I Preliminary G.S.R. 75203).-In exercise of tbe powers con­ ferred by section 9 of the Sugar Development Fund Act, 1982 (4 of 1982), the Central Govern­ ment hereby makes the followi .. •lg r:ules, namely :-

1. Short title and comm~ncement.-(1) 'These rtiles may be celled the Sugar Deveioprn~ni: Fund Rules, 1983.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.-In these rules, unless the con­ tex otherwise requires,-

(a) 'Accounts Officer' means the Controller of Accounts, Department of Food, Go-1:-·.:ern­ ment of India, New Delhi;

(b) 'Act' means the Sugar Development Fund Act, 1982 (4 of 1982);

(c) 'Central gove=ent' unless otherwise specified, means the Goverfu11ent of India in the Department of Food;

(d) 'cess' means the duty of excise levied and collected under se:oticn 3' of the Sugar Cess Act, 1982 (3 of 1982);

(e) 'Chief Direct<Jr' mems the Chief Direcior in the Directorate of Sugar, Department of Food of the Gove=ent of India and includes any Additional Chief Direct<Jr, Director or Deputy Director in the said Directoni.te;

(f) 'Committees' means the Standing Com­ mittee constituted under rnle 6;

(g) 'Financial institution' means the Industrial Finance Corporation of Tl!dia. r.he. In dustrial Development Bank ofJndia or the Industrial C:redit and Investment , .. : '·! 1,-;· ' ' : .. I'L ·. 1\: I,,: 'il 'I··:· THE GAZ'ilTTE OF Il'IDIA :EXTRAORDINARY .... • Cornoration of India Limited referred to ii:t sub-section (1) of section 4A of the Comnanies Act, 1956 (1 of (1956), or any ·other financial institution as may be specified under sub-section (2) of the said Act. n) 'Fmm' means any one of the forms ap­ pended to these· rules i) 'grade' means the Inilian Sugar Standard grade, represented by the standard seal­ ~d samples of sugar in bottles issued by the Director, National Sugar Institute, Kanpur, confo!'ll:lh"lg to the standards laid down by the Indian Standards Insti­ tution referred to in clause (e) of section 2 of the Indian Standards Institution (Certification Marks) Act, 1952 (36 of 1952) 'j) '-occupier' in relation to anY sugar factory, ~ealls the person who has ultimate con­ rol over the affairs of the sugar factory, or the owner of the sugar factory in case he is not the occupier;

(k) 1Sch~dule' means the Schedule annexed to these rules; Q) 'sugar factory'. meam >ny premises (inclu­ ding the precincts thereof) in any part ,nf which sugar is manufactured by vacuum pan process;

(m) ''sugar' means any form of sugar, inclu­ ding crushed sugar nr sugar is crystallis­ ed ·Or powder form. containing ninety per cent or more of sucrose and Pro­ duced by the vac~um pan· process and includes -raw sugar produced by the said process;

(n) 'sugar undertaking' means an undertaking engaged in the manufacture or produc­ tion of sugar bv means of vacuum pan and with the aid of mechanical power;

(o) 'sugar year' means the period of twelve months commencing on the Isi day of October and endig with the 30th day of September next following :·

CHAPTER H 'lito:;. to th~ Fund and maint~n a nee of .:tccot~nto:;. Credits to the Fund._:.._(l) the Central Govern­ •! shall forinulate, from time to time neces-. . . sary Demand for Grants, under Major Head C-Food-C-9-0ther expenditure-C9 (3) pa·yrn1em, against collection of Cess on Sugar for withdrawal of amounts from the conS<lli<lat1eri Fund of india and, after appropriation by the liament, arrange credit to the Fund _?f amounts, not exceeding the proceeds or the collected, as reduced by cost o£ collection, as be speciiied by the Central Government;

Provided that until such cost of collection is specified, h shall be one per cent of the cess col­ lected.

(2) In addition to the amounts received Ulider provisions of sub-rule (1) amounts received on count of repayment of loans, interest, re;ali~;ati.on securities for loans and penalty for any amounts payable to the Central Government th·e purpose ~f t~e Act, shall be cre<l~ted to. Maintenance of accounts.-The Accounts·,;'.'·""'"' Officer shall maintain the accounts of the Fund. ·

5. Manner of accounting.-( l) ill! amounts . · received into the credit of -the Fund shall be ac­ counted for under };fajor Head "829" Dev.elopme11t and \Velfare Funds-Development Funds for. Agricultural purposes-Sug31' Development Fund.-.

Provided that the Central Government 1uav nomi­ nate not more than two officers of that Govern­ : ment having special knowledge of any aspect of · sugar iridustry as additional members of the Com­ ··mittee as experts. Fuil.ctions .of the Comm[ttee.-(1) The Com­ shall consider from time to time applications ;.re<:enred for purposes covered under rules 16, 17 18 for payment of loan assista:1cc and g~·ants such other matters as may be referred to It by Central Government ;

Provided that in the case of any reference made the Central Government, the Committee shall its recon:Unendations within two months the date they are referred to it.

