�कलोमीटर तक है। अंडमान समुP के समीपवतN पूवN भाग क# ओर इसका िवJतार शूdय है। पा�रिJथितक# संवेदी जोन का 5े"फल 21.82 वग� �कलोमीटर है। (2) पा�रिJथितक# संवेदी जोन क# सीमा को दशा�ता रा@ीय उAान का मानिच" उपाबंधउपाबंधउपाबंधउपाबंध----I (I (I (I (कककक) ) ) ) औरऔरऔरऔर ((((खखखख)))) पर है और पा�रिJथितक# संवेदी जोन और संरि5त 5े" क# सीमा के भू-िनदfशांक. क# सूची bमशः उपाबंधउपाबंधउपाबंधउपाबंध---- IIIIIIII (क) महायोजनामहायोजनामहायोजनामहायोजना –––– (1) संघ राCय 5े" सरकार, पा�रिJथितक# संवेदी जोन के �योजन के िलए राजप" म& इस अिधसूचना के �काशन क# तारीख से दो वष� क# अविध के भीतर, Jथानीय ,ि-य. के परामश� से और इस अिधसूचना म& �दए गए अनुबंध. का पालन करते <ए संघ राCय 5े" के स5म �ािधकारी के अनुमोदन से आंचिलक महायोजना तैयार करेगी। (2) संघ राCय 5े" सरकार %ारा पा�रिJथितक# संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित से जो इस अिधसूचना म& िविनyद�U ट �कए गए ह ैके अनुसार तथा सुसंगत क& Pीय और संघ राCय 5े" िविधय. के अनु�प और क& Pीय सरकार %ारा जारी माग�िनदfश., य�द कोई ह., %ारा तैयार होगी । (3) आंचिलक महायोजना, उ- योजना म& पा�रिJथितक# और पया�वरणीय बात. को समाकिलत करने के िलए संघ राCय 5े" सरकार के िन�िलिखत िवभाग. के परामश� से तैयार होगी, अथा�त्:--
(i) पया�वरण और वन;
(ii) कृिष ;
(iii) पशु पालन;
(iv) अंडमान लोक िन मा�ण िव भाग;
(v) राजJ व;
(vi) म[Jय पालन;
(vii) Zामीण िवकास; और
(viii) अंडमान और ल5%ीप बंदरगाह िनमा�ण (एएलएचड2लयू) और अdय अनुसंधान संगठन। (4) आंचिलक महायोजना अनुमो�दत िवAमान भू-उपयोग, अवसंरचना और �bयाकलाप. पर कोई िनब�धन अिधरोिपत नह9 करेगी जब तक �क इस अिधसूचना म& इस �कार िविनyद�U ट न हो और आचंिलक महायोजना सभी अवसंरचना और �bयाकलाप. म& जो अिधक द5ता और पा�रिJथितक# अनुकूल ह. का संवध�न करेगी । (5) आंचिलक महायोजना म& अनाhछा�दत 5े". के जीणc|ार, िवAमान जल िनकाय. के संर5ण, आवाह 5े". के �बंधन, जल-संभर. के �बंधन, भूतल जल के �बंधन, मृदा और नमी संर5ण, Jथानीय समुदाय. क# आव}यकताl तथा पा�रिJथितक# और पया�वरण से संबंिधत ऐसे अdय पहलुl, िजन पर �यान दनेा आव}यक ह,ै के िलए उपबंध ह.गे । (6) आंचिलक महायोजना सभी िवAमान पूजा J थल., Zाम. और नगरीय बिJतय., वन. के �कार और �कJ म., कृिष 5े"., ऊपजाऊ भूिम, ह�रत 5े" जैसे उAान और उसी �कार के J थान, उAान कृिष 5े", फलोउAान, झील. और अdय जल िनकाय. का अ�यकंन करेगी । इस योजना के मानिच" के साथ िवAमान और �Jतािवत भूिम उपयोग िवशेषताl का िववरण अनुसमgथ�त होगा । (7) आंचिलक महायोजना पा�रिJथितक# संवेदी जोन म& िवकास को िविनयिमत करेगी और सारणी म& सूचीब| पैरा-4 म& �ितिष| और िविनयिमत �bयाकलाप. का अनुपालन करेगी और J थानीय समुदाय. के पा�रिJथितक# अनुकूल िवकास के िलए जीवकोपाज�न को सुरि5त करने के िलए सुिनि�त �कया जा सकेगा। (8) आंचिलक महायोजना 5े"ीय िवकास योजना क# सह िवJतारी होगी । (9) इस �कार अनुमो�दत आंचिलक महायोजना इस अिधसूचना के उपबंध. के अनुसार मॉनीटरी के अपने काय� को करने के िलए मॉनीटरी सिमित के िलए एक संदभ� दJतावेज तैयार करेगी । 3. संघसंघसंघसंघ रा�यरा�यरा�यरा�य �े �े �े �े सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय————संघ राCय 5े" सरकार इस अिधसूचना के उपबंध. को �भावी करने के िलए िन�िलिखत उपाय करेगी, अथा�त्:-- (1) भूभभूूभू----उपयोगउपयोगउपयोगउपयोग––––((((कककक) ) ) ) पा�रिJथितक# संवेदी जोन म& वन., उAान-कृिष 5े"., कृिष 5े"., आमोद-�मोद के �योजन के िलए िचिdहत �कए गए उAान. और खुले Jथान. का मुoय वािणिCयक या मुoय आवासीय �5े" या मुoय औAोिगक �bयाकलाप. के िलए उपयोग या संप�रवत�न नह9 होगा: परंतु पा�रिJथितक# संवेदी जोन के भीतर भाग (क) म& िविनyद�z �योजन से िभS �योजन के िलए कृिष और अdय भूिम का संप�रवत�न मानीटरी सिमित क# िसफा�रश पर और यथा लागू और 5े"ीय नगर योजना अिधिनयम तथा केdPीय/ संघ राCय 5े" सरकार के अdय िनयम. तथा िविनयम. के अधीन स5म �ािधकारी के पूव� अनुमोदन से, तथा इस अिधसूचना के उपबंध. %ारा Jथानीय िनवािसय. क# िन�िलिखत आवासीय ज8रत. को पूरा करने के िलए अनु�ात �कया जाएगा, जैसे:-
(i) िवAमान सड़क. को चौड़ा करना और उdह& सुदढृ करना तथा नई सड़क. का संिनमा�ण;
