PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 23 फरवरी, 2024 सा.का.जन. 130(अ).—केन्द्रीर् सरकार, धारा 49 ि की उपधारा (2) के साथ परित वन्द्र् िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) की धारा 63 की उप-धारा (1) के खंड (ञझझ) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, जनम्नजलजखत जनर्म बनाती ह,ै अथाात्:—

(1) सजंक्षप्त नाम और प्रारंभ.—इन जनर्मों का संजक्षप्त नाम अनुसूजचत नमूना (छूट की ितें और प्रदिर्ा), जनर्म, 2024 ह।ै

(2) रे् रािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंग े।

2. पररभाषा—(1) इन जनर्मों में, िब तक दक संिभा से अन्द्र्था अपेजक्षत न हो,- (क) “अजधजनर्म” से वन्द्र् िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) अजभप्रेत ह;ै (ख) “एटीए कारनेट" से एटीए अजभसमर् के अधीन िारी एक अंतरराष्ट्रीर् एक समान सीमा िुल्क िस्ट्तावेि अजभप्रेत ह;ै (ग) "एटीए अजभसमर्" से माल के अस्ट्थार्ी प्रवेि के जलए एटीए कारनेट पर सीमा िुल्क अजभसमर् अजभप्रेत ह;ै (घ) "पररजिष्ट" से अजधजनर्म से संलग्ल अनुसूची 4 के अधीन जनर्िाष्ट पररजिष्ट अजभप्रते ह;ै (ङ) "प्ररूप" से इन जनर्मों से संलग्न प्ररूप अजभप्रेत ह;ै स.ं 119] नई दिल्ली, िुिवार, फरवरी 23, 2024/फाल् गनु 4, 1945 No. 119] NEW DELHI, FRIDAY, FEBRUARY 23, 2024/PHALGUNA 4, 1945 सी.जी.-डी.एल.-अ.-28022024-252448 CG-DL-E-28022024-252448 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (च) "प्रबंधन प्राजधकरण" से अजधजनर्म की धारा 49ङ के अधीन नामजनर्िाष्ट प्राजधकरण अजभप्रेत ह;ै (छ) "स्ट्वामी" से दकसी नमून ेका स्ट्वामी अजभप्रेत ह ैऔर इसमें ऐसा कोई भी व्यजि िाजमल ह ैजिसके पास ऐसा नमूना ह;ै (ि) "परजमट" से अजभसमर् के अधीन िारी दकर्ा गर्ा परजमट र्ा प्रमाणपत्र अजभप्रेत ह;ै (झ) "व्यजिगत र्ा घर गृहस्ट्थी का सामान" से ऐसे नमनू ेिो गैर-वाजणजयर्क उद्देश्र्ों के जलए व्यजिगत रूप से स्ट्वाजमत्व में हैं और आर्ात, जनर्ाात र्ा पुनः जनर्ाात के समर् र्ा तो पहने हुए हैं र्ा व्यजिगत सामान में िाजमल हैं; र्ा घरेलू सामान का जहस्ट्सा और इसमें जिकार रादफर्ों में िाजमल गैंडे के सींग और हाथी िांत िाजमल नहीं हैं;

(ञ) "नमूना संग्रह" से पररजिष्ट 1 र्ा 2 में जनर्िाष्ट मृत नमनूों, भागों और उनके वु्यत्पन्नों का संग्रह और पररजिष्ट 1 में जनर्िाष्ट प्रिाजतर्ां बंिी जस्ट्थजत में उत्पन्न होन ेर्ा व्यावसाजर्क उद्देश्र्ों के जलए कृजत्रम रूप से तैर्ार प्रिाजतर्ां अजभप्रेत हैं;

(2) उन िब्िों और पिों के िो इसमें प्रर्ुि हैं, पररभाजषत नहीं दकए गए हैं दकन्द्त ुअजधजनर्म में पररभाजषत दकर्ा गर्ा ह,ै वही अथा होंगे िो उस अजधजनर्म में हैं।

3. अजभवहन र्ा र्ानातं्रण के अधीन नमनूों के जलए छूट.—(1) नमूनों को जनर्ाात र्ा पुन: जनर्ाात परजमट की आवश्र्कता नहीं होगी िब नमून ेभारत के माध्र्म से र्ा उसके रायर्क्षेत्र में अजभवहन र्ा र्ानांत्रण में हों, िबदक नमून े सीमा िुल्क जवभाग के जनर्ंत्रण में हों।

(2) नमनूे के साथ जनर्ाात र्ा पुनः जनर्ाात के ििे द्वारा िारी जनर्ाात र्ा पुनः जनर्ाात परजमट की प्रजत, िैसा भी मामला हो, संलग्न की िाएगी।

(3) नमूना संग्रह के मामल ेमें,- (क) परजमट में र्ानांत्रण का गंतव्य स्ट्पष्ट रूप से ििाार्ा िाना चाजहए, िो िारी करने का िेि होगा;

(ख) एटीए अजभसमर् के अधीन आने वाले नमूनों के नमनूा संग्रह की सीमा पार गजतजवजधर्ों के साथ अजभसमर् के अधीन िारी एक मानक परजमट होगा, जिस पर र्ह संकेत दिर्ा िाएगा दक िस्ट्तावेज़ जनर्ाात, पनुः जनर्ाात और के जलए एक परजमट ह।ै र्ह स्ट्पष्ट रूप से जनर्िाष्ट करेगा दक िस्ट्तावेज़ नमूना संग्रह के जलए िारी दकर्ा गर्ा ह;ै (ग) परजमट जनर्िाष्ट करेगा दक र्ह एक नमूना संग्रह के अतंगात आता ह ैऔर वैध एटीए कानेट के साथ आन ेतक अमान्द्र् ह;ै (घ) परजमट के अधीन आने वाला नमूना परजमट िारी करने वाले रायर् के रायर्क्षेत्र के बाहर बेचा र्ा अन्द्र्था स्ट्थानांतररत नहीं दकर्ा िाएगा;

