PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 753] ubZ fnYyh] c`gLifrokj] ekpZ 16] 2017@iQkYxqu 25] 1938 No. 753] NEW DELHI, THURSDAY, MARCH 16, 2017/PHALGUNA 25, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ ली, 14 माचᭅ, 2017 का.आ. 839(अ).—भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का. आ. 3104 (अ) तारीख 17 नव᭥बर, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ उᲦ अिधसूचना अंतᳶव᳥ ह,ै उपल᭣ध करा दी गई थᱭ, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करत ेᱟए, एक ᮧाᱧप अिधसूचना भारत के राजपᮢ असाधारण मᱶ ᮧकािशत कᳱ गई थी;
और, ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से कोई टीका ᳯट᭡पिणयां/आᭃेप और सुᭃाव ᮧा᳙ नहᱭ ᱟए ह;ᱹ और, झᲯर-बचौली व᭠ यजीव अभयार᭛य िजला ᱧपनगर, पजंाब मᱶ अवि᭭थत ह ैऔर अᭃांश 310 16'उ. और देशांतर 760 31' 5'पू. के बीच ि᭭थत होते ᱟए 1.16 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ फैला ᱟआ ह।ै और, वन᭭पित और जीवज᭠तु इस अभयार᭛य िवपुल जैवीय मह᭜व का ᳒ोतक ह।ै िजसमᱶ मुय ᮧजाितयां सांबर (ᱨसा यूिनकोलोर) (केरर,1972), मंुजक (मुि᭠टएस मु᭠तजक) (िजममेरमांन, 1780), अजगर (पायथन ᭭पा), कोबरा (नाजा नाजा) (ᳲलनाएउस, 1758), ᭭पेकटेलड कोबरा (नाजा ओिसजेन) (ऐचवा᭨ड,1831), लाल जंगली मुगᱮ (गैलस गलैस) (ᳲलनाएउस,1758) और अ᭠य ᮧजाितयां ह;ᱹ और, झᲯर-बचौली व᭠ यजीव अभयार᭛य के इदᭅ िगदᭅ संरिᭃत ᭃेᮢ को, पाᳯरि᭭थितक पयाᭅवरण और जैव िविवधता कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, पंजाब रा᭔ य मᱶ झᲯर-बचौली व᭠ यजीव अभयार᭛य कᳱ सीमा के इदᭅ िगदᭅ 100 मीटर तक के िव᭭ ताᳯरत ᭃेᮢ को झᲯर-बचौली व᭠ यजीव अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:--
1. पाᳯरि᭭थितक सवंदेी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭ थितक संवेदी जोन, झᲯर-बचौली व᭠ यजीव अभयार᭛य के इदᭅ िगदᭅ सीमा से 100 मीटर तक िव᭭तार सिहत 0.65 वगᭅ ᳰकलोमीटर का होगा । सीमा के ᭣ यौरे और अᭃांश तथा देशा᭠तर के साथ पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ उपाबधं- I के ᱨप मᱶ उपाब ह।ै झᲯर-बचौली व᭠ यजीव अभयार᭛य कᳱ सीमा जी.पी.एस. िनदᱷशांकᲂ के िब᭠ दᲐु के साथ उपाबधं II मᱶ ᳰदए गए ह ᱹ। पाᳯरि᭭ थितक संवेदी जोन के अतंगᭅत आने वाल ेᮕामᲂ कᳱ सूची उपाबधं – III मᱶ दी गई ह ै।
2. पाᳯरि᭭थितक सवंदेी जोन के िलए आचंिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस रा᭔य सरकार मᱶ सᭃम ᮧािधकारी के िवचाराथᭅ और अनुमोदनाथᭅ अिधसूचना से संल न अनुबंधᲂ का पालन करत े ᱟए आंचिलक महायोजना तैयार करेगी ।
(2) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस रीित मᱶ जो, इस अिधसूचना मᱶ िविन᳸द᭬ ट ह ैतथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, के अनुᱧप ह ै᳇ारा तैयार होगी ।
(3) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को उᲦ योजना मᱶ समाकिलत करने के िलए रा᭔ य सरकार के िन᳜िलिखत िवभागᲂ के परामशᭅ से तैयार कᳱ जाएगी, अथाᭅत्:--
(i) पयाᭅवरण;
(ii) वन और व᭠यजीव;
(iii) कृिष ;
(iv) राज᭭ व;
(v) नगर िवकास;
(vi) पयᭅटन;
(vii) ᮕामीण िवकास;
(viii) ᳲसचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका;
(x) पंचायती राज; और
(xi) लोक िन माᭅण िव भाग।
(4) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(5) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भू जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलुᲐ, िजन पर ᭟यान देना आव᭫यक ह,ै के िलए उपबंध हᲂग े।
(6) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(7) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन सुिनि᭫ चत करन े के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
(8) आंचिलक महायोजना इस अिधसूचना के उपबंधᲂ ᳇ारा मानीटरी करन ेके अपन ेकायᲄ ᳰᮓयाि᭠वत करन ेके िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज होगा ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान े वाल े उपाय-- रा᭔य सरकार, इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजनᲂ के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुल े᭭थानᲂ का मुय वािणि᭔यक या औ᳒ोिगक ᳰᮓयाकलापᲂ के िलए ᭃेᮢᲂ मᱶ उपयोग या संपᳯरवतᭅन नहᱭ ᳰकया जाएगा। मानिचᮢᲂ के साथ आंचिलक महायोजना मᱶ ᭭प᳥ ᱨप से ᭃेᮢᲂ को पᳯरभािषत ᳰकया गया ह:ै परंत ुपाᳯरि᭭थितक संवेदी जोन के भीतर कृिष और अ᭠य भूिम का संपᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और ᭃेᮢीय नगर योजना अिधिनयम के तहत सᭃम ᮧािधकारी के पूवᭅ अनुमोदन के से और यथा लाग ूके᭠ᮤीय/रा᭔य सरकार के अ᭠य िनयमᲂ और िविनयमᲂ, जो ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए आव᭫यक ह,ᱹ अनु᭄ात ᳰकया जा सकेगा, जैसे:-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;
