PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 61] ubZ fnYyh] eaxyokj] tuojh 10] 2017@ikS"k 20] 1938 No. 61] NEW DELHI, TUESDAY, JANUARY 10, 2017/PAUSA 20, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ली, 9 जनवरी, 2017 का.आ. 70(अ).—भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का. आ. 1054 (अ) तारीख 11 माचᭅ, 2016, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसूचना अंतᳶव᳥ ह,ै उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करते ᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी; और, उᲦ राजपᮢ िजसमᱶ उ त अिधसूचना अंतᳶव᭬ ट ह,ै कᳱ ᮧितयां जनता को 11 माचᭅ, 2016 को उपल᭣ध करा दी गई थᱭ ; और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर कᱶ ᮤीय सरकार ᳇ारा स᭥यक् ᱨप से िवचार ᳰकया गया; और, भीमबांध व᭠ यजीव अभयार᭛ य, मंुगेर वन ᮧभाग िबहार रा᭔ य के मंुगेर, लखीसराय और जमुई िजले मᱶ 24°55’ और 25°15’ उ᭜ तर के अᭃांश पर और 86°15’ तथा 86°33’ पूवᭅ के देशांतर पर अवि᭭थ त है और िजसका िव᭭ तार 681.90 वगᭅ ᳰकलोमीटर ᭃेᮢ ह;ै और, इस अभयार᭛ य मᱶ वन᭭ पित और ᮧािणयᲂ कᳱ ᮧचुर जैिवक मह᭜व का ᮧितिनिध ᭜ व ह;ै और, इस अभयार᭛ य मᱶ तᱶदआु (पे᭠थेरा ᮧᲽूस), रीछ(मेलउसुᭅस उᳶसनस) के अलावा जैसे लकड़ब घा(᳭ेना ᭭पा), भेिडया(कैिनस लुपस), भारतीय गंधिबलाव (वीवरे िज़बेथ), मुंजक(मुि᭠टएस मु᭠तजक) संकटाप᳖ जीव ᮧजाितयᲂ सिहत व᭠यजीवᲂ और ऐसे सरीसृपᲂ, उभयचरᲂ तथा पिᭃ यᲂ को आ᮰य दतेा ह ैजो संकटाप᭠ न ह ᱹऔर संरᭃण कᳱ दिृ᳥ से अ᭜यंत मह᭜ वपूणᭅ हᱹ; और, इस अभयार᭛ य के भू-दृ᭫ य और वन ऊपर उि᭨लिखत व᭠य जीवᲂ के िलए उपयुᲦ ᮧाकृितक आवास ह ैऔर उ᭬णकᳯटबंधी शु᭬क पणᭅपाती तथा उ᭬णकᳯटबंधी आᮤᭅ पणᭅपाती वनᲂ वाली वन᭭पित कᳱ िविवधता कᳱ दिृ᳥ से अ᭜यिधक मह᭜वपूणᭅ भी ह ै; 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, भीमबांध व᭠ यजीव अभयार᭛ य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ हᱹ, पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह;ै अतः, इसिलए, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, िबहार रा᭔ य मᱶ भीमबांध व᭠ यजीव अभयार᭛ य कᳱ सीमा से 200 मीटर से 5 ᳰकलोमीटर तक के िव᭭ तार तक के ᭃेᮢ को भीमबांध व᭠ यजीव अभयार᭛ य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत् :--
(1) पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन के ᭃेᮢ का िव᭭ तार 434.35 वगᭅ ᳰकलोमीटर तक होगा और पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा भीमबांध व᭠ यजीव अभयार᭛ य के चारᲂ ओर 200 मीटर से 5 ᳰकलोमीटर तक होगी।
(2) पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत आने वाले ᮕामᲂ कᳱ सूची उपाबंध I मᱶ दी गई ह।ै
(3) भीमबांध व᭠ यजीव अभयार᭛ य कᳱ सीमा के िनदᱷशांक ᳲबद ुउपाबंध II मᱶ ᳰदए गए है और पाᳯरि᭭थितक संवेदी जोन के िनदᱷशांक उपाबंध III मᱶ ᳰदए गए है ।
(4) पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ अᭃांश और देशां᭠ तर के साथ सीमा के ᭣ यौरा सिहत उपाबधं IV के ᱨप मᱶ उपाब है ।
2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;
(v) नगरपािलका ;
(vi) राज᭭ व ;
(vii) कृिष ;
(viii) िबहार रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ;
(ix) ᳲसचाई; और
(x) लोक िनमाᭅण िवभाग ।
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(8) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा: परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं0 9, 21, 32, 40 और सं. 41के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद ;
(ii) िव᳒मान सड़कᲂ को चौड़ा और सुदढ़ृ बनाना ;
(iii) ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोग;
(iv) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधाजनक भंडार और ᭭ थानीय सुख-सुिवधाएं हᱹ; और
(v) वषाᭅ जल संचयन । परंतु यह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा : परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोतᲂ - आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पयᭅटन महायोजना पयᭅटन िवभाग ᳇ारा रा᭔ य सरकार के वन और पयाᭅवरण िवभाग के परामशᭅ से तैयार कᳱ जाएगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा; 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ii) पाᳯरि᭭ थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय भीमबांध व᭠ यजीव अभयार᭛ य कᳱ सीमा से एक ᳰकलोमीटर भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अनु᭄ात नहᱭ होगा; परंतु संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर कᳱ दरूी से परे पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक नए होटल और ᳯरसोटᭅ कᳱ ᭭थापना पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पयᭅटन सुिवधा के िलए पूवᭅ पᳯरभािषत और िविन᳸द᳥ ᭭थान मᱶ ही अनु᭄ात ᳰकया जाएगा ।