(ङ) एटीए कानेट के साथ आन ेवाली संख्र्ा सीमा िुल्क िस्ट्तावेज़ के पषृ्ांकन के जलए उत्तरिार्ी सीमा िुल्क द्वारा ररकाडा और ििा की िाएगी;

(च) आर्ातक और जनर्ाातक र्ा पनुः जनर्ाातक के ििे सजहत नाम और पता परजमट और एटीए कारनेट में समान होगा, और िौरा दकए िान ेवाले ििेों के नाम इंजगत दकए िाएंगे;

(छ) परजमट की समाजप्त की तारीख उसके साथ आने वाल ेएटीए कारनेट की तारीख से बाि की नहीं होगी और वैधता की अवजध उस तारीख से छह महीने से अजधक नहीं होगी जिस दिन इसे प्रिान दकर्ा गर्ा था;

(ि) सीमा िुल्क, प्रवेि र्ा जनकास के बबंि ुपर, अजभसमर् के अधीन िारी दकए गए परजमट की उपजस्ट्थजत को सत्र्ाजपत करेगा और इसे संग्रह के साथ रहने की अनुमजत िगेा, और र्ह सुजनजित करेगा दक एटीए कानेट एक सीमा िुल्क अजधकारी द्वारा एक प्राजधकृत स्ट्टांप और हस्ट्ताक्षर के साथ उजचत रूप से पृष्ांदकत ह।ै

(4) परेजषती को प्रबंधन प्राजधकरण र्ा प्राजधकृत अजधकारी र्ा सीमा िुल्क के अजधकाररर्ों की मांग पर वैध परजमट की उपजस्ट्थजत को सत्र्ाजपत करन ेके जलए परजमट प्रस्ट्ततु करना होगा।

4. अजभसमर्-पवूा प्रमाणपत्र के जलए आविेन.—(1) जनर्ाात र्ा पुन: जनर्ाात करने का आिर् रखन ेवाले दकसी व्यजि को, वन्द्र् िीव (संरक्षण) संिोधन अजधजनर्म, 2022 के प्रारंभ होने से पहल ेप्राप्त नमूने का जनर्ाात करन ेके जलए एक हिार रुपर् ेकी फीस के साथ प्ररूप 1 में प्रबंधन प्राजधकरण को, इलेक्ट्रॉजनक रूप से आवेिन करना होगा।

(2) प्रत्र्ेक आवेिन के साथ प्ररूप 2 में उस के्षत्र पर क्षेत्राजधकार रखन ेवाल ेऐसे अजधकारी िो उप वन संरक्षक की रैंक से नीचे का न हो, द्वारा िारी दकर्ा गर्ा जवजधक उपापन प्रमाण पत्र संलग्न होना चाजहए। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3

(3) प्रबंधन प्राजधकरण र्ा प्राजधकृत अजधकारी, र्दि सत्र्ापन पर पाता ह ै दक वह तारीख जिस पर प्रिाजत का नमूना— i. िंगल से हटा दिर्ा गर्ा था; र्ा ii. बंिी जस्ट्थजत में उत्पन्न र्ा जनर्ंजत्रत वातावरण में कृजत्रम रूप से तैर्ार दकर्ा गर्ा था; र्ा iii. र्दि ऐसी तारीख अज्ञात ह ैर्ा सुजनजित नहीं की िा सकती ह,ै तो जिस तारीख को नमूना प्राप्त दकर्ा गर्ा था वह तारीख वही होगी जिस पर वह पहली बार आवेिक के पास था, उस तारीख से पहल ेिब संबंजधत प्रिाजत को पहली बार पररजिष्ट में िाजमल दकर्ा गर्ा था, प्ररूप 3 में एक प्रमाण पत्र िारी करें।

5. व्यजिगत र्ा घरेल ूप्रभाव के जलए छूट.- (1) कोई भी व्यजि, िो भारत का नागररक ह ैऔर उसन ेभारत के भीतर एक नमूना प्राप्त दकर्ा ह ै जिस पर व्यजिगत र्ा घरेलू प्रभाव ह,ै व्यजिगत र्ा घरेलू प्रभाव के रूप में नमूना के रजिस्ट्रीकरण के जलए प्रबंधन प्राजधकरण र्ा प्राजधकृत अजधकारी को प्ररूप 4 में आवेिन करेगा।

(2) उप-जनर्म (1) के अधीन आवेिन के साथ प्ररूप 2 में क्षते्र पर क्षेत्राजधकार रखने वाले ऐसे अजधकार िो उप वन संरक्षक की रैंक से नीचे का न हो, द्वारा िारी जवजधक उपापन प्रमाण पत्र और एक हिार रुपर् ेकी फीस संलग्न की िाएगी। .

