And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/s Salasar Highways Private Ltd. having its registered office at 16th Floor, Tower-A, Building No. 5, Cyber Terrace, DLF Cyber City Gurgaon (Haryana) -122002 (hereinafter referred to as the “Concessionaire”), for the bid submitted on 19.10.2012 for the development of Rajasthan Border-Fatehpur-Salasar section from km. 0.000 to km. 154.141 (hereinafter referred to as the “said section”) of the NH-65 in the state of Rajasthan to two lane with paved shoulder with provision of subsequent Capacity Augmentation to four-laning (before the 10 th anniversary of the Appointed Date) under NHDP Phase IV through Public Private Partnership on Design, Build, Finance, Operate and Transfer (DBFOT) basis;

4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E), dated 5th December, 2008 and amended vide G.S.R. 950(E), dated 3rd December, 2010, G.S.R 15(E), dated 12th January, 2011 and G.S.R. 1756(E), dated 12th October, 2011, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said Section of said National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said agreement between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles at the rate specified in column (2) of the Table 1 (60% and 90% respectively for net road section and bypass for two lane with paved shoulder and 100% and 150% respectively for net road section and bypass after four laning) for net road section length of 131.891 km. for use of two lane with paved shoulder section (hereinafter referred to as “base rate”) and at one and one half times the base rate for use of bypasses having an aggregate length of 22.250 km. costing each Bypass Rupees Ten Crore or more on the Type of Vehicles specified in column (1) of the Table 1 below and authorizes the said Concessionaire to collect and retain the fee on and from the date of Commercial Operation (COD) and on getting the Completion Certificate or the Provisional Certificate, as the case may be, from the Authority or publication of this Notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 225.00 (Rupees Two Hundred Twenty Five only) for the year 2014-15 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely;

Amount Payable Maximum number of one way journeys allowed Period of validity One and half times of the fee for one way journey Two Twenty four hours from the time of payment Two-third of amount of the fee payable for fifty or more single journeys Fifty or more One month from date of payment

5. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

6. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.

7. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.

8. Two-Laning shall be deemed to be complete when the Completion Certificate or the Provisional Certificate, as the case may be, is issued and accordingly the Commercial Operation Date (COD) of the project shall be the date on which such Completion Certificate or the Provisional Certificate is issued.

It is further clarified that subsequent Capacity Augmentation to Four Laning of the Project Highway will deemed to be completed when the Completion Certificate or the Provisional Certificate for subsequent Capacity Augmentation to Four Laning, is issued and accordingly the Commercial Operation Date (COD) of subsequent Capacity Augmentation to Four Laning shall be the date on which such Completion Certificate or the Provisional Certificate is issued.

For avoidance of doubt, it is clarified that the term COD shall have different dates and meaning for Two Laning and Four Laning of the Project Highway.

9. Based on the Base Rate of Fee per km. for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of completed length of the Project Highway. The same shall be got published by the Authority through the Concessionaire in at least one newspaper, each in English and vernacular language and thereafter revised annually in accordance with the rule 5 of the said rules and provision of Concession Agreement and got published, provided that no revision shall be effected within a period of 6 (six) months from the date of the preceding revision of Fee.
