PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 751] ubZ fnYyh] c`gLifrokj] ekpZ 16] 2017@iQkYxqu 25] 1938 No. 751] NEW DELHI, THURSDAY, MARCH 16, 2017/PHALGUNA 25, 1938 पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢालय अिधसचूना नई िदल् ली, 16 माचर्, 2017 का. आ. 837(अ).— महाराष् ᮝ राज् य मᱶ उमरेर करहन् डाला वन् यजीव अभयारण्य, नागपुर और बांᮤा िजलᲂ के चारᲂ ओर के क्षेᮢ को पािरिस्थितक संवेदी जोन के रूप मᱶ घोिषत करने के िलए एक भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं. का.आ. 2544(अ) तारीख 17 िसतम्बर, 2015 ᳇ारा उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने की संभावना थी, उस तारीख से, िजसको उस राजपᮢ की ᮧितयां, िजसमᱶ यह अिधसूचना अंतिव᳥ ह,ै उपलब्ध करा दी गई थᱭ, साठ िदन की अविध के भीतर आक्षेप और सुझाव आमिᮢत करते हुए एक ᮧारूप अिधसूचना ᮧकािशत की गई थी ;
और, उᲦ अिधसूचना वाले राजपᮢ की ᮧितयां 06 अक्टूबर, 2015 को पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की वेबसाइट पर जनता को उपलब्ध कराई गईं;
और, उᲦ ᮧारूप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधािरयᲂ से ᮧा᳙ आक्षेपᲂ और सुक्षावᲂ पर केन्ᮤीय सरकार ᳇ारा सम्यक रुप से िवचार िकया गया;
उमरेर करहन् डाला वन् यजीव अभयारण्य, महाराष् ᮝ के दो िजले नागपुर और बांᮤा के संगम पर िस् थत ह ैिजसके पूवᱮ ओर वेनगंगा नदी िस् थत ह ै। उमरेर करहन् डाला अभयारण्य के वन क्षेᮢ मᱶ ऐितहािसक, आिथक और औषधीय गुण के स् थल ह ᱹ और 63.230 वगर् िकलोमीटर के क्षेᮢ तक फैला हुआ है;
और, उमरेर करहन् डाला वन् यजीव अभयारण्य तारीख 29 जून, 2012 को महारा᳦ राज्य सरकार संख्या डब्ल्यूएलपी.2012/सीआर.186/एफ-1, की अिधसूचना ᳇ारा अिधसूिचत िकया गया ह;ै और, अभयारण्य पक्षी जीवजन्तु के िलए जाना जाता ह ैिजसमᱶ पिक्षयᲂ की ᮧजाितयᲂ मᱶ पटᲃकेल्स इन्डसस (पᱶट रेड मुगर् पक्षी), पावो िᮓस्टटस (मोर), गैलस सोननेतीई (ᮕे जंगल मुगᱮ), पेिडक्स पेिडक्स (ᮕे तीतर), टिनक्स मेलानोगस्टर (ब्लैक 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ᮩेस्टेड बटेर), टिनक्स ससेिसटर (भारतीय बस्टडर् बटेर), कोलाबा लाइिवया (ब्लू रॉक कबूतर), ᮕुस ᮕुस (सामान्य सारस), ᮕस एंटीगोन (ससर सारस), िस्पलोपेलीया िचनेिसस (स्पॉटीड फ़ाख़ता), नेटटापस कॉरोमेन्डेिलयनस (कॉटन चैती), डᱶᮟॉसीन जावानीका (लेसर िव्हस्टिलग चैती), िजप्सी इंडसस (इंिडयन िग), बुबो ज़ीलोनᱶिसस (ᮩाउन िफश उल्लू), कैरेल रूडी (पेड ᳴कगिफशर), टडᲃइड्स स्ᮝेटाटा (जंगल बैबलर), डायᯗयूरस मैᮓोककर् स (ब्लैक ᮟᲂगो), साइनाकोᲵा िᮓस्टटा (ब्लू जै), आिद सिम्मिलत ह;ᱹ और, क्षेᮢ मᱶ बहुत अिधक जीवजन्तु और वनस्पित िविवधता के साथ 22 स्तनपािययᲂ की ᮧजाितयां, लगभग 25 सरीसृपᲂ की ᮧजाितयां और उभयचर की कई ᮧजाितयां पाई जाती ह ᱹऔर इस क्षेᮢ के वनस्पित "5 ए/दिक्षणी उष्णकिटबंधीय शुष्क पणर्पाती वनᲂ" के ᳇ारा ᳒ोतक ह ैजैसे टेकटोना ᮕांिडस (टीक), मंिगफेरा इंिडका (आम), साइजीिगयम कुिमनी (जामुन), डाल्बिगया लैिटफोिलया (िशशम), हाडर्िविकया िबनाटा (अंजन), टिमनिलया बेलािरका (बेहाडा), टिमनिलया टोमᱶटोसा (ऐन), मधुका इंिडका (महुआ), ब्यूटा मोनोस्पामार् (पलास), इराईिᮣना इंिडका (पंगारा), अकेिशया कैटेचु (खैर), गरुगा पᱶटाटा (काकड), अजािदराछा इंिडका (नीम), िफकस रेसमोसा (अम्बेर) आिद वृक्षᲂ और किरसा कारांडास (कारवंड), बारलेिरया ᮧोिनटाइटीस (कोरंती), स्ᮝोिबलैन्थस कॉलोसस (करवी), िवटेक्स िनकंुडो (िनरगुडी) आिद झािड़यां सिम्मिलत ह;ᱹ और, क्षेᮢ महत्वपूणर् वन्यजीव जैसे पᱹथेरा िटगिरस (बाघ), पᱹथेरा पाडर्स (तᱶदआु), हनैा हनैा (धारीदार लकड़बग्घा), क्यून अल्पाइनस (भारतीय डोल), कैिनस ऑिरयस इंिडकस (िसयार), वुल्प्स बᱶगलᱶिसस (भारतीय लोमड़ी), बोसेलैफस ᮝेगोमेमेलस (नीलगाय), रुसा यूिनकोलर (सांभर), एिक्सस एिक्सस (िचᱫल), फेिलस चौस (जंगली िबल्ली), वीव᳷रकुला इंिडका (लघु भारतीय मुश्किबलाव), मुिनटास मंटजैक (मुंजक), हपᱷस्टेस एडवड्सर्इ (सामान्य ᮕ ेनेवला), मेलुरसरस अरिसनस (रीछ), आिद का संभरण ह;ै और, पूवᲃक् त विणत अभयारण्य का गठन करते ह,ᱹ िक मानव पयार्वास और चालू िवकास िᮓयाकलापᲂ से अित िनकटता उिचत सुरक्षोपायᲂ और ऐसे िᮓयाकलापᲂ पर समुिचत िनयंᮢण की अपेक्षाᲐ को आवश् यक बनाती ह;ै और, पािरिस्थितक और पयार्वरणीय दिृष् ट से पािरिस् थितक संवेदी जोन के रूप मᱶ उमरेर करहन् डाला वन् यजीव अभयारण्य के संरिक्षत क्षेᮢ, िजसका िवस् तार और सीमाएं इस अिधसूचना उपाबंध-I मᱶ िविन᳸दष् ट ह,ᱹ को संरिक्षत और सुरिक्षत करना