(3) प्रबंधन प्राजधकरण र्ा प्राजधकृत अजधकारी व्यजिगत र्ा घरेल ू प्रभाव के रूप में नमूने के प्ररूप 5 में रजिस्ट्रीकरण का प्रमाण पत्र िारी करेगा।

(4) र्दि कोई व्यजि व्यजिगत र्ा घरेलू प्रभाव के रूप में जनम्नजलजखत प्रिाजतर्ों में से दकसी को जनर्ाात करन ेका आिर् रखता ह,ै तो उसे प्रबंधन प्राजधकरण र्ा प्राजधकृत अजधकारी द्वारा प्राजधकृत एिेंसी द्वारा िारी दकए गए उस आिर् का प्रमाण पत्र िेना होगा, अथाात्:— (क) स्ट्टिान प्रिाजत (एजसपेंसररफोमेस एसपीपी) के कैजवर्ार, अजभसमर् के अनुसार लेबल दकए गए कंटेनर में प्रजत व्यजि एक सौ पच्चीस ग्राम से अजधक नहीं ले िार्ा िा सकता ह;ै (ख) कैक्ट्टैसी प्रिाजत की लकडी वषाा प्रजत व्यजि तीन नमनूों से अजधक नहीं होनी चाजहए;

(ग) अगरवुड के नमून ेप्रजत व्यजि एक दकलोग्राम लकडी के जचप्स, चौबीस जमलीलीटर तेल और मोजतर्ों र्ा प्राथाना माला के िो सेट (र्ा िो हार र्ा कंगन) से अजधक नहीं होने चाजहए।

(5) कोई भी स्ट्वामी जिसने अपने िेि की नागररकता में नमूना हाजसल कर जलर्ा ह,ै उसे जनर्ाात के ििे द्वारा िारी दकए गए जनर्ाात परजमट के जबना ऐसे नमून ेके आर्ात की अनमुजत िी िाएगी र्दि नमनूे के साथ आर्ातक के व्यजिगत र्ा घरेलू प्रभाव के रूप में नमूने का उल्लेख करते हुए जनर्ाात के ििे के प्रबंधन प्राजधकरण द्वारा िारी प्रमाण पत्र संलग्न ह।ै

6. पररजिष्ट 1 की बंिी जस्ट्थजत में उत्पन्न नमून ेको पररजिष्ट 2 के समान माना िाएगा- (1) पररजिष्ट 1 में सूचीबद्ध और वाजणजयर्क प्रर्ोिनों के जलए बंिी जस्ट्थजत में उत्पन्न प्रिाजतर्ों के नमून ेका प्रत्र्ेक स्ट्वामी जनर्ाात प्रर्ोिन के जलए अजभसमर् के अनचु्छेि 7 के अधीन छूट के जलए प्ररूप 6 में आवेिन करेगा।

(2) उप-जनर्म (1) के अधीन आवेिन के साथ प्ररूप 2 में क्षेत्रों पर क्षेत्राजधकार रखन ेवाल ेऐसे अजधकारी िो उप वन संरक्षक की रैंक से नीचे के न हो, द्वारा िारी जवजधक उपापन प्रमाण पत्र और एक हिार रुपर् ेकी फीस संलग्न की िाएगी ।

(3) उप-जनर्म (1) के अधीन आवेिन के साथ जनम्नजलजखत सबूत संलग्न दकए िाएंग-े (क) सुजवधा को अजधजनर्म के अधीन बनाए गए जनर्मों के अनुसार अनजु्ञजप्त प्राप्त ह;ै (ख) सुजवधा अजभसमर् के सजचवालर् के साथ रजिस्ट्रीकृत ह;ै और (ग) जनर्ाात दकए िाने वाले नमूने के साथ अजधजनर्म के अधीन बनाए गए जनर्मों के अनुसार रजिस्ट्रीकरण का प्रमाण पत्र संलग्न होगा ।

(4) र्दि आवेिन सही पार्ा िाता ह ैतो प्रबंधन प्राजधकरण पंरह दिनों की अवजध के भीतर वैज्ञाजनक प्राजधकरण से सलाह ल ेसकता ह।ै 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(5) वैज्ञाजनक प्राजधकरण ऐसी िांच और परीक्षण करने के पिात्, िो वह आवश्र्क समझे, प्रबंधन प्राजधकरण को सलाह िेगा।

(6) वैज्ञाजनक प्राजधकरण की सलाह प्राप्त होन ेपर प्रबंधन प्राजधकरण पंरह दिनों की अवजध के भीतर जनर्ाात र्ा पुनः जनर्ाात के जलए परजमट िारी करेगा।

(7) अनुसूची 4 के पररजिष्ट 1 में सूचीबद्ध और वाजणजयर्क उद्देश्र्ों के जलए बंिी जस्ट्थजत में उत्पन्न, प्रिाजतर्ों के नमून ेके स्ट्वामी िो आर्ात परजमट की आवश्र्कता से छूट लेन ेका आिर् रखत ेहैं, उन्द्हें र्थाजस्ट्थजत, स्रोत कोड 'घ' के साथ जनर्ाात र्ा पुन: जनर्ाात ििे के प्रबंधन प्राजधकरण द्वारा िारी जनर्ाात र्ा पुनः जनर्ाात परजमट प्रमाण पत्र की आवश्र्कता होगी।

7. परजमट र्ा प्रमाण पत्र के बिल ेप्रमाण पत्र की स्ट्वीकृजत.—(1) पररजिष्ट में सूचीबद्ध दकसी प्रिाजत के नमून ेके आर्ात के मामल ेमें, जनर्ाात के िेि के प्रबंधन प्राजधकरण से र्ह प्रमाण पत्र दक दकसी पि ुप्रिाजत का कोई नमनूा बंिी जस्ट्थजत में उत्पन्न हुआ था र्ा दकसी पौधे की प्रिाजत का कोई नमूना कृजत्रम रूप से तैर्ार दकर्ा गर्ा था, र्ा ऐसे पि ुर्ा पौधे का भाग ह ैर्ा पिु के मामले में स्रोत कोड 'ग' के साथ और पौधों के मामले में स्रोत कोड 'क' के साथ प्राप्त दकर्ा गर्ा था। अजधजनर्म के अधीन आवश्र्क दकसी भी अन्द्र् परजमट र्ा प्रमाण पत्र के बिल ेमें स्ट्वीकृत दकर्ा िाएगा ।

