418.000 (AP/Orissa Border to Bhubaneshwar section), km 0.000 to km 27.800 & km 61.000 to km 200.000 (Bhubaneshwar to Balasore section) and km 27.800 to km 61.000 (Jagatpur to Chandikol section) of National Highway number 5 in the State of Orissa to the National Highways Authority of India (hereinafter referred to as the “Authority”);
And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) and in supersession of the National Highways (Temporary Bridges) Rules, 1964, the National Highways (Collection of Fees by any person for the Use of Section of National Highways/Permanent Bridge/Temporary Bridge on National Highways) Rules, 1997, the National Highways (Fees for the use of National Highway Section and Permanent Bridge-Public Funded Project) Rules, 1997 and the National Highways (Rate of Fees) Rules, 1997, has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R.
838 (E) dated the 5th Dec, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011 and G.S.R 778 (E) dated 16th December, 2013, G.S.R 26(E) dated 16th January, 2014 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels;
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), and in supersession of the notification bearing No. S.O. 2904 (E) dated 14.12.2012 as amended vide Sl. No. 49 of Table 1 of fee notification bearing S.O. No. 896 (E) dated 26.03.2014, the Central Government hereby levies the fee at the base rate specified in column (2) of Table 1 for net road section length of 77.799 km {including 76.539 km road and 0.126 Km of structure (having length more than 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 60 m) with equivalent length of 1.26 km} (hereinafter referred to as “base rate”) for use of the four and more lane sections on the Type of Vehicles specified in column (1) of Table 1 below, under the project of four laning of Sunakhala to Bhubaneswar section from Km 337.010 to Km 413.000 (new chainage from km 362.000 to km 286.010) of NH-16 (Old NH-5) in the State of Odisha and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:- TABLE 1 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees)

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for net road length specified for such Toll Plaza:

2. In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Toll Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10:

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the toll plaza is Rs. 225.00 (Rupees Two Hundred Twenty Five only) for the year 2014-15 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
4. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
6. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall not be permitted to use the National Highways for crossing the toll plaza unless the excess load has been removed from such mechanical vehicle. The driver or owner or a person incharge of such overloaded mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle under the Rules.
7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.
8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.
9. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
10. The Capital cost of the project is Rupees 385.825 Crore. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules. A total of Rs. 114.21 Crore has been recovered from the user fee realized till 30.06.2014
11. The increase in the rates of fee shall in no case be more than twenty-five percent of the rates of fee applicable in the immediately preceding year.