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नैसᳶगक िवरासत - पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाए ं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, के अंतगᭅत ᭟विन ᮧदषूण िनयंᮢण बोडᭅ (िविनयमन एवं िनयंᮢण) िनयम, 2000 के ᮧावधानᲂ के आधार पर तैयार करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या िबहार रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाए ंतैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन. 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधया ंआवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होन ेऔर रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होन ेतक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(12) औ᳒ोिगक इकाईया ं- (क) ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ िव िध के अनुसार ᭭ थािप त िव ᳒ मान का᭬ ठ आधाᳯर त उ᳒ोगᲂ के िस वाए नए का᭬ ठ आधाᳯर त उ᳒ोगᲂ कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (ख) जल, वायु, मृदा, ᭟ विन ᮧदषूण काᳯर त करने वाले ᳰक सी नए उ᳒ोग कᳱ ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा ।
4. पाᳯरि᭭थितक संवदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और तीन बनाए गए िनयमᲂ ᳇ारा शािसत हᲂगे और नीच ेदी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-- सारणी ᮓम सं. ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
1. वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइया ं। (क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर उ᭜खनन और उनको तोड़ने कᳱ इकाइयां ᮧितिष ह,ᱹ िसवाय िनवािसयᲂ कᳱ वा᭭तिवक घरेलू आव᭫यकताᲐ के नहᱭ हᲂगी, िजसके अंतगᭅत गृहᲂ के संिनमाᭅण या मर᭥ मत के िलए िमᲵी कᳱ खुदाई और ᭪ यि तक उपभोग के िलए गृहᲂ के िनमाᭅण के िलए दशेी टाइलᲂ या टᲂ का संिनमाᭅण भी है । (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
2. आरा मीलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
3. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠यथा उपबंिधत के िसवाय) ।
4. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाले का िव᭭ तार अनु᭄ात नहᱭ होगा ।
5. नई बृहत ताप और जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
6. जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
7. ᭡ लाि᭭ टक थैलᲂ का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
8. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । िविनयिमत ᳰᮓयाकलाप
9. होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट है, नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे : पर᭠तु व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱧप होगा । वािणि᭔यक पाᳯरि᭭थितक पयᭅटन के साथ "व᭠यजीव िनवास मᱶ गैर वािनकᳱ ᳰᮓयाकलापᲂ के िलए ᳰदशा-िनदᱷशᲂ" के अनुसार जारी एफ. सं. 610/2011 व᭠यजीव तारीख 15-03.2011 ᳇ारा पयाᭅवरण और वन मंᮢालय (व᭠यजीव 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ᮧभाग), नई ᳰद᭨ली और रा᳦ीय बाघ संरᭃण ᮧािधकरण के ᳰदशा िनदᱷशᲂ (यᳰद लागू हो) के साथ िविनयिमत ᳰकया जाएगा ।
10. संिनमाᭅण ᳰᮓयाकलाप। (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा: परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ अनुमित दी जाएगी । पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे । (ख) एक ᳰकलोमीटर से आगे और पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक वा᭭ तिवक ᭭ थानीय आव᭫ यकताᲐ के िलए संिनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे।
11. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा रा᳦ीय उ᳒ान ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
12. ᮝेᳲ᭠चग ᮕाउंड । नए ᮝेᳲ᭠ चग ᮕाउंड कᳱ ᭭ थापना ᮧितिष ह ै । पुराने ᮝेᳲ᭠ चग ᮕाउंड को लागू िविधयᲂ के अनुसार िविनयिमत ᳰकया जाएगा ।
13. ᮧाकृितक जल िनकायᲂ मᱶ बिह᮲ाᭅव और ठोस अपिश᭬ ट का िन᭭सारण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
14. वायु और यािनक ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
15. ᭟ विन ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
16. भूिमगत जल का िन᭬ कषᭅण। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
17. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी । (ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ कᳱ दशा कायᭅयोजना मᱶ ᳰदए गए िववरण का अनुसरण ᳰकया जाएगा ।
18. ᮧवासी चारवाहे। लागू िविधयᲂ के अधीन और आंचिलक महायोजना के अनुसार िविनयिमत हᲂगे।
19. िव᳒मान ᭭ थापना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
20. िव᳒ुत लाइनᲂ का रोधन । भूिम मᱶ केबल डालने को ᮧो᭜ सािहत करना। पाᳯरि᭭ थ ितक संवेदी जोन से होकर गुजरने वाली सभी िव᳒मान िव᳒ुत लाईनᲂ को आंचिलक महायोजना के अधीन िविहत समय सीमा मᱶ पयाᭅ᭡ त ᱨप से रोिध त ᳰकया जाएगा ।
21. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना। उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनुसार हᲂगे ।
22. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना। लागू िविधयᲂ के अधीन िविनयिमत होगा । व᭠ यजीव के मु त संचलन को अनु᭄ात करने के िलए पाᳯरि᭭ थितक संवेदी जोन के भीतर होटलᲂ या अ᭠ य वािणि᭔ यक ᭭ थापना अपनी पᳯरसंपि᭜ तयᲂ मᱶ कांटेदार से बाड नहᱭ लगाएगंे और कोई भी बाड़ एक मीटर से ऊंची नहᱭ होगी । कोई िव᳒मान बाड़, जो इस उपदशᭅ का अनुपालन नहᱭ करती ह,ै को ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 आंचिलक महायोजना मᱶ वᳶणत समय-सीमा के अनुसार उपांतᳯरत ᳰकया जाएगा ।
23. नᳰदयᲂ / जल बोडᭅ मᱶ मछली पकड़ना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
24. वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. मोबाईल टावरᲂ कᳱ ᭭ थापना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
26. कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. ᮧाकृितक जल संसाधनᲂ का वािणि᭔ यक उपयोग, िजसके अंतगᭅत भू-जल संचयन भी ह ै। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
29. िवदेशी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
30. वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
31. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । जब तक आंचिलक महायोजना के अधीन अनु᭄ात न ᳰकया जाए जब तक 1 से 10 मीटर के पहाड़ी ढलानᲂ पर और ᳰकसी नदी तट और ᮧाकृितक नाले से 100 मीटर तक कोई संि᭠ न माᭅण ᳰᮓयाकलाप नहᱭ ᳰकया जाएगा।
32. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन मᱶ दशेीय माल से उ᭜पादᲂ का उ᭜पादन करने वाले गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत दशेीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात ᳰकए जाएंगे ।
33. रᲯुमागᭅ का िनमाᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
34. सुरᭃा रा᭔य-िव᭡लव कᳱ ᭭थापना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
35. पाᳯरि᭭थितक-पयᭅटन ᳰᮓयाकलाप । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
36. ठोस अपिश᳥ ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । संवᳶधत ᳰᮓयाकलाप
37. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
38. जैिवक कृिष। सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
39. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
40. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह ᱹ। सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
41. वषाᭅ जल संचयन। सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा।
42. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा |
43. कृिष वािनकᳱ। सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
44. कौशल िवकास । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
45. पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
5. मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत्:-
(i) ᮧभागीय आयुᲦ, मंुगेर राज᭭व ᮧभागीय- अ᭟ यᭃ;
(ii) िबहार सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए एक िवशेष᭄- सद᭭य; 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) मानीटरी सिमित का कायᭅकाल तीन वषᭅ का होगा।
(3) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(4) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(5) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(6) मानीटरी सिमित का सद᭭य-सिचव या संब उपायु त, ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।
(7) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत े ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(8) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ रा᭔ य के मु य व᭠ यजीव वाडᭅन को अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ उपाबधं V पर उपाब ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।
(9) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश द ेसकेगा, जो वह ठीक समझे ।
6. इस अिधसूचना के उपबंध, भारत के माननीय उᲬतम ᭠यायालय या उᲬ ᭠यायालय या रा᭬ ᮝीय हᳯरत ᮧािधकरण ᳇ारा पाᳯरत कोई आदेश या पाᳯरत होन ेवाले ᳰकसी आदशे, यᳰद कोई हᲂ, के अधीन हᲂगे । [फा. सं. 25/198/2015-ईएसजेड-आरई] डॉ. टी. चांदनी, वै᭄ािनक ‘जी’
(iii) कृिष िवभाग, ᮧितिनिध, िबहार सरकार- सद᭭य;
(iv) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै का ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए िबहार रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध- सद᭭य;
(v) वन और पयाᭅवरण िवभाग, ᮧितिनिध, िबहार सरकार- सद᭭य;
(vi) ᮧादिेशक अिधकारी, िबहार रा᭔य ᮧदषूण िनयंᮢण बोडᭅ- सद᭭य;
(vii) जल संसाधन िवभाग, ᮧितिनिध, िबहार सरकार- सद᭭य;