(ii) पा�रिJ थितक# अनुकूल पय�टन �bयाकलाप. के िलए पय�टक. के अJ थायी आवासन के िलए पा�रिJ थितक# अनुकूल आरामगाह जैसे �क तंबू और लकड़ी के मकान;
(iii) �दषूण उ[पS न करने वाले लघु उAोग;

(iv) वषा� जल संचय, और
(v) संवgध�त �bयाकलाप पैराZाफ 4 के अधीन �दया गया है: परंतु यह और �क 5े"ीय नगर योजना अिधिनयम और संघ राCय 5े" सरकार के अdय िनयम. और िविनयम. के अधीन स5म �ािधकारी के पूव� अनुमोदन के िबना और संिवधान के अनुhछेद 244 और त[समय �वृ: िविध के उपबंध. के अनुपालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अdय परंपरागत वन िनवासी (वन अिधकार. क# माdयता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिCयक या औAोिगक िवकास �bयाकलाप. के िलए जनजातीय भूिम का उपयोग अनु�ात नह9 होगा: परंतु यह भी �क पा�रिJथितक# संवेदी जोन के भीतर भू-अिभलेख. म& उपसंजात कोई "ु�ट, मानीटरी सिमित के िवचार �ा; करने के प�ात ् संघ राCय 5े" सरकार %ारा �[येक मामले म& एक बार संशोिधत होगी और उ- "ु�ट के संशोधन क# सूचना क& Pीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं"ालय को दी जाएगी। परंतु यह भी �क उपयु�- "ु�ट का संशोधन म& इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म& भू-उपयोग का प�रवत�न सिYमिलत नह9 होगा; (ख) वनीकरण तथा वास जीणc|ार �bयाकलाप. सिहत अन�युX त या अनु[ पादक कृिष 5े". म& पुन: वनीकरण करने के �यास �कए जाएंगे । (2) �ाकृितक�ाकृितक�ाकृितक�ाकृितक जल जल जल जल �ोत��ोत��ोत��ोत� -- आचंिलक महायोजना म& सभी �ाकृितक जल �ोत. के आवाह 5े". क# पहचान क# जाएगी और उनके संर5ण और नवीकरण के िलए योजना सिY मिलत होगी और संघ राCय 5े" सरकार %ारा ऐसे 5े". पर या उनके िनकट िवकास �bयाकलाप �ितिष| करने के िलए ऐसी रीित से माग�िनदfश तैयार �कए जाएंगे । (3) पय�टनपय�टनपय�टनपय�टन////पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� पय�टन िवभाग %ारा संघ राCय 5े" पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के 8प म& होगी । (घ) पा�रिJथितक# पय�टन संबंधी �bयाकलाप िन�िलिखत के अधीन िविनयिमत ह.गे, अथा�त् :- (i) रा@ीय उAान क# सीमा से एक �कलोमीटर के भीतर या पा�रिJथितक# संवेदी जोन के िवJतार तक, इनम& जो भी िनकट ह,ै नये वािणिCयक होटल और �रसोट� अनु�ात नह9 ह.गे। परंतु, रा@ीय उAान क# सीमा से एक �कलोमीटर क# दरूी से परे पा�रिJथितक# संवेदी जोन के िवJतार तक होटल. और सैरगाह. का Jथापन केवल पूव� प�रभािषत और नामिनyद�z 5े". म& पय�टन महायोजना के अनुसार पा�रिJथितक# पय�टन सुिवधाl के िलए ही अनु�ात होगा; (ii) पा�रिJथितक# संवेदी जोन के भीतर नए पय�टन �bयाकलाप. या िवAमान पय�टन �bयाकलाप. का िवJतार क& Pीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं"ालय के माग�दश�क िस|ांत. के %ारा तथा राU ̀ ीय p या� संर5ण �ािधकरण, %ारा जारी पा�रिJथितक# पय�टन (समय-समय पर यथा संशोिधत) माग�दश�क िस|ांत. के अनुसार होगा; (iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय�टन के िलए िवकास और िवAमान पय�टन �bयाकलाप. के िवJतार को वाJतिवक Jथल िविनyद�z संवी5ा और मानीटरी सिमित क# िसफा�रश पर आधा�रत संबंिधत िविनयामक �ािधकरण. %ारा अनु�ात �कया जाएगा और पा�रिJथितक# संवेदी जोन के अंदर �कसी नये होटल या सैरगाह या वािणिCयक �ित�ान का संिनमा�ण अनु�ात नह9 �कया जायेगा । (4) नैस"ग�कनैस"ग�कनैस"ग�कनैस"ग�क िवरासतिवरासतिवरासतिवरासत -------- पा�रिJथितक# संवेदी जोन म& मह[वपूण� नैसgग�क िवरासत के सभी Jथल. जैसे सभी जीन कोश आरि5त 5"े, शैल िवरचनाएं, जल �पात., झरन., घाटी माग�, उपवन., गुफाएं, Jथल., �मण, अ�रोहण, �पात. आ�द क# पहचान क# जाएगी और िवरासत संर5ण योजना आंचिलक महायोजना के भाग के �प म& प�रर5ण और संर5ण के िलए तैयार क# जाएगी । (5) मानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थल ल ल ल ---- पा�रिJथितक# संवेदी जोन म& भवन., संरचनाl, िश�प-त�य, ऐितहािसक, कला[मक और सांJकृितक मह[व के 5े". क# पहचान और उनके संर5ण के िलए िवरासत योजना आंचिलक महायोजना के भाग के �प म& तैयार क# जाएगी । (6) % व% व% व% विन �दषूणिन �दषूणिन �दषूणिन �दषूण -- पया�वरण (संर5ण) अिधिनयम,1986 के अधीन �विन �दषूण (िविनयमन और िनयं"ण) िनयम, 2000 म& िनयत उपबंध. के अनुसार म& पा�रिJथितक# संवेदी जोन म& �विन �दषूण के िनयं"ण के िलए िविनयम. को काया�िdवत करेगा । (7) वायुवायुवायुवायु �दषूण�दषूण�दषूण�दषूण- पा�रिJथितक# संवेदी जोन म&, वायु �दषूण के िनवारण और िनयं"ण का वायु (�दषूण िनवारण और िनयं"ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम. के उपबंध. के अनुसार अनुपालन �कया जाएगा । (8) बिह�ावबिह�ावबिह�ावबिह�ाव काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण -- पा�रिJथितक# संवेदी जोन म& उपचा�रत बिह�ाव का िनJसारण, साधारण. मानक. के अdतग�त पया�वरणीय (संर5ण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयम. के अधीन आने वाले पया�वरणीय �दषूण स5म �ािधकारी क# पूव� अनुमित के िबना वन, सरकारी या राजJव या िनजी भूिम पर या वन. म& वृ5. क# कटाई नह9 होगी । (ख) वृ5. क# कटाई संबंिधत क& Pीय या राCय अिधिनयम या उसके अधीन बनाए गए िनयम. के उपबंध के अनुसार AND WHEREAS, the Mount Harriet National Park is spread over an area of 46.62 square kilometers falling in South Andaman district of the Union territory (UT) of Andaman and Nicobar Islands (A & N) and is a unique representative of terrestrial, mountain and coastal ecosystem. The Mount Harriet National Park is located in the eastern part of South Andaman Island at about 40 kilometer (by road) from Port Blair. The ecosystem of the National Park is very complex and diverse in nature. Mount Harriet National Park has an altitude of 459 meters above Mean Sea Level and possesses one of the highest peaks in the Andaman and Nicobar Islands;

Some fauna recorded from the National Park are Andaman wild pig (Sus scrofa andamanensis), Indian barking deer (Muntiacus muntijak), spotted deer (Axis axis), Jungle cat (Felis chaus), Andaman masked palm civet (Paguma laroata tyckelli), Andaman Lesser Shortnosed Fruit Bat (Cynopterus brachyotis brachysoma), Horsefield’s myotis Bat (Myotis horsefieldii), Intermediate horse shoe bat (Rhinoplophus affinis), black rat (Rattus rattus), Miller’s rat (Rattus muelleri), Andaman ground shrew (Crocidura andamanensis), Jenken’s ground shrew (Crocidura jenkinsi), yellow striped trinket snake (Elaphe flavolineata), Andaman keel back water snake (Xenochrophis melanozostus), Andaman krait (Bungarus andamanensis), Cantor’s narrow-headed sea snake (Hydrophus cantoris), Anderson’s pit viper (Trimersurus andersoni), southeast Asian wolf snake (Lycodon capucinus), slender sea snake (Hydrophis gracilis), common Asian toad (Bufo melanostictus), black bull frog (Kaula baleata ghoshi), Andaman paddy field frog (Fejervarya andamanensis), Charles Darwin’s frog (Rana charlesdarwini), green sea turtle (Chelonian mydas), Hawksbill sea turtle (Eretmochlyus imbricate), leather back turtle (Dermochelys coreacea), olive Ridley turtle (Lepidochelys olivacea), salt water crocodile (Crocodylus porosus), Andaman grass skink (Mabuya andamanensis), water monitor lizard (Varanus salvator andamanensis), Andaman cobra (Naja sagittifera), king cobra (Ophiophagus Hannah), brahminy worm snake (Ramphotyphlops braminus), tawny cat snake (Boiga andamanensis), blue bronze back snake (Dendrelaphis cyanochloris) etc.;
AND WHEREAS, Mount Harriet National Park is very rich in avian fauna, about 89 species of avian fauna have been recorded from the National Park of which 18 species of endemic birds reported from the island are found in this National Park. Some of the prominent birds found in the Park includes Andaman stork-billed kingfisher (Pelargopsis capensis), Andaman tree pie (Dendrocitta bayleyi), Andaman white-breasted waterhen (Amauromis phoenicurus), Andaman white-breasted kingfisher (Halcyon smymensis), Andaman white-collared kingfisher (Halcyon chloris), Andaman wood pigeon (Columba palumbodies), black-capped kingfisher (Halcyon pileata), brown shrike (Lanius cristatus), brown-throated spine tailed swiftlet (Chaetura gigantean), Burmese red turtle-dove (Streptopelia tranquebarica), cattle egret (Bubulcus ibis), common sandpiper (Actitis hypoleucos), curlew (Numenius arquata), eastern black-naped tern (Sterna sumatrana), eastern greenish leaf warbler (Pyhlloscopus trochiloides), eastern jungle crow (Corvus levaillantii), lesser sand plover (Charadrius mongolus), small Andaman drongo (Dicrurus andamanensis), white bellied sea eagle (Haliaeetus leucogaster), etc.;
