PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 752] ubZ fnYyh] c`gLifrokj] ekpZ 16] 2017@iQkYxqu 25] 1938 No. 752] NEW DELHI, THURSDAY, MARCH 16, 2017/PHALGUNA 25, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय अिधसचूना नई ᳰद᭨ ली, 16 माचᭅ, 2017 का.आ. 838(अ).—एक ᮧाᱧप अिधसूचना भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना स.ं का.आ. 2539(अ), तारीख 17 िसत᭥बर, 2015, ᳇ारा भारत के राजपᮢ असाधारण मᱶ उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ सभंावना थी, उस तारीख से, िजसको उᲦ अिधसूचना से यᲦु राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ध करा दी गई थᱭ, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सᭃुाव आमंिᮢत करत ेᱟए ᮧकािशत कᳱ गई थी;
और, उᲦ अिधसूचना से यᲦु राजपᮢ कᳱ ᮧितया ंजनता को 17 िसत᭥बर, 2015 को उपल᭣ध करा दी गई थᱭ;
और, ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सझुावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक् ᱨप से िवचार ᳰकया गया;
और, दरांगघाटी व᭠ यजीव अभयार᭛ य, िहमाचल ᮧदेश के रामपुर, िजला िशमला मᱶ अवि᭭ थत ह ैऔर 770 46' 20'' स े 770 47' 32'' पूवᭅ देशातंर और 310 24' 03'' स े310 26' 42'' उᱫरी अᭃाशं के म᭟य 167 वगᭅ ᳰकलोमीटर के ᭃेᮢ तक इसका िव᭭तार ह ै। और, इस अभयार᭛ य मᱶ वन᭭पितयां एवं जीव-ज᭠त ुकᳱ जैव-िविवधता कᳱ संप᳖ता को दशाᭅत ेह ᱹ। तीतर कᳱ सकंटप᳖ ᮧजाितयाँ जैस ेपि᳟मी ᮝागोपन (ᮝोगोपानᭅ मलेानसेफेलस), चीर तीतर (कैटरस वािलची) इस ᭃेᮢ मᱶ पाये जाते ह;ै इस ᭃेᮢ मᱶ क᭭तूरी िहरण (मोशस ᮓायसोगा᭭टर) जसैी संकटाप᳖ ᭭तनपायी भी पाये जाते ह ᱹऔर अ᭠य मुय ᮧजाितया ँिहमालयन मोनल (लोफोफोरस इ᭥पिेनयस), कोकलाश तीतर (पᮓिसया मᮓैोओलोफा) और कालीज तीतर (लोफरा ᭨यूकोमेलन), िहमािलयन थार, (हिेमᮢगस जे᭥लािहस), घोरल (नीमोहाᭅडस गोरल), सेराव (एन. समुाᮢािसस), भरूा भालू (उसᭅस आकᭅ टोस), एिशयाᳯटक काला भालू (उसᭅस िथबेटनस), मुंजक (मिुनटास मंटजाक), और तᱶदआु (पᱶथेरा पाडᭅस) आᳰद पाये जाते ह;ै और, पाᳯरि᭭थितक, पयाᭅवरणीय और जैव िविवधता कᳱ दिृ᭬ ट से पाᳯरि᭭ थितकᳱय संवेदी जोन के ᱨप मᱶ दरांगघाटी व᭠ यजीव अभयार᭛ य के चारᲂ ओर के संरिᭃत ᭃेᮢ िजसका िव᭭तार और सीमाए ँपैरा 1 मᱶ िविन᳸द᳥ ह ैसंरिᭃत और सरुिᭃत 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] करना आव᭫ यक ह ैतथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ का वगᲄ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह ै;
अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (सरंᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (सरंᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, दरांगघाटी व᭠ यजीव अभयार᭛ य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᳟ात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ िहमाचल ᮧदशे रा᭔य मᱶ दरागंघाटी व᭠यजीव अभयार᭛ य, कᳱ सीमा के चारᲂ ओर 375 मीटर तक के िव᭭तार ᭃेᮢ को अिधसूिचत करती है िजसके ᭣यौरे िन᳜ानुसार ह,ᱹ अथाᭅत्:-
1. पाᳯरि᭭थितक सवंदेी जोन का िव᭭तार और उसकᳱ सीमाएं.—(1) पाᳯरि᭭ थितक संवेदी जोन, दरांगघाटी व᭠ यजीव अभयार᭛ य कᳱ सीमा के चारᲂ ओर 375 मीटर तक कᳱ सीमा से 22.5 वगᭅ ᳰकलोमीटर होगा तथा पाᳯरि᭭थितक संवेदी जोन कᳱ सीमाᲐ और इसके अᭃांश और दशेा᭠तर के साथ मानिचᮢ उपाबधं I के ᱨप मᱶ उपाब ह ै।
(2) पाᳯरि᭭ थितक संवेदी जोन मᱶ कोई ᮕाम नहᱭ आता है ᳰक᭠तु नजदीक के ᮕाम वनᲂ के वा᭭तिवक उपयोग पर िनभᭅर ह ै।
(3) दरांगघाटी व᭠ यजीव अभयार᭛ य कᳱ सीमा का ᭣ यौरा उपाबधं II मᱶ ᳰदए गए ह ᱹऔर दरागंघाटी व᭠ यजीव अभयार᭛ य और भमूंडलीय ि᭭थित ᮧणाली िनदᱷशाकंᲂ के िनबंधनᲂ मᱶ इसका पाᳯरि᭭ थितक संवेदी जोन उपाबधं III मᱶ वᳶणत ह।ै