(ii) अवसंरचना और नागᳯरक सुख सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) ᮧदषूण उ᭜प᳖ न करने वाल ेलघ ुउ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजसके अतंगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुख सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन िजस मᱶ सहायक हो ᮕह वास; और
(v) संवᳶधत ᳰᮓयाकलाप और अनु᭒छेद 7 के अधीन ᳰदया गया ह:ै परंत ुयह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार ᭃेᮢीय नगर योजना अिधिनयम और अ᭠य िनयमᲂ तथा िविनयमᲂ के अधीन सᭃम अिधकारी के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै के अनुपालन के िबना, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अन᭄ुात नहᱭ होगा :
परंत ु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ ᮧकट कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात ्रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी । परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट को संशोधन मᱶ इस उप पैरा के अधीन यथा-उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंत ुयह और भी ᳰक वनरोपण और आवास पनुᱧार वाल ेअनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंग े।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ के आवाह ᭃेᮢᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और जीणᲃार के िलए योजनाए सि᭥ मिलत हᲂगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के बारे मᱶ ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंग े।
(3) पयᭅटन/पाᳯरि᭭थितक पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर िव᳒मान सभी नए पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप या पयᭅटन ᳰᮓयाकलाप पाᳯरि᭭थितक संवेदी जोन संबंधी पयᭅटन महायोजना के अनुसार हᲂग े। (ख) पाᳯरि᭭थितक पयᭅटन महायोजना, पयᭅटन िवभाग, ᳇ारा रा᭔य पयाᭅवरण और वन िवभाग के परामशᭅ से तैयार कᳱ जाएगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ होगी । (घ) पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) होटलᲂ और ᳯरसᲃटᲂ का नया संिनमाणᭅ व᭠यजीव अभयार᭛य कᳱ सीमा से 1 ᳰक.मी. के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक जो भी िनकट हो, अनु᭄ात नहᱭ ᳰकया जाएगा । तथािप, व᭠यजीव अभयार᭛य कᳱ सीमा से 1 ᳰक.मी. कᳱ दरूी से परे, पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक नए होटलᲂ और ᳯरसᲃटᲂ कᳱ ᭭थापना पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पयᭅटन सुिवधाᲐ के िलए पूवᭅ सीमांᳰकत और पदािभिहत ᭃेᮢᲂ मᱶ ही अनु᭄ात कᳱ जाएगी ।;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा मागᭅदशᭅक िसांतᲂ के तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा-संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितकᳱ पयᭅटन पर बल देते ᱟए होगा;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया जाएगा ।
(4) नसैᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाᲐ, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ और अ᭠य नैसᳶगक िवरासत कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा योजना आंचिलक महायोजना को भाग के ᱧप मᱶ तैयार कᳱ जाएगी ।
(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य और ऐितहािसक, वा᭭त ु िश᭨पीय, सᲅदयᭅपरक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ और पᳯरवेश कᳱ पहचान कᳱ जाएगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार कᳱ जाएंगी ।
(6) ᭟ विन ᮧदषूण – पयाᭅवरण (संरᭃण) अिधिनयम 1986 के अधीन ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 मᱶ िनयत उपबंधᲂ के अनुसार मᱶ पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟विन ᮧदषूण के िनयंᮢण के िलए िविनयमᲂ को कायाᭅि᭠वत करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, रा᭔य सरकार के पयाᭅवरण िवभाग वायु (ᮧदषूण िनवारण एवं िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के उपबंधᲂ के अनुसार वायु ᮧदषूण के िनयंᮢण के िलए मानक और िविनयम कायाᭅि᭠वत करेगा । यᳰद आव᭫यक हो, पयाᭅवरण कᳱ सरंᭃण के िलए मानक ओर अिधक कठोर बनाये जा सकते ह।ᱹ
(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के अ᭠तगᭅत आने वाले पयाᭅवरणीय ᮧदषूण के िन᭭सारण संबंधी साधारण मानकᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा--
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ िनपटान, समय-समय पर संशोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं.
का.आ. 1357(अ) तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ᳰकए गए थ,े के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶग े;

