'frl*~Z<l4, ~ '7Jft' 25 ['lifT[ I.I~~ 3(ii)] MINISTRY OF ENVIRONMENT AND FORESTS NOTIFICATION New Delhi, the 4th October, 2012 S.O. 2364(E).- WHEREAS, the Bandipur National Park was fonned by including most M the torest areas of the then Venugopala Wildlife Park and its Sanctum Sanctorum at Bandipur in the year 1974. In the year 2001, after going through the due process of law, the State Government vide its Notification No. FEE 211 FWL 98 Dated 27-06-2001 notified an area of 870.36 Sq.Km. as the National Park under the provisions ofthe sub-section (4) of section 35 of the Wild life (Protection) Act, 1972. This is one of the Nine Protected Areas brought under Project Tiger during 1973. Presently, a total area of 912.04 Sq.Km. including adjoining forest areas which are part of the buffer zone notified vide 'No.FEE 136 FWL, 2008, dated 31-08-2010 is under Bandipur Tiger Reserve and declared as Core/Critical Tiger habitat as per 'section 38 V of the Wild life (Protection) Act, 1972; . AND WHEREAS, the Bandipur Tiger Reserve is not only central and critical part of the 5500 square kilometers Nilgiri Biosphere Reserve but also fonns an integral part of the Mysore Elephant Reserve under the Project Elephant. It supports a very high density of Wild Elephant Population with significantly higher number of Adult Tuskers. This area fonns part of the designated elephant corridor namely Kaniyanpura Elephant. Corridor which connects Sathyamangalam and Moyar Reserves, It is one of the high density Tiger landscapes recognized by the Global Tiger Initiative for conservation of Tiger and also is one of the richest Wild life areas noted for the intact assemblage of Seven large Ungulate species such as Chital, Sambar, Chowsingha, Gaur, Muntjac, Wild Pig and Elephant and has more than 250 species of birds; AND WHEREAS, the area has a very high Faunal and Floral diversity. Bandipur Tiger Reserve alongwith Nagarahole, Mudumalai and Wyanad Protected Areas has the highest breeding population of Wild Tigers amongst the thirteen Tiger Range countries in the World. The forests of the Tiger Reserve are varied and rich. To the eastern most portion lie the scrub forests of Moyar. While the vegetation in the central portion of the Tiger Reserve viz., Kaniyanpur, Bandipur part of Beerambadi is dry deciduous, the vegetation in the western part of the reserve viz., Ainurmarigudi, Begur and Beerambadi is moist deciduous. The vegetation, therefore, changes from scrub type to moist deciduous type from east to west. These forests are classified as Scrub type (Group 5 Sub-Group 5B- DSF-I-Dry deciduous scrub of Champion and Seth classification): The . vegetation comprises of species of Shorea talura, Santalurn album (Sandal), Terminalia chebula, Anogeissus lati/olia, A:wdirachta indica, Chloroxylon swietenia, Acacia leucophloea, Acacia catechu, Stereospermurn chelonoides, Zizyphus sps.,Diospyros melnoxylon, Diospyros montana, etc. 3782 G1/2012-4 THE GAZETfE OF [NDlA : EXTRAORDINARY [PART \I-SEC. 3(ii)1 Lantana bushes often cover large areas as under growth and Phoenix acaulis at some places. Cassia tora, Cassia auricuiata, Desmodium etc., also form the undergrowth. Bamboos are generally absent. Acacia intsia is the common climber. Grass is generally abundant but is stunted. Sandal profusely comes up in this type. This Protected Area is. catchment of important perennial rivers such as Kabini, Moyar, and Nugu. The area is completely free from human habitation requiring no resettlement of any human population; The Kabini Reservoir is providing a good aquatic habitat for fish and many species of birds and Otters. Small tanks and rivers provide habitat for fish, crab, tortoise and crocodile etc. Porcupines, Mongoose, Scaly anteaters, Bandicoots, rats and snakes (Pythons) are as much sub terrestrial dwellers as they are terrestrial ones. Some of the animals use the subterranean food, Porcupines burrows and eat roots of Cassia fistula. Wild boars feed on the tuberous roots of Costus sps., Dioscorea and Vitis climbers. Elephants are observed uprooting grass and feeding on the succulent root portions. The sloth bear feeds on roots and underground white ants. The same behavior is still seen. The Elephants feed on underwater weed found in the shallow backwater as well as by scraping the grass by kicking through the nails of their front feet in the vast foreshore area of Kabini reservoir during pinch period; AND WHEREAS, it is necessary to conserve and protect the area around the protected area of Bandipur National Park as Eco-sensitive Zone from ecological and environmental point of view, to protect, propagate or develop Wild life therein or its environment; AND WHEREAS, a draft notification under sub-section (1) read with clause
(v) and clause (xiv) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment and Forests number S.O. 2154(E), dated the 21 st September, 2011, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said notification were made available to the public on the 21 st September, 2011; AND WHEREAS, all objections and suggestions received in response to the draft notification have been duly considered by the Central Government; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub - section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area upto 7.78 kilometer from the boundary of the protected area ofBandipur National Park and Tiger Reserve, enclosed within the boundary described below in the State of Kamataka as the [co-sensitive Zone (herein after called as the Bandipur Eco-sensitive Zone): ['I1J1T I1-~ 3(ii)]
1. Boundaries of Eco-sensitive Zone
(i) Bandipur National Park and Tiger Reserve situated in Mysore (Nanjungud and H.D.Kote taluks) and Chamarajanagar (Gundlupet taluk) districts of Karnataka State lies between the North Latitudes 11 0 35' 34" and 11 0 55' 02" and between the East Longitudes 760 12' I?" and 76° 51' 32". The boundaries of the said Eco sensitive Zone are given at Annexure-A. The map and boundary Global Positioning System points of the said Eco-sensitive Zone are given at Annexure B.