2. पाᳯरि᭭थितक सवंदेी जोन के िलए आचंिलक महायोजना.—(1) रा᭔ य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख स ेदो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ स ेऔर इस अिधसूचना मᱶ सलं न अनबंुधᲂ के सामजं᭭ य से, एक आचंिलक महायोजना तैयार करेगी और उ त योजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(2) पाᳯरि᭭ थितक संवेदी जोन के िलए आंचिलक महायोजना, रा᭔ य सरकार ᳇ारा इस अिधसचूना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित मᱶ तथा ससुंगत कᱶ ᮤीय और रा᭔ य सरकार कᳱ िविधयᲂ के सामजं᭭ य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(3) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करन े के िलए संब रा᭔ य के सभी िवभागᲂ के परामशᭅ स ेउᲦ योजना तैयार कᳱ जाएगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन और व᭠यजीव;
(iii) कृिष;
(iv) राज᭭ व ;
(v) नगर िवकास ;
(vi) पयᭅटन;
(vii) ᮕामीण िवकास;
(viii) ᳲसचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िनमाᭅण िवभाग।
(4) आंचिलक महायोजना अनमुोᳰदत िव᳒मान भ-ूउपयोग, अवसरंचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हो और आंचिलक महायोजना मᱶ सभी अवसंरचना मᱶ दᭃता और पाᳯरि᭭थितकᳱय अनकूुलता का संवधᭅन करेगी ।
(5) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-सभंरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मदृा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐस ेअ᭠य पहलᲐू, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(6) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 जनजातीय ᭃेᮢ, कृिष ᭃेᮢᲂ, ऊपजाऊ भिूम, हᳯरत ᭃेᮢ जसै ेउ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का मानिचᮢᲂ के साथ अ᭤यकंन करेगी और योजना को मानिचᮢᲂ मᱶ ᳰदए गए िव᳒मान तथा ᮧ᭭तािवत भूिम उपयोग सुिवधाᲐ के िववरण ᳇ारा समᳶथत ᳰकया जाएगा।
(7) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास के पाᳯरि᭭ थितक अनकूुल िवकास और ᭭ थानीय समदुायᲂ कᳱ आजीिवका को सिुनि᭫ चत करते ᱟए िविनयिमत होगी ।
(8) आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के संबंध मᱶ अपन ेकायᲄ के बाहर ल ेजान े के िलए िनगरानी सिमित के िलए एक सदंभᭅ द᭭तावेज तैयार करेगी ।
3. रा᭔ य सरकार ᳇ारा ᳰकए जान े वाल े उपाय.—रा᭔ य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन े के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग.—(क) पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुल े᭭थानᲂ को ᮧमुख वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा और मानिचᮢ के साथ आंचिलक महायोजना मᱶ ᭭प᳥ ᱨप से ऐसे ᭃेᮢᲂ को िनधाᭅᳯरत ᳰकया गया ह:ै (ख) परंत ुपाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का सपंᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनमुोदन स,े ᭃेᮢीय नगर योजना अिधिनयम के तहत सᭃम ᮧािधकारी के पूवᭅ अनमुोदन के साथ और के᭠ᮤीय/रा᭔य सरकार के अ᭠य िनयमᲂ और िविनयमᲂ के ᱨप मᱶ लागू हᲂगे, जो ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए ह,ै जैस:े-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढ़ृ करना तथा नई सड़कᲂ का सिंनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का सिंनमाᭅण और नवीकरण;
(iii) ᮧदषूण उ᭜प᳖ न करन ेवाल ेलघ ुउ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर ह;ᱹ सिुवधाजनक भ᭛डार और ᭭थानीय सुिवधाᲐ सहायक पाᳯरि᭭थितक पयᭅटन मᱶ सि᭥मिलत ᮕह वास; और