आवश् यक ह ैतथा उᲦ पािरिस्थितक संवेदी जोन मᱶ उ᳒ोगᲂ के ᮧचालन या ᮧसंस्करण या उ᳒ोगᲂ के वगᲄ का ᮧचालन और ᮧसंस्करण करने को ᮧितिष करना आवश्यक ह;ै अतः, अब, केन्ᮤीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पिठत पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए, महाराष् ᮝ राज् य के नागपरु और बांᮤ ा िजलᲂ मᱶ उमरेर करहन् डाला वन् यजीव अभयारण्य की बाहरी सीमा से 63.230 वगर् िकलोमीटर तक के िवस् तािरत क्षेᮢ को उमरेर करहन् डाला वन् यजीव अभयारण्य पािरिस् थितकीय संवेदी जोन (िजसे इसमᱶ इसके पश् चात् पािरिस् थितक संवेदी जोन कहा गया ह)ै के रूप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथार्त् :--
1. पािरिस्थितक संवेदी जोन का िवस्तार और उसकी सीमाएं--(1) पािरिस् थितक संवेदी जोन का िवस् तार, उमरेर करहन् डाला वन् यजीव अभयारण्य की संरिक्षत क्षेᮢ के चारᲂ ओर 63.230 वगर् िकलोमीटर ह ै । उमरेर करहन् डाला वन् यजीव अभयारण्य महारा᳦ के बांᮤा िजल ेके पौवनी तालुका और नागपुर िजला के िभवापुर, कुही और उमरेदा तालुका के कुछ ᮕामᲂ मᱶ उᱫर अक्षांश 220 50’ 01’’ से 210 37’ 02’’ और पूवर् देशांतर 790 00' 25" से 790 26' 10" के बीच िस्थत ह ै । पािरिस्थितक संवेदी जोन की सीमा उपाबंध I मᱶ दी गई ह ै।
(2) अक्षांश और दशेांतर के साथ पािरिस्थितक संवेदी जोन का मानिचᮢ उपाबंध II के रूप मᱶ उपाब ह ै।
(3) भ-ूसमकक्ष संरिक्षत क्षेᮢ और पािरिस्थितक संवेदी जोन अिधसूचना के उपाबंध III तथा अक्षांश और दशेान्तर के साथ पािरिस्थितक संवेदी जोन के अंतगर्त आने वाले ᮕामᲂ की सूची उपाबंध IV के रूप मᱶ उपाब ह ᱹ। ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
2. पािरिस्थितक संवदेी जोन के िलए आंचिलक महायोजना –(1) राज्य सरकार, पािरिस् थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन की तारीख से दो वषर् की अविध के भीतर, स्थानीय ᳞िᲦयᲂ के परामशर् से, इस अिधसूचना मᱶ संलग् न अनुबंधᲂ के सामंजस् य से आंचिलक महायोजना तैयार करेगी । उक् त योजना राज् य सरकार मᱶ सक्षम ᮧािधकारी ᳇ारा अनुमोिदत होगी ।
(2) पािरिस् थितक संवेदी जोन के िलए आंचिलक महायोजना, राज् य सरकार ᳇ारा इस अिधसूचना मᱶ िविन᳸दष् ट रूप मᱶ ऐसी रीित मᱶ तथा सुसंगत कᱶ ᮤीय और राज् य िविधयᲂ के सामंजस् य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागर्िनदᱷश, यिद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, इसमᱶ पयार्वरणीय और पािरिस् थितक िवचारᲂ को समाकिलत करने के िलए राज् य के सभी संब िवभागᲂ के परामशर् से तैयार होगी, अथार्त्:--
(i) पयार्वरण;
(ii) वन और वन्यजीव ;
(iii) कृिष;
(iv) राजस् व;
(v) शहरी िवकास;
(vi) पयर्टन;
(vii) ᮕामीण िवकास;
(viii) िसचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका;
(x) पंचायती राज,
(xi) लोक िनमार्ण िवभाग ।
(4) महायोजना अनुमोिदत िव᳒मान भू-उपयोग, अवसंरचना और िᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक िक इस अिधसूचना मᱶ िविन᳸दष् ट न हᲂ और आंचिलक महायोजना मᱶ सभी अवसंरचना और िᮓयाकलापᲂ के सुधार के कारक तथा पािरिस् थितकीय अनुकूलता का संवधर्न करेगी ।
(5) आंचिलक महायोजना मᱶ अनाच्छािदत क्षेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरक्षण, आवाह क्षेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरक्षण, स्थानीय समुदायᲂ की आवश्यकताᲐ तथा पािरिस्थितकी और पयार्वरण से संबंिधत ऐसे अन्य पहलुᲐ, िजन पर ध्यान दनेा आवश्यक ह,ै के िलए उपबंध हᲂगे ।
(6) आंचिलक महायोजना सभी िव᳒मान पूजा स् थलᲂ, ᮕामᲂ और नगरीय बंदोबस्तᲂ, वनᲂ के ᮧकार और िकस् मᲂ, कृिष क्षेᮢᲂ, ऊपजाऊ भूिम, हिरत क्षेᮢ जैसे उ᳒ान और उसी ᮧकार के स् थान, उ᳒ान कृिष क्षेᮢ, आ᳸कडᲂ, झीलᲂ और अन्य जल िनकायᲂ का अभ्यकंन करेगी ।
(7) आंचिलक महायोजना पािरिस् थितक संवेदी जोन मᱶ िवकास के पािरिस् थितक अनुकूल िवकास और स् थानीय समुदायᲂ की आजीिवका को सुिनिश् चत करते हुए िविनयिमत होगी ।
(8) आंचिलक महायोजना, मानीटरी सिमित के िलए अिधसूचना के उपबंधᲂ के अधीन मानीटरी के कृत्यᲂ के पालन हतुे एक संदभर् दस्तावेज होगी ।
3. राज्य सरकार ᳇ारा िकए जान े वाल े उपाय-- राज्य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथार्त् :-- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(1) भ-ूउपयोग — पािरिस् थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष क्षेᮢᲂ, कृिष क्षेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचिन्हत िकए गए पाकᲄ और खुले स्थानᲂ का वािणिज्यक और औ᳒ोिगक संब िवकास िᮓयाकलापᲂ के िलए उपयोग या संपिरवतर्न नहᱭ होगा :
