vf/klwpuk नई �द�ली, 31 माच , 2015 dk-vk- 938¼v½-&के��ीय सरकार ने भारत सरकार के त�कालीन पया�वरण और वन मं�ालय क� अिधसूचना सं. का.आ. 19(अ) तारीख 6 जनवरी, 2011 (िजसे इसम इसके प!ात् उ$ अिधसूचना कहा गया ह)ै (ारा कितपय तटीय *े�+ को तटीय िविनयमन जोन के -प म घोिषत 0कया गया ह ैऔर उ$ जोन म उ1ोग+ के िव2तार, उ1ोग 2थािपत करने और उनके 4चालन और 4सं2करण पर िनब6धन अिधरोिपत 0कए गए थे । और उ$ अिधसूचना के पैरा 5 के खंड (viii) के अधीन रा9य सरकार का संघ रा9य *े� के तटीय *े� 4बंध 4ािधकरण (ारा पया�वरण और वन मं�ालय को िसफा;रश+ के साथ 4ा-प तटीय *े� 4बंध योजना छह मास के भीतर अथा�त् 30 िसतंबर, 2013 को या उसके पूव� पणधा;रय+ से 4ा> 0कए गए सुझाव और आ*ेप को िनगिमत करने के प!ात् 42तुत 0कया जाना अपेि*त ह ै। और उ$ अिधसूचना के पैरा 5 के खंड (xii) के अधीन तटीय *े� 4बंध योजनाB को सी. आर. जेड अिधसूचना के अधीन पहल ेही अनुमो0दत 0कया गया ह,ै ऐसा चौबीस मास क� अविध के िलए िविधमा�य होगा जब तक 0क पया�वरण और वन मं�ालय (ारा िविनFदG अिधसूचना जारी करके उ$ अविध िव2ता;रत न कर 0दया जाए । और तटीय *े� 4बंध योजनाB क� तैयारी क� ि2थित का अविधक -प से पुनHवलोकन करने से य0द के��ीय सरकार का समाधान Iआ ह ैतब वह उनके Jमवार 4ा-प तटीय *े� 4बंध योजनाB के अनुमोदन हतुे 42तुत करने के िलए रा9य+ और संघ रा9य*े�+ को कुछ और समय दे सकता ह ै। और पया�वरण (संर*ण) िनयम, 1986 के िनयम 5 का उपिनयम (4) के उपबंध+ को Kयान म रखते Iए के��ीय सरकार क� यह राय ह ै0क उ$ अिधसूचनाB को संशोिधत करने के िलए उ$ िनयम+ के िनयम 5 के उपिनयम (3) के खंड (क) के अधीन सूचना क� अपे*ा को �य$ करना लोकिहत म ह ै। अतः, पया�वरण (संर*ण) अिधिनयम, 1986 (1986 का 29) क� धारा 3 क� उपधारा (1) और खंड (v) के साथ प;ठत पया�वरण (संर*ण) िनयम+, 1986 के िनयम 5 के उपिनयम 3 का खंड (घ) और उपिनयम (4) (ारा 4दN शि$य+ का 4योग करते Iए के��ीय सरकार उ$ अिधसूचना म िनOिलिखत संशोधन करती ह ैअथा�त्:- उ$ तटीय िविनयमन *े�, अिधसूचना 2011 म – 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) पैरा 5 म ,- (i) मद (viii) के 2थान पर िनOिलिखत मद रखा जाएगा, अथा�त्:- “(viiii) रा9य या संघ रा9य *े� के तटीय *े� 4बंध 4ािधकरण (ारा पणधा;रय+ के 4ा> 0कए गए सुझाव और आ*ेप को िनगिमत करने के प!ात् उनक� िसफो;रश+ के साथ 4ा-प तटीय *े� 4बंध योजना को पया�वरण, वन और जलवायु प;रवत�न मं�ालय को 42तुत 0कया जाएगा” । (ii) मद (xii) के 2थान पर, िनOिलिखत मद रखा जाएगा, अथा�त्:- “(xii) पया�वरण और वन मं�ालय (ारा पहले ही अनुमो0दत तटीय *े� 4बंध योजनाएं तारीख 31 जनवरी, 2016 तक िविधमा�य होगा या उस समय तक जैसा0क उ$ मं�ालय (ारा उ$ अिधसूचना के अधीन बनाए गए नए िसरे से तटीय *े� 4बंध योजनाB के बारे म 0कया गया अनुमोदन जो भी पहले हो” । [सं.जे-17011/18/96-आईए-III] िब”Okkनाथ िस�हा, संयु$ सिचव ;टPपण :::: मूल िन यम भारत के राजप�, असाधारण, भाग 2, खंड 3 उपखंड (ii) म अिधसूचना संQ यांक का. आ. 19(अ), तारीख 6 जनवरी, 2011 (ारा 4कािशत क� गई थी और त� पS चात् उसको िनT निलिखत (ारा संशोिधत 0कया गया :-- 1. का. आ. 2557 (अ) तारीख 22 अग2त, 2013. 2. का. आ. 1244 (अ) तारीख 30 अ4ैल, 2014. 3. का. आ. 3085 (अ) तारीख 28 नवंबर, 2014. 4. का. आ. 383 (अ) तारीख 4 फरवरी, 2015; और 5. का. आ. 556 (अ) तारीख 17 फरवरी, 2015.
MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 31st March, 2015 S.O. 938(E).—Whereas, by notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O.19 (E), dated the 6th January, 2011 (hereinafter referred to as the said notification), the Central Government had declared certain coastal stretches as Coastal Regulation Zone and restrictions were imposed on the setting up and expansion of industries, operations and processes in the said Zone;
And whereas, under clause (viii) of paragraph 5 of the said notification, the Coastal Zone Management Authority of a State Government or of a Union territory is required to submit the draft Coastal Zone Management Plan along with its recommendations to the Ministry of Environment and Forests within a period of six months, i.e., on or before the 30th September, 2013, after incorporating the suggestions and objections received from the stakeholders;
And Whereas, under clause (xii) of paragraph 5 of the said notification, the Coastal Zone Management Plans already approved under the CRZ notification, 1991, shall be valid for a period of twenty-four months unless the said period is extended by the Ministry of Environment and Forest by a specific notification;
And whereas after the periodic review of the status of preparation of the Coastal Zone Management Plans, the Central Government is satisfied that it may take some more time for the States and Union territories to submit their respective draft Coastal Zone Management Plans for approval;
And whereas the Central Government, having regard to provision of sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, is of the opinion that it is in public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rules for amending the said notifications;
¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 3 Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with clause (d) of sub-rule (3) and sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the said notification, namely:- In the said Coastal Regulation Zone, notification, 2011,-
(a) in paragraph 5,-
(i) for item (viii), the following item shall be substituted, namely:- “(viii) The Coastal Zone Management Authority of a State or of a Union territory shall submit the draft Coastal Zone Management Plan along with its recommendations to the Ministry of Environment, Forest and Climate Change, after incorporating the suggestions and objections received from the stakeholders”.
(ii) for item (xii), the following item shall be substituted, namely:- “(xii) The Coastal Zone Management Plans as already approved by the Ministry of Environment and Forests shall be valid up to the 31st day of January, 2016, or till such time as the approval is given by that Ministry to the fresh Coastal Zone Management Plans made under the said notification, whichever is earlier.” [No. J-17011/18/96-IA-III] BISHWANATH SINHA, Jt.