(v) संवᳶधत ᳰᮓयाकलाप और अनु᭒छेद 4 के अंतगᭅत ᳰदया गया ह:ै (ग) परंत ुयह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार ᭃेᮢीय नगर योजना अिधिनयम और अ᭠य िनयमᲂ तथा िविनयमᲂ के अधीन सᭃम अिधकारी के पूवᭅ अनमुोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ िजसके अंतगᭅत अनसुिूचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै के अनुपालन के िबना, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अन᭄ुात नहᱭ होगा:
(घ) परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भ-ूअिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करन ेके प᳟ात ्रा᭔य सरकार ᳇ारा ᮧ᭜येक मामल ेमᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय को दनेी होगी । (ड.) परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भ-ू उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । (च) परंतु यह और भी ᳰक िजसस ेहᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल-᮲ोत.—आंचिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके सरंᭃण और पनुनᭅवीकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐस ेᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे िजसस े ᳰक उन ᭃेᮢᲂ मᱶ या इसके समीप िवकास ᳰᮓयाकलाप को रोका जा सके जो ऐसे ᭃेᮢ के िलए हािनकारक ह ᱹ। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(3) पयᭅटन.—(क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, पयᭅटन महायोजना के अनुसार हᲂगे, जो आंचिलक महायोजना का भाग ᱨप हᲂगे । (ख) पयᭅटन महायोजना रा᭔य सरकार के पयᭅटन िवभाग ᳇ारा वन और पयाᭅवरण िवभाग के परामशᭅ से तैयार होगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ होगी । (घ) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक अनकूुल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै नय ेवािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे तथािप, जहा ँपाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा ह ैवहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना के अनुसार होगा;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनसुार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(iii) आंचिलक महायोजना का अनमुोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगक िवरासत.—पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैस े सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाᲐ, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ पᳯररिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए, उपयुᲦ योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।
(5) मानव िनᳶमत िवरासत ᭭ थल.—पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ और अहातᲂ कᳱ पहचान कᳱ जाएगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख स े छह मास के भीतर उनके संरᭃण कᳱ योजनाए ंतैयार कᳱ जाएगंी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएंगी ।
(6) ᭟ विन ᮧदषूण.—रा᭔य सरकार के पयाᭅवरण िवभाग या रा᭔य ᮧदषूण िनयंᮢण पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के अधीन ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 के उपबंधᲂ के अनसुरण मᱶ पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟विन ᮧदषूण के िनयंᮢण के िलए िविनयमᲂ को कायाᭅि᭠वत करेगा ।
(7) वाय ुᮧदषूण.—रा᭔य सरकार के पयाᭅवरण िवभाग या रा᭔य ᮧदषूण िनयंᮢण पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के ᮧावधानᲂ के अनसुार वायु ᮧदषूण के िनयंᮢण के िलए मागᭅदशᭅक िसांत और िविनयम लागू हᲂगे ।