(2) नमूना पररजिष्ट 1 में बंिी जस्ट्थजत में उत्पन्न नमनूे में व्यापार की अनुमजत केवल तभी िी िाएगी िब इसे अजभसमर् के संकल्पों में अंकन के उपबंधों के अनुसार जचजननत दकर्ा गर्ा हो और र्दि जचनन का प्रकार और संख्र्ा व्यापार प्राजधकृत करन ेवाले िस्ट्तावेज़ पर इंजगत की गई हो।

8. वजै्ञाजनक, वजै्ञाजनक ससं्ट्थान के बीच गरै-वाजणजयर्क ऋण, िान र्ा जवजनमर्.—(1) कोई भी वैज्ञाजनक र्ा वैज्ञाजनक संस्ट्थान िो हबेररर्म नमून,े अन्द्र् संरजक्षत, सूखे र्ा एम्बेडेड संग्रहालर् नमनूे, और सूचीबद्ध प्रिाजतर्ों के िीजवत पौधों की सामग्री का जनर्ाात करन ेका आिर् रखता ह ैऔर पररजिष्टों में वैज्ञाजनक र्ा गंतव्य िेि के प्रबंधन प्राजधकरण के साथ रजिस्ट्रीकृत एक वैज्ञाजनक संस्ट्थान के साथ गरै-वाजणजयर्क ऋण, िान र्ा जवजनमर् और परजमट र्ा प्रमाण पत्र के संबंध में छूट की मांग के जलए प्ररूप 7 में रजिस्ट्रीकरण के जलए प्रबंधन प्राजधकरण को आवेिन करेगा ।

(2) उपजनर्म (1) के अधीन आवेिन के साथ, के्षत्र पर अजधकार के्षत्र रखने वाले उप वन संरक्षक द्वारा प्ररूप 2 में िारी जवजधक उपापन प्रमाणपत्र और एक हिार रुपर् ेका िुल्क संलग्न दकर्ा िाएगा ।

(3) प्रबंधन प्राजधकरण, समाधान होने पर वैज्ञाजनक र्ा वैज्ञाजनक संस्ट्था को रजिस्ट्रीकृत करेगा और वैज्ञाजनक र्ा वैज्ञाजनक संस्ट्था के नमून ेर्ा उसके पैकेि पर जचपकाने के जलए प्ररूप 8 में एक लेबल जचनन और लेबल िारी करेगा ।

(4) प्रबंधन प्राजधकरण, रजिस्ट्रीकृत संस्ट्थाओं की पहचान करन े के जलए पांच-अक्षर का कोड समनुिेजित करेगा, जिसमें पहले िो अक्षर 'आईएन' होंग ेऔर अंजतम तीन अक्षर एक जवजिष्ट संख्र्ा होनी चाजहए ।

(5) वैज्ञाजनक र्ा वैज्ञाजनक संस्ट्था, उपजनर्म (3) के अनुसार रजिस्ट्रीकृत होने पर और लेबल जचनन िारी करने पर, जनर्ाात से पहले नमून ेर्ा उसके पैकेि पर लेबल जचपकाने के जलए प्राजधकृत होगा ।

(6) कोई भी वैज्ञाजनक र्ा वैज्ञाजनक संस्ट्था, िो अनुज्ञा की अपेक्षा से छूट चाहती ह ैऔर हबेररर्म नमूने, अन्द्र् संरजक्षत, सूखे र्ा एम्बेडडे संग्रहालर् नमून ेआर्ात करन ेका, और पररजिष्ट में सूचीबद्ध प्रिाजतर्ों की िीजवत पौधों की सामग्री को गैर-वाजणजयर्क ऋण, संिान का र्ा जनर्ाातक ििे के प्रबंधन प्राजधकरण द्वारा रजिस्ट्रीकृत वैज्ञाजनक र्ा वैज्ञाजनक संस्ट्था से जवजनमर् का आिर् रखता ह,ै उस िेि के प्रबंधन प्राजधकरण द्वारा िारी र्ा अनुमोदित दकए गए लेबल रखेगी ।

9. वजै्ञाजनक ससं्ट्थानों के रजिस्ट्रीकरण के जलए मानक—(1) जनर्म 8 के अधीन रजिस्ट्रीकृत प्रत्र्ेक वैज्ञाजनक और वैज्ञाजनक संस्ट्था, जनम्नजलजखत मानकों का पालन करेंगी, अथाात् :-- (क) स्ट्थार्ी रूप से रखे गए और वृजत्तक रूप से संग्रहीत, पिुओं र्ा पािकों के नमूनों का संग्रह, और उनके सहबद्ध अजभलेख, उजचत रूप से बनाए रखे िाएंग;े (ख) सभी अर्हात उपर्ोगकतााओं, जिनमें वे भी सजम्मजलत हैं, िो अन्द्र् संस्ट्थाओं से हैं, के जलए पहुचंर्ोग्र् नमून े पृथक् रूप से अजभजलजखत दकए िाएंगे;

(ग) सभी अजधजमलन, एक स्ट्थार्ी सूची में समुजचत रूप से अजभजलजखत दकर्े गर् ेहैं;

(घ) अन्द्र् संस्ट्थाओं को ऋण और अतंरण के जलए स्ट्थार्ी अजभलेख रखे िाएंग;े [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (ङ) प्रमुख रूप से अनुसंधान के प्रर्ोिनों के जलए प्राप्त नमूनों की वैज्ञाजनक प्रकािनों में ररपोटा की गई ह;ै (च) नमूने इस प्रकार से तैर्ार दकए गए हैं और संग्रह इस तरह से व्यवजस्ट्थत दकर् ेगर् ेहैं दक उनकी उपर्ोजगता सुजनजित हो सके;

