures to be taken by Union territory Government.-The Union Territory shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed at item numbers 19,22,30 and 36 in column (2) of the Table in paragraph 4, namely 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Ecofriendly tourism activities;
(ii) Small scale industries not causing pollution;
(iii) Rainwater harvesting; and
(iv) Agro-Forestry, Agriculture operations including plantation, horticulture and orchards.:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the Union territory Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.-(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall be part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Union territory Government of Chandigarh in consultation with the Department of Revenue and Forests, Government of Union territory Chandigarh.
(c) The activity of tourism shall be regulated as under, namely.-
(i) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be and based on carrying capacity study of the Eco-sensitive Zone in accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;
(ii) New construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone;
(iii) Till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- Chandigarh Pollution Control Committee shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- Chandigarh Pollution Control Committee shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) The local authorities shall draw up plans for the segregation of solid wastes intobiodegradable and nonbiodegradable components;
(iii) The biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) The inorganic material may be disposed in an environmentally acceptable manner at site (s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.-All activities in the Ecosensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- TABLE Sl. (a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited except for the domestic needs of bona fide local residents.

04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs.
UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of existing polluting industries shall be permitted within the Eco-sensitive Zone.
4. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per law.
5. Commercial use of firewood. Prohibited (except as otherwise provided) as per law.
6. Uses of plastic carry bags. Prohibited (except as otherwise provided) as per law.
7. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per law.
8. Setting-up of Medium Density Fiber/ Particle Board Units/ Plants.
Prohibited (except as otherwise provided) as per applicable laws.
9. Change of land use pattern. Prohibited (except as otherwise provided) as per law.
10. Commercial water resources including ground water harvesting.
Commercial use of natural water resources including ground water will be prohibited in the Eco-sensitive Zone.
All steps will be taken to prevent contamination or pollution of water.
11. Fencing of premises of Hotels and lodges. Fencing of premises of Hotels and Lodges shall be prohibited in the Eco-sensitive Zone.
12. Introduction of exotic species. Introduction of exotic species shall be prohibited in the Eco-sensitive Zone of City Bird Sanctuary.
13. Use of Fireworks/ Crackers. Use of Fireworks/Crackers in the Eco-sensitive Zone of City Bird Sanctuary shall be Prohibited.

14. Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the Union territory.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or Union territory Act and the rules made there under.
15. Erection of High tension Transmission lines. (i) Laying of high tension transmission lines shall be prohibited in the Eco-sensitive Zone of City Bird Sanctuary.
(ii) Erection of new electric cables shall be regulated as per Eco-sensitive Management Plan.
(iii) Laying of underground cabling shall be promoted.
16. Widening and strengthening of existing roads and construction of new roads.
Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable
17. Air (including noise) and vehicular pollution. As regulated under law.
18. Commercial Sign boards and hoardings. As regulated under law.
19. Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc. for Eco-friendly tourism activities.
As regulated under law.
20. Erection of Street lights. As regulated under law.
21. Discharge of treated effluents in natural water bodies or land area.
Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
22. Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco-sensitive Zone which do not cause any adverse impact on environment shall be permitted.
23. Undertaking activities related to tourism like over-flying the national park area by aircraft, hot-air balloons.
Regulated under applicable laws.
24. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer.
Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any.
(b) Beyond one kilometer upto the extent of Ecosensitive Zone, construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per the Zonal Master Plan.
25. Erection of Mobile Tower. Erection of Mobile Towers shall be regulated in the Eco-sensitive Zone of City Bird Sanctuary.

26. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometer or up to the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Tourism Master Plan.
27. Solid Waste Management. Regulated under applicable laws

29. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming and fisheries.

30. Rain water harvesting. Shall be actively promoted.
31. Use of renewable energy sources. Permitted under law.
32. Adoption of green technology for all activities. Shall be actively promoted.
33. Organic farming. Shall be actively promoted.
34. Community Nature Reserve. Shall be actively promoted.
35. Vegetative fencing. Permitted under law.
36. Agro-Forestry, Agriculture operations including plantation, horticulture and orchards.
Permitted under applicable laws.
37. Cottage industries including village artisans, etc. Shall be actively promoted.
38. Environnemental Awareness. Shall be actively promoted.
39. Skill Development. Shall be actively promoted.
5. Eco-sensitive Zone Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) Chief Wildlife Warden, Union territory (UT) of Chandigarh - Chairman;
(ii) Chief Architect, UT, Chandigarh –Member;
(iii) Chief Engineer, UT, Chandigarh –Member;
(iv) Chief Engineer, Municipal Corporation UT, Chandigarh –Member;
(v) Director Rural Development, UT, Chandigarh – Member;
(vi) Member Secretary, Chandigarh Pollution Control Committee, UT, Chandigarh -Member;
(vii) A representative of Non-governmental Organizations’ working in the field of environment to be nominated by the Government of Union territory Chandigarh for three years – Member;
(viii) One expert in the area of ecology and environment to be nominated by the Government of UT, Chandigarh for a term of three years - Member; and
(ix) Member of State Biodiversity Board - Member
(x) Dy. Conservator of Forest - Member Secretary Terms of Reference:
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The tenure of the committee will be three years.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Conservator Forest (WL) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the Union Territory proforma appended at Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
