12. सद; य सिचव, केरला ; टेट काउंिसल फॉर साइंस, टै� नोलोजी एंड इंवायरम�ट, केरल - सद; य सिच व, पदेन । II. �ािधकरण और उसका मुM यालय ित@वनंतपुरम म� ि; थत होगा । III. �ािध करण क� बैठक के िल ए गणमूDत उसके सद; य# क� कुल संM या का एक ित हाई होगी । IV. पदेन सद; य से िभ� न Gकसी सद; य को क� �ीय सरकार �ारा Gकए गए िविन� चय के मानदंड# के अनुसार भ! ते संद! त Gकए जाएंगे । V. �ािधकरण, तटीय पया वरण क� � वािलटी को संरि�त और उसम� सुधार करने, केरल रा> य के तटीय िविनयमन जोन �े(# म� पया वरणीय �दषूण के उपशमन और िनयं(ण करने के �योजन के िलए िनN निलिखत उपाय करेगा, अथा त् :- (i) यGद �ािधकरण को �; ताव योजना के अनुमोदन के िलए कोई आवेदन �ाP त होता ह ैतो वह अनुमोGदत तटीय जोन �बंध योजना के अनुसार उसका परी�ण करेगा और भारत सरकार के कोयला मं(ालय �ारा जारी अिधसूचना सं का.आ. 19 (अ), तारीख 6 जनवरी, 2011 (िजसे इसम� इसके प� चात् उ� त अिधसूचना कहा गया ह)ै के तटीय िविनयमन जोन का अनुपालन करेगा और ऐसे आवेदन क� �ािP त क� तारीख से साठ Gदन क� अविध के भीतर उ� त अिधसूचना म� यथा िविनRदS ट संबT �ािधकरण से ऐसे पCरयोजना के अनुमोदन के िलए िसफाCरश� करेगा । (ii) �ािधकरण उ� त अिधसूचना म� यथा िविनRदS ट तटीय िविनयमन �े(# के सभी िवकासा! मक GUयाकलाप# को िविनयिमत करेगा । (iii) �ािधकरण उ� त अिधसूचना के उपबंध# का �वत न करने या मानीटर करने के िलए मुM यतया उ! तरदायी होगा । (iv) �ािधकरण, तटीय िविनयमन जोन �े(# का वगVकरण और तटीय जोन �बंध योजना म� पCरवत न# या उपांतरण# के िल ए रा> य सरकार से �ाP त �; ताव# का परी�ण करेगा और उसके प� चात् उस पर राS Fीय तटीय जोन �बंध �ािधकरण से िविनRदS ट िसफाCरश� करेगा । (v) �ािधकरण - (क) उ� त अिधिनयम के उपबंध# और उसके अधीन बनाए गए िनयम# या Gकसी अ� य िविध के अिभकिथत उW लघंन क� दशा म� जांच करेगा और यGद आव� यक �तीत हो तो ऐसे Gकसी िविनRदS ट मामल# म� उ� त अिधिनयम क� धारा 5 के अधीन ऐसे िनदेश जारी करेगा जो Gक न तो राS Fीय तटीय जोन �बंध �ािधकरण �ारा या न ही क� �ीय सरकार �ारा जारी िनदेश# से असंगत ह#; (ख) उ� त अिधिनयम के उपबंध# और उसके अधीन बनाए गए िनयम# या Gकसी अ� य िविध के उW लंघन# म� अंतY ; त मामल# का पुनDवलोकन करेगा और यGद आव� यक �तीत हो तो राS Fीय तटीय जोन �बंध �ािधकरण �ारा पुनDवलोकन करने के िलए अपनी CटP पिणय# के साथ ऐसे मामल# को िनRदS ट करेगा : परंतु यह Gक �ािधकरण उW लंघन# के मामल# क� ऐसी जांच या पुनDवलोकन ; व�ेरणा से या Gकसी Z यिS ट या �ितिनिध िनकाय या संगठन �ारा क� गई िशकायत के आधार पर करेगा; (vi) �ािधकरण, उसके �ारा जारी Gकए गए िनदेश# के अननुपालन के Gकसी Z यि� त के िव@T उ� त अिधिनयम क� धारा 19 के अधीन िशकायत� फाइल करेगा ; (vii) �ािधकरण, ऐसी कार वाई करेगा जो Gकसी मामले म� उसके सम� त[ य# को स! यािपत करने के िलए उ� त अिधिनयम क� धारा 10 के अधीन अपेि�त हो । ¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 3 VI. �ािधकरण, तटीय िविनयमन जोन से संबंिधत पया वरणीय िववाधक# का िनपटारा करेगा िजसे रा> य सरकार, राS Fीय तटीय जोन �बंध �ािधकरण या क� �ीय सरकार �ारा उसे िविनRदS ट Gकया गया हो; VII. �ािधकरण, अपने काय करण म� पारदDशता बनाए रखने के �योजन के िलए एक समDपत वेबसाइट तैयार करेगा और वेबसाइट पर काय सूची, काय वृ! त Gकए गए िविन� चय, अ] यावेदन प(, उW लघंन और ऐसे उW लघंन# पर क� गई कार वाई, � यायालय मामल ेिजसके अंतग त � यायालय# के आदेश भी ह ̂और रा> य सरकार के अनुमोGदत तटीय जोन �बंध योजना को डालगेा । VIII. राS Fीय तटीय जोन �बंध �ािधकरण अपने GUयाकलाप क� Cरपोट छह मास म� कम से कम एक बार �ािधकरण को �; तुत करेगा । IX. �ािधकरण क� पूव गामी शि� तयां और कृ! य, क� �ीय सरकार के अधी�ण और िनयं(ण के अधीन ह#ग े। [फा. सं. जे- 17011/26/2007-आईए-III (भाग)] िब � वनाथ िस� हा, संयु� त सिचव MINISTRY OF ENVIRONMENT, FORESTS AND CLIMATE CHANGE NOTIFICATION New Delhi, the 31st March, 2015 S.O. 935(E).— In exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereinafter referred to as the said Act), the Central Government hereby constitutes an authority to be known as the Kerala Coastal Zone Management Authority (hereinafter referred to as the Authority) consisting of the following persons, for a period of one year, with effect from the date of publication of this notification in the Official Gazette, namely: -
1. Principal Secretary, Chairman, ex-officio Science and Technology Department, Government of Kerala, Kerala.
2. Principal Secretary, Member, ex-officio Local Self Government, Government of Kerala, or his nominee.
3. Secretary, Member, ex-officio Environment Department, Government of Kerala or his nominee.
4. Principal Secretary, Member, ex-officio Industries Department, Government of Kerala or his nominee.
5. Principal Secretary, Member, ex-officio Revenue Department, Government of Kerala or his nominee.
6. Secretary, Member,ex-officio Fisheries Department, Government of Kerala or his nominee.
7. Chairman, Member, ex-officio Kerala State Pollution Control Board, Government of Kerala.
8. Director, Member,ex-officio Centre for Earth Science Studies, Thiruvananthapuram.

II. The Authority shall have its headquarters at Thiruvananthapuram.
III. The quorum of the meeting of the authority shall be one-third of the total number of its Members.
IV. A Member, other than an ex-officio Member, shall be paid allowances as per the norms decided by the Central Government.
V. The Authority shall, for the purposes of protecting and improving the quality of the coastal environment and preventing, abating and controlling environmental pollution in the Coastal Regulation Zone areas in the State of Kerala, shall take the following measures, namely:-
(i) the Authority shall receive application for approval of project proposal and examine the same if it is in accordance with the approved Coastal Zone Management Plan and complies with the requirement of the Coastal Regulation Zone notification issued by the Government of India in the Ministry of Environment and Forests vide S.O. 19 (E), dated the 6 th January, 2011( herein after referred to as the said notification), and make recommendations for approval of such project to the concerned authority as specified in the said notification, within a period of sixty days from date of receipt of such application;
(ii) the Authority shall regulate all developmental activities in the Coastal Regulation Zone areas as specified in the said notification;
(iii) the Authority shall primarily be responsible for enforcing and monitoring the provisions of said notification;
(iv) the Authority shall examine the proposals received from the State Government for changes or modifications in the classification of Coastal Regulation Zone areas and in the Coastal Zone Management Plan and make specific recommendations thereon, to the National Coastal Zone Management Authority therefore.
(v) the Authority shall-
(a) inquire into cases of alleged violation of the provisions of the said Act and the rules made thereunder or any other law which is relatable to the objects of the said Act and, if found necessary, in any specific case, issue such direction under section 5 of the said Act as are not inconsistent with the directions issued in that specific case either by the National Coastal Zone Management Authority or by the Central Government;
(b) hold review of cases involving violations of the provisions of the said Act and the rules made there under, or under any other law which is relatable to the objects of the said Act, and if found necessary, refer such cases, along with its comments for review by the National Coastal Zone Management Authority:

Provided that such inquiry or review of cases of violations may be taken up by the Authority suo-moto, or on the basis of a complaint made by any individual or representative body or organization;
(vi) the Authority may file complaints, under section 19 of the said Act, against any person for noncompliance of directions issued by it;
(vii) the Authority shall take such action as may be required under section 10 of the said Act to verify the facts before it in any case.
VI. the Authority shall deal with environmental issues relating to Coastal Regulation Zone which may be referred to it by the State Government, the National Coastal Zone Management Authority or the Central Government.
VII. the Authority shall, for the purpose of maintaining transparency in its working create a dedicated website and post the agenda, minutes, decisions taken, recommendation letters, acts of violations and actions taken on such violations, court matters including the orders of the courts and the approved Coastal Zone Management Plan of the State Government.
VIII. The Authority shall furnish report of its activities at least once in six months to the National Coastal Zone Management Authority.
IX. The foregoing powers and functions of the Authority shall be subject to the supervision and control of the Central Government.