(छ) नमूना लेबल, स्ट्थार्ी सूची और अन्द्र् अजभलेख पर सटीक डॉटा अनुरजक्षत दकर्ा गर्ा ह;ै (ि) नमूनों का अजधग्रहण और कब्ज़ा ऐसे अिान और कब्ज़ ेको जनर्जंत्रत करन ेवाली जवजधर्ों के अनुसार दकर्ा गर्ा ह;ै और (झ) पररजिष्ट 1 में सजम्मजलत प्रिाजतर्ों के सभी नमूनों को वैज्ञाजनक संस्ट्था के प्रत्र्क्ष जनर्ंत्रण के अधीन स्ट्थार्ी रूप से और कें रीर्कृत रूप में रखा गर्ा ह,ै और उनका प्रबंध, सिावट, रॉफी र्ा अजभसमर् के जसद्धांतों से असंगत अन्द्र् प्रर्ोिनों के जलए ऐसे नमूनों के उपर्ोग को रोकन ेकी रीजत से दकर्ा गर्ा ह ै।

(2) फोरेंजसक अनुसंधान में जनर्ोजित दकसी संस्ट्था की ििा में, उपजनर्म (1) के अधीन मानकों के अजतररि, जनम्नजलजखत मानकों का अनुपालन करना होगा, अथाात्:-- (क) प्रबंधन प्राजधकरण र्ह सुजनजित करेगा दक ऐसे संस्ट्था वन्द्र्िीव फोरेंजसक जवश्लेषण प्रिान करन े के जलए उपर्ुि हैं;

(ख) अनुसंधान के प्रर्ोिनों के जलए वन्द्र्िीव संिभा डेटाबेस के जवकास के माध्र्म से फोरेंजसक अनुसंधान क्षमताओं के जवस्ट्तार के जलए मूल रूप से अर्िात पिु र्ा पािप नमूनें, स्ट्थार्ी सूची में उजचत रूप से अजभजलजखत दकए गए हैं;

(ग) स्ट्थार्ी अजभलेख में अन्द्र् संस्ट्थाओं को ऋण और अंतरण के बारे में सूचना और संव्यवहार का प्रर्ोिन अंतर्वाष्ट हो;

(घ) प्रत्र्ेक संस्ट्था, अनुसंधान संचाजलत करने के जलए प्रर्ुि उसकी क्वाजलटी प्रबंधन प्रणाली का संिभा िेगी;

और (ङ) सटीक डेटा, उिाहरण के जलए वैज्ञाजनक नाम, विन, भौगोजलक उत्पजत्त, स्रोत कोड, अनुसंधान का प्रर्ोिन और पररणाम, स्ट्थार्ी सूची में अजभजलजखत दकर्ा गर्ा हो, और नमूनों पर सटीक और पर्ााप्त रूप से लेबल लगार्ा गर्ा हो ।

10. दकसी र्ात्रा जचजडर्ाघर, सकास, मनेाजगरी, पािप प्रििानी र्ा अन्द्र् र्ात्रा प्रििानी में नमनूों का रजिस्ट्रीकरण—(1) दकसी र्ात्रा जचजडर्ाघर, सका स, मनेाजगरी, पािप प्रििानी र्ा अन्द्र् र्ात्रा प्रििानी का कोई भी अजधकृत व्यजि, जिसके पास वन्द्र् िीव (संरक्षण) संिोधन अजधजनर्म, 2022 के प्रारंभ से पूवा अर्िात दकए गए नमून ेहैं, ऐसे र्ात्रा जचजडर्ाघर, सका स, मेनाजगरी, पािप प्रििानी र्ा अन्द्र् र्ात्रा प्रििानी के रजिस्ट्रीकरण के जलए प्ररूप 9 में आवेिन करेगा ।

(2) उपजनर्म (1) के अधीन आवेिन के साथ के्षत्र पर अजधकाररता रखन ेवाल ेउप वन संरक्षक द्वारा प्ररूप 2 में िारी दकर्ा गर्ा जवजधक उपापन प्रमाणपत्र और एक हिार रुपर् ेका फीस संलग्न होगी ।

(3) प्रबंधन प्राजधकरण र्ा प्राजधकृत अजधकारी प्ररूप 10 में रजिस्ट्रीकरण प्रमाणपत्र िारी करेगा, र्दि प्रबंधन प्राजधकरण का र्ह समाधान हो िाता ह ैदक,-- (क) ऐसा नमूना, िीजवत िानवरों की ििा में अजधजनर्म की धारा 49ढ और उसके अधीन बनाए गए जनर्मों के अनुसार ह ै;

(ख) दकसी िीजवत नमून ेका पररवहन और िेखभाल इस प्रकार की िाएगी दक पिओुं के प्रजत िूरता का जनवारण अजधजनर्म, 1960 (1960 का 59) के उपबंधों के अनुपालन में क्षजत के िोजखम, स्ट्वास्ट््र् के नुकसान को कम दकर्ा िा सके र्ा उपचार िा सके ।

(4) ऐसे नमून,े िो र्ात्रा जचजडर्ाघर, सका स, मेनाजगरी, पािप प्रििानी र्ा प्रबंधन प्राजधकरण के साथ रजिस्ट्रीकृत अन्द्र् र्ात्रा प्रििानी का भाग हैं, जनर्ाात र्ा पुन: जनर्ाात अनजु्ञा के जबना जनर्ाात दकए िा सकेंगे ।

