The major portion of the park forms a part of Ambika catchments; ~f) WHEREA~, the area harboured population of tigers in the past and harbours species like Spotted Deer, Palm Civet, Small Indian Civet, Barking Deer, Four Homed Antelope, Wild Boar, Flying Squirrel, Rusty Spotted Cat, Leopard Cat and many species of rodents, reptiles and amphibians. The area has several bird speCies typical of the Western Ghats and the moist nature of the locality has facilitated occurrence of variety of shrubs and herbs of immense medicinal value and also many kinds of orchids, lichens and ferns exist in the forest making it unique in flora; And whereas. it is necessary to conserve and protect the area around the protected area of Vansda National Park as Eco-sensitive Zone from ecological and environmental point of view by habitat management aiming at improving and preserving the genetic resources of Vansda National Park, reintroduction and rehabilitation of local species through breeding programmes; And whereas. a draft notification under sub-section (I) read with clause (v) and c\"ause (XIV) of sub-section (2) of section 30f the Environment (Protection) Act, 1986 (29 of 1986) was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment and Forests number S.O. 1267(E), dated the 151 June, 2011, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; And whereas. I copies of the Gazette containing the said notification were made available to the public on the 1st June, 2011; And whereas. all objections and suggestions received in response to the draft nOffiicatlon have been duly considered by the Central Government; Now. therefore, in exercise of the powers conferred by sub-section (1) read with clause

(v) and clause (xiv) 01' sub - section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area upto 5 kilometers from the boundary of the protected area of Vansda National Park, enclosed within the boundary described below in the ['I1'l II-~ 3(ii)l in the State of Gujarat as the Eco-sensitive Zone (herein after called as the Vansda Eco­ sensitive Zone ):-

1. Boundaries ofVansda Eco-sensitive Zone.-

(a) The Vansda National Park in Vansda Taluka, Valsad District is located between 20° 51' 16" and 21° 21' 22" N latitude and between 73° 20' 30" and 73° 31' 20'.' E longitudes; which has hilly terrain having moderate altitudes and are extensions of Sahyadri range;

(b) the range of radius of the El;o-sensitive zone is 0-5 kilometers on all sides and mean distance is 2 kilometers surrounding the Protected Area;

(c) the Park represents the Northern zone of the Western Ghat in Gujarat State along with Puma Wildlife$anctuary;

(d) the Vansda National Park and the Puma Wildlife Sanctuary together form 4.2% of the total geographical area of the forests in the Western Ghat zone represented in Gujarat;

(e) the Map and boundary Global Positioning System pointsofVansda National Park and Vansda Eco-sensitive Zone are appended to this notification as Annexure I and the list of the villages falling within Vansda Eco-sensitive Zone is appended as Annexure II.

2. Zonal Master Plan. for the Vansda Eco-sensitive Zone. - (I) A Zonal Master Plan for the Vansda Eco-sensitive Zone shall be prepared by the State Government in such mauner as are specified under the Wild Life (Protection) Act, 1972 (53 of 1972), the law relating to town and country plauning for the time being in force in the State, the divisional working plans and the guidelines issued by Central Government, within a period of two years from the date of this notification and approved by the Central Government in the Ministry of Environment and Forests.

(2) The Zonal Master Plan shall be ptepared with due involvement of all concerned State . Departments of Environment, Forest, Urban Development, Tourism, Municipal, Revenue and the Gujarat State Pollution Control Board for integrating environmental and ecological considerations into it.

(3) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that 'li'ed attention.

(4) The Zonal Master Plan shall demarcate all the existing worshipping places, village settlements, types and kinds of forest" agricultural areas, fertile lands, green areas, horticultural areas, orchards, lakes and other water bodies.

(5) No change of land use from green uses such as tea gardens, horticulture areas, agriculture, parks and others like places to 'non green uses shall be permitted in the Zonal Master Plan. However, to meet the residential needs of the local residents due to the natural growth of existing local population, strictly limited conversion of agricultural lands may be permitted, with the prior approval of the State Government.

(6) All the human habitation areas with populations of 5000 and above shall have Area Development Plan and be prepared under the guidance gf local self Government.

(7) Pending the preparation of the Zonal Master Plan for Eco-sensitive Zone and approval thereof by the Ministry of Environment and Forests all new constructions and other 48 mE GAZEITE OF INDIA : EXTRAORDINARY {PAKr II-S~. 3(~ . developmental activities shall be referred to the Ministry of Environment and Forests by the Monitoring Committee as per sub-para (4) of paragraph 4 of the notification.

(8) There shall be no consequential reduction in Green area such as forest area, agricultural area, etc. and the unused or unproductive agricultural areaS may be re­ forested.

(9) The Zonal Master Plan shall be a reference document for the Monitoring Committee for any decision to be taken by them.

(10) The Central Govermnent and the State Govermnent may specify other measures, if it considers necessary, in giving effect to the provisions of this notification.

3. Regulated or re$trictive activities in the Eco-sensitive Zone. - All activities in the Vansda Eco-sensitive Zone shall be governed by the provisions of. the Wildlife (Protection) Act, 1972 (53 of 1972), the Forest (Conservation) Act, 1980 (69 of 1980) and the Environment (Protection) Act, 1986 (29 of 1986). Subject to the provisions of this paragraph, the activities in the Eco-sensitive Zone shall be regulated in accordance with Annexure III to this notification.