परंतु पािरिस्थितक संवेदी जोन के भीतर कृिष भूिम का संपिरवतर्न, के अधीन मानीटरी सिमित की िसफािरश पर और राज्य सरकार के पूवर् अनुमोदन से, स्थानीय िनवािसयᲂ की आवासीय जरूरतᲂ को पूरा करने के िलए और िन᳜िलिखत िᮓयाकलापᲂ को पूरा करने के िलए अनुज्ञात हᲂगे, अथार्त् :—
(i) िव᳒मान सड़कᲂ को चौड़ा करना और सुदढ़ृ बनाना तथा नई सड़कᲂ का सिन् नमार्ण;
(ii) अवसंरचना और नागिरक सुिवधाᲐ का िनमार्ण और नवीकरण;
(iii) ᮧदषूण कािरत न करने वाले लघु उ᳒ोग;
(iv) कुटीर उ᳒ोग, िजसके अंतगर्त ᮕामीण उ᳒ोग, सुिवधा भंडार और स् थानीय सुख-सुिवधाएं ह ᱹजो पािरिस्थितक पयर्टन को समिथत करती ह,ै िजसके अंतगर्त होम स्टे ह,ै और;
(v) पैरा 4 के अधीन दी गई ᮧो᳖त गितिविधयां:
परंतु यह और भी िक राज्य सरकार के पूवर् अनुमोदन और संिवधान के अनुच् छेद 244 या तत्समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकारᲂ की मान्यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिज्यक या उ᳒ोग िवकास िᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनुज्ञात नहᱭ होगा :
परंतु यह और भी िक पािरिस् थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ पाई जाने वाली कोई ᮢुिट मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् राज्य सरकार ᳇ारा ᮧत्येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुिट के संशोधन की भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को सूचना दनेी होगी :
परंतु यह और भी िक उपयुर्Ღ ᮢुिट के संशोधन मᱶ इस उप-पैरा के अधीन यथाउपबंिधत के िसवाय िकसी भी दशा मᱶ भू-उपयोग का पिरवतर्न सिम्मिलत नहᱭ होगा :
परंतु यह और भी िक हिरत क्षेᮢ जैसे वन क्षेᮢ, कृिष क्षेᮢ मᱶ कोई पािरणािमक कटौती नहᱭ होगी और अᮧयुक् त या अनुत् पादक कृिष क्षेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास िकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत.—आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ की पहचान की जाएगी और उनके संरक्षण और पुनरुद्भूतकरण के िलए योजना सिम् मिलत होगी और राज् य सरकार ᳇ारा ऐसे क्षेᮢᲂ पर या उनके िनकट िवकास िᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागर्िनदᱷश तैयार िकए जाएंगे ।
(3) पयर्टन.— (क) पािरिस्थितक संवेदी जोन के भीतर पयर्टन संबंधी िᮓयाकलाप, पयर्टन महायोजना के अनुसार हᲂगे, जो आंचिलक महायोजना का भाग रूप हᲂगे । (ख) पयर्टन महायोजना पयर्टन िवभाग ᳇ारा ᮓमश: राज् य सरकारᲂ के वन और पयार्वरण िवभाग के परामशर् से तैयार होगी । (ग) पयर्टन महायोजना आंचिलक महायोजना का घटक होगी । (ग) पयर्टन संबंधी िᮓयाकलाप िनम् निलिखत के अधीन िविनयिमत हᲂगे, अथार्त् :—
(i) उमरेर करहन् डाला वन् यजीव अभयारण्य की एक िकलोमीटर सीमा के भीतर होटलᲂ और िरसाटᲄ के नए संिनमार्ण अनुज्ञात नहᱭ हᲂगे िसवाय पािरिस् थितक अनुकूल पयर्टन िᮓयाकलापᲂ के संबंध मᱶ पयर्टकᲂ के िलए अस् थायी िनवास स् थानᲂ के; परंतु यह िक संरिक्षत के्षᮢ की सीमा से 1 िकलोमीटर की दरूी के आगे पािरिस् थितक संवेदी जोन तक नए होटलᲂ और िरसाटᲄ को स् थािपत करने के िलए अनुज्ञा पूवर् पिरभािषत और पदािभिहत क्षेᮢᲂ मᱶ केवल पयर्टन महायोजना के अनुसार पािरिस् थितक पयर्टन सुिवधाᲐ के िलए दी जाएगी;

(ii) पािरिस्थितक संवेदी जोन के भीतर सभी नए पयर्टन िᮓयाकलापᲂ या िव᳒मान पयर्टन िᮓयाकलापᲂ का िवस्तार राष् ᮝीय व् याᮖ संरक्षण ᮧािधकरण, पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय ᳇ारा जारी (समय-समय पर यथा- संशोिधत) मागर्िनदशेᲂ के अनुसार होगा िजसमᱶ पािरिस्थितक पयर्टन, पािरिस्थितक िशक्षा और पािरिस्थितक िवकास को महत्व िदया जाएगा और पािरिस्थितक संवेदी जोन की वहन क्षमता के अध्ययन पर आधािरत होगा ;
(iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव᳒मान पयर्टन िᮓयाकलापᲂ के िवस्तार को वास्तिवक स्थल िविन᳸द᳥ संवीक्षा तथा मानीटरी सिमित की िसफािरश पर आधािरत संबंिधत िविनयामक ᮧािधकािरयᲂ ᳇ारा अनुज्ञात िकया जाएगा ।
(4) नैसिगक िवरासत—पािरिस्थितक संवेदी जोन मᱶ महत्वपूणर् नैसिगक िवरासत के सभी स्थलᲂ जैसे सभी जीन कोश आरिक्षत क्षेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाᲐ, स्थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आिद की पहचान की जाएगी और उन्हᱶ पिररिक्षत िकया जाएगा तथा उनकी सुरक्षा और संरक्षा के िलए इस अिधसूचना के ᮧकाशन की तारीख से एक वषर् के भीतर, उपयुᲦ योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।