12. उि ्गम ििे वह िेि ह,ै जिस िेि में वन्द्र् के्षत्र से नमनू ेजलए गए थ,े बंधक अवस्ट्था में प्रिनन दकर्ा गर्ा था र्ा कृजत्रम रूप से उनका प्रसार दकर्ा गर्ा था जसवार् पािपों के नमनूों के, िो संकटापन्न वन्द्र् प्राणी और वनस्ट्पजत में व्यापार पर अतंरााष्ट्रीर् अजभसमर् के उपबंधों से छूट प्राप्त करन ेके जलए अर्हात नहीं ह ै। ऐसे मामलों में उि ्गम िेि वह ििे माना िाएगा जिसमें नमूने छूट के जलए अर्हात होना समाप्त कर िेत े हैं । जनर्ाात करने वाले िेि के जलए परजमट र्ा प्रमाणपत्र की संख्र्ा को उपिर्िात करें तथा िारी करन ेकी तारीख को भी उपिर्िात करें । र्दि संपूणा र्ा भागत: सूचना ज्ञात नहीं ह ैतो इसे ब्लॉक 5 में न्द्र्ार्ोजचत िहरार्ा िाना चाजहए । इस ब्लॉक को केवल पनु: जनर्ाात की ििा में परूा दकर्ा िाएगा ;

1. Short title and commencement.—(1) These rules may be called the ‘Scheduled Specimen (Conditions and Procedure for exemption), Rules, 2024’.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definition.—(1) In these rules, unless the context otherwise requires,—

(a) “Act” means the Wild Life (Protection) Act, 1972 (53 of 1972);

(b) “ATA carnet” means an International uniform Customs document issued under ATA Convention;

(d) “Appendix” means an Appendix specified under Schedule IV appended to the Act;

(e) “Form” means form annexed to these rules;

(f) “Management Authority” means the authority designated under section 49E of the Act;

(g) “owner” means the owner of a specimen and includes any person in possession of such specimen;

(h) “ Permit” means a permit or certificate issued under the Convention;

(i) “personal or household effects” means specimens that are personally owned for non-commercial purposes and at the time of import, export or re-export either worn, carried or included in personal baggage; or part of a household move and does not include rhino horn and elephant ivory contained in hunting trophies;

(j) ”sample collection” means collection of dead specimen, parts and derivatives thereof specified in Appendix II or III and species specified in Appendix I relating to bred in captivity or artificially propagated for commercial purposes;

(2) The words and expressions used herein and not defined but defined in the Act shall have the meanings, respectively assigned to them in the Act.

3. Exemptions for specimens under transit or transhipments.—(1)The specimens shall not require export or re-export permit when the specimen are in transit or transhipment through or in the territory of India while the specimens remain in the control of the Customs Department.

(2) The specimen shall be accompanied with the copy of export or re-export permit issued by the country of export or re-export, as the case may be.

(3) In the case of a sample collection,—

(a) the permit must clearly show the destination of the shipment, which shall be the country of issuance;

(b) the cross-border movements of sample collection of specimens covered under the ATA Convention shall be accompanied by a standard permit issued under the Convention, on which it shall be indicated that the document is a permit for export , re-export and, it shall clearly specify that the document is issued for a sample collection ;

(d) the specimen covered by the permit shall not be sold or otherwise transferred whilst outside the territory of the State that issued the permit;

(e) the number of accompanying ATA carnet shall be recorded and entered by the Customs responsible for the endorsement of the Customs document;

(f) the name and address including the country of the importer and the exporter or re-exporter shall be the same in the permit and the ATA carnet, and the names of the countries to be visited shall be indicated;

(g) the date of expiry the permit shall not be later than that of the ATA carnet accompanying it and the period of validity shall not be more than six months from the date on which it was granted;

(h) the Customs shall, at the point of entry or exit, verify the presence of the permit issued under the Convention and allow it to remain with the collection, and ensure that the ATA carnet is properly endorsed with an authorised stamp and signature by a Customs official.

(4) The consignee shall on demand by the Management Authority or authorised officer or the officers of the Customs produce the permit to verify the presence of a valid permit.

4. Application for pre-convention certificate.—(1)Any person intending to export or re-export a specimen acquired prior to the commencement of the Wild Life (Protection) Amendment Act, 2022 shall make an application electronically to the Management Authority in Form I accompanied with a fee of one thousand rupees.

(2) Every application shall be accompanied with the legal procurement certificate, issued by an officer not below the rank of the Deputy Conservator of Forests having jurisdiction over the area, in Form II.

(3) The Management Authority or the authorised officer shall, if on verification finds that the date on which the specimen of the species wasi. removed from the wild; or ii. born in captivity or artificially propagated in a controlled environment; or iii. if such date is unknown or cannot be acertained, the date on which the specimen was acquired shall be the date on which it was first possessed by the applicant, is prior to the date on which the species concerned was first included in the Appendices, issue a certificate in Form III.

5. Exemptions for personal or household effects.—(1) Any person, who is a citizen of India and has acquired a specimen within India which is a personal or household effect shall apply in Form IV to the Management Authority or the authorised officer for registration of the specimen as personal or household effect.

(2)The application under sub-rule (1) shall be accompanied with the legal procurement certificate issued by an officer not below the rank of the Deputy Conservator of Forests having jurisdiction over the area in Form II and a fee of one thousand rupees.

(3) The Management Authority or the authorised officer shall issue a certificate of registration in Form V of the specimen as personal or household effect.

