182.000 (Nasirabad to Chittorgarh Section) of National Highway No. 79 in the State of Rajasthan to the National Highways Authority of India (hereinafter referred to as the “Authority”);
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 ( hereinafter referred to as the “said Rules”) , the Central Government hereby levies the fee at the base rate specified in columns (2) of the Table 1 for net road section length(hereinafter referred to as “base rate”) [for use of the four and more. lane sections and at one and one half times the base rate for bypasses costing Rupees ten crore or more ] on the Type of Vehicles specified in column (1) of Table below, for the use of the section from kilometer 0.000 to kilometer
35.000 on the National Highway No. 79A and section from kilometer 15.000 to kilometer 81.000 on the National Highway No. 79 in the State of Rajasthan and authorises the Authority to collect, either through its officials or through a contractor, the said fee, namely:— TABLE Type of vehicle I Base rate of fee per km for the base year 2007-08 (in Rupees) _
(1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini 1 05 Bus Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving 3.45 Equipment (EME) or Multi Axle Vehicle (MAV) (four to six axles) 5 Oversized Vehicles (seven or more axles) 4.20 _) FIFTH—@113 3(ii)] W 311 W : WW Notes : - l. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for net road length specified for such Toll Plaza:

2. The rate of monthly pass for local personal traffic is Rs. 190.00 (Rupees One Hundred Ninty only) for the year 2011—12 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
3. For multiple journey on the highway section, passes shall be issued at the following rates, namely.
i Amount Payable Maximum number of Period of validity one way journeys allowed One and half times of the fee for Two Twenty four hours one way journey from the time of payment Two—third of amount of the fee Fifty One month from date ayable for fifty single journeys of payment
4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative roaduis available for use of such commercial vehicles.
Mechanical vehicles which is loaded in exceSS of permissible load specified for its category under the rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.
The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.
The fee rates shall be revised annually in accordance with the rule 5 of the' said rules provided that no revision shall be effected within six’months.
The estimated capital cost of the project is Rupees 326 crores. The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be 333 L; ‘73 12,2, THE GAZETTE OF INDIA : EXTRAORDINARY [PART ll‘~SEC. 3(ii)] reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
10. The rate of fee for the use of a section of a national highway consisting of bypass or tunnel constructed on or after 11th September, 1956 but before 5th December, 2008, through public funded project or build, operate and transfer (annuity) project, shall be the same, as provided in sub— rule (2) and
(3) for the Section of a national highway, and, shall be revised in accordance with the provisions of rule 5. F
Provided that notwithstanding whether the Section of the national Highway or the bridge has been taken for further lane upgradation or not, the increase in the rate of fee for use of a Section of such national highway, permanent bridge, bypass or tunnel constructed through any public funded 'project or any build, operate and transfer (annuity) project constructed before the commencement of the said rules, shall not be increased after the commencement of the National Highways Fee (Determination of Rates and Collection) Second Amendment, Rules, 2011 by more than twenty—five per cent of the rates of fee applicable immediately before such commencement and further annual increase shall in no case be more than twenty—five per cent of the rate applicable in the immediately preceding year.” [F.
