PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 765] ubZ fnYyh] 'kqØokj] vizSy 10] 2015@pS=k 20] 1937 No. 765] NEW DELHI, FRIDAY, APRIL 10, 2015 /CHAITRA 20, 1937 पया�वरणपया�वरणपया�वरणपया�वरण,,,, वन और जलवाय ुप�रवत�न म�ंालय वन और जलवाय ुप�रवत�न म�ंालय वन और जलवाय ुप�रवत�न म�ंालय वन और जलवाय ुप�रवत�न म�ंालय अिधसचूनाअिधसचूनाअिधसचूनाअिधसचूना नई �द� ली, 10 अ ैल, 2015 काकाकाका....आआआआ. . . . 996996996996((((अअअअ).).).).---- के� �ीय सरकार, पया�वरण (संर�ण) िनयम, 1986 के िनयम 5 के उपिनयम (4) के साथ प�ठत पया�वरण (संर�ण) अिधिनयम, 1986 क� धारा 3 क� उप-धारा (1) और उप-धारा (2) के खंड (v) !ारा द" त शि%य& का योग करते )ए, उ+ त िनयम& के िनयम 5 के उपिनयम (3) के खंड (क) के अधीन सूचना क� अपे�ा से अिभमुि% दनेे के प1 चात् लोकिहत म3 भारत सरकार के त" कालीन पया�वरण और वन मं5ालय क� अिधसूचना सं6 या का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 म3 िन7 निलिखत और संशोधन करती है, अथा�त् :— उ+ त अिधसूचना म3, - पैरा 7 के उप-पैरा 2 के उपशीष� के खंड (i) और (i) के < थान पर िन7 निलिखत रखा जाएगा,अथा�त् :— ( i) ''िव< तारण'' उस �=या को िन>द? ट करता ह ै िजसके !ारा िव< तृत C यापक काय� अवधा�रत करने के िलए उस प�रयोजना या �=याकलाप& के संबध म3 कोई पया�वरणीय समाघात िनधा�रण �रपोट� तैयार करने के िलए सभी सुसंगत पया�वरणीय समु" थान& को िजसके िलए पूव� पया�वरणीय अनापि" त ईिF सत क� गई ह ै । से+ टर िवशेषH आकलन सिमित स ेपरामश� कर मं5ालय !ारा िवकिसत मानक प�रयोजना �=याकलाप& के िलए सJपे गए कृ" य पया�वरण, वन और जलवायु प�रवत�न मं5ालय क� वेबसाइट पर दLशत �कए जाएंगे : परंतु यह �क िवशेषH आकलन सिमित या राM य िवशेषH आकलन सिमित, य�द प�रयोजना के िलए यह आव1 यक पाया जाए तो िविन>द? ट Nप 1 या Nप 2 म3 आवेदन को < वीकार करने के तीस �दन म3 संशोधन को अंितम Nप म3 दान करेगी । मानक सJपे गए कृ" य आवेदन के आनलाइन < तुत होने और रिज< Oीकरण के सफलतापूव�क होने के प1 चात् कोई पया�वरण समाघात िनधा�रण के ारंभ क� तैयारी का प�रयोजना < ताव होगा । तथािप यह और �क िवशेषH आकलन, य�द यह आव1 यक हो तो िविन>द? ट आवेदन Nप 1 और Nप 2 म3 आवेदन को < वीकार होने म3 तीस �दन म3 अित�र+ त सJपे गए कृ" य& का अनुबंध कर सकेगी । 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और < तावक प�रयोजना अित�र+ त सJपे गए कृ" य& के साथ-साथ मानक सJपे गए कृ" य& पर आधा�रत ईआईए को करेगा य�द सीईएसी !ारा अनुबंिधत हो, य�द कोई हो । परंतु यह �क िन7 निलिखत के िलए िव< तारण अपेि�त नहQ ह ै:—- (i) अनुसूची के मद 8 (क) के सामने वग� ‘ख’ के अधीन सूचीब! सभी प�रयोजना और �=याकलाप ; (ii) अनुसूची के मद 7 (च) के सामने और < तंभ (3) को (i) < तभं (4) क� िविR (ii) के अधीन आने वाले सीमांत राM य& के सभी राजमाग� ; (iii) अनुसूची के मद 7 (च) के सामने < तभं (3) क� िविR (i) और िविR (ii) के अधीन आने वाले सभी राजमाग� िव< तार प�रयोजना ; परंतु यह भी �क – (क) खंड (i) म3 िन>द? ट सभी प�रयोजना और कृ" य Nप 1 और Nप 1क और संक� पना प�रयोजना के आधार पर आकिलत �कए जाएंगे । ([k) खंड (ii) म3 िन>द? ट सभी प�रयोजनाएं पया�वरण, वन और जलवायु प�रवत�न मं5ालय !ारा िविन>द? ट मानक सJपे गए कृ" य& के आधार पर पया�वरण समाधात िनधा�रण �रपोट� और पया�वरण ईएमपी क� �रपोट� के आधार पर तैयार �कए जाएंगे । (ii) पैरा 7 के उप पैरा (i) के उपशीष� म3 खंड (iii) को उनके खंड (ii) के Nप म3 पुन�सं6 या�कत �कया जाएगा । [ फा. सं. 22-62/2015-आईए-III] मनोज कुमार Sसह, संयु% सिचव �ट� प�ट� प�ट� प�ट� पणणणण :::: मूल अिधसूचना भारत के राजप5, असाधारण, भाग II , खंड 3, उप खंड (ii) सं6 यांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 को कािशत क� गई थी और अंितम संशोधन का.आ. 1737 (अ), तारीख 11 अ+ तूबर, 2007, का.आ. 3067 (अ), तारीख 1 �दस7 बर, 2009, का.आ. 695(अ), तारीख 4 अ ैल, 2011, का.