(2) The Committee may also be entrusted with other functions connected with the Act as b~ decided by the Central Government from to time. · )G

(3) The Committee may appcint one or more sub-comnrittees whenever ir considers it. necessary so to do for facilitatillg- effici-ent and speedy dis­ cbarae of its functions. Tne Chairman of the Committee may nominate wy one of the members of tile snb·comn1itte::: as its con­ venor and where no such nomi...Tlation has been made, the memb.ers o! the sub-committee may themselves elect a convenor.

(4) The Member-Secretary of the Committee shall act as Secretary to all sub-cm=ittees. CH.AJ'TER IV Procedures relating tD meetings of Committ[e 2nd S'JJ-coomit:~e~~

8. Meetings.-The Co=ittee may hold meet­ ings as often as may be deemed necessary by it, but shall meet at least one~ in each quarer of a year;

Provided that in a quarter d.uring \-:;hich no application, or any other m2tter referable . to it under sub-rule (2) of rule 7, has bee a received by the ColllJlittee, il shall not be n~cessary to hold a meeting in that quarrer.

9. Quorum : Three members in the case of the Committee and two members in the case of a sub-committee shall constitute the quomm.

10. Presiding over the meetings of the Com­ mittee and sub-committees.-The Chai.rman of the Committee and the convenor of a sub-committee respectivelj-shaJIPreside ove c the meetings of the Committee or the sub-co=ittee as the case may be. In the event of the Chairman or, as the case 1nay be, the convenor being unable to attend the meeting for any reason, the members present may elect one amongst themselves to preside over the meeti~g.

11. Power ,to call a meeting : (1) The Chairman of the Committee -or the convenor of a sub-com­ mittee may, at any time, call a meeting of the Committee or a sub-committee.

Provided that the Chairman or the convenor, as the case may be, shall call a meeting if a r.equisi­ tion for that purpose is presented to him by at least three members in the case of the Conimi.ttee and two members in the case of a sub-committee. ,(2) At least 14 clear da~.'s' notice indicating the time and place of a proposed meeting, signed by the Member-Secretary of the Committee, shall be sent fo the members of the Committee or the· sub­ committee : ------- ---------------- THE GAZETTE OF INDIA : EXTP~'I.ORDINARY Pro\ided iliat in case of urgency, a special meet­ ing of the Comrrllttee or sub-corr:un.ittee may be called at any time by the Chairman or the con­ venor. who shall inform the members at least one clear ·day in advance of the subject matter for consideration at the mee:ti.ng a.r..d the reasons for which he considers meeting urgent :

Provided further that no other business shall be transacted at such a meeting. ·(3) The Chairman or the convenor, as the case may be, may invite any persou to a~end uny meet­ ing of the Corim.ittee or sub-committee as a spedal invitee but such person shall not be entitled to vote.

12. Agenda : ( 1) At least seven clear days befor': any ineetin'g of the Commjttee or a sub­ ·-::omm7ttee, e~cept meetings reft~rred to in proYiso to sub-rule (2) to ·rule l La list of business pro-gosed to be transEcte_d at the meeting, signed by the Nle:n:ber·Secretary of the Committee .. shall be sent 10 the members of the Committee or, as the case may be) o£ a sub-colll.I:littee. ·

(2) No business, not included in the list of busi­ ness, shall be transacted at a meeting ·without the perm.ission .of the person presiding over the rn~tm mg.

13. Business by Circulation.--(1) Any business which is not of 8Jl mgent nature and .... vvhich is to be transacted by tb.e CoiJJ..ID.ittee or a sub-commit­ tee, if tnc Chairman of the Committee or conve­ noi" of the sub-coDJ.ill..ittee so directs, shall be refer­ red to members by circulation of papers and any proposal so circulated aud approved by the majo­ rity c•f the m~m.bers vvho have given their approval in writing, shall be dr::emed to be the recon.1illenda­ tkm of the Co:m.m.ittee or the sub-committee as if the proposal had been appioved by a majority of t11e members at a meeting.

Provided that at least three members }n the case of the CoE11J.J..ittee aud tvm members in the case of a sub-committee have giyen their approval to the. proposal. .Provided further· that w herr a oroposa.I is refer­ red to in embers by circulation of 'pap.ers, any three memhers of the Committee or nvo me.mbers of a su"!:;-com..mittee may require that the proposal be refened to members at a meeting, and thereupon sucl1 · reference shall be made to members at a meeting of the Committee or sub-committeo. as the case may be. ·

(2) When auy business is referred to members by circulation, a period of not less ·than 14 clear days' ·shall be allowed for receipt of replies from members, such period being reckoned from the date on which the said business is so referred· by · the Secretary to the m~mbers. · - · ·

CHAPTER V Loan for modernisatianJrehabilitatioZJ.