(4) If any person intends to export any of the following species as personal or household effect, it shall accompany a certificate to that effect issued by an agency authorised by the Management Authority or authorised officer, namely:—

(a) caviar of sturgeon species (Acipenseriformes spp.) not exceeding one hundred and twenty five grams per person carried in a container labelled in accordance with the Convention;

(b) rain sticks of Cactaceae species not exceeding three specimens per person;

(c) specimens of agarwood not exceeding one kg of wood chips, twenty four ml of oil and two sets of beads or prayer beads (or two necklaces or bracelets) per person

(5) Any owner who has acquired the specimen in his country of citizenship shall be allowed import of such specimen without the export permit issued by the country of export if the specimen is accompanied by a certificate issued by the Management Authority of the country of export mentioning the specimen as a personal or household effect of the importer.

6. Specimen of Appendix I bred in captivity to be treated as that of Appendix II.—(1) Every owner of the specimen of the species listed in Appendix I and bred in captivity for commercial purposes shall apply in Form VI for seeking exemption under Article VII of the Convention for export purpose.

(3) The application under sub-rule (1) shall be accompanied with a proof that- 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(a) the facility is licenced in accordance with the rules made under the Act;

(b) the facility is registered with the Secretariat of the Convention; and

(4) The Management Authority may if the application is found to be in order, seek advice of the Scientific Authority, within a period of fifteen days.

(5) The Scientific Authority shall after making such inquiry and examination as it may consider necessary, advice to the Management Authority.

(6) The Management Authority upon receipt of advice of the Scientific Authority shall issue the permit for export or re-export within a period of fifteen days.

(7) The owner of the specimen of the Species listed in Appendix I of the Schedule IV and bred in captivity for commercial purposes who intends to seek exemption from the requirement of import permit shall require an export or re-export permit or certificate issued by the Management Authority of the country of export or re-export as the case may be with source code ‘D’.

7. Acceptance of certificate in lieu of permits or certificates.—(1) In case of import of the specimen of a species listed in the Appendices, a certificate from the Management Authority of the country of export that any specimen of an animal species was bred in captivity or any specimen of a plant species was artificially propagated, or is a part of such an animal or plant or was derived therefrom with source code ‘C’ in case of animals and with source code ‘A’ in case of plants, shall be accepted in lieu of any other permits or certificates required under the Act.

(2) The trade in a specimen bred in captivity in Appendix I specimen shall be permitted only if it is marked in accordance with the provisions on marking in the Resolutions of the Convention and if the type and number of the mark are indicated on the document authorising the trade.

8. Non-commercial loan, donation or exchange between scientist, scientific institution.—(1) Any scientist or a scientific institution who intends to export herbarium specimens, other preserved, dried or embedded museum specimens, and live plant materials of species listed in Appendices as non-commercial loan, donation or exchange with scientist or a scientific institution registered with the Management Authority of the country of destination and seeking exemption regarding permit or certificate shall make an application for registration to the Management Authority for registration in Form VII.

(2) The application under sub-rule (1) shall be accompanied with the legal procurement certificate issued by the Deputy Conservator of Forests having jurisdiction over the area in Form II and a fee of one thousand rupees.

(3) The Management Authority upon being satisfied shall register the scientist or the scientific institution and issue a label mark to be affixed on the specimen or its package of the scientist or the scientific institution and the label in Form VIII.

(4) The Management Authority shall assign five-character code identifying registered institutions with the first two characters as ‘IN’ and the last three characters should be a unique number.

(5) The scientist or scientific institution may upon registration and issuance of the label mark as per sub-rule

(3) shall be authorised to affix the label upon the specimen or its package before export.

(6) Any scientist or scientific institution seeking exemption from the requirement of permit and intending to import herbarium specimens, other preserved, dried or embedded museum specimens, and live plant material of the species listed in Appendices as a non-commercial loan, donation or exchange from scientist or scientific institution registered by a Management Authority of the country of export shall carry a label issued or approved by the Management Authority of that country.

9. Standards for registration of scientific institutions.—(1) Every scientist and scientific institution registered under rule 8 shall comply with the following standards namely:-

(a) collections of animal or plant specimens, and records ancillary to them, permanently housed and professionally curated have been properly maintained;

(b) specimens accessible to all qualified users, including those from other institutions have been recorded separately;

(d) permanent records have been maintained for loans and transfers to other institutions;

(e) specimens acquired primarily for purposes of research have been reported in scientific publications;

(f) specimens have been prepared and collections have been arranged in a manner that ensures their utility;

(g) accurate data have been maintained on specimen labels, permanent catalogues and other records;

(h) acquisition and possession of specimens have been in accordance with the laws governing such acquisition and possession; and

(i) all specimens of species included in Appendix I have been permanently and centrally housed under the direct control of the scientific institution, and managed in a manner to preclude the use of such specimens for decoration, trophies or other purposes incompatible with the principles of the Convention.

(2) In case of any institution engaged in forensic research, shall, in addition to the standards under sub-rule

(1), comply with the following, namely:—

(a) the Management Authority shall ensure that such institutions are suitable to provide wildlife forensic analysis;

(b) animal or plant specimens acquired primarily for purposes of research, to expand forensic research capabilities through development of wildlife reference databases, have been properly recorded in a permanent catalogue;

(c) permanent records contain information about loans and transfers to other institutions and the purpose of the transaction;

(d) every institution shall made reference to its quality management system used for research conducted;

and

(e) accurate data, for example scientific name, weight, geographical origin, source code, purpose and result of research, have been recorded in the permanent catalogue, and specimens have been accurately and adequately labelled.