(5) मानव िनिमत िवरासत स् थल—पािरिस् थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िशल्प-तथ्य, ऐितहािसक, कलात्मक और सांस्कृितक महत्व के क्षेᮢᲂ की पहचान की जाएगी और इस अिधसूचना के ᮧकाशन की तारीख से एक वषर् के भीतर उनके संरक्षण की योजनाएं तैयार की जाएंगी तथा आंचिलक महायोजना मᱶ सिम्मिलत की जाएंगी ।
(6) ध् विन ᮧदषूण—पयार्वरण (संरक्षण) अिधिनयम 1986 के अधीन ध्विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 के उपबंधᲂ के अनुसार पािरिस्थितक संवेदी जोन मᱶ ध्विन ᮧदषूण के िनयंᮢण के िलए राज्य सरकार का पयार्वरण िवभाग या महारा᳦ राज्य िनयंᮢण बोडर् िविनयमᲂ को कायार्िन्वत करेगा ।
(7) वाय ु ᮧदषूण—पािरिस्थितक संवेदी जोन मᱶ, राज्य सरकार के पयार्वरण िवभाग वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार वायु ᮧदषूण के िनयंᮢण के िलए मागर्दशर्क िसांत और िविनयम तैयार करᱶगे ।
(8) बिह᮲ाव का िनस्सारण—पािरिस्थितक संवेदी जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण सामान्य मागर्दशर्क िसांतᲂ के िलए पयार्वरणीय ᮧदिूषत आच्छािदत के िनस्सारण के अंतगर्त पयार्वरणीय (संरक्षण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत रूप मᱶ होगा—
(i) पािरिस्थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय-समय पर यथासंशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलका ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा ;
(ii) स्थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के माध्यम से पुनःचिᮓत िकया जाएगा ;
(iv) अकाबर्िनक सामᮕी का िनपटान िकसी पयार्वरणीय स्वीकृत रीित मᱶ होगा ।
(10) जैव िचिकत् सीय अपिशष् ट—पािरिस्थितक संवेदी जोन मᱶ जैव िचिकत्सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. 343 (अ) तारीख 28 माचर्, 2016 ᳇ारा ᮧकािशत जैव िचिकत्सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(11) प्लािस्टक अपिश᳥ ᮧबधंन—पािरिस्थितक संवेदी जोन मᱶ प्लािस्टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 340(अ), तारीख 18 माचर्, 2016 ᳇ारा ᮧकािशत प्लािस्टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(12) िनमार्ण और िवध्वसं अपिश᳥ ᮧबधंन—पािरिस्थितक संवेदी जोन मᱶ संिनमार्ण और िवध्वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 317(अ), तारीख 29 माचर्, 2016 ᳇ारा ᮧकािशत संिनमार्ण और िवध्वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा ।
(13) यानीय यातायात—पिरवहन की यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत िकए जाएंगे और आंचिलक महायोजना के तैयार होने और राज् य सरकार के सक्षम ᮧािधकारी ᳇ारा अनुमोिदत होने तक, मानीटरी सिमित सुसंगत अिधिनयमᲂ के अधीन िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(14) औ᳒ोिगक इकाईया—ं (i) सरकारी राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन को या उसके प᳟ात् पािरिस्थितक संवेदी जोन के भीतर कोई नए ᮧदिूषत उ᳒ोगᲂ की स्थापना की अनुमित नहᱭ दी जाएगी।
(ii) पािरिस्थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण बोडर् के वगᱮकरण के भीतर िसफर् गैर- ᮧदिूषत उ᳒ोगᲂ की स्थापना की अनुमित दी जाएगी।
(15) पहाड़ी ढलानᲂ को सरंक्षण—पहाड़ी ढलानᲂ के संरक्षण के अंतगर्त:
क. आंचिलक महायोजना पहाड़ी ढलानᲂ पर क्षेᮢᲂ का संकेत होगा जहां िकसी भी संिनमार्ण की अनुमित नहᱭ दी जाएगी । ख. कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर िकसी भी संिनमार्ण की अनुमित नहᱭ दी जाएगी ।
(16) अगर यह आवश्यक समझता ह,ै इस अिधसूचना के ᮧावधानᲂ को ᮧभावी करने मᱶ केन्ᮤ सरकार और राज्य सरकार, अन्य उपायᲂ िन᳸द᳥ करेगा।
4. पािरिस्थितक सवंेदी जोन मᱶ ᮧितिष और िविनयिमत िकए जाने वाल ेिᮓयाकलापᲂ की सूची—पािरिस्थितक संवेदी जोन मᱶ सभी िᮓयाकलाप पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और इसके अधीन बनाए गए िनयमᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथार्त् :— सारणी ᮓम सं. िᮓयाकलाप टीका-िटप्पणी
(1) (2) (3) ᮧितिष िᮓयाकलाप :
(1) वािणिज्यक खनन, पत्थर की खदान और उनको तोड़ने की इकाइयां । (क) सभी ᮧकार के खनन, पत्थर की खानᱶ और उनको तोड़ने की इकाइयां के िसवाय नहᱭ हᲂगी ;
(ख) खनन संिᮓयाएं, माननीय उᲬतम न्यायालय की िरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमर्न िथरुमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अगस्त, 2006 और िरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतिरम आदशे के अनुसरण मᱶ सवर्दा ᮧचालन होगा । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
