12.07.2016, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from kilometer 299.000 to kilometer 418.750 (Hospet– Chitradurga Section) of NH- 13 (New NH - 50) in the State of Karnataka to the National Highways Authority of India (hereinafter referred to as the “Authority”);

4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] And whereas, in exercise of the powers conferred by Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement on 19.01.2012 (hereinafter referred to as said agreement) with M/s Hospet Chitradurga Tollways Limited having its registered office at 6- 3-1089/G/10&11, Gulmohar Avenue, Rajbhavan Road, Somajiguda, Hyderabad – 500082, Andhra Pradesh, India, (hereinafter referred to as the “Concessionaire”), for the bid submitted on 29.09.2011 for the development of the Hospet – Chitradurga (Km 299.000 to Km 418.600) Section of NH - 13 (New NH – 50) in the State of Karnataka (hereinafter referred to as the “said section”) to Four lane standards and operation and maintenance of the said section on Design, Build, Finance, Operate and Transfer (DBFOT) basis.

Accordingly, a notification authorizing M/s Hospet Chitradurga Tollways Limited was published vide S.O.

No. 2221(E) dated 22.07.2013. However, the contract agreement dated 19.01.2012 was terminated on

31.12.2013 and notification no. S.O. 2221(E) dated 22.07.2013 has not been implemented.

And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement on 10.06.2015 (hereinafter referred to as said agreement) with M/s Hampi Expressways Private Limited having its registered office at 6-Elphinstone Building, 2nd Floor, 10, Veer Nariman Road, Mumbai- 400001, India, (hereinafter referred to as the “Concessionaire”), for the bid submitted on 30.03.2015 for the development of the Hospet – Chitradurga (Km

299.000 to Km 418.750) Section of NH - 50 (Old NH – 13) in the State of Karnataka (hereinafter referred to as the “said section”) to Four lane standards and operation and maintenance of the said section on Design, Build, Finance, Operate and Transfer (DBFOT) basis.

Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011, G.S.R 778(E) dated 16th December, 2013, G.S.R 26(E) dated 16th January, 2014 & G.S.R. 831(E) dated 21st November, 2014 (hereinafter referred to as the “ said Rules”) and in supersession of the notification number S.O. 2221 (E) dated 22.07.2013, except as respects things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of four or more lane of the said section having net road length of 119.937 Km (59.924 Km + 60.013 Km) and for 2.430 Km (1.761 Km + 0.669 Km) equivalent length of structure (having 0.2430 Km of structure length of more than 60 m length) at the rates specified in columns (2) of the Table 1 (hereinafter referred to as “base rate”) on the Type of Vehicles specified in column (1) of the Table 1 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation declared by the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as per the said agreement;

The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 235.00 (Rupees Two Hundred Thirty only) for the year 2016-17, and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules,

2008.

4. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle.

6. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall not be permitted to use the National Highway or crossing the Toll Plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in charge of such overloaded mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to the Toll Collecting agency, equal to 10 times of the fee applicable to such category of mechanical vehicles under the rules.

7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rules.

8. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules.

9. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the Concessionaire and thereafter revised annually in accordance with the rule 5 of the said Rules and provisions of the Concession Agreement and will be published provided, that no revision shall be effected within a period of 6 (six) months from the date of the preceding revision of fee.