(8) बिह᮲ाव का िन᭭सारण.—पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मागᭅदशᭅक िसातंᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (सरंᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥.—ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा--
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, समय-समय पर सशंोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 सं. का.आ. 1357(अ), तारीख 8 अᮧलै, 2016 ᳇ारा ᮧकािशत ᳰकए गए थ,े के उपबंधᲂ के अनसुार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय सघंटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम स े पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।
(10) जैव िचᳰक᭜ सीय अपिश᭬ ट.—पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासशंोिधत अिधसूचना सा.का.िन. 343(अ), तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) ᭡लाि᭭टक अपिश᳥ ᮧबधंन.—पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसचूना सं.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनसुार ᳰकया जाएगा।
(12) िनमाᭅण और िव᭟वंस अपिश᳥ ᮧबधंन.—पाᳯरि᭭थितक संवेदी जोन मᱶ सिंनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत सिंनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनसुार ᳰकया जाएगा ।
(13) यानीय यातायात.—पᳯरवहन कᳱ यानीय गितिविधया ं आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होन ेतक, मानीटरी सिमित सुसंगत अिधिनयमᲂ के अधीन िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(14) औ᳒ोिगक इकाईया.ं—(i) सरकारी राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन को या उसके प᳟ात् पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनमुित नहᱭ दी जाएगी।
(ii) पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण बोडᭅ के वगᱮकरण के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनमुित दी जाएगी।
(15) पहाड़ी ढलानᲂ को सरंᭃण.—पहाड़ी ढलानᲂ के संरᭃण के अंतगᭅत:
क. आंचिलक महायोजना पहाड़ी ढलानᲂ पर ᭃेᮢᲂ का सकेंत होगा जहां ᳰकसी भी सिंनमाᭅण कᳱ अनमुित नहᱭ दी जाएगी । ख. कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर ᳰकसी भी संिनमाᭅण कᳱ अनमुित नहᱭ दी जाएगी ।
(16) अगर यह आव᭫यक समझता ह,ै इस अिधसूचना के ᮧावधानᲂ को ᮧभावी करन ेमᱶ के᭠ᮤ सरकार और रा᭔य सरकार, अ᭠य उपायᲂ िन᳸द᳥ करेगा।
4. ᮧितिष और िविनयिमत और सवंᳶधत ᳰᮓयाकलाप.—पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (सरंᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई सारणी मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-- 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणी ᮓम स.ं ᳰᮓयाकलाप ᳯट᭡पिणया ँ
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
(1) वािणि᭔यक खनन, प᭜थर कᳱ खदान, उनको तोड़न ेकᳱ इकाइयां । (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न ेकᳱ इकाइया ंवा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेल ू आव᭫यकताᲐ िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइ᭨स या टᲂ का िनमाᭅण करना भी सि᭥मिलत ह,ै के िसवाय नहᱭ हᲂगी ;
(ख) खनन संᳰᮓयाए,ं माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामल े मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अतंᳯरम आदशे के अनसुरण मᱶ सवᭅदा ᮧचालन होगा ।