(1) Industrial Units: On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed within the Eco-sensitive Zone and the non­ polluting industries in the region may be considered with the provision of minimum of 50 meter wide green belt;

(2) Quarrying and Mining: (a) No mining and crushing shall be allowed within the Eco­ sensitive Zone; provided that the quarrying of sand for local use in river beds in Tapi and Navsari Districts may be permitted at selected sites in consultation with Forest and Environment Departments with due safe guards, as per the existing rules and regulation prevailing for the purpose;

(b) no fresh mining lease shall be granted in eco-sensitive zone and the existing mining leases if any shall be phased out with ~ term of current lease and no extension of those mining lease shall be allowed;

Provided that the permission to collect sand and stone from river bed for local use at locations shall be permitted at sites approved vide no. 8-104, 89-FC dated 26/07/1990 under FCA-1980 by the Ministry of Environment and Forests.

(3) Trees: Felling of trees on forest should be as per the Working Plan or Management Plan approved by the Competent Authority and the felling of trees on private or revenue lands may be allowed in accordance with the State regulations.

(4) Tourism: Tourism activities shall be as per the Tourism Master Plan which shall emphasize on ecotolLTism, eco-education and eco-development and be prepared by the Department of Tourism in consultation with the Department of Environment and Forest and shall be a component of the Zonal Master Plan.

(5) Ground Water:

(a) Extraction of ground water for bona-fide agricultural and domestic consumption of the occupier of land shall be allowed. ['II'T n-~ 3(ii)]

(b) Extraction of ground water for industrial, commercial use shall require prior written pennission, including the amount that can be extracted, from the State Ground Water Board.

(c) Appropriate steps shall be taken to prevent contamination or pollution of water, including from agriculture activities.

(6) Use of Plastics: No person shall use plastic carry bags within the Eco-sensitive zone area and the disposal of plastic articles shall be strictly regulated.

(7) Noise pollution: The Environment Department or the State Forest Department, Gujarat shall be the authority to draw up guidelines and regulations for the control of noise in the Eco-sensitive Zone.

(8) Discharge of emnents: No untreated or industrial effiuent shall be pennitted to be discharged .into any water body or on land within the Eco-sensitive Zone and the treated effiuent shall meet the provisions of the Water (Prevention and Control of Pollution) Act,

1974.

(9) Solid Wastes: (a) The solid waste disposal shall be carried out in accordance with the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 notified by the Central Government vide notification number S.O. 908 (E), dated the 25th September 2000, as amended from time to time.

(b) (i) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;

(ii) the biodegradable material may be recycled preferably through composting or venniculture;

(iii) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone; and

(iv) no burning or incineration of solid wastes shall be p'<mlltted in the Eco-sensitive Zone.

(10) Natural Springs: The catchment areas of all springs shall be identified and plans for their conservation and rejuvenation of those that have run dry, in their natural setting shall be incorporated in the Zonal Master Plan and the strict guidelines shall be drawn up by the State Government to ban development activities at or near these areas.

(11) Awareness: The state Environment and Forests Department shall regularly carried out nature education and environmental awareness campaigns in each village falling in Eco­ sensitive Zone, highlighting the importance and usefulness of the Wildlife Sanctuary.

4. Monitoring Commitlt·e. -

(1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29. of 1986), the Central Government hereby constitutes a Committee to be called the Vansda Eco-sensitive Zone Monitoring Committee to monitor the compliance of this notification.

(2) The Monitoring Committee referred to in sub-paragraph (I) above, shall consist of not more than ten members who shall represent the following, namely:- 1965GII12-7 49 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II-SEC. 3(iil]

(a) Collector, Valsad - Chair;aan;

(b) a representative of the MElistry of EnviiOnnient and Forests, Government of India -Member; .

(c) one representative of NOll-govellilllcntal Organizations working in the field of environment to be nominated by the Government of India - Member;

(d) Regional Officer, Gujaf8.t St.ate POUUti'Jfl Control Board, Valsad - Member;

(e) Senior Town Planner oftl", area - Ivierlber;

(f) a representative of the Lepanmc, t ',:f Forests and Environment, Government of Gujarat -. Member;

(g) one expert in the area of ecology and environment to be nominated by the Ministry of Environment and Forests, Government ofIndia - Member;

(h) Deputy Conservator of I'orests (In Charge of the National Park); Valsad - Member Secretary,

(3) The powers and functions of the Monitoring Committee shall be restricted to the compliance of the provisions of this notification.

(4) In case of activities requiring prior permission, under the provisions of the notification of the Government or India in the Ministry of Environment and Forests number S.O. 1533 (E), dated th," 14th September, 2006 published in the Gazette of India, , Extraordinary, Part n, Section 3, Sub-section (ii), the Monitoring Committee shall refer all such matters to the Central Government in the Ministry of Environment and Forests for prior clearances under the provisions of the said notification.

(5) The Monitoring Committee may invite representatives or experts from concerned Departments or Associations to assist in its deliberations depending on the requirements on issue to 'issue basis.

(6) The Chairman or the Member Secretary of Monitoring Committee shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 for non­ compliance of the provisions of this notification.

(7) The Monitoring Committee shall submit its annual action taken report of its activities by the 31 51 March of every year to the Central Government in Ministry of Environment and Forests.

(8) The Ministry of Environment and Forests shall give directions, from time, to time, to the Monitoring Committee for eflective discharge, of the functions of the Monitoring Committee.