AND WHEREAS, bio-geographically Mount Harriet National Park represent majority of forest types found in the Andaman islands and supports fauna which are diverse and adopted to live in terrestrial, aquatic and arboreal ecosystems. Important endemic species recorded from the National Park are jungli kaju (Semecarpus kurzii), neva (Polyalthia parkinsonii), crape jasmine (Tabernaemontana crispa), sea mohwa (Manilkara littoralis), paddy (Oryza indandamanica), charaigudua (Vitex diversifolia), Hippocretea andamanica, Chailletia andamanica, Garcinia andamanica, Tadehage triquetrum, Amoora manii, Psychotria andamanica,Tetrastigma andamanicum etc. The sea shore, creeks as well as sand bar on the beaches serves as an excellent habitat for the threatened/rare species like didu (Bombax insigne), arguna (Cycas rumphii), trefle gros (Tadehagi triquetrum), Amoora manii, Plecospermum andamanicum, Olax imbricate, Pittospermum ferrugineum, etc.;
AND WHEREAS, AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Mount Harriet National Park which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent ranging from 0 kilometer on east and upto 1 kilometer on South, West and North directions around the boundary of Mount Harriet National Park in the South Andaman district of the Union Territory of Andaman and Nicobar Islands as 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the Mount Harriet National Park Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely: -
1. Extent and boundaries of Eco-sensitive Zone. - (1) The extent of Eco-sensitive Zone varies from 0 (zero) to 1
(one) kilometer around the Mount Harriet National Park. Zero extent is towards eastern side adjoining Andaman Sea.
The area of the Eco-Sensitive Zone is 21.82 square kilometers.
(2) The maps of the National Park demarcating the Eco-sensitive Zone boundary are appended at Annexure-I A and Annexure-I B and the lists of geo co-ordinates of the boundary of the Protected Area and the Eco-Sensitive Zone are at Annexure-II A and Annexure-II B, respectively.
(3) The boundary description of the Eco-sensitive Zone is appended as Annexure-III.
(4) No villages are located within the Eco-sensitive Zone.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The Union Territory Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority of Union Territory.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union Territory Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union Territory laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Union Territory Departments, for integrating the ecological and environmental considerations into the said plan, namely:-
(i) Environment and Forests;
(ii) Agriculture;
(iii) Animal Husbandry;
(iv) Andaman Public Works Department;
(v) Revenue;
(vi) Fisheries;
(vii) Rural Development; and
(viii) Andaman and Lakshadweep Harbour Works (ALHW) and other research organisations.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the Union Territory Government - The Union Territory Government shall take the following measures for giving effect to the provisions of this notification, namely:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