(2) आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(3) ᳰकसी पᳯरसकंटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(4) जल या वाय ु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर ᳰकसी नए और ᮧदषूण काᳯरत करने वाल ेिव᳒मान उ᳒ोगᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(5) नये वृ᭮त थमᭅल और जल िव᳒ुत पᳯरयोजनाᲐ कᳱ ᭭ थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(6) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । रा᭔ य ᭭ तर सिमित ᳇ारा अनु᭄ात के िसवाए कोई सि᭠ नमाᭅण ᳰᮓयाकलाप 1 स े10 से अिधक ढलाव वाली पहािड़यᲂ और ᳰकसी नदी, ᮧाकृितक नाल,े के ᳰकनारे से 100 मीटर तक नहᱭ ᳰकया जाएगा ।
(7) जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(8) ᭡ लाि᭭ टक के थैलᲂ का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(9) फमᲄ, कॉपᲃरेट, कंपिनयᲂ, आᳰद ᳇ारा बड़ ेपैमान ेपर वािणि᭔यक पशुधन संपदा और कुकुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को परूा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
(10) ट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । िविनयिमत ᳰᮓयाकलाप
(11) होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । कोई नए वािणि᭔यक होटलᲂ और ᳯरसोटᭅ पाᳯरि᭭थितक संवेदी जोन के संरिᭃत ᭃेᮢ कᳱ सीमा स े एक ᳰकलोमीटर के भीतर या सीमा तक पाᳯरि᭭थितक पयाᭅवरण ᳰᮓयाकलापᲂ स े संबं पयᭅटकᲂ के अ᭭थाई आवास के िसवाय, जो नजदीक हो अनु᭄ात नहᱭ होगा :
परंतु, जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर स े ᭔यादा ह ैवहाँ, एक ᳰकलोमीटर स ेपरे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना के अनुसार होगा। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
(12) संिनमाᭅण ᳰᮓयाकलाप । (क) ᳰकसी ᳰक᭭म का कोई नया वािणि᭔यक सिंनमाᭅण संरिᭃत ᭃेᮢ कᳱ सीमा स ेएक ᳰकलोमीटर के भीतर अनु᭄ात नहᱭ होगा । परंतु ᭭थानीय ᳞िᲦयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ भिूम मᱶ संिनमाᭅण िजसके अंतगᭅत आंचिलक महायोजना के अनुसार पैरा 6 के उप-पैरा (1) मᱶ सचूीब ᳰᮓयाकलाप भी हᱹ, को करने के िलए अनु᭄ात ᳰकया जाएगा । (ख) पर᭠त ु यह और ᳰक ऐस े लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ स े संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे, यᳰद कोई हो ।
(13) खाई-᭭ थल । नए खाई ᭭ थल का ᭭ थापन को ᮧितिष ᳰकया जाएगा और परुाने खाई ᭭ थलᲂ को लागू िविधयᲂ के अनसुार िविनयिमित ᳰकया जाएगा ।
(14) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(15) वायु और यािनक ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(16) ᭟ विन ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(17) भ-ूजल का िन᭬ कषᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(18) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनमुित के िबना वन, सरकारी या राज᭭व या िनजी भिूम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी ;
(ख) वृᭃᲂ कᳱ कटाई, संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार िविनयिमत होगी ;
(ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ के मामले मᱶ कायᭅ-योजना के िनदशेᲂ का पालन ᳰकया जाएगा ।
(19) ᮧवासी चारागाहᲂ । लागू िविधयᲂ के अधीन और आंचिलक महायोजना के अनुसार िविनयिमत हᲂगे ।
(20) िव᳒मान स् थापनᲂ । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(21) िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण और केबल िबछाना और अ᭠य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । (भूिमगत केबल को बढ़ावा ᳰदया जाएगा)।
(22) नागᳯरक सिुवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