(ii) The Eco-sensitive zone covers a geographical area of 479.18 square kilometers which includes one hundred and twenty three villages given at Annexure - C. Further, the notified reserved forest area and the Section 4 area details are given at Annexure - D & E.
(iii) The range of extent of the Eco-sensitive zone varies from 0-7.78 kilometers with a mean distance of 3.62 kilometers.
2. Zonal Master Plan for the Bandipur Eco-sensitive Zone.
(i) A Zonal Master Plan for the Bandipur Eco-sensitive Zone shall be prepared by the State Government in such manner as are specified under the Wild Life (Protection) Act, 1972 (53 of 1972), Panchayati Raj Act, 1993, the law relating to town a?<i country planning for the time being in force in the State, the divisional working plans and the guidelines issued by Central Government, within a period of two years from the date of this notification and approved by the Central Government in the Ministry ofEnvironment and Forests.
(ii) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments of Environment, Forest, Urban Development, Tourism, Municipal, Revenue and the Karnataka State Pollution Control Board with a view to include therein various aspects of the environment and ecology.
(iii) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(iv) The Zonal Master Plan would also ensure that no restrictions are imposed on the existing legal land use pattern, as well as the legal infrastructure and activities and same would continue as before. However, the Zonal Master Plan would also factor in improvement of all infrastructure/activities to be more efficient and eco-friendly.
(v) The Zonal Master Plan shall demarcate all the existing worshipping places, village settl(;":ments, types and kinds of forests, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas, orchards, lakes and other water bodies.
(vi) No change of land use from green uses such as tea gardens, horticulture areas, agriculture, parks and others like places to non green uses shall be 28 THE GAZETTE OF INDIA: EXTRAORDINARY [PART II-SEC. 3(ii)] permitted in the Zonal Master Plan. However, to meet the residential needs of the local residents due to the natural growth of existing local population, strictly limited conversion of agricultural lands may be permitted, with the prior approval of the State Government.
(vii) There shall ordinarily be no reduction in Forest Zone, Green Zones and Agricultural Area.
(viii) Pending the preparation of the Zonal Master Plan for Eco-st'nsitive Zone and approval thereof by the Ministry of Environment and Forests all new constructions and other developmental activities shall be referred to the Ministry of Environment and Forests by the Monitoring Committee as per sub-para (4) of paragraph 4 of the notification.
(ix) The Monitoring Committee oversee the proper execution of the Zonal Master Plan by all Departments and stakeholders as well. This Committee would also look into the gnevances of people and find amicable solution of such grievances.
(x) Adequate pUblicity shall be given to the provisions of the Zonal Master Plan.
3. Prohibited, regulated and permitted activities in Eco~sensitive Zone All activities in the Bandipur Eco-sensitive Zo:ne shall be governed by the provisions of the Wildlife (Protection) Act, 1972 (53 of 1972), the Forest (Conservation) Act, 1980 (69 of 1980) and the Environment (Protection) Act, 1986 (29 of 1986). Subject to the provisions of this paragraph, the activities in the Eco sensitive Zone shall be regulated in accordance with tabular column given below. SI. (1) Industrial Units: No new establishment of any industrial unit shall be permitted in the eco sensitive zone.
(2) In the non municipal areas, the following shall also be permitted: Structures connected with small agro-based industries, activities related to the needs of the local village economy and processing or storage of local agro based products may be allowed subject to the permission to be obtained from the revenue authorities for alienation of land for non agricultural purposes.
(3) Quarrying and Mining: Commercial quarrying and mmmg activities shall be banned in the Eco Sensitive zone and no fresh mining lease shall be granted.
(4) Trees: There shall be no felling of trees either on forest, Government, revenue or private lands, without the prior permission of the State Government. The felling of trees shall be regulated in accordance with the Kamataka Forest Act, 1963 and the Kamataka Preservation ofTrees Act, 1976.
(5) TourislJl: Tourism activities shall be allowed in accordance with the Tourism Master Plan, with emphasis on eco-tourism, eco-education and eco-development, to be prepared by the Department of Tourism of the State Government in consultation with the Ministry of Tourism, Government of India and approved by the Ministry of Enviromnent and Forests which shall also form apart of the Zonal Master Plan.
(6) Use of plastics: . The use of plastics, laminates and tetra-packs within the Eco-sensitive zone shall be regulated as per the activities mentioned in this notification.
(7) Forest Areas under the control of Revenue Department: Any non-forestry activities will be regulated in accordance with "The guidelines for taking non forestry activities in Wild life Habitats" issued vide F .No. 6-10/20 II WL dated 15-03-20 II by the Ministry of Environ~nt and Forests (WL Division), New Delhi. - . 33 (\'IPT U-"@lS 3(ii)]
(8) Discharge of emuents: a) The discharge of any untreated effiuent is prohibited within the Eco Sensitive Zone. b) No effiuent, either treated or untreated, shall be permitted to be discharged into any water body or water source within the Eco-sensitive zone.
(9) Solid Wastes: a). The local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components. b) The biodegradable material may be recycled preferably through composting or vermiculture and the inorganic material may be disposed of at environmentally acceptable locations. c) No burning or incineration of solid wastes shall be permitted.
Explanation - in this notification, "Solid wastes" shall include domestic, industrial, commercial & garden wastes.
(10) Natural springs: a) The catchment area of all natural· springs shall be identified and plans for their conservation and rejuvenation of those that have run dry in their natural setting shall be incorporated in the Zonal Master Plan. b) Strict guidelines shall be drawn up by the State Government to ban development activities at or near these areas.
(11) Awareness: The State Environment and Forests Department shall regularly carry out nature education and environmental awareness campaigns in each village falling in Eco-sensitive Zone, highlighting the importance and usefulness of the National Park and Tiger Reserve and Eco-sensitive. Zone.
4. Monitoring Committee.
(l) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a committee to be called as the Aandipur Eco-sensitive Zone Monitoring Committee to monitor the compliance of this notification.
(2) The Monitoring Committee referred to in sub-paragr~ph (1) above, shall consist of the following members, namelv:
(i) Regional Commissioner, Mysore - Chairman
(ii) representative of the Department of Environment, Government of Karnataka - Member;
(iii) representative of the Department of Urban Development, Government of Karnataka - Member;
(iv) representative of Non-governmental Organizations working in the field of natural conservation (including heritage conservation) to be nominated by the Ministry of Environment and Forests, Government of India - Member;
(v) the Regional Officer, Kamataka State Pollution Control Board, Mvsore -Member; 34 THE GAZETTE OF INDIA: EXTRAORDINARY IPART II-SEC. 3(ii)]
(vi) one expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by the Ministry of Environment and Forests, Government of India - Member.
(vii) Deputy Commissioner or his representative, Chamarajanagar - Member
(viii) representative of Ministry of Environment and Forests Government of India - Member
(ix) the Deputy Conservator of Forests, Project Tiger Division, Bandipur Member Secretary.
(3) The powers and functions of the Monitoring Committee shall be restricted to the compliance of the provisions of this notification.
(4) In case of activities requiring prior permission, under the provisions of the notification of the Government of India in the Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), the Monitoring Committee shall refer all such matters to the Central Government in the Ministry of Environment and Forests for prior clearances under the provisions of the said notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments or Associations to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Chairman or the Member Secretary of Monitoring Committee shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 for non-compliance of the provisions of this notification.
(7) The Monitoring Committee shall submit its' annual action taken report of its activities by the 31st March of every year to the Central Government in Ministry of Environment and Forests.
(8) The Central Government in Ministry of Environment and Forests shall give directions, from time to time, to the Monitoring Committee for effective discharge of the functions of the Monitoring Committee. .. 35 ['lWT 1I~1§!TI:5 3(ii)] ANNEXURE-A BOUNDARY DESCRIPTION Boundary Description for the above forest areas is as described in the Govt.
