.—योजना और वा� तुकला िव�ालय अिधिनयम, 2014 (2014 का 37) (िजसे इसम! इसके प# चात् उ' त अिधिनयम कहा गया ह)ै 22 जनवरी, 2015 को (वृ* त +आ था ;
और उ' त अिधिनयम क/ धारा 33 क/ उपधारा (2) उ' त अिधिनयम क/ धारा 33 क/ उपधारा (1) के अधीन ग3ठत क/ जाने वाली प3रषद,् एक क! 7ीय िनकाय, क/ संरचना का उपबंध करती ह ै;
और उ' त अिधिनयम क/ धारा 33 क/ उपधारा (2) का खंड (ख) भारत क/ ससंद ्के दो सद� य (लोक सभा अ> य? @ारा नामिनAदB ट �कया जान ेवाला एक सद� य और राD य सभा के सभापित @ारा नामिनAदB ट �कया जाने वाला एक सद� य), पदने, का उपबंध करता ह;ै और धारा 33 क/ उपधारा (2) का खंड (ड) कुला> य? @ारा नामिनAदB ट �कए जान ेवाले तीन F यि' त िजनम!
से कम से कम एक मिहला होगी और एक एक नगरीय और (ादिेशक योजना से होगा, िजनके पास वा� तकुला या भू-द#ृ य वा� तकुला या नगरीय िडजाइन क/ बाबत िवशेष Hान या F यावहा3रक अनुभव हो, पदने, का उपबंध करता ह;ै और उ' त अिधिनयम के पूवJ' त उपबंधK को (भावी करन ेम! िन निलिखत क3ठनाईयां उ* पL न हो गई हM :-- (क) धारा 33 क/ उपधारा (2) के खंड (ख) म! आने वाला 'पदने' शO द संगत नहP ह ै' यK�क संसद ् के सद� यK को माननीय सभापित या अ> य? @ारा दोनK सदनK के सद� यK म! से नामिनAदB ट �कया जाता ह ै और इसिलए वे पदने पद नहP हM ;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) धारा 33 क/ उपधारा (2) के खंड (ड) म! आने वाला 'पदने' शO द संगत नहP ह ै ' यK�क कुला> य? @ारा नामिनAदB ट �कए जाने वाले तीन िवQ यात F यि' त योजना या भ-ूद#ृ य वा� तकुला या नगरीय िडजाइन और नगरीय और (ादिेशक योजना क/ बाबत िवशेष Hान या F यावहा3रक अनुभव रखते हM और इसिलए वे पदने पद नहP हM ;
और उ' त अिधिनयम क/ धारा 34 प3रषद ्के सद� यK क/ पदाविध उनके बीच 3रि' तयK और उL ह! संदये भ* तK का उपबंध करती हM ;
और उ' त अिधिनयम क/ धारा 34 क/ उपधारा (3) के उपबंध को (भावी करने म! िन निलिखत क3ठनाई उ* पL न हो गई हM :-- धारा 34 क/ उपधारा (3) म! आन ेवाले शOद 'िजसने उसे िनवाSिचत �कया ह'ै संगत नहP हM ' यK�क ससंद ्के सद� यK को माननीय सभापित या अ> य? @ारा नामिनAदB ट �कया जाता ह ैऔर उL ह! सदन @ारा िनवाSिचत नहP �कया जाता ह ैजैसा �क उपधारा म! वTणत ह ै;
अत:, अब क! 7ीय सरकार, योजना और वा� तुकला िव�ालय अिधिनयम, 2014 (2014 का 37) क/ धारा 40 क/ उपधारा (1) @ारा (द* त शि' तयK का (योग करते +ए, पूवJ' त क3ठनाईयK को दरू करने के िलए िन निलिखत आदशे करती ह ै:--
1. सिं�� त सिं�� तसिं�� त सिं�� त नाम और �ारंभ नाम और �ारंभ नाम और �ारंभ नाम और �ारंभ— —— —(1) इस आदशे का नाम योजना और वा� तुकला िव�ालय (क3ठनाईयK को दरू करना) आदशे, 2015 ह ै।
(2) यह इसके राजपV म! (काशन क/ तारीख को (वृ* त होगा ।
2. योजना और वा� तुकला िव�ालय अिधिनयम, 2014 म! :-- (क) धारा 33 क/ उपधारा (2) के खंड (ख) म! अंत म! आने वाले 'पदने' शO द का लोप �कया जाएगा ;
(ख) धारा 33 क/ उपधारा (2) के खंड (ड) म! अंत म! आने वाल े 'पदने' शO द का लोप �कया जाएगा ; और (ग) धारा 34 क/ उपधारा (3) म! आने वाले 'िजसने उसे िनवाSिचत �कया ह'ै शO द का लोप �कया जाएगा । [फा. स.ं 3-7/2015-टीएस.VI] आर. सYुमिनयम, अपर सिचव MINISTRY OF HUMAN RESOURCE DEVELOPMENT (Department of Higher Education) ORDER New Delhi, the 21st September, 2015 S.O. 2605(E).—Whereas, the School of Planning and Architecture Act, 2014 (37 of 2014) (hereinafter referred to as the said Act) came into force on 22 nd day of January, 2015;
And whereas, sub-section (2) of section 33 of the said Act provides for the composition of the Council, a central body to be established under sub-section (1) of section 33 of the said Act;
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 And whereas, clause (b) of sub-section (2) of section 33 of the said Act provides that two Members of the Parliament of India (one Member to be nominated by the Speaker of Lok Sabha and one Member to be nominated by the Chairman of Rajya Sabha), ex-officio;
And whereas, clause(m) of sub-section (2) of section 33 of the said Act provides that three persons to be nominated by the Visitor, atleast one of whom shall be a woman, having special knowledge or practical experience in respect of Architecture or Landscape Architecture or Urban Design and one from Urban and Regional Planning, ex-officio;
And whereas, the following difficulties have arisen in giving effect to the above provisions of the said Act:-
(a) the word ‘ex-officio’ appearing in clause (b) of sub-section (2) of section 33 is not relevant as Members of Parliament are nominated by Hon’ble Chairman or Speaker from amongst the Members of both the Houses and hence these are not ex-officio posts;
(b) the word ‘ex-officio’ appearing in clause (m) of sub-section (2) of section 33 is not relevant as three eminent persons are to be nominated by the Visitor having special knowledge or practical experience in respect of Architecture or Landscape Architecture or Urban Design and Urban and Regional Planning and hence these are not ex-officio posts;
And whereas, section 34 of the said Act provides for the term of office of vacancies among, and allowances payable to Members of Council;
And whereas, the following difficulty has arisen in giving effect to the provision of sub-section (3) of section 34 of the said Act:- the words “which elected him” appearing in sub-section (3) of section 34 are not relevant as Members of Parliament are nominated by the Hon’ble Chairman or Speaker and not elected by the House as mentioned in the sub-section;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 40 of the School of Planning and Architecture Act, 2014 (37 of 2014), the Central Government hereby makes the following order to remove the aforesaid difficulties, namely:-
1. Short title and commencement.—(1) This order may be called the School of Planning and Architecture (Removal of Difficulties) Order, 2015.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. In the School of Planning and Architecture Act, 2014:-
(a) in section 33, in sub-section (2), in clause (b), the word ‘ex-officio’ occurring at the end shall be omitted;
(b) in section 33, in sub-section (2), in clause (m), the word ‘ex-officio’ occurring at the end shall be omitted; and
(c) in section 34, in sub-section (3), the words “which elected him” occurring at the end shall be omitted.
