Section 79: Application for trial on separate charge-sheet

(1) Where a chargesheet contains more than one charge, the accused may, before pleading to the charges, apply to the Court to be tried separately on any charge in that chargesheet on the ground that he would be prejudiced in his defence if he were not tried separately on that charge.
(2) Where the accused makes such an application, the prosecutor may address the Court in answer thereto and the accused may reply to the prosecutor's address.
(3) Where the Court is of the opinion that interests of justice so require, it shall allow the application and try the accused separately on the charge to which it relates as if that charge has been framed in a separate chargesheet.