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । 34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 9th January, 2017 S.O.70(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.1054 (E), dated 11th March, 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the draft notification were made available to the public on the 11th March, 2016; AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government; AND WHEREAS, the Bhimbandh Wildlife Sanctuary, Munger Forest Division lies between Latitudes 24°55’ and 25°15’ N and Longitude 86°15’ and 86°33’ E in the Munger, Lakhisarai and Jamui districts of Bihar and extends over an area of 681.90 square kilometers; AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary; AND WHEREAS , this sanctuary shelters wild animals including Leopard (Panthera pardus), Sloth bear (Melursus ursinus), besides some of the endangered species like Hyena(Hyaena sp.), Wolf (Canis lupus), Large Indian civet(Viverra zibetha), Barking deer(Muntiacus muntjak), and also reptiles, amphibians and birds that are endangered and are of high conservation significance; AND WHEREAS, the landscape and forests of this sanctuary are suitable habitats for the abovementioned wild animals, and are also of considerable significance from point of view of diversity of vegetation comprising of Tropical Dry deciduous and Tropical Moist deciduous forests; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Bhimbandh Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 200 meters to five kilometers around the boundary of Bhimbandh Wildlife Sanctuary in the State of Bihar as the Bhimbandh Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The area of Eco-sensitive Zone shall be spread over an area
434.35 square kilometers and the extent of Eco-sensitive Zone varying from 200 meters to five kilo meters around the Bhimbandh Wildlife Sanctuary Wildlife Sanctuary.
(2) The list of villages falling in the in Eco-sensitive Zone area are given at Annexure-I.
(3) The co-ordinates of points along the boundary of Bhimbandh Wildlife Sanctuary are given at Annexure-II and the co-ordinates of Eco-sensitive Zone are given at Annexure-III .
(4) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-IV .
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the competent authority in the State Government. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 35
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Bihar State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department, for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 9, 21, 32, 40 and 41 in column (2) of the Table in paragraph 4, namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities,
(ii) widening and strengthening of existing roads and construction of new roads,
(iii) small scale industries not causing pollution,
(iv) cottage industries including village artisans, and
(v) rainwater harvesting:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): 36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) The activity relating to eco-tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, in consultation with Department of Forests and Environment of the State Government.
(c) The activity of eco-tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Ecosensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Bhimbandh Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond the distance of one kilometre from the boundary of the protected areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated area for eco-tourism facilities as per Tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for eco-tourism and expansion of existing eco-tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made therein. -
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 37
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Ecosensitive Zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil or noise pollution within the proposed Ecosensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- TABLE Sl.No. Activity Remarks

1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited except for the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal use.