16. (5) The final decisioD·of tbe Committee on any application shall be submitted to the Central Goven1Eent il) the fot!Il of a recomnlendation.

(6) The Central Governm,nt may, after coEsi­ derati0n of tho~ r-~commendation of the Committee ·and any other i'ekvant factor, authorise payment to a s12gar under:taking of such amount of loan, not excecd~.n;:; the amount required by the financial ·institution to be contributed by such sugar under­ taki..L""!g as promoters' contribution, as may be determirled by the Central Go':errunent.

(7) Tbe amoLtnt of loan authorised under sub­ rule ( 6) shall be disbursed by tbe Central Govern­ ment to th·e sugar undertaldng, or paid by it to the financial institution for disbursement to the sugar undertaking, either in lump surn or in n:vo or more instalrrlents as may be considered necessary by the Central Government.

( 8) Tbe financial institutioD shall treat tbe amount paid to it under sub-mle (7) as tbe pro­ moters' coDtribution, or as part thereof, required to be raised by the sugar undertaking for rcvailing of the loan under its relevant scheme for moderni­ sation and rehabi-litation.

(I) The Central Go·<emment may, &fter taking into considiration the recornmenc!.r~tions of tbe Committee and any other relevant factor, accord sanction to the payment of a loan from the Fund to a· sugar undertaking in COllitection \'.:ith the development of sugarcane in its area for thf3 purposes of-

(a) setting up of beat treatment plants ;

(b) bearmg of nurseries ;

(c) pest control measures ;

Provided that loans from the Fund shall be granied ·mJlY if the Central Governm~nt is satisfied ~n the basis of the iPJormation given in Form III that no fi11ancial assistance is available. for the pur· pose from any agency. and, if available, the amount thereof is, in th~ opinion of the Central Govern· ,"11ent, inadequate and needs to be sup-plen1entcd by loans from the Fund. .. (3) (a) The amount of loan advanced under this rule sllall carry sucl1 rat~ of interest as rna y be decided by the Central Governrnent from time to t:1ne.

(b) In case of any default in repayment of the amount of the loan, or payment of any instal­ ment thereof or interest thereon in accordance with the provisions of the agreement executed under sub-rule (2), an additional interest at the rate of two and' a half j)er cent .per annum on the amount of default shall be payable by the sugar undertaking.

( 4) An applicatior: for loan under this rule shall be submitted in Form-III, with twelve copi~ thereof to the Government of the State in which the applicant sugar un,tertaking is located and the State Government may, after scrutiny of the appli­ cation, ~orward the same and elev~n copies there­ of Wlth 1ts comments and recommendations to the· M~mber-Secretary of the Committee.

CHAPTER VII Grants for research

18. Provided further that disbursement of grant authorised unde1· this ;.·u.k shall be 111ade through the said Development Council for Industry.

(2) Payment of grants shall be subject provisions contained in the Schedule.

CHAPTER VIII Buffer Stock

19. (1 ) The Central Government, regard to the stock of sugar held:. with undertakings, the prospects of sugar the requirement of sugar for consumption the country and exports and such other relev<mi" factors as may be considered necessary, from time to rime, the quantity of sugar to maintained as buffer stock.

(2) The sugar maintained .,in the buffer stock snall conform to the grade laid down from time to time by the Indian Standards Institution referr- · ed to in clause (e) of section 2 of the Indian • Standards Institution· (Certification Marks) Act, 1952 (36 of 1952) and shall be af such grade as may be decided by the Central Government.

( 3) The Central Government ·or the Chief · Director may, from time to time, require an occu­ pier of the sugar factory to set apart such quantity and grade of sugar, Pertaining to such sugar year ·or years, as may be necessary for the purpc>se of buffer stock :

Provided that the share of each occupier shall be on the basis of the production of the sugar .undertaking in a particular sugar year.

( 4) ·Every occupier of a sugar factory shall set -apart .sugar so required, and shall store it in se­ parate and distinctly identifiableo stacks and lots and in separate godowns within the premises of the sugar undertaking :

Provided that the Central Government may, lll exceptional cases and for reasons to be recorded in wliting, .grant exemption to an occupier of a sugar factory from the operation of this rule.

( 5) Every occupier of a sugar factory shall, within fifteen days of the date of issue of the communiQation under clause (3), furnish a com­ pliance report, in triplicate, in Fom1-IV to the Central Gove=ent.

Provided further that the payment of subsidy in respect of a quarter subsequent to the one end­ ing on the 31st March, 1983, or a part thereof, the value of the buffer stock shall be determined with reference to the average actual realisation per quintal of sugar made by the claimant sugar undertaking on the sale of non-levy sugar in the open market during the relevant quarter[pe'riod to which the cla!m relates.