(1) Land use. –
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/Union Territory Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for ecofriendly tourism activities;
(iii) Small scale industries not causing pollution;
(iv) Rainwater harvesting; and
(v) Promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Union Territory Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the Union Territory Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union Territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism/ Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with Union Territory Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within one kilometre from the boundary of the National Park or up to the extent of the Eco-sensitive Zone whichever is nearer. However, beyond the distance of one kilometre from the boundary of the National Park till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by Union Territory Government whichever is more stringent.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste. – Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number G.S.R. 343 (E), dated the 28 th March, 2016.
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.
(11) Plastic waste management. - The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.
(13) E-waste. - The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.

(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the Union Territory Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be complied with applicable laws.
Efforts to be made for use of cleaner fuel.
(16) Industrial Units.– (a) on or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone;
(b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification.
In addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes. - The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- Sl. 2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, nonpolluting cottage industries shall be promoted.
3. Establishment of major thermal and hydroelectric projects.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.

9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
Regulated activities
10. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area of Mount Harriet National Park or upto the extent of Ecosensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents.
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
12. Small scale nonpolluting industries. Nonpolluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, smallscale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
13. Felling of trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the UT Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or UT Act and the rules made thereunder.
14. Erection of electrical and communication towers and laying of cables and other Regulated under applicable laws except railway lines.

(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment, 2006 vide S.O. 1533 (E), dated the 14 th September, 2006, and Coastal Regulation Zone, 2011 vide S.O. No. 19(E) dated the 6 th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23 considered as specified in the guidelines issued by the Central Pollution Control Board for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14 th September, 2006 and S.O. 19 (E) dated the 6 th January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wild Life Warden of the Union Territory under intimation to this Ministry as per proforma appended at Annexure-IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and Union Territory Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
