और कें रीय सरकार की यह राय ह ैदक ईि ऄजधसूचना का संिोधन करना लोकजहत में अवश्यक और समीचीन ह;ै और पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 का ईप-जनयम (4) यह ईपबंध करता ह ै दक जब भी कें रीय सरकार को यह प्रतीत होता ह ैदक ऐसा करना लोकजहत में ह,ै तो आसके जलए पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के खंड (क) के ऄधीन नोरिस की ऄपेक्षा से ऄजभमुजि दी जा सकती है;

(i) पैरा 2 के, ईप-पैरा (1) के स्ट्थान पर, जनम्नजलजखत ईप-पैरा रखा जाएगा, ऄथाात:्- “(1) राज्य सरकार, पाररजस्ट्थजतक संवेदी जोन के प्रयोजनों के जलए, 11 ऄक्िूबर, 2023 से दो वर्ा की ऄवजध के भीतर, स्ट्थानीय लोगों के परामिा से और आस ऄजधसूचना के ऄनुसार एक अंचजलक महायोजना तैयार करेगी”;
(ii) पैरा 5 के स्ट्थान पर, जनम्नजलजखत परैा रखा जाएगा, ऄथाात:्- “5. मानीिरी सजमजत.- (1) केन्द्रीय सरकार, पाररजस्ट्थजतक -संवेदी जोन की प्रभावी मानीिरी के जलए एक मानीिरी सजमजत का गिन करती ह ै,जजसमें जनम्नजलजखत व्यजि होंग,े ऄथाात:्-
(i) क्षेत्रीय अयुि, बेंगलरुू ऄध्यक्ष, पदेन;
(ii) पयाावरण जवभाग के प्रजतजनजध, कनाािक सरकार सदस्ट्य, पदेन;
(iii) िहरी जवकास जवभाग के प्रजतजनजध, कनाािक सरकार सदस्ट्य, पदेन;
(iv) प्रत्येक मामले पर तीन वर्ा की ऄवजध के जलए कनाािक सरकार द्वारा नामजनर्ददष्ट प्रकृजत संरक्षण ) जजसके ऄंतगात जवरासत संरक्षण भी है (के क्षते्र में काम करने वाले गरै-सरकारी संगिनों का एक प्रजतजनजध। सदस्ट्य;
(v) प्रत्येक मामले पर तीन वर्ा की ऄवजध के जलए कनाािक सरकार द्वारा नामजनर्ददष्ट कनाािक राज्य के प्रजतजित संस्ट्था या जवश्वजवद्यालय से पाररजस्ट्थजतकी में एक जविेर्ज्ञ। सदस्ट्य;
(vi) क्षेत्रीय ऄजधकारी, कनाािक राज्य प्रदरू्ण जनयंत्रण बोडा, मैसूर। सदस्ट्य, पदेन;
(vii) ईप-अयुि या ईनके प्रजतजनजध, दावनगरेे सदस्ट्य, पदेन;
(viii) सदस्ट्य, राज्य जैव-जवजवधता बोडा सदस्ट्य, पदेन;
(ix) ईप वन संरक्षक, दावनगरेे (िी) प्रभाग, दावनगरेे सदस्ट्य-सजचव, पदेन।
(iii) पैरा 6 के स्ट्थान पर, जनम्नजलजखत पैरा रखा जाएगा, ऄथाात:्- “6. मानीिरी सजमजत के काया .- (1) मानीिरी सजमजत, वास्ट्तजवक स्ट्थल -जव जनर्ददष्ट जस्ट्थजतयों के अधार, भारत सरकार के तत् कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संखयांक का .अ. 1533(ऄ), तारीख 14 जसतंबर, 2006 की ऄनुसूची के ऄंतगात अन े वाल े और आसके पैराग्राफ 4 के ऄधीन सारणी में यथा जवजनर्ददष्ट प्रजतजर्द्ध गजतजवजधयों के जसवाय पाररजस्ट्थजतकी संवेदी जोन में अन ेवाल ेदियाकलापों की जांच करेगी और ईि ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरणीय ऄनापजत्त ऄनुदत्त करवाने के जलए, केन्द्रीय सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय या, यथाजस्ट्थजत राज्य पयाावरण समाघात जनधाारण प्राजधकरण को जनर्ददष्ट करेगी।
(2) आस ऄजधसूचना के पैरा 4 के ऄधीन सारणी में यथा जवजनर्ददष्ट प्रजतजर्द्ध दियाकलापों के जसवाय, भारत सरकार के तत् कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संखयांक का .अ. 1533(ऄ), तारीख 14 जसतंबर, 2006 की ऄजधसूचना के ऄनुसूची के ऄतंगात नहीं अन े वाल े दियाकलाप, और पाररजस्ट्थजतकी संवेदी जोन में अन े वाले दियाकलाप, ऐसे दियाकलापों की वास्ट्तजवक स्ट्थल जवजनर्ददष्ट जस्ट्थजतयों के अधार पर मानीिरी सजमजत द्वारा जांच की जाएगी और समुजचत प्राजधकरण को जनर्ददष्ट दकया जाएगा।
(3) मानीिरी सजमजत का सदस्ट्य-सजचव या संबंजधत ईपायुि या ईप-वन संरक्षक ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के ईपबंधों का ईल्लघंन करता ह,ै पयाावरण )संरक्षण ( ऄजधजनयम,1986 की धारा 19 के ऄधीन पररवाद दायर करन ेके जलए सक्षम होंगे। [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3
(4) मानीिरी सजमजत संबंजधत जवभागों से प्रजतजनजधयों या जविेर्ज्ञों, औद्योजगक संगमों के प्रजतजनजधयों या संबंजधत पणधाररयों को, प्रत्येक मामल ेमें अवश्यकता के ऄनुसार, ऄपन े जवचार-जवमिा में सहायता के जलए अमंजत्रत कर सकेगी ।
(5) मानीिरी सजमजत जपछल ेजवत्तीय वर्ा के दौरान ऄपनी वार्षर्क कारावाइ में ईसके पूरे दियाकलापों की ररपोिा, राज्य के मुखय वन्द्यजीव वाडान को, आस ऄजधसूचना से संलग्न ईपाबद्ध-IV में जवजनर्ददष्ट प्रपत्र के ऄनुसार ,ईस वर्ा की 30 जून तक प्रस्ट्तुत करेगी ।
(6) केन्द्रीय सरकार, मानीिरी सजमजत को आस ऄजधसूचना के ऄधीन ईसके कायों के प्रभावी जनवाहन के जलए ऐसे जनदेि दे सकेगी जो वह ईजचत समझे।”। [फा. सं. 25/161/2015-इएसजेड-अरइ] डॉ. एस. करकेट्टा, वैज्ञाजनक ‘जी’ रिप्पण : मूल ऄजधसूचना भारत के राजपत्र, ऄसाधारण, भाग II, खंड 3, ईपखंड (ii) में ऄजधसूचना संखयांक का.अ. 1811 (ऄ), तारीख 7 जून, 2017 द्वारा प्रकाजित की गइ थी;
MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 11th October, 2023 S.O. 4421(E).—Whereas the Central Government, in exercise of the power conferred by sub section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 issued in the Gazette of India, Extraordinary, Part-II, Section 3, sub-section (ii), vide number S.O. 1811(E), dated the 7 th June, 2017;
And whereas the Central Government is of the opinion that it is necessary and expedient in the public interest to amend the said notification;
And whereas sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that whenever it appears to the Central Government that it is in the public interest to do so, it may dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986;
And whereas the Central Government is of the opinion that it is in the public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for amending the notification number S.O. 1811(E), dated the 7 th June, 2017;
Now, therefore, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of subsection (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendment in the notification of the Government of India, Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O. 1811(E), dated the 7 th June, 2017, namely:- In the said notification, -
(i) in paragraph 2, for sub-paragraph (1), the following sub-paragraph shall be substituted, namely:- ―(1) The State Government shall prepare a Zonal Master Plan for the purposes of the Eco-sensitive Zone in consultation with local people and in accordance with this notification, within a period of two years from the 11 th October, 2023‖;
(ii) for paragraph 5, the following paragraph shall be substituted, namely:- ―5. Monitoring Committee.- There shall be a committee to be known as Monitoring Committee constituted of the Central Government for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) Regional Commissioner, Bengaluru Chairman, ex Officio;
(ii) Representative of the Department of Environment, Government of Karnataka.
Member, ex Officio;

(iii) Representative of the Department of Urban Development, Government of Karnataka Member, ex Officio;
(iv) Representative of Non-Governmental Organisations working in the field of nature conservation (including heritage conservations) to be nominated by the Government of Karnataka for a term of three years in each case.
Member;
(v) One expert in ecology from reputed Institution or University of the State of Karnataka to be nominated by the Government of Karnataka for a term of three years in each case.
Member;
(vi) Regional Officer, Karnataka State Pollution Control Board, Mysuru. Member, ex Officio;
(vii) Deputy Commissioner or his representative, Davanagere. Member, ex Officio;
(viii) Member, State Biodiversity Board Member, ex Officio;
(ix) Deputy Conservator of Forests, Davanagere (T) Division, Davangere.
Member Secretary, ex Officio.
(iii) for paragraph 6, the following paragraph shall be substituted, namely:- ―6. Functions of the Monitoring Committee. – (1) The Monitoring Committee shall, based on the actual site-specific conditions, scrutinise the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, number S.O. 1553 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and refer to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for consideration of grant of prior environmental clearances under the provisions of the said notification.
(2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the appropriate authority.
(3) The Member-Secretary of the Monitoring Committee and the District Collector concerned or the Deputy Conservator of Forests concerned shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(4) The Monitoring Committee may invite representative or expert from the Department concerned, representative from industry associations or stakeholders to assist in its deliberations depending on the requirements on case to case basis.
(5) The Monitoring Committee shall submit the annual action taken report giving full account of its activities during the previous financial year by the 30 th June of that year to the Chief Wildlife Warden of the State in proforma specified in Annexure-IV, appended to this notification.
(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions under this notification.‖.
