PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1639] ubZ fnYyh] 'kqØokj] tqykbZ 1] 2016@vk"kk<+ 10] 1938 No. 1639] NEW DELHI, FRIDAY, JULY 1, 2016/ ASADHA 10 , 1938 मानव संसाधन िवकास मं�ालयमानव संसाधन िवकास मं�ालयमानव संसाधन िवकास मं�ालयमानव संसाधन िवकास मं�ालय (उ� च(उ� च(उ� च(उ� चतर िश ा िवभाग)तर िश ा िवभाग)तर िश ा िवभाग)तर िश ा िवभाग) आदेशआदेशआदेशआदेश नई �द� ली, 30 जून, 2016 का.आका.आका.आका.आ.... 2268(2268(2268(2268(अअअअ))))....————यत: योजना और वा� तुकला िव�ालय अिधिनयम, 2014 (2014 का 37) (िजसे इसके प� चात, उपयु�� त अिधिनयम उि�लिखत �कया जाएगा) जनवरी, 2015 के 22व) �दन लागू +आ; और यत: उपयु�� त अिधिनयम क- धारा 27 के ख. ड (क) म) 12 येक िव�ालय के � टाफ क- िनयुि5 य�द िनयुि5 शै8िणक � टाफ पर सहायक 1ोफेसर के पद पर क- जाती ह,ै या य�द िनयुि5 अशै8िणक � टाफ के 12 येक संवग�, िजसके वेतनमान का अिधकतम =पु (क) के अिधका>रय? के 1चिलत वेतनमान से अिधक हो, म) बोड� Aारा क- जाती ह;ै करने का उपबBध ह;ै और यत: धारा 27 के ख. ड (क) के उपबB ध? को लाग ूकरने के प>रणाम � वCप िनD निलिखत क>ठनाई उ2 पB न +ई ह ै�क अB य पद? अथा�त 1ोफेसर, एसोिसएट 1ोफेसर इ2 या�द को उ� त धारा म) सिDमिलत नहH �कया गया ह;ै और यत:, उ� त अिधिनयम क- धारा 42 के ख. ड (ग) म) आगे उपबB ध ह ै �क इस अिधिनयम के 1ारD भ होने के त2 काल पूव� 12येक िव�ालय का शासी बोड�, िव2 त सिमित, शै8िणक प>रषद, भवन और िनमा�ण सिमित तथा अB य ऐसी सिमितयां जो काय� कर रही थH इसी 1कार तब तक िनरBतर काय� करना जारी रख)गी जब तक �क ि़व�ालय के िलए इस अिधिनयम के अB तग�त नया बोड� ग>ठत नहH हो जाता ले�कन इस अिधिनयम के अB तग�त नए बोड� का गठन होने पर 12 येक िव�ालय के शासी बोड�, िवL सिमित, शै8िणक प>रषद, भवन और िनमा�ण सिमित तथा अB य ऐसी सिमितय? के सद� य, जो गठन से पूव� पद पर थे, पद पर नहH रह)ग;े और यत: धारा 42 के ख. ड (ग) के उपबB ध? को लागू करने म) िनD निलिखत क>ठनाई उ2 पB न +ई ह ैअथा�त िव�ालय के िलए एक बार नया बोड� ग>ठत होने पर 12 येक िव�ालय क- िव2 त सिमित, शै8िणक प>रषद, काय�कारी प>रषद, भवन और 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िनमा�ण सिमित तथा अB य ऐसी सिमितयां, जो इस अिधिनयम के 1ारD भ होने के त2काल पहल े तक काय� करती थH, अकाया�2 मक हो जाएंगी िजससे इन मह2 वपूण� सिमितय? के अभाव म) >र� तता क- ि�थित हो जाएगी और इसके अित>र� त, िव2 त सिमित और भवन तथा िनमा�ण सिमित, िजनक- क� पना योजना और वा� तुकला अिधिनयम, 2014 के 1थम प>रिनयम के अB तग�त क- गई थी, िजनको अिBतम Cप देने म) कुछ और समय लगगेा। तथािप, ये सिमितयां अपने �दन-1ित�दन के कायN के िनव�हन व � कूल के काया�2 मक पहलOु के िलए आव�यक हP तथा इन सिमितय? क- काया�2 मकता अ2 यB त मह2 वपूण� ह।ै अत: अब केB R सरकार उ� त अिधिनयम क- धारा 40 क- उप-धारा (1) Aारा 1दत शि5य? का 1योग करते +ए पूवS� त क>ठनाइयां दरू करने के िलए एतTारा िनD निलिखत आदेश करती ह ैअथा�त: 1. संि�� तसंि�� तसंि�� तसंि�� त शीष�क और �ार� भ शीष�क और �ार� भ शीष�क और �ार� भ शीष�क और �ार� भ:::: -------- (1) यह आदेश योजना और वा� तुकला िव�ालय (क>ठनाइयां िनवारण) तृतीय आदेश, 2016 कहलाएगा। (2) यह शासक-य राजपV म) इसके 1काशन क- तारीख से लागू होगा। 2 योजना और वा� तुकला िव�ालय अिधिनयम, 2014 म) :-- (क) धारा 27 म), ख. ड (क) म) ‘सहायक 1ोफेसर’ शY द ‘’1ोफेसर या एसोिसएट 1ोफेसर या सहायक 1ोफेसर’’ शY द? से 1ित� थािपत �कया जाएगा; (ख) घारा 42 म), ख. ड (ग) के �थान पर िनD निलिखत ख. ड रखा जाएगा, अथा�त (ग) िव2 त सिमित, शै8िणक प>रषद, काय�कारी प>रषद, भवन और िनमा�ण सिमित और 12 येक � कूल क- ऐसी अB य सिमितयां, जो इस अिधिनयम के 1ारD भ के त2काल पहल े12 येक िव�ालय म) काय� कर रही थH, नई िवL सिमित, शै8िणक सिमित, काय�कारी सिमित, भवन और िनमा�ण सिमित और अB य ऐसी सिमितय? का गठन होने तक, लगातार काय� करती रह)गी �कB तु, नई िवL सिमित, शै8िणक प>रषद, काय�कारी प>रषद, भवन और िनमा�ण सिमित तथा ऐसी ही अB य सिमितय? के गठन होने पर िव2 त सिमित, शै8िणक प>रषद, भवन और िनमा�ण सिमित तथा ऐसी अB य सिमितय? के सद� य इन पद? पर नहH रह)गे। [फा. सं. 3-11/2015-टी.एस.VI] एस. पी. गोयल, संयु� त सिचव MINISTRY OF HUMAN RESOURCE DEVELOPMENT (Department of Higher Education) ORDER New Delhi, the 30th June, 2016 S.O. 2268(E).—Whereas the School of Planning and Architecture Act, 2014 (37 of 2014) (hereinafter referred to as the said Act) came into force on 22 nd day of January, 2015;
And, whereas, clause (a) of the section 27 of the said Act provides for the appointment of the Staff of every School by the Board, if the appointment is made on the academic staff in the post of Assistant Professor or if the appointment is made on the non-academic staff in every cadre the maximum of the pay scale of which exceeds prevalent grade pay scale for Group ’A’ Officers;
And, whereas, the following difficulty has arisen in giving effect to the provisions of clause (a) of section 27 that the provision for other posts i.e. Professors, Associate Professors etc. have not been included in the said section;
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 And, whereas, further clause (c) of section 42 of the said Act provides that the Board of Governors, Finance Committee, Academic Council, Executive Council, Building and Works Committee and such other Committees of every School functioning as such immediately before the commencement of this Act shall continue to so function until a new Board is constituted for the School under this Act, but on the constitution of a new Board under this Act, the members of the Board of Governors, Finance Committee, Academic Council, Building and Works Committee and such other Committees holding office before such constitution shall cease to hold office;
And, whereas, the following difficulty has arisen in giving effect to the provisions of clause (c) of the section 42 that once a new Board is constituted for the School, the Finance Committee, Academic Council, Executive Council, Building and Works Committee and such other Committees of every School functioning as such immediately before the commencement of this Act become non-functional leading to the state of vacuum in the absence of these important Committees and moreover, the constitution of Finance Committee and Building and Works Committee has been envisaged under First Statute of the School of Planning and Architecture Act, 2014 which are under way and may take some more time in their finalisation. However, these Committees being important in discharging the day to day activities and for the better functional aspects at the School level, the functionality of these Committees is of high importance.
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 40 of the said Act, the Central Government hereby makes the following Order to remove the aforesaid difficulties, namely:-
1. Short title and commencement.— (1) This order may be called the School of Planning and Architecture (Removal of Difficulties) Third Order, 2016.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. In the School of Planning and Architecture Act, 2014(37 of 2014),-
(a) in section 27, in clause (a), for the words “Assistant Professor”, the words “Professor or Associate Professor or Assistant Professor” shall be substituted;
(b) in section 42, for clause (c), the following clause shall be substituted, namely:- “(c) the Finance Committee, Academic Council, Executive Council, Building and Works Committee and such other Committees of every School functioning as such immediately before the commencement of this Act shall continue to so function until a new Finance Committee, Academic Council, Executive Council, Building and Works Committee and such other Committees of every School is constituted, but on the constitution of a new Finance Committee, Academic Council, Executive Council, Building and Works Committee and such other Committees, the members of the Finance Committee, Academic Council, Building and Works Committee and such other Committees holding office before such constitution shall cease to hold office;”.