(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा;
(v) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण और भूिम भराव के ᭭थापनᲂ को अनु᭄ात नहᱭ ᳰकया जाएगा ।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन - यातायात कᳱ यानीय संचलन आवास के अनुकूल रीित मᱶ िविनयिमत हᲂगी और इस संबंध मᱶ िविन᳸द᳥ उपबंध आंचिलक महायोजना मᱶ समािव᳥ ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने तक और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय संचलन के अनुपालन को मानीटर करेगी ।
(12) औ᳒ोिगक इकाइया ं- (i) सरकारी राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन के पर या उसके प᳟ात, पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदषूणकारी उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित नहᱭ दी जाएगी।
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर कᱶ ᮤीय ᮧदषूण बोडᭅ के ᮧवगᱮकरण के ᳇ारा केवल गैर- ᮧदषूणकारी उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित दी जाएगी।
(13) पहाड़ी ढलानᲂ को सरंᭃण- पहाड़ी ढलानᲂ का संरᭃण िन᳜ानुसार होगा :
(क) आंचिलक महायोजना पहाड़ी ढलानᲂ पर ᭃेᮢᲂ को उपदᳶशत करेगी जहां ᳰकसी भी संिनमाᭅण कᳱ अनुमित नहᱭ दी जाएगी । (ख) कटाव के िव᳒मान खड़ी पहाड़ी ढलानᲂ या उᲬ िडᮕी वाले ढलानᲂ पर ᳰकसी भी संिनमाᭅण कᳱ अनुमित नहᱭ दी जाएगी ।
(14). के᭠ᮤीय सरकार और रा᭔य सरकार यह वह आव᭫यक समᭃे, इस अिधसूचना के उपबंधᲂ को ᮧभावी करने मᱶ, अ᭠य उपायᲂ को िन᳸द᳥ करेगी।
4. ᮧितिष और िविनयिमत और सवंᳶधत ᳰᮓयाकलाप - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत ्:-- सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी

(1) वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़न ेकᳱ इकाइयां । (क) सभी नए और िव᳒मान खनन (लघ ुऔर वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न े कᳱ इकाइयां िसवाय वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेल ू आव᭫यकताᲐ िजसमᱶ मकानᲂ के संिनमाᭅण या मर᭥मत के िलए जमीन खुदाई भी ह ैऔर मकान बनान ेके िलए देशी टाइलᲂ या टᲂ के िनमाᭅण और अ᭠य ᳰᮓयाकलापᲂ के िलए तुर᭠त 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ᮧभाव से ᮧितिष हᲂगी । (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के आदेश के अनुसार कᳱ जाएंगी ।
(2) आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(3) ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(4) जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करन ेवाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन मᱶ जल या वायु या मृदा या ᭟विन ᮧदषूण फैलान ेवाल ेउ᳒ोगᲂ कᳱ ᭭थापना या उनके िव᭭तार कᳱ अनुमित नहᱭ दी जाएगी । कृिष आधाᳯरत लघ ु उ᳒ोगᲂ सिहत के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ वगᱮकरण मᱶ के ᱧप मᱶ ᮧवगᱮकृत हᳯरत या ᳡ेत उ᳒ोगᲂ को िविनयमᲂ के अनुसार अन᭄ुात ᳰकया जाएगा।
(5) बृहत जल िव᳒ुत पᳯरयोजना कᳱ ᭭ थापना । लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
(6) जलावन लकड़ी का वािणि᭔यक उपयोग । लाग ू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
(7) फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुधन संपदा और कुकुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को परूा करने के िलए लाग ू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
(8) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । िविनयिमत ᳰᮓयाकलाप
(9) होटल और ᳯरसोटᭅ का वािणि᭔यक ᭭थापन । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलापᲂ संबंधी पयᭅटकᲂ कᳱ लघ ु संरचनाᲐ के िलए संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात हᲂग,े अ᭠यथा नहᱭ :
परंत,ु जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा ह ैवहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना और यथा-लाग ूमागᭅदशᱮ िसांतᲂ के अनुᱧप होगा।
(10) संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो, कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अन᭄ुात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय लोगᲂ को परैा 6 के उप-पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करन ेकᳱ अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी :
पर᭠त ुयह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंग ेऔर लाग ू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंग े। (ख) एक ᳰकलोमीटर से आग े आंचिलक महायोजना कᳱ अनुसार िविनयिमत हᲂगे ।
(11) प् लाि᭭ टक थैलᲂ का उपयोग । लाग ू िविधयᲂ के अधीन िविनयिमत(अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
(12) ᮧाकृितक जल िनकायᲂ या भू ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(13) वायु और यािनक ᮧदषूण । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(14) ᭟ विन ᮧदषूण । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(15) भू-जल का िन᭬ कषᭅण । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(16) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई, संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार िविनयिमत होगी ।
(17) ᮧवासी चरवाहᲂ । आंचिलक महायोजना के लाग ू िविधयᲂ के अधीन और उनके अनुसार िविनयिमत हᲂगे ।
(18) पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᱶ, हलेीका᭡टर, ᮟोन, माइᮓोलाइटस और अ᭠य पयᭅटन ᳰᮓयाकलाप आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(19) िव᳒मान ᭭थापना। लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(20) िव᳒ुत और संचार टावरᲂ का पᳯरिनमाᭅण और केबल िबछाना और अ᭠य अवसरचनाएँ । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । भूिमगत केबल डालने को बढ़ावा ᳰदया जाएगा ।
(21) नागᳯरक सुिवधाᲐ सिहत अवसंरचना । लागू िविधयᲂ, िनयमᲂ और िविनयमᲂ और उपल᭣ध ᳰदशािनदᱷशᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ िविनयिमत हᲂग े।
(22) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण । लागू िविधयᲂ, िनयमᲂ और िविनयमᲂ और उपल᭣ध ᳰदशािनदᱷशᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ िविनयिमत हᲂग े।
(23) होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लाग ूिविधयᲂ के अधीन िविनयिमत होगा । व᭠ यजीव के िनबाᭅध संचलन को अनु᭄ात करन ेके िलए, पाᳯरि᭭थितक संवेदी जोन के भीतर होटलᲂ या अ᭠ य वािणि᭔ यक ᭭ थापनᲂ अपनी पᳯरसंपत् ितयᲂ मᱶ कांटेदार बाड़ नहᱭ लगाएंग ेऔर कोई भी बाड़ एक मीटर से ऊंची नहᱭ होगी । कोई िव᳒मान बाड़, जो इस अनुबंध का अनुपालन नहᱭ करती ह,ै को आंचिलक महायोजना मᱶ वᳶणत समय- सीमा के अनुसार उपांतᳯरत ᳰकया जाएगा ।
(24) कृिष ᮧणाली मᱶ ᮧबल पᳯरवतᭅन । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(25) ᮧाकृितक जल संसाधन िजसके अंतगᭅत लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] भू-जल संचयन भी ह ै वािणि᭔यक का उपयोग ।
(26) रािᮢ मᱶ यािनक यातायात का संचलन । लाग ूिविधयᲂ के अधीन वािणि᭔यक यानᲂ के िलए िविनयिमत हᲂगे ।
(27) ᮧवासी ᮧजाितयᲂ को लाना । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(28) साइनबोडᭅ और होᳺडग । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(29) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । जब तक आंचिलक महायोजना के अधीन अ᭠यथा अनु᭄ात न ᳰकया जाए तब तक 1 से 10 मीटर के पहाड़ी ढलानᲂ पर और ᳰकसी नदी तट और ᮧाकृितक नाल े से 100 मीटर तक कोई संि᭠ न माᭅण ᳰᮓयाकलाप नहᱭ ᳰकया जाएगा।
(30) पाᳯरि᭭थितक-अनुकूलतम पयᭅटन ᳰᮓयाकलाप । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(31) ठोस अपिश᳥ ᮧबंधन । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(32) ᭭थानीय समुदायᲂ ᳇ारा चलाए जा रह े कृिष और बागवानी ᳞वसायᲂ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । ᭭थानीय उपयोग के िलए लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(33) सतह और भूिमगत जल कᳱ वािणि᭔यक िनकासी । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
(34) खुल ेकुआ, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत हᲂगे और समुिचत ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ को कड़ाई से मानीटर ᳰकया जाएगा। संवᳶधत ᳰᮓयाकलाप
(35) जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(36) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(37) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी हᱹ । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(38) वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