(23) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना । लागू िविधयᲂ के अनसुार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
(24) रािᮢ मᱶ यािनक पᳯरवहन का सचंलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
(25) ᮧवासी ᮧजाितयᲂ को लाना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(26) ᭡ लाि᭭ टक थलैᲂ का उपयोग। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(27) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(28) ᮧाकृितक जल िनकायᲂ या भ ू ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(29) ᮧदषूण उ᭜प᳖ न करन े वाल े लघ ु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन मᱶ देशीय माल स ेउ᭜पादᲂ का उ᭜पादन करने वाले गैर ᮧदषूण, गैर पᳯरसकंटमय, लघ ु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत दशेीय माल स ेऔ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालत ेह,ᱹ अनु᭄ात ᳰकए जाएगें ।
(30) वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(31) ठोस अपिश᳥ ᮧबंधन । ठोस अपिश᳥ का ᮧबंधन पयाᭅवरण (सरंᭃण) अिधिनयम, 1986 के अधीन ठोस अपिश᳥ ᮧबंधन िनयम 2016 के उपबंधᲂ के अनुसार होगा ।
(32) पाᳯरि᭭थितक-पयᭅटन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(33) पयᭅटन से संबंिधत ᳰᮓयाकलाप जैस े गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा अभयार᭛य ᭃेᮢ के ऊपर स ेउड़ना जैस े ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । सवंᳶधत ᳰᮓयाकलाप
(34) ᭭थानीय समदुायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष और मछली पालन । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(35) जैिवक खेती । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(36) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(37) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह ᱹ। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(38) वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(39) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(40) कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(41) पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(42) कौशल िवकास । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(43) िन᳜ीकृत भूिम या वन या आवास कᳱ जीणᲃ᳇ार । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
5. मानीटरी सिमित.—(1) कᱶ ᮤीय सरकार के अंतगᭅत आन ेवाल ेपाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करती ह ैजो िन᳜िलिखत स ेिमलकर बनेगी, अथाᭅत ्:- िन᳜िलिखत सद᭭यᲂ के साथ िहमाचल ᮧदशे रा᭔य के िलए मानीटरी सिमित, अथाᭅत ्:-
(i) उपायु त, िशमला - अ᭟यᭃ ;
(ii) पाᳯरि᭭ थितक और पयाᭅवरण के ᭃेᮢ मᱶ एक िवशेष᭄ िजसे िहमाचल ᮧदेश कᳱ सरकार ᳇ारा तीन वषᭅ के िलए नामिन᳸द᭬ ट ᳰकया जाएगा - सद᭭ य ;
(iii) पयाᭅवरण, व᭠ य और जलवायु पᳯरवतᭅन मंᮢालय का ᮧितिनिध – सद᭭ य ;

(iv) गैर सरकारी संगठन का एक ᮧितिनिध िजसे भारत सरकार का ᳇ारा तीन वषᭅ कᳱ अविध के िलए पयाᭅवरण के ᭃेᮢ मᱶ और िवरासत सरंᭃण कायᭅ करने के िलए नामिन᳸दष् ट ᳰकया जाएगा –सद᭭ य ;
(v) कायᭅपालक इंजीिनयर, िहमाचल ᮧदशे ᮧदषूण िनयंᮢण बोडᭅ – सद᭭ य ;
(vi) उपखंड अिधकारी, रामपुर या उनके ᮧितिनिध – सद᭭ य ;
(vii) खंड वन अिधकारी (ᭃेᮢीय) – सद᭭ य ;
(viii) जैव-िविवधता बोडᭅ का सद᭭य – सद᭭ य ;
(ix) ᮧभागीय वन अिधकारी (व᭠ यजीव) – सद᭭ य-सिचव ।
6. िनदᱷश िनबंधन.—
(1) सिमित का कायᭅकाल अिधसूचना जारी होने कᳱ तारीख स ेतीन वषᭅ कᳱ अविध के िलए होगा।
(2) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.

