And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838 (E) dated the 5 th Dec, 2008, and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12 th October,2011 and G.S.R 778 (E) dated 16 th December,2013, G.S.R 26(E) dated 16 th January, 2014, G.S.R 831(E) dated 21 st November,2014 and G.S.R 220(E) dated 23rd March, 2015 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels;
And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement with M/s L&T PNG Tollway Private Limited, having its registered office at P.O. Box 979, Mount Poonamallee Road, Manapakkam, Chennai – 600089 (hereinafter referred to as the Concessionaire) for Design, Engineering, Finance, Construction, Development, Operation and Maintenance of the existing two lane section from km 380.000 to km 440.000 (Pimplegaon-Nashik-Gonde Section) of National Highway No. 3 in the State of Maharashtra to six lane divided carriageway on Design, Build, Finance, Operate and Transfer (DBFOT) Basis.
And whereas, in exercise of the powers conferred by Section 8A of the National Highway Act, 1956 (48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central Government by notification of the Government of India vide S.O. No. 2096 (E) dated 19.09.2011 authorized the Concessionaire M/s L & T PNG Tollway Private Limited, Chennai, for levying and collecting fee on mechanical vehicles for the use of the stretch from Pimplegaon-Nashik-Gonde section from km 380.000 to km 440.000 on National Highway No. 3 in the State of Maharashtra on BOT (Toll) basis on and from the Date of Commercial Operation declared by the Authority and till the termination date as specified in the Agreement.
And whereas, the BOT Concession Agreement was foreclosed on account of termination of BOT Concession Agreement by the Authority on 29.03.2016. Consequent upon termination of BOT Concession Agreement, NHAI is continuing the user fee collection as per provisions in Concession Agreement/Fee Notification dated 19.09.2011.
However, w.e.f. date of publication of this fee notification, NHAI shall collect user fee as per provisions under this fee notification.
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), and in supersession of the notification number S.O. 2096 (E) dated 19.09.2011, except as respects things done or omitted to be done before such supersession, the Central Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for total equivalent road length of 123.98 km [including 52.870 km road and 7111 m of structures (having length more than 60m) with equivalent length of 71.11 km] for use of the four and more lane sections (hereinafter referred to as “base rate”) on National Highway No.
3 in the State of Maharashtra on the Type of Vehicles specified in column (1) of the Table 1 below and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:- Table 1 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees)

1. The fee levied and collected hereunder shall be due and payable at the following Fee Plazas for the distance specified for each such Fee Plaza:

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10:

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 235.00 (Rupees Two Hundred Thirty Five only) for the year 2016-17, and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
4. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle.

The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle
7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rules.
8. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules.
9. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the sections and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
10. The present value of Capital Cost of the Project is Rs. 1058.79 Crore (Rupee One Thousand Fifty Eight crore and Seventy Nine lakh only). The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
