PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 840] ubZ fnYyh] c``gLifrokj] ekpZ 23] 2017@pS=k 2] 1939 No. 840] NEW DELHI, THURSDAY, MARCH 23, 2017/CHAITRA 2, 1939 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय अिधसचूना नई ᳰद᭨ली, 23 माचᭅ, 2017 का.आ. 938(अ).—एक ᮧाᱧप अिधसूचना, भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का. आ. 2598 (अ), तारीख 22 िसत᭥बर, 2015, ᳇ारा भारत के राजपᮢ मᱶ ᮧकािशत कᳱ गई थी िजसमᱶ उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उᲦ अिधसूचना मᱶ अंतᳶव᳥ ह,ै राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ध करा दी गई थᱭ, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत ᳰकए गए थ;े और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक् :i से िवचार ᳰकया गया;
और, वन िवहार व᭠यजीव अभयार᭛य, राज᭭थान रा᭔य के िजला धौलपुर मᱶ अवि᭭थत ह ैऔर 23.6 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ फैला ᱟआ ह;ै और, अभयार᭛य मᱶ िविवध आ᮰य ᭭थल ह ै िजनमᱶ िविवध ᮧकार के जीव-ज᭠तु एवं वन᭭पित जसैे रीछ, जंगली िब᭨ली, जंगली कुᱫा, लकड़बघा, िसयार, लोमड़ी, नीलगाय, बनैला सूअर, ᭣लकै बक, ᳲचकारा, सांभर तथा िचᱫीदार िहरण का वास ह;ै और, चᱹिपयन तथा सेठ के वगᱮकरण के अनुसार अभयार᭛य के मुय वन ᮧकार मᱶ शु᭬क पणᭅपाती कांटेदार वन ह ै और मुय वन᭭पित एनोिगयािसस पᱶडुला के साथ सहयोगी वृᭃ ᮧजाित जसैे अकाᳰकया कैचू, अकाᳰकया िलयोको ᳰफिलया, अकाᳰकया सेनेगल, बलिन᭗स एिगयपᳯरका, बोᳯटया मोनोसपᭅमा, कापाᳯरस िडिसᲽम, कपाᳯरस िसपीयाᳯरया और कोरिडया मैयसा ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, वन िवहार व᭠यजीव अभयार᭛य ᭃेᮢ के चारᲂ ओर कᳱ ᭃेᮢ का पाᳯरि᭭थितक और पयाᭅवरण कᳱ दिृ᳥ स े पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करन ेको ᮧितिष करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, राज᭭थान रा᭔य मᱶ वन िवहार व᭠यजीव अभयार᭛य कᳱ सीमा से 1.5 ᳰकलोमीटर स े5 ᳰकलोमीटर के िव᭭तार के ᭃेᮢ को वन िवहार व᭠यजीव अभयार᭛य पाᳯरि᭭थितक सवेंदी जोन (िजस ेइसमᱶ इसके प᳟ात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:-
1. पाᳯरि᭭थितक सवंदेी जोन का िव᭭तार और उसकᳱ सीमाए-ं-(1) पाᳯरि᭭थितक संवेदी जोन वन िवहार व᭠यजीव अभयार᭛य कᳱ सीमा से 1.5 ᳰकलोमीटर से 5 ᳰकलोमीटर के िव᭭तार पर 23.38 वगᭅ ᳰकलोमीटर ᭃेᮢ तक फैला ᱟआ ह ैऔर पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का वणᭅन उपाबधं I और उपाबधं I-क मᱶ ᳰदया गया ह ै।
(2) इस अिधसूचना मᱶ पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ अᭃांश-दशेांतर के साथ उपाबधं II के ᱨप मᱶ उपाब ह ै।
(3) पाᳯरि᭭थितक संवेदी जोन राज᭭थान रा᭔य के िजला धौलपुर के 47 ᮕामᲂ तक फैला ᱟआ ह।ै
(4) पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत आने वाले ᮕामᲂ कᳱ सूची के साथ मुय िब᭠दᲐु का िनदᱷशांक उपाबंध III के ᱨप मᱶ उपाब ह ै।
2. पाᳯरि᭭थितक सवंदेी जोन के िलए आचंिलक महायोजना – (1) रा᭔य सरकार, पाᳯरस् िथितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) उᲦ योजना मᱶ सᭃम ᮧािधकारी ᳇ारा रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, पयाᭅवरण और वन मंᮢालय कᳱ मंजरूी के िलए अनुमोᳰदत कᳱ जाएगा ।
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित मᱶ रा᭔ य सरकार तथा सुसगंत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करके संब रा᭔ य के सभी िवभागᲂ के परामशᭅ से तैयार कᳱ जाएगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) कृिष;
(iv) राज᭭ व ;
(v) नगर िवकास ;
(vi) पयᭅटन;
(vii) ᮕामीण िवकास;
(viii) ᳲसचाई और बाढ़ िनयंᮢ ण;

(ix) नगरपािलका ;
(x) पंचायती राज;
(xi) लोक िनमाᭅण िवभाग।
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भ-ूउपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन तब तक अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᭬ ट न ᳰकया गया हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी सरंᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण स ेसंबंिधत ऐसे अ᭠य पहलुᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बि᭭तयᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