(2) आरा िमलᲂ की स्थापना । पािरिस्थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िवस् तार अनुज्ञात नहᱭ होगा ।
(3) जल या वायु या मृदा या ध् विन ᮧदषूण कािरत करने वाले उ᳒ोगᲂ की स् थापना । पािरिस्थितक संवेदी जोन के भीतर िकसी नए और ᮧदषूण कािरत करने वाले िव᳒मान उ᳒ोगᲂ का िवस् तार अनुज्ञात नहᱭ होगा ।
(4) बृहत थमर्ल और जल िव᳒ुत पिरयोजनाᲐ की स्थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
(5) िकसी पिरसंकटमय पदाथᲄ का उपयोग या उत्पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
(6) ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ अनुपचािरत बिह᮲ार्व और ठोस अपिश᳥ᲂ का िनस्सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
(7) नए काष् ठ आधािरत उ᳒ोग। पािरिस् थितक संवेदी जोन की सीमाᲐ के भीतर नए काष् ठ आधािरत उ᳒ोग की स् थापना को अनुज्ञात नहᱭ िकया जाएगा :
परंतु िव᳒मान नए का᳧ आधािरत उ᳒ोग िविध के चालू रह सकते ह ᱹ।
(8) बड़े वािणिज्यक पशुधन और मुगᱮ पालन फामᲄ ᳇ारा फमᲄ, कॉरपोरेट, कंपिनयᲂ की स्थापना । स्थानीय आवश्यकताᲐ को पूरी करने के िलए के िसवाय, लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
(9) ईंट भᲵᲂ की स्थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे। िविनयिमत िᮓयाकलाप
(10) होटलᲂ और िरसोटᲄ की स्थापना । पािरिस्थितक अनुकूल पयर्टन िᮓयाकलाप से संबंधी पयर्टकᲂ को अस्थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिक्षत क्षेᮢ सीमा के एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन सीमा, जो भी िनकटतर हो, कोई नया वािणिज्यक होटल और िरसोटर् अनुज्ञात नहᱭ हᲂगे । परंतु पािरिस्थितक संवेदी जोन के एक िकलोमीटर से परे या पािरिस्थितक संवेदी जोन के िवस्तार तक सभी नए पयर्टन िᮓयाकलाप या िव᳒मान िᮓयाकलापᲂ का िवस्तार पयर्टन महायोजना और रा᳦ीय ᳞ाᮖ संरक्षण ᮧािधकरण के मागर्-िनदᱷशᲂ के अनुरूप हᲂगे ।
(11) संिनमार्ण िᮓयाकलाप । (क) िकसी िकस्म का कोई नया वािणिज्यक संिनमार्ण संरिक्षत क्षेᮢ की सीमा से 1 िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन की सीमा तक, जो भी िनकटᱫर हो अनुज्ञात नहᱭ होगा । परन्तु यह िक स्थानीय िनवािसयᲂ को उनकी घरेलू आवश्यकताᲐ, िजनके अंतगर्त पैरा 3 के उप-पैरा (1) मᱶ सूचीब िᮓयाकलाप भी ह,ᱹ के िलए अनुज्ञात िकया हᲂगे :
परन्तु यह और िक ᮧदषूण कािरत न करने वाले उ᳒ोगᲂ से संबंिधत संि᳖मार्ण िᮓयाकलाप यथा लागू िनयमᲂ और िविनयमᲂ, यिद कोई हᲂ, के अनुसार सक्षम ᮧािधकारी की पूवर् अनुमित से िविनयिमत हᲂगे और न्यूनतम पर रखे जाएंगे ।
(12) भूिमगत जल का िनष् कषर्ण। स्थानीय लोगᲂ की पेयजल या कृिष अपेक्षाᲐ को पूरा करने के िलए लागू िविधयᲂ के अधीन िविनयिमत होगा।
(13) वृक्षᲂ की कटाई । (क) राज्य सरकार मᱶ सक्षम ᮧािधकारी की पूवर् अनुमित के िबना वन, सरकारी या राजस्व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृक्षᲂ की कटाई नहᱭ होगी । (ख) वृक्षᲂ की कटाई, संबंिधत कᱶ ᮤीय या राज्य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार िविनयिमत होगी । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(14) िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पिरिनमार्ण । लागू िविधयᲂ के अधीन िविनयिमत (भूिमगत केबलᲂ को ᮧोत्साहन दनेा)
(15) अवसंरचना िजसके अंतगर्त नागिरक सुिवधाएं ह ᱹ। शमन उपायᲂ के साथ लागू िविधयᲂ, िनयमᲂ और िविनयमᲂ और उपलब्ध मागर्दशर्क िसांतᲂ के अनुसार िकया जाएगा ।
(16) िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना । उिचत पयार्वरण समाघात िनधार्रण और न् यूनीकरण उपाय यथा लागू अनुसार हᲂगे ।
(17) रािᮢ मᱶ यािनक पिरवहन का संचलन । लागू िविधयᲂ के अधीन वािणिज्यक ᮧयोजन के िलए िविनयिमत हᲂगे।
(18) िवदेशी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(19) वािणिज्यक जल संसाधन िजसके अंतगर्त भू-जल संचयन भी ह ै। (क) भूिम के अिधभोगी के वास्तिवक कृिष और घरेलू खपत के िलए ही जल का सतही और भूिमगत जल िनष्कषर्ण अनुज्ञात होगा । (ख) औ᳒ोिगक या वािणिज्यक उपयोग के िलए सतही और भूिमगत जल के िनष्कषर्ण के िलए संबंिधत िविनयामक ᮧािधकारी से पूवर् िलिखत अनुज्ञा अपेिक्षत होगी िजसके अंतगर्त िकतने पिरमाण मᱶ वह िनष्कषर्ण करेगा, भी ह ै। (ग) सतही या भूजल का िवᮓय अनुज्ञात नहᱭ होगा । (घ) िकसी भी ᮲ोत से, िजसके अंतगर्त कृिष भी है, जल के संदषूण या ᮧदषूण को रोकने के िलए सभी उपाय िकए जाएंगे ।