10. Registration of specimens in a travelling zoo, circus, menagerie, plant exhibition or other travelling exhibition.—(1) Any authorised person of a travelling zoo, circus, menagerie, plant exhibition or other travelling exhibition having specimen acquired prior to the commencement of the Wild Life (Protection) Amendment Act, 2022 shall apply for registration in Form IX of the such travelling zoo, circus, menagerie, plant exhibition or other travelling exhibition.

(2) The application under sub-rule (1) shall be accompanied with the legal procurement certificate issued by of the Deputy Conservator of Forests having jurisdiction over the area in Form II and a fee of one thousand rupees.

(3) The Management Authority or the authorised officer shall issue a registration certificate in Form X if the Management Authority is satisfied that -

(a) such specimen is in accordance with section 49 M of the Act and rules made thereunder in case of live animals;

(b) any living specimen will be so transported and cared for as to minimize the risk of injury, damage to health or treatment in compliance with the provisions of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960).

(4) Such specimens which are part of travelling zoo, circus, menagerie, plant exhibition or other travelling exhibition registered with the Management Authority may be exported without an export or re-export permit.

11. Verification with country of import.—The applicant shall, before export or re-export from India, check with potential importers or with the Management Authority of the intended country of destination whether such country shall accept the certificate issued under these Rules for import.

Instructions and explanations (These correspond to block numbers on the form)

1. Tick the square which corresponds to the type of document issued (export permit, re-export certificate, import permit or other). If the box "other" has been ticked, the type of document must be indicated. The original number is a unique number allocated to each document by the Management Authority.

2. For export permits and re-export certificates, the date of expiry of the document may not be more than six months after the date of issuance (one year for import permits).

3. Complete name and address of the importer.

3a. The name of the country must be written in full.

4. Complete name and address of the exporter/re-exporter. The name of the country must be stated. The absence of the signature of the applicant renders the permit or certificate invalid.

5. Special conditions may refer to national legislation or special conditions placed on the shipment by the issuing Management Authority. This block can also be used to justify the omission of certain information.

5a. The following codes should be used: T for commercial, Z for zoo, G for botanical garden, Q for circus or travelling exhibition, S for scientific, H for hunting trophy, P for personal, M for medical, E for education, N for reintroduction or introduction into the wild, B for breeding in captivity or artificial propagation and L for law enforcement / judicial / forensic.

5b. Indicate the number of the security stamp affixed in block 13.

6. The name, address and country of the issuing Management Authority should already be printed on the form.

Indicate the scientific name (genus and species, where appropriate subspecies) of the animal or plant as it appears in the Convention Appendices or the reference lists approved by the Conference of the Parties, and the common name of the animal or plant as known in the country issuing the permit.

9. Describe, as precisely as possible, the specimens entering trade (live animals, skins, flanks, wallets, shoes, etc.). If a specimen is marked (tags, identifying marks, rings, etc.), whether or not this is required by a Resolution of the Conference of the Parties (specimens originating in a ranching operation, specimens subject to quotas approved by the Conference of the Parties, specimens of Appendix-I species bred in captivity for commercial purposes, etc.), indicate the number and type of mark. The sex and age of the live animals should be recorded, if possible.

10. Enter the number of the Appendix of the Convention (I, II or III) in which the species is listed.

Use the following codes to indicate the source:

W Specimens taken from the wild X Specimens taken in “the marine environment not under the jurisdiction of any State”.

R Ranched specimens: specimens of animals reared in a controlled environment, taken as eggs or juveniles from the wild, where they would otherwise have had a very low probability of surviving to adulthood.

D Appendix-I animals bred in captivity for commercial purposes in operations included in the Secretariat's Register, in accordance with Resolution Conf. 12.10 (Rev. CoP15), and Appendix-I plants artificially propagated for commercial purposes, as well as parts and derivatives thereof, exported under the provisions of Article VII, paragraph 4, of the Convention A Plants that are artificially propagated in accordance with Resolution Conf. 11.11 (Rev. 11. The quantity and units indicated should conform to the most recent version of the Guidelines for the preparation and submission of Convention on International Trade in Endangered Species of wild fauna and flora annual reports.

11a. Indicate the total number of specimens exported in the current calendar year (1 January to 31 December) (including those covered by the present permit) and the current annual quota for the species concerned (for example 500/1000). This should be done for the national quotas as well as for those determined by the Conference of the Parties.

12. The country of origin is the country in which the specimens were taken from the wild, bred in captivity or artificially propagated, except in the case of plant specimens that cease to qualify for an exemption from the provisions of Convention on International Trade in Endangered Species of wild fauna and flora. In such instances, the country of origin is deemed to be the country in which the specimens ceased to qualify for the exemption. Indicate the number of the permit or certificate of the exporting country and the date of issuance. If all or part of the information is not known, this should be justified in block 5. This block must only be completed in case of re-exports;

12a. The country of last re-export is the country from which the specimens were re-exported before entering the country in which the present document is issued. Enter the number of the re-export certificate of the country of last reexport and its date of issuance. If all or part of the information is not known, this should be justified in block 5. This block must only be completed in case of re-export of specimens previously re-exported.

12b. The “No. of the operation” is the number of the registered captive-breeding or artificial propagation operation.

The “date of acquisition” is defined in Resolution Conf. 13.6 (Rev. CoP16) and is required only for pre-Convention specimens.

13. To be completed by the official who issues the permit. The name of the official must be written in full. The security stamp must be affixed in this block and must be cancelled by the signature of the issuing official and a stamp or seal. The seal, signature and security-stamp number should be clearly legible.

14. To be completed by the official who inspects the shipment at the time of export or re-export. Enter the quantities of specimens actually exported or re-exported. Strike out the unused blocks.

15. Enter the number of the bill of lading or air way-bill if the method of transport used requires the use of such a document.