आ. 2896 (अ), तारीख 13 �दस7 बर, 2012, का.आ. 674(अ), तारीख 13 माच�, 2013, का.आ. 2559 (अ), तारीख 22 अग< त, 2013, का.आ. 2731(अ), तारीख 9 िसत7 बर, 2013, का.आ. 562 (अ), तारीख 26 फरवरी, 2014, का.आ. 637 (अ), तारीख 28 फरवरी, 2014, का.आ. 1599 (अ), तारीख 25 जून, 2014, का.आ. 2601 (अ), तारीख 7 अ+ तबूर, 2014, का.आ. 3252 (अ), तारीख 22 �दस7 बर, 2014, का.आ. 382 (अ), तारीख 3 फरवरी, 2015, का.आ. 811 (अ), तारीख 23 माच�, 2015 !ारा संशोिधत �कए गए थे । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 10th April, 2015 S.O. 996(E).—In exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following further amendments to the notification of the Government of India, in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 after having dispensed with the requirement of notice under clause(a) of sub-rule (3) of said rule 5, in public interest, namely.— In the said notification, in paragraph 7 in sub–paragraph (i), in sub-heading II. for clauses (i) and (ii), the following shall be substituted, namely:—
(i) “Scoping” refers to the process to determine detailed and comprehensive Terms of Reference (TOR) addressing all relevant environmental concerns for the preparation of an Environment Impact Assessment (EIA) Report in respect of the project or activity for which prior environmental clearance is sought. Standard TOR developed by the Ministry in consultation with the sector specific Expert Appraisal Committees shall be the deemed approved TOR for the projects or activities. The standard Terms of Reference are displayed on the website of the Ministry of Environment, Forest and Climate Change:

Provided that the Expert Appraisal Committee (EAC) or State Expert Appraisal Committee (SEAC) may finalise amendment, if found necessary for a project within thirty days of the acceptance of application in specified application Form I or Form IA. These standard TOR shall enable the Project Proponent to commence preparation of an Environment Impact Assessment Report after successful online submission and registration of the application:
Provided further that, the Expert Appraisal Committee (EAC) or State Expert Appraisal Committee (SEAC) may stipulate additional Terms of Reference, if found necessary, within thirty days of the acceptance of the application in the specified application Form I or Form IA and the Project Proponent shall carry out the EIA study based on the standard TORs as well as the additional TOR, if any, stipulated by EAC/SEAC:
Provided also that the following shall not require Scoping−
(i) all projects and activities listed under Category ‘B’, against Item 8(a) of the Schedule;
(ii) all Highway projects in border States covered under entry (i) of column (3) and entry (i) of column (4) against item 7(f) of the Schedule;
(iii) all Highway expansion projects covered under entry (ii) of column (3) and entry (ii) of column (4) against item 7(f) of the Schedule;
Provided also that – (A) the project and activities referred to in clause (i) shall be appraised on the basis of Form I or Form IA and the conceptual plan;
(B) the projects referred to in clause (ii) shall prepare EIA and EMP report on the basis of standard TOR specified by the Ministry of Environment, Forest and Climate Change;
(ii) in Paragraph 7 in sub-paragraph (i), in sub-heading, clause (iii) shall be renumbered as clause (ii) thereof.