(20) प् लािस् टक के थैलᲂ का उपयोग । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
(21) पहाड़ी ढलानᲂ और नदी तटᲂ संरक्षण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(22) ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ उपचािरत बिह᮲ार्व का िनस्सारण । उपचािरत बिह᮲ार्व के पुनचᮓण को ᮧोत्सािहत करना और अबमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
(23) वािणिज्यक साइनबोडर् और होिडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(24) ᮧदषूण कािरत न करने वाले लघु उ᳒ोग। पािरिस् थितक संवेदी जोन मᱶ दशेीय माल से उत् पादᲂ का उत् पादन करने वाले गैर ᮧदषूण, गैर पिरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधािरत ऐसे उ᳒ोग जो पयार्वरण पर कोई िवपरीत ᮧभाव नहᱭ डालते ह,ᱹ अनुज्ञात िकए जाएंगे ।
(25) वन उत्पादᲂ और गैर का᳧ वन उत्पादᲂ का संᮕहण (एन.टी.एफ.पी.) । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(26) वायु और यानीय ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(27) ध्विन ᮧदषूण । राज्य सरकार का पयार्वरण िवभाग या कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् पािरिस्थितक संवेदी जोन मᱶ ध्विन ᮧदषूण के िनयंᮢण के िलए िविनयमᲂ का अनुपालन ध्विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 मᱶ पयार्वरण (संरक्षण) अिधिनयम, 1986 के अधीन उपदिशत उपबंधᲂ के अनुसार करᱶगे ।
(28) कृिष या अन्य उपयोग हेतु खुले हुए कुएं, बोरवेल आिद। िविनयिमत और इस िᮓयाकलाप की समुिचत ᮧािधकारी ᳇ारा सख्ती से मानीटरी की जानी चािहए ।
(29) ठोस अपिश᳥ ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(30) पािरिस् थितक-पयर्टन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(31) पयर्टन से संबंिधत िᮓयाकलाप जैसे गमर् वायु गुब्बारᲂ आिद ᳇ारा उमरेर करहन्डाला वन्यजीव अभयारण्य क्षेᮢ के ऊपर से उड़ना जैसे िᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 संविधत िᮓयाकलाप
(32) डेयरी, डेयरी उ᳒ोग, एक् वाकल् चर और मत् स् य उ᳒ोग के साथ स्थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी गितिविधयां । सिᮓय रूप से बढ़ावा िदया जाएगा ।
(33) जैिवक खेती । सिᮓय रूप से बढ़ावा िदया जाएगा ।
(34) सभी गितिविधयᲂ के िलए हिरत ᮧौ᳒ोिगकी को ᮕहण करना । सिᮓय रूप से बढ़ावा िदया जाएगा ।
(35) कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण कारीगर भी ह ᱹ। सिᮓय रूप से बढ़ावा िदया जाएगा ।
(36) वषार् जल संचयन । सिᮓय रूप से बढ़ावा िदया जाएगा ।
(37) नवीकरणीय ऊजार् ᮲ोत का उपयोग । सिᮓय रूप से बढ़ावा िदया जाएगा ।
(38) कृिष वािनकी । सिᮓय रूप से बढ़ावा िदया जाएगा ।
(39) पयार्वरणीय जागरूकता । सिᮓय रूप से बढ़ावा िदया जाएगा ।
(40) कौशल िवकास । सिᮓय रूप से बढ़ावा िदया जाएगा ।
(41) िन᳜कोिटकृत भूिम/वनᲂ/वास का पुनरुार। सिᮓ य रूप से बढ़ावा िदया जाएगा ।
5. मानीटरी सिमित—(1) कᱶ ᮤीय सरकार, महाराष् ᮝ राज् य के अंतगर्त आने वाल ेपािरिस्थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित गिठत करती ह ैजो िन᳜िलिखत से िमलकर बनगेी, अथार्त ्:—
1. कलेक् टर, नागपरु िजला - अध्यक्ष;
2. कलेक् टर, बांᮤा िजला का ᮧितिनिध - सदस् य;
3. िजला पिरषद,् नागपरु िजला का ᮧितिनिध - सदस् य;
4. िजला पिरषद,् बांᮤा िजला का ᮧितिनिध - सदस् य;
5. गरै सरकारी संगठन का ᮧितिनिध जो पयार्वरण के क्षेᮢ मᱶ कायर् कर रहा ह,ै उसे राज् य सरकार ᳇ारा ᮧत्यके मामले मᱶ तीन वषर् की अविध के िलए नामिन᳸दष् ट िकया जाएगा – सदस् य;
6. पािरिस् थितक और पयार्वरण के क्षेᮢ मᱶ एक िवशेषज्ञ िजसे महाराष् ᮝ राज् य सरकार ᳇ारा ᮧत्येक मामले मᱶ तीन वषर् के िलए नामिन᳸दष् ट िकया जाएगा - सदस् य;
7. क्षेᮢीय अिधकारी, महाराष् ᮝ राज् य ᮧदषूण िनयंᮢ ण बोडर्, नागपुर िजला - सदस् य;
8. पᱶच ᳞ाᮖ पिरयोजना, नागपरु िजला के मुख् य वन संरक्षक और क्षेᮢ ीय िनदशेक का ᮧितिनिध - सदस् य;
9. क्षेᮢ के विरष् ठ नगर योजनाकार, नागपुर िजला - सदस् य;
10. क्षेᮢ के विरष् ठ नगर योजनाकार, बांᮤा िजला - सदस् य;
11. महाराष् ᮝ राज् य के पयार्वरण िवभाग का ᮧितिनिध - सदस् य;
12. जैव-िविवधता बोडर् का सदस्य - सदस् य;

6. िनदᱷश और िनबधंन—
(1) मानीटरी सिमित का कायर्काल तीन वषर् का होगा ।
(2) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(3) पािरिस्थितक संवेदी जोन मᱶ भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना सं.