(39) ᮧदषूण उ᭜प᳖ न करन ेवाल ेलघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन से देशीय माल से उ᭜पादᲂ का उ᭜पादन करन े वाले गरै ᮧदषूण, गरै पᳯरसंकटमय, लघ ु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालत ेह,ᱹ अनु᭄ात ᳰकए जाएंगे ।
(40) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । संᳰᮓय ᱧप से बढ़ावा ᳰदया जाएगा ।
(41) कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
(42) पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
(43) कौशल िवकास । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
(44) िन᳜ीकृत भूिम या वन या आवास कᳱ जीणᲃ᳇ार । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
5. झᲯर बचौली व᭠यजीव अभयार᭛य के िलए पाᳯरि᭭थितक संवदेी जोन अिधसचूना कᳱ मानीटरी के िलए पाᳯरि᭭थितक संवदेी जोन मानीटरी सिमित:
कᱶ ᮤीय सरकार न ेपयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 3 कᳱ उप-धारा (3) के अधीन, इस अिधसूचना के ᮧभावी उपबंधᲂ कᳱ िनगरानी के िलए एक िनगरानी सिमित का गठन ᳰकया गया, जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत्:- - ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9
(i) कले टर, ᱧपनगर, पंजाब -अ᭟यᭃ ;
(ii) पंजाब सरकार ᳇ारा तीन वषᭅ कᳱ अविध के िलए नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का एक िवशेष᭄ -सद᭭य;
(iii) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै का तीन वषᭅ कᳱ अविध के िलए पंजाब रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध -सद᭭य;
(iv) ᭃेᮢीय अिधकारी, पंजाब ᮧदषूण िनयंᮢण बोडᭅ -सद᭭य;
(v) रᱶज अिधकारी (व᭠ यजीव),ᱨपनगर -सद᭭य;
(vi) उप पुिलस अधीᭃक, ᱨपनगर -सद᭭य;
(vii) वᳯर᭬ ठ पश ुिचᳰक᭜सा अिधकारी, नरूपरु बेदी -सद᭭य;
(viii) जैव-िविवधता बोडᭅ का सद᭭य -सद᭭य;
(ix) उप वन संरᭃक -सद᭭य सिचव।
6. िनदᱷश िनबधंन- (1) मानीटरी सिमित का कायᭅकाल तीन वषᭅ का होगा
(2) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।।
(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.
1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आन े वाल ेऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ुपाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(5) मानीटरी सिमित का सद᭭य-सिचव या संब कलटर या सबध पाकᭅ भार साधक ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लघंन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा ।
(6) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत े ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपन ेिवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को अपन ेᳰᮓयाकलापᲂ कᳱ वाᳶषक कारᭅवाई ᳯरपोटᭅ उपाबधं IV मᱶ ᳰदए गए िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 14th March, 2017 S.O. 839(E).—Whereas, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.
3104(E), dated 17th November, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, no comments/ objections and suggestions were received from persons and stakeholders in response to the draft notification;
Whereas, the Jhajjar- Bachauli Wildlife Sanctuary located in Rupnagar District, Punjab and lying between Latitude 31º16’N and Longitude 76º31.5’E is spread over an area of 1.16 square kilometers.
And Whereas, the flora and fauna represent rich biological significance of this Sanctuary. The key species are Sambar (Rusa unicolor) (Kerr, 1972), Barking Deer (Muntiacus muntjak) (Zimmermann, 1780), Python (Python sp.), Cobra (Naja naja) (Linnaeus, 1758), Spectacled Cobra (Naja oxiana) (Eichwald, 1831), Red Jungle Fowl (Gallus gallus) (Linnaeus, 1758) and others species.
And Whereas, it is necessary to conserve and protect the area surrounding the protected area of Jhajjar-Bachauli Wildlife Sanctuary as Eco-sensitive zone from ecological, environmental and biodiversity point of view.
Now Therefore, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent upto 100 meters around the boundary of Jhajjar- Bachauli Wildlife Sanctuary in the State of Punjab as the Jhajjar- Bachauli Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall be of 0.65 square kilometers with an extent upto 100 meters around the boundary of Jhajjar-Bachauli Wildlife Sanctuary. The map of the Ecosensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-I. The GPS Coordinates of points along the boundary of Jhajjar- Bachauli Wildlife Sanctuary are given at Annexure-II.
The list of villages falling in Eco-sensitive Zone are given at Annexure-III.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for consideration and approval of the Competent authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj; and
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions of monitoring vide the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or industrial activities.
Such areas shall be clearly defined in the Zonal Master Plan along with maps:
Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central/State Government as applicable, to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and
(v) Promoted activities and given under para 7:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provide also that efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such areas.
(3) Tourism/ Eco-tourism (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 kilometre from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer. However, beyond the distance of 1 kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs and other natural heritage shall be identified and preserved and plan shall be drawn up as part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder. If required, standards may be made more stringent for protection of environment.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and nonbiodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vemiculture;
(iv) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone;
(v) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste in the Eco-sensitive Zone shall be disposed of in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed be established within Eco-sensitive Zone vide Central Pollution Board’s categorisation.
(13) Protection of Hill Slopes.- The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(14) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. Prohibited, Regulated and Promoted Activities.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks

2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution.
Establishment or expansion of industries causing water or air or soil or noise pollution shall not be permitted in the Eco-sensitive zone.
Industries categorized as Green or White in the Central Pollution Control Board Classification including agrobased small scale industries will be permitted as per regulations.
5. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
Regulated Activities
9. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Ecotourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
10. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.

11. Use of plastic bags. Regulated (except as otherwise provided) as per applicable laws.
12. Discharge of treated effluents and solid waste in natural water bodies or land area.

15. Extraction of ground water. Regulated under applicable laws.
16. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
17. Migratory graziers. Regulated under applicable laws and as per Zonal Master Plan.
18. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites and other tourism activities.

20. Erection of electrical and communication towers and laying of cables and other infrastructures.

Any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan.

5. Eco-sensitive Zone Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification for Jhajjar Bachauli Wildlife Sanctuary:
The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:- i) Collector, Rupnagar, Punjab - Chairman ii) An expert in the area of ecology and environment - Member
28. Sign board and hoardings. Regulated under applicable laws.
29. Protection of hill slopes and river banks. No construction activity unless otherwise permitted by under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 and also upto 100 meters from the banks of any river, and natural nallah.
30. Eco-friendly tourism activities. Regulated under applicable laws.
31. Solid waste management. Regulated under applicable laws.
32. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

33. Commercial extraction of surface and ground water.

34. Open Well, Bore Well etc. for agriculture or other usage.

6. Terms of Reference.- (1) The tenure of the Committee shall be three years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India of Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Ecosensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Park incharge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Central Government in the Ministry of Environment, Forest and Climate Change as per pro forma given in Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