(5) मानीटरी सिमित का सद᭭य-सिचव या संब कलटर या सबंंिधत उ᳒ान भारसाधक ऐस े᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा ।
(6) मानीटरी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमिंᮢत कर सकेगी ।

8. कोई अ᭠ य मह᭜ वपणूᭅ िवषय । [फा. सं. 25/46/2015-ईएसजेड-आरई] लिलत कपूर, वै᭄ािनक ‘जीʹ MINISTRY OF ENVIORNMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 16th March, 2017 S.O. 838(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 2539 (E), dated the 17 th September, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said notification were made available to the public on the 17 th September, 2015;
AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
AND WHEREAS, the Daranghati Wildlife Sanctuary located in Rampur, Shimla District, Himachal Pradesh and lying between 77 o 46ʹ 20ʹ to 77 o 47ʹ 32ʹ E longitude and 31 o 24ʹ 03ʹ to 31 o 26ʹ 42ʹ N latitude spread over an area of 167 Sq. km.
AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary the highly endangered species of pheasants like western tragopan (Tragopan melanocephalus), Cheer Pheasant (Catreus wallichii), are found in this area; Musk Deer (Moschus chrysogaster) an endangered mammal is also found in this area and other main species found are Himalayan Monal (Lophophorus impejanus), Koklass Pheasant (Pucrasia macrolopha) and Kaleej Pheasant (Lophura leucomelanos), Himalayan Thar (Hemitragus jemlahicus), Goral 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (Nemorhaedus goral), Serow (N. sumatraensis), Brown Bear (Ursus arctos), Asiatic Black Bear (Ursus thibetanus), Barking Deer (Muntiacus muntjak), and Leopard (Panthera pardus);
AND WHEREAS, it is necessary to conserve and protect the area, the inter and boundaries are specified in paragraph 1 surrounding the protected area of Darangahti Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent upto 375 meters around the boundary of Daranghati Wildlife Sanctuary in the State of Himachal Pradesh as the Daranghati Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Ecosensitive Zone) details of which are as under, namely:—
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone shall be of 22.5 sq. kms with an extent upto 375 meters around the boundary of Daranghati Wildlife Sanctuary and the map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-I.
(2) No villages are falling in Eco-sensitive Zone, but nearby villages are dependent on forests.
(3) The boundaries of Daranghati Wildlife Sanctuary are given in Annexure-II and the boundary details of Daranghati Wildlife Sanctuary and its Eco-sensitive Zone in terms of Geographical Positioning System coordinates are given in Annexure-III.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for consideration and approval of the Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said Plan:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj ;
(xi) Public Works Department,
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions of monitoring under the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:—
(1) Land use.—
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or industrial activities and such areas shall be clearly defined in the Zonal Master Plan along with maps:
(b) Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable, to meet the residential needs of the local residents and for the following activities, namely:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4.
(c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
(d) Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
(e) Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(f) Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas and efforts:
(g) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment area plan shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such areas.
(3) Tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:— 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) no new construction of hotels and resorts shall be allowed within 1 kilometre from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer, however, beyond the distance of 1 kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone whichever is nearer, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up as part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
(7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein.—
(9) Solid wastes. - Disposal of solid wastes shall be as under:—
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and nonbiodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28 th March, 2016, as amended from time to time.
(11) Plastic Waste Management:- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management:- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317 (E), dated the 29th March, 2016, as amended from time to time.

(13) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(14) Industrial units- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed to be established within Eco-sensitive Zone as per the Central Pollution Control Boardʹ s categorisation.
(15) Protection of hill slopes.- The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
16. The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. Prohibited, regulated and promoted activities.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below, namely:— TABLE S. (a) All new and existing (minor and major minerals), stone quarrying and crushing units shall be prohibited except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Honʹ ble Supreme Court dated 04 th August, 2006 in the matter of T.N.
Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
5. Establishment of new major thermal and hydro-electric projects.
Prohibited (except as otherwise provided) as per applicable laws.
6. Protection of hill slopes and river banks.
No construction activity unless otherwise permitted by State Level Committee shall be undertaken on the hill with slopes more than 1 to 10 and also up to 100 meters from the banks of any river, and natural nallah.
7. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
8. Use of polythene bags. Prohibited (except as otherwise provided) as per applicable laws.

9. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
10. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
Regulated Activities
11. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or up to the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the Protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
12. Construction activities. (a) No new commercial construction of any kind shall be permitted within the Eco-sensitive Zone:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per applicable building byelaws:
(b) Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any.
13. Trenching ground. Establishing of new trenching ground shall be prohibited and old trenching grounds shall be regulated under applicable laws.
14. Discharge of effluents and solid waste in natural water bodies or land area.
Regulated under applicable laws.
15. Air and vehicular pollution. Regulated under applicable laws.
16. Noise pollution. Regulated under applicable laws.
17. Extraction of ground water. Regulated under applicable laws.
18. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
(c) In case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed.
19. Migratory graziers. Regulated under applicable laws and as per Zonal Master Plan.
20. Existing establishments. Regulated under applicable laws.
21.
Erection of electrical and communication towers and laying of cables and other infrastructures Regulated under applicable law (underground cabling may be promoted).
22. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
23. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
24. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws.
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 Monitoring Committee.- (1) The Central Government for effective monitoring of the Eco-sensitive Zone, hereby constitutes a Committee for the State of Himachal Pradesh to be called the Monitoring Committee(MC),as under:- Monitoring Committee for the State of Himachal Pradesh comprising of the following members, namely:-
(i) Deputy Commissioner, Shimla - Chairman;
(ii) An expert in the area of ecology and environment - Member;
to be nominated by the Government of Himachal Pradesh for a period of three year
(iii) Representative of Ministry of Environment Forest and Climate Change - Member;
(iv) One representatives of Non-governmental Organization - Member;
(working in the field of environment including heritage Conservation) to be nominated by the Government of India for a period of three year
25. Introduction of exotic species. Regulated under applicable laws.
26. Uses of plastic carry bags. Regulated under applicable laws.
27. Protection of hill slopes and river banks. Regulated under applicable laws.
28. Discharge of treated effluents in natural water bodies or land area.
The discharge of treated effluent shall be regulated as per applicable laws and efforts shall be made to recycle/re-use the treated effluent.
29. Small scale industries not causing pollution.
Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
30. Collection of Forest Produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
31. Solid Waste Management. Management of solid waste shall be as per the provisions of the Solid Waste Management Rules, 2016 under Environment (Protection) Act, 1986.
32. Eco-tourism. Regulated under applicable laws.
33. Undertaking activities related to ecotourism like over-flying the Wildlife Sanctuary Area by aircraft, hot-air balloons.
Regulated under applicable laws.
Promoted Activities
34. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Shall be actively promoted.
35. Organic farming. Shall be actively promoted.
36. Adoption of green technology for all activities. Shall be actively promoted.
37. Cottage industries including village artisans. Shall be actively promoted.
38. Rain water harvesting. Shall be actively promoted.
39. Use of renewable energy sources. Shall be actively promoted.
40. Agro Forestry. Shall be actively promoted.
41. Environmental Awareness. Shall be actively promoted.
42. Skill Development. Shall be actively promoted.
43. Restoration of Degraded Land/ Forests/ Habitat.
Shall be actively promoted.

(v) Executive Engineer, Himachal Pradesh Pollution Control Board - Member;

(viii) Member of the State Biodiversity Board - Member;
(ix) Divisional Forest Officer (Wild Life) - Member-Secretary.
6. Terms of reference:
(1) The tenure of the Monitoring Committee shall be for a period of three years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14 th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column
(3) of the Table under paragraph 4 thereof, shall be scrutinised by the MC based on the actual sitespecific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30th June of that year to the Central Government in the Ministry of Environment, Forest and Climate Change as per pro forma given in Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this Notification are subject to the orders, if any, passed, or to be passed, by the Honʹ ble Supreme Court of India or the High Court or National Green Tribunal (NGT).