का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अनुसचूी के अधीन सिम्मिलत िᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ िविन᳸दष् ट ᮧितिष गितिविधयᲂ के िसवाय आने वाल े ऐसे िᮓयाकलापᲂ की दशा मᱶ वास्तिवक िविन᳸द᳥ स्थलीय दशाᲐ पर आधािरत मानीटरी सिमित ᳇ारा संवीक्षा की जाएगी और उᲦ अिधसचूना के उपबंधᲂ के अधीन पूवर् पयार्वरण िनकासी के िलए केन्ᮤीय सरकार के पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢालय को िन᳸द᳥ की जाएगी ।
(4) इस अिधसचूना के पैरा 4 के अधीन यथािविन᳸द᳥ ᮧितिष िᮓयाकलापᲂ के िसवाय, भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसचूना संख्यांक का.आ. 1533(अ) तारीख 14 िसतबंर, 2006 की अिधसूचना के अनुसचूी के अधीन ऐस ेिᮓयाकलापᲂ, िजन्हᱶ सिम्मिलत नहᱭ िकया गया ह,ै परंत ुपािरिस्थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐसे िᮓयाकलापᲂ की वास्तिवक िविन᳸द᳥ स्थलीय दशाᲐ पर आधािरत मानीटरी सिमित ᳇ारा संवीक्षा की जाएगी और उस े संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ िकया जाएगा ।
(5) मानीटरी सिमित का सदस्य-सिचव या संब कलक्टर या संबंिधत उ᳒ान उप वन सरंक्षक ऐसे ᳞िᲦ के िवरु, जो इस अिधसचूना के िकसी उपबंध का उल्लघंन करता ह,ै पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 19 के अधीन पिरवाद फाइल करन ेके िलए सक्षम होगा ।

8. कोई अन् य महत् वपूणर् िवषय । [फा. सं. 25/44/2015-ईएसजेड-आरई] लिलत कपूर, वैज्ञािनक ‘जी’ 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIORNMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 16th March, 2017 S.O. 837(E).—WHEREAS, a draft notification, declaring Eco-Sensitive Zone around Umred Karhandla Wildlife Sanctuary in Nagpur and Bhandara Districts in the State of Maharashtra was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forests and Climate Change number S.O. 2544 (E), dated 17 September 2015 inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the Public;
AND WHEREAS, copies of the Gazette containing the said notification were made available to the Public on website of the Ministry of Environment, Forests and Climate Change on 6th October, 2015;
AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government.