(b) The mining operations shall strictly be in accordance with the orders of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon’ble Supreme Court dated the 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
5. Establishment of new major thermal and hydro-electric projects. Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws.
8. Discharge of untreated effluents and solid waste in natural water bodies or Prohibited (except as otherwise provided) as per applicable laws. 38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] land area. Regulated activities
9. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometre or up to the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Tourism Master Plan. Commercial eco-tourism establishments shall be regulated strictly in accordance with the guidelines for taking nonforestry activities in Wild life habitats" issued vide F.No.610/2011 WL, dated the 15 March, 2011 by the erstwhile Ministry of Environment and Forest (WL Division), New Delhi and National Tiger Conservation Authority Guidelines (if applicable).
10. Construction activities.
(a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any.
(b) Beyond one kilometre upto the extent of Eco-Sensitive Zone, construction for bone fide local needs shall be allowed and other construction activities and construction and augmentation of civic amenities shall be regulated as per the Zonal Master Plan.
11. Undertaking activities related to tourism like over-flying the national park area by aircraft, hot-air balloons. Regulated under applicable laws.
12. Trenching ground. Establishing of new trenching ground is prohibited and old trenching grounds shall be regulated under applicable laws.
13. Discharge of treated effluents and solid waste in natural water bodies or land area. Regulated under applicable laws.
14. Air and vehicular pollution. Regulated under applicable laws.
15. Noise pollution. Regulated under applicable laws.
16. Extraction of ground water. Regulated under applicable laws.
17. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
(c) In case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed.
18. Migratory graziers. Regulated under applicable laws and as per Zonal Master Plan.

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-
(i) Divisional Commissioner, Munger Division Revenue - Chairman;
(ii) An expert in the area of ecology and environment - Member; to be nominated by the Government of Bihar
20. Insulation of electric lines. Underground cabling shall be promoted and all existing electric lines passing through the Eco-sensitive Zone shall be adequately insulated in the time frame specified under the Zonal Master Plan.
21. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
22. Fencing of existing premises of hotels and lodges. Regulated under applicable laws. In order to allow free movement of wildlife, hotels or other commercial establishments within the Eco-sensitive Zone shall not fence their properties with barbed wire and no fence shall be higher than one meter. Any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan.
23. Fishing in rivers or water board. Regulated under applicable laws.
24. Collection of small fodder and other Non Timber Forest Product. Regulated under applicable laws.
25. Installation of mobile towers. Regulated under applicable laws.
26. Drastic change of agriculture system. Regulated under applicable laws.
27. Commercial use of natural water resource including ground water harvesting. Regulated under applicable laws.
28. Movement of vehicular traffic at night. Regulated under applicable laws.
29. Introduction of exotic species. Regulated under applicable laws.
30. Sign board and hoardings. Regulated under applicable laws.
31. Protection of hill slopes and river banks. No construction activity unless otherwise permitted by under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 meters and also upto 100 meters from the banks of any river, and natural nallah.
32. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
33. Construction of rope ways. Regulated under applicable laws.
34. Setting up of security coups. Regulated under applicable laws.
35. Eco-tourism activities Regulated under applicable laws.
36. Solid Waste Management Regulated under applicable laws. Promoted activities
37. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Shall be actively promoted.
38. Organic farming. Shall be actively promoted.
39. Adoption of green technology for all activities. Shall be actively promoted.
40. Cottage industries including village artisans. Shall be actively promoted.
41. Rain water harvesting. Shall be actively promoted.
42. Use of renewable energy sources. Shall be actively promoted.
43. Agro forestry. Shall be actively promoted.
44. Skill Development. Shall be actively promoted.

(iii) Representation of Agriculture Department, Government of Bihar - Member;
(iv) One representatives of Non-governmental Organisation - Member; (working in the field of environment including heritage conservation) to be nominated by the Government of India for a period of three years
(v) Representation of Department of Forests and Environment, - Member ; Government of Bihar
(vi) Regional Officer, Bihar State Pollution Control Board - Member;
(vii) Representation of Department of Water Resources, - Member; Government of Bihar
(viii) Member State Biodiversity Board - Member;
(ix) Concerned Divisional forest Officer Territorial - Member- Secretary.
(2) The tenure of the Committee shall be three years.
(3) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(4) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(5) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(6) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Park incharge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(7) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(8) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the State as per proforma given in Annexure V.
(9) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The provisions of this notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