(9) आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के संबंध मᱶ अपने कायᲄ के बाहर ल ेजाने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन ेके िलए िन᳜िलिखत उपाय करेगी, अथाᭅत ्:--
(1) भ-ूउपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए वनᲂ, उ᳒ान- कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭃेᮢीय नगर योजना अिधिनयम के अधीन सᭃम ᮧािधकारी के पूवᭅ अनुमोदन के साथ और के᭠ᮤीय/रा᭔य सरकार के अ᭠य िनयमᲂ और िविनयमᲂ के ᱨप मᱶ लागू हᲂगे, जो ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए ह,ै जसै:े-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और सुदढ़ृ करना और नई सड़कᲂ के सिंनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर भी ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुिवधाᲐ सहायक पाᳯरि᭭थितक पयᭅटन मᱶ सि᭥मिलत गृह वास; और
(v) संवᳶधत ᳰᮓयाकलाप और पैरा 7 के अंतगᭅत ᳰदया गया ह:ै परंतु यह और ᳰक ᭃेᮢीय नगर योजना अिधिनयम और अ᭠य िनयमᲂ और िविनयमᲂ के अधीन रा᭔य सरकार के पूवᭅ अनुमोदन तथा सिंवधान के अन᭒ुछेद 244 और त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना दनेी होगी :
परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । हᳯरत ᭃेᮢ मᱶ जैस ेवन ᭃेᮢ, कृिष ᭃेᮢ, आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएगें ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके सरंᭃण और पुननᭅवीकरण के िलए योजना को सि᭥ मिलत ᳰकया जाएगा और रा᭔ य सरकार ᳇ारा ऐसी रीित से मागᭅदशᭅक िसांत बनाए जाएगें िजससे ᳰक उन ᭃेᮢᲂ मᱶ या इसके समीप िवकास ᳰᮓयाकलाप को ᮧितिष ᳰकया जा सके।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो पयᭅटन महायोजना के अनुसार हᲂगे, आंचिलक महायोजना का भाग ᱨप मᱶ हᲂगे । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, ᳇ारा पयाᭅवरण और वन िवभाग के परामशᭅ से तैयार होगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ जाना जायेगा । (घ) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक अनकूुल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे। परंतु, जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा ह ैवहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना के अनुसार होगा;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दते े ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान े तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात होगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(4) नसैᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और उनके संरᭃण कᳱ योजनाए ंतैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण – रा᭔य सरकार के पयाᭅवरण िवभाग या महारा᳦ रा᭔य पयाᭅवरण िनयंᮢण बोडᭅ पयाᭅवरण (संरᭃण) अिधिनयम 1986 के अधीन ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 मᱶ िनयत उपबंधᲂ के अनुसरण मᱶ पाᳯरि᭭थितक सवेंदी जोन मᱶ ᭟विन ᮧदषूण के िनयंᮢण के िलए िविनयमᲂ को कायाᭅि᭠वत करेगा ।
(7) वाय ु ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, रा᭔य सरकार के पयाᭅवरण िवभाग महारा᳦ रा᭔य पयाᭅवरण िनयंᮢण बोडᭅ वायु (ᮧदषूण िनवारण एवं िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के उपबंधᲂ के अनुसार वायु ᮧदषूण के िनयंᮢण के िलए मागᭅदशᭅक िसांत और िविनयम लागू हᲂगे ।
(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मागᭅदशᭅक िसांतᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अधीन पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा--
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, समय-समय पर सशंोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ᳰकए गए थे, के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाए ंतैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा;
(v) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 343 (अ), तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएगें और आंचिलक महायोजना के तैयार होन ेऔर रा᭔ य 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होन ेतक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(12) औ᳒ोिगक इकाईया ं- (i) सरकारी राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन को या ᮧकाशन के प᳟ात ् पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित नहᱭ दी जाएगी।
(ii) पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण बोडᭅ के वगᱮकरण के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित दी जाएगी।
4. पाᳯरि᭭थितक सवंदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सचूी - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीच े दी गई सारणी मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत ्:-- सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी 1 2 3 क. ᮧितिष ᳰᮓयाकलाप (टे᭥पलटे के अतं मᱶ ᮧितिष ᳰकए जान ेवाल ेᳰᮓयाकलापᲂ कᳱ सचूी के िलए तकᭅ ᳰदया गया ह)ै
1. वािणि᭔यक खनन । (क) सभी नए और िव᳒मान (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न े कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेल ूआव᭫यकताᲐ िजसके अंतगᭅत िनजी उपयोग के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइ᭨स या टᲂ का िनमाᭅण करना भी सि᭥मिलत ह,ै के िसवाय नहᱭ हᲂगी ;
(ख) खनन संᳰᮓयाए,ं माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन.
गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
2. ᮧदषूण काᳯरत करने वाले नए उ᳒ोगᲂ कᳱ ᭭ थापना जल, वायु, मृदा, ᭟ विन, आᳰद । कोई नए या पाᳯरि᭭थितक सवेंदी जोन मᱶ ᮧदषूण फैलाने वाले उ᳒ोगᲂ के िव᭭तार कᳱ अनुमित नहᱭ दी जाएगी। के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ वगᱮकरण मᱶ हᳯरत या ᳡ेत के ᱨप मᱶ वगᱮकृत उ᳒ोग िजसके अंतगᭅत कृिष आधाᳯरत लघु उ᳒ोग भी ह ै िविनयमᲂ के अनुसार िविनयिमत ᳰकया जाएगा।
3. बृहत जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
4. ᳰकसी खतरनाक पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
5. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
6. कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़ े पैमाने पर वािणि᭔यक पशुᲐ और पो᭨ᮝी फामᲄ कᳱ ᭭थापना । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
7. नई आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अन᭄ुात नहᱭ होगा ।
8. ट भᲵᲂ कᳱ ᭭थापना । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । ख. िविनयिमत ᳰᮓयाकलाप
9. होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप पयᭅटकᲂ के लघु अ᭭थायी संरचना के िलए सरंिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक, जो भी िनकट हो, के भीतर ही नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ :
पर᭠तु व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर स े परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱧप होगा ।
10. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो कᳱ सीमा स ेएक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंत ु᭭थानीय ᳞िᲦयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण िजसके अंतगᭅत भवन संबंधी उपिविध के अनुसार पैरा 6 के उपपैरा (1) मᱶ सूचीब ᳰᮓयाकलाप भी ह,ᱹ को करने के िलए अनु᭄ात ᳰकया जाएगा । पर᭠तु, यह और ᳰक ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोगᲂ स े संबंिधत सिंनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएगें और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी के पूवᭅ अनु᭄ा से ऐसे ᮧदषूण को कम ᳰकया जाएगा । (ख) एक ᳰकलोमीटर से परे आंचिलक महायोजना के अनुसार िविनयिमत ᳰकया जाएगा।
11. ᮧदषूण उ᭜प᳖ न करन ेवाले लघ ुउ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन से गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष, पु᭬ प, कृिष, 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उ᳒ान कृिष, या कृिष आधाᳯरत उ᳒ोग दशेीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई ᮧितकूल ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात हᲂगे।
12. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन या सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳰक᭠ही वृᭃᲂ कᳱ कटाई नहᱭ होगी;
(ख) वृᭃᲂ कᳱ कटाई सबंंिधत के᭠ᮤीय या रा᭔य अिधिनयम और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार िविनयिमत हᲂगे।
13. वन उ᭜पादᲂ और गैर का᳧ वन उ᭜पादᲂ का संᮕहण (एन.टी.एफ.पी.) । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
14. िव᳒ुत और दरूसंचार टावरᲂ और िबछाई गई केबलᲂ और अ᭠य बुिनयादी ढाँचᲂ का पᳯरिनमाᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे। भूिमगत केबलᲂ को ᮧो᭜सािहत ᳰकया जा सकेगा ।
15. नागᳯरक सुिवधाᲐ सिहत बुिनयादी ढांचे । लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
16. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढ़ृ करना और नई सड़कᲂ का संिनमाᭅण। लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयम और उपाबंध ᳰदशािनदᱷश िविनयिमत हᲂगे ।
17. पयᭅटन से संबंिधत अ᭠य ᳰᮓयाकलाप जैस े गमᭅ वायु गु᭣बारᲂ, हलेीका᭡टर, ᮟोन, माइᮓोलाइ᭗स, आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना जैस े ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
18. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
19. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
20. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ दुधशाला, डयेरी उ᳒ोग, एᲤाक᭨चर और म᭜᭭य पालन। ᭭थानीय लोगᲂ के उपयोग के लागू िविधयᲂ के अधीन अनुमित दी जाएगी ।
21. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । लागू िविधयᲂ के अनुसार अनुपचाᳯरत बिह᮲ाᭅव का िन᭭सारण िविनयिमत हᲂगे ।
22. वािणि᭔यक सतह और भूिमगत जल कᳱ िनकासी । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
23. खुले कुआ, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ सती से मानीटरी कᳱ जाएगी।
24. ठोस अपिश᭬ ट ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

27. पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ग. सवंᳶधत ᳰᮓयाᳰकलाप
29. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
30. जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
31. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
32. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर, आᳰद भी ह ᱹ। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
33. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । बायोगैस, सौर रोशनी आᳰद को बढ़ावा ᳰदया जाएगा।
34. कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
35. कौशल िवकास । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
36. िन᳜ीकृत भूिम या वन आवास कᳱ बहाली । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
37. पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
5. मानीटरी सिमित - (1) कᱶ ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) के ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए वन िवहार व᭠यजीव अभयार᭛य के पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-
(i) िजला कलटर, धौलपुर – अ᭟यᭃ;
(ii) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅरत गैर सरकारी संगठन का एक ᮧितिनिध िजसे राज᭭थान सरकार ᳇ारा तीन वषᭅ कᳱ अविध के िलए नाम िन᳸द᳥ ᳰकया जाए – सद᭭य;
(iii) पाᳯरि᭭थितक और पयाᭅवरण के ᭃेᮢ मᱶ एक िवशेष᭄ िजसे राज᭭थान सरकार ᳇ारा ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए नाम िन᳸द᳥ ᳰकया जाए - सद᭭य ;
(iv) िन᳜िलिखत िवभागᲂ के िजला ᭭तरीय अिधकारी :
लोक िनमाᭅण िवभाग, खनन, ᳲसचाई, पयᭅटन, पुिलस, नगर पᳯरषद, उ᳒ोग, – सद᭭यगण;
(v) ᭃेᮢीय अिधकारी (आर.ओ), रा᭔य ᮧदषूण िनयंᮢण बोडᭅ – सद᭭य;
(vi) माननीय व᭠यजीव वाडᭅन, धौलपुर – सद᭭य;
(vii) उप खंड अिधकारी, धौलपुर – सद᭭य;
(viii) ᮧभागीय वन अिधकारी – सद᭭य;
(ix) रा᭔य जैव-िविवधता बोडᭅ का सद᭭य - सद᭭य;

6. िनदᱷश िनबधंन :
(1) सिमित का कायᭅकाल तीन वषᭅ कᳱ अविध के िलए होगा।
(2) मानीटरी सिमित राजपᮢ अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी।
(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं.
का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अनुसचूी मᱶ सि᭥मिलत ᳰᮓयाकलापᲂ और पैरा 4, सारणी मᱶ यथा िविन᳸द᳥ ᮧितिष के अधीन कᳱ गितिविधयᲂ के िसवाय उसके वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी।
(4) इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ुपाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उस े संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(5) मानीटरी सिमित का सद᭭य-सिचव या संबंिधत उ᳒ान के उप-वन संरᭃक, कोई ᳞िᲦ जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै उसके िवᱧ पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा ।
(6) मानीटरी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहत ेᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिध ᮧित मु ेकᳱ अपेᭃाᲐ के अनसुार िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ को अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠यजीव वाडᭅन को उपाबधं IV पर उपाब ᮧाᱨप पर उᲦ वषᭅ ᳰक 30 जून तक ᮧ᭭तुत करेगी ।
(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदशे द ेसकेगा, जो वह ठीक समझे ।
7. अिधसूचना के उपबंधᲂ को ᮧभाव दनेे के िलए कᱶ ᮤीय सरकार और रा᭔ य सरकार अितᳯर त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकेगी ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FORESTS AND CLIMATE CHANGE NOTIFICATION New Delhi, the 23rd March, 2017 S.O. 938(E).––WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 2598 (E), dated the 22 September 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 WHEREAS, Van Vihar Wildlife Sanctuary is situated in Dholpur district of Rajasthan and is spread over an area of 23.6 square kilometer;
AND WHEREAS, the sanctuary has varied habitats having diverse flora and fauna and harbors Sloth Bear, Jungle Cat, Wild Dog, Hyaena, Jackal, Fox, Nilgai, Wild Bor, Black buck, Chinkara, Sambhar and Spotted Dear;
AND WHEREAS, the main forest type according to Champion and Seth Classification in the Sanctuary is Dry Deciduous Thorny Forest and the main flora is Anogeissus pendula along with associate trees species such as Acacia catechu, Acacia leucophloea, Acacia Senegal, Balanites aegyptica, Butea monosperma, Capparis deciduas, Capparis sepiaria, and Cordia myxa;
AND WHEREAS, it is necessary to conserve and protect the area around the area of Van Vihar Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view.
NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and
(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government here by notifies an area with an extent of 1.5 kilometer to five kilometer all around the boundary of Van Vihar Wildlife Sanctuary in the State of Rajasthan as the Van Vihar Wildlife Sanctuary Eco sensitive Zone (herein after called as Eco-sensitive Zone) and the details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of
23.38 square kilometre with an extent of 1.5 kilometer to 5 kilometer around the boundaries of Van Vihar Wildlife Sanctuary and the boundary description of the Eco-sensitive Zone are given in Annexure I and Annexure I-A.
(2) The map of the eco-sensitive zone along with latitude and longitude is appended to this notification as Annexure II.
(3) The Eco-sensitive Zone is spread across 47 villages in Dholpur District of the state of Rajasthan.
(4) The list of the villages falling within Eco-sensitive Zone along with coordinates of prominent points is appended as Annexure III.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The said Plan shall be prepared by the Competent Authority of the State Government within a period of two years from the date of publication of the final notification in the Official Gazette, for consideration and approval of the Ministry of Environment and Forests.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department;
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone as to ensure Ecofriendly development for livelihood security of local communities.
(9) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions of monitoring vides the provisions of this notification.
3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or industrial activities and such areas shall be clearly defined in the Zonal Master Plan along with maps:
Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the Regional Town Planning Act and other rules and regulations of Central/State Government as applicable, to meet the residential needs of the local residents such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under para 7:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the of the competent authority under the Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such areas.
(3) Tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km. from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km.
from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on Eco-tourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up as part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(v) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial Units:- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed to be established within Eco-sensitive Zone vide Central Pollution Board’s categorisation.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions the Environment (Protection) Act, 1986 (29 of 1986), and be regulated in the manner specified in the Table below, namely:- 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S. 1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04 August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21 April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of new industries causing pollution (Water, Air, Soil, Noise, etc.).
No new or expansion of polluting industries in the Eco-sensitive zone shall be permitted.
Industries categorised as Green or White in the CPCB Classification including agro-based small scale industries will be regulated as per regulations.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
7. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
8. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
9. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

10. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 6 as per building byelaws:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
11. Small scale industries not causing pollution.
Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the competent Authority.
12. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
13. Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
14. Erection of electrical and communication towers and laying of cables and other infrastructures .
Regulated under applicable law. Underground cabling may be promoted.
15. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
16. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
17. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Micro-lights, etc.
Regulated under applicable law.
18. Protection of Hill Slopes and river banks.
Regulated under applicable laws.
19. Movement of vehicular traffic at night.
Regulated for commercial purpose under applicable laws.
20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
21. Discharge of treated effluents in natural water bodies or land area.
The discharge of treated effluent shall be regulated as per applicable laws.

5. Monitoring Committee: - In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone Notification for Van Vihar Wildlife Sanctuary, which shall comprise of, namely:-
(i) District Collector, Dholpur - –Chairman
(ii) One representative of Non-Governmental Organisation working in the field of environment to be nominated by the Government of Rajasthan for a term of three years –Member
(iii) one expert in the area of ecology and environment to be nominated by the Government of Rajasthan for a term of three years in each case –Member
(iv) District level officers of the following departments:
PWD, Mining, Irrigation, Tourism, Police, Municipal Council, Industry –Members
22. Commercial extraction of surface and ground water.
Regulated under applicable law.
23. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
24. Solid Waste Management. Regulated under applicable laws.
25. Introduction of Exotic species. Regulated under applicable laws.
26. Eco-tourism. Regulated under applicable laws.
27. Use of polythene bags. Regulated under applicable laws.
28. Commercial Sign boards and hoardings.

C. Promoted Activities
29. Rain water harvesting. Shall be actively promoted.
30. Organic farming. Shall be actively promoted.
31. Adoption of green technology for all activities.
Shall be actively promoted.
32. Cottage industries including village artisans, etc.
Shall be actively promoted.
33. Use of renewable energy. Bio gas, solar light etc. to be actively promoted.
34. Agro-Forestry. Shall be actively promoted.
35. Skill Development. Shall be actively promoted.
36. Restoration of Degraded Land/ Forests/ Habitat.
Shall be actively promoted.
37. Environmental Awareness. Shall be actively promoted.

6. Terms of Reference:
(1) The tenure of the Monitoring committee is for a period of three years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of Gazette Notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma given in Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and the State Government may specify additional measures, if any, for giving effect to provisions of the notification.
8. The provisions of this Notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal (NGT).