WHEREAS, the Umred Karhandla Wildlife Sanctuary, is located on the junction of Nagpur and Bhandara in Maharashtra with Wainganga River on Eastern side and the said Sanctuary is having historical, economic and medicinal values and spread over an area of 63.230 square kilometres;
AND WHEREAS, the Umred Karhandla Wildlife Sanctuary is notified vide notification of the Government of Maharashtra number WLP. 2012/C.R.186/ F-1, dated the 29thJune, 2012;
AND WHEREAS, the Sanctuary is known for avifauna with species of birds including Pterocles indicus (Painted sand grouse), Pavo cristatus (Peacock), Gallus sonneratii (Grey jungle fowl), Perdix perdix (Grey partridge), Turnix melanogaster (Black breasted quail), Turnix suscitator (Indian bustard quail), Columba livia (Blue rock pigeon), Grus grus (Common Crane), Grus antigone (Sarus crane), Spilopelia chinensis (Spotted Dove), Nettapus coromandelianus (Cotton teal), Dendrocygna javanica (Lesser Whistling teal), Gyps indicus (Indian Vulture), Bubo zeylonensis (Brown fish owl), Ceryle rudis (Pied kingfisher), Turdoides striata (Jungle babbler), Dicrurus macrocercus (Black drongo), Cyanocitta cristata (Blue jay), etc;
AND WHEREAS, the area has very high faunal and floral diversity with about 22 species of mammals, about 25 species of reptiles and many species of amphibian are found and the flora of this area is represented by “5A/Southern tropical DryDeciduous Forests” including species like Tectona grandis (Teak), Mangifera indica (Mango), Syzygium cumini (Jamun), Dalbergia latifolia (Sisham), Hardwickia binata (Anjan), Terminalia bellarica (Behada), Terminalia tomentosa (Ain), Madhuca indica (Mahua), Butea monosperma (Palas), Erythrina indica (Pangara), Acacia catechu (Khair), Garuga pinnata (Kakad), Azadirachta indica (Neem), Ficus racemosa (Umber), etc. among trees and Carissa carandas (Karvand), Barleria prionitis (Koranti), Strobilanthes callosus (Karvi), Vitex negundo (Nirgudi), etc., among shrubs;
AND WHEREAS, the area also supports important wildlife such as Panthera tigris (Tiger), Panthera pardus (Leopard), Hyaena hyaena (Striped Hyena), Cuon alpinus (Indian Dole), Canis aureus indicus (Jackal), Vulpes bengalensis (Indian fox), Boselaphus tragocamelus (Nilgai), Rusa unicolor (Sambar), Axis axis (Chital), Felis chaus (Jungle Cat), Viverricula indica (Small Indian Civet), Muntiacus muntjak (Barking Deer), Herpestes edwardsii (Common Grey Mongoose), Melursus ursinus (Sloth bear), etc;
AND WHEREAS, the extremely close vicinity of the aforesaid Sanctuary to human habitation and ongoing developmental activities, necessitate the requirement of proper safeguards and control over such activities;
AND WHEREAS, it is necessary to conserve and protect the area, extent and boundaries of which are specified in Annexure-I of this notification, around the protected area of Umred Karhandla Wildlife Sanctuary, as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub section (1) and clauses (v) and (xiv) of subsection (2) of section 3 of the Environment (Protection) Act 1986 (29 of 1986), read with sub rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of 63.230 square kilometres around the outer boundry of the Umred Karhandla Wildlife Sanctuary in Nagpur and Bhandara Districts in the State of Maharashtra as the Umred Karhandla Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone—(1) The Eco-sensitive Zone is spread over an area of
63.230 square kilometres with an extent of 130 meters to 2.5 kilometres around the protected area of Umred Karhandla Wildlife Sanctuary situated including villages of Bhiwapur, Kuhi and Umred taluka of Nagpur District and Paoni Taluka of Bhandara District of Maharashtra between North 220 50’ 01’’ to 210 37’ 02’’ Lattitude and between East 790 00' 25" to 790 26' 10" Longitude. The boundary description of Eco-sensitive Zone is given in Annexure - I.

(2) The map of the Eco-sensitive Zone along with latitude and longitude is appended as Annexure - II.
(3) The Geo-coordinates of protected area and the Eco-sensitive Zone are appended to this notification as Annexure- III and the list of the villages falling within Eco-Sensitive Zone with latitude and longitude is annexed as Annexure - IV.
2. Zonal Master Plan for Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for consideration and approval of the Competent authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions of monitoring under the provisions of this notification.
3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.—Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or industrial activities:
Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents and for the following activities, namely.
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under para 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.—(a) All new eco-tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 kilometre from the boundary of the Umred Karhandla Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer, however, beyond the distance of 1 kilometre from the boundary of the said Sanctuary till the extent of the Eco-sensitive Zone whichever is nearer, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up as part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.—The Environment Department of the State Government or State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
(7) Air pollution.—The Environment Department of the State Government or State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.

(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein. -
(9) Solid wastes.—Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343(E), dated the 28th March, 2016, as amended from time to time.
(11) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317 (E), dated the 29th March, 2016, as amended from time to time.
(13) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(14) Industrial units.—(i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed to be established within Eco-sensitive Zone as per the Central Pollution Control Board’s categorisation.
(15) Protection of hill slopes.—The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
16. The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.—All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under and be regulated in the manner specified in the Table below, namely:- TABLE S. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No. 202 of 1995 and dated 21th April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No. 435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
4. Establishment of new major hydroelectric projects and irrigation projects.
Prohibited (except as otherwise provided) as per applicable laws.
5. Use, production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
6. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
7. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone:
Provided the existing wood-based industry may continue as per law:
8. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
Regulated Activities
10. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or up to the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the Protected Area or upto the extent of Ecosensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided further that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per applicable building byelaws:
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any.
12. Extraction of ground water Regulated under applicable laws to meet the drinking water or agricultural requirement of locals.
13. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
14. Erection of electrical and communication towers and laying of cables and other infrastructures Regulated under applicable law (underground cabling may be promoted).
15. Infrastructure including civic amenities Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
16. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

5. Monitoring Committee.—The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
1. Collector, Nagpur District Chairman;
2. A Representative of Collector, Bhandara District Member;
3. A Representative of Zilla Parishad, Nagpur District Member;
17. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws.
18. Introduction of exotic species. Regulated under applicable laws.
19. Uses of plastic carry bags. Regulated under applicable laws.
20. Protection of hill slopes and river banks. Regulated under applicable laws.
21. Discharge of treated effluents in natural water bodies or land area.
The discharge of treated effluent shall be regulated as per applicable laws and efforts shall be made to recycle/re-use the treated effluent.
22. Commercial sign boards and hoardings. Regulated under applicable laws.
23. Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
24. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
25. Air and vehicular pollution Regulations for the control of air pollution in the Ecosensitive Zone shall be in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with.
26. Noise pollution Control of noise pollution in the Eco-sensitive Zone shall be in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
27. Open Well, Bore Well ,etc. for agriculture or other usage Regulated and the activity shall be strictly monitored by the concerned appropriate authority.
28. Solid Waste Management. Management of solid waste shall be as per the provisions of the Solid Waste Management Rules, 2016 under Environment (Protection) Act, 1986.
29. Eco-tourism Regulated under applicable laws.
30. Undertaking activities related to eco-tourism like over-flying the Umred Karnadhla Wildlife Sanctuary Area by aircraft, hot-air balloons.
Regulated under applicable laws.
Promoted Activities
31. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

6. Terms of Reference.—
(1) The tenure of monitoring committee shall be for three years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V.
(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal .
