(1) The trustee and the Collective Investment Management company shallenter into an agreement for managing the 39 [collective investment scheme] property.

(2) The agreement for managing the 40 [collective investment scheme] property shall contain suchclauses as are specified in the Fifth Schedule and such other clauses as arenecessary for the purpose of fulfilling the objectives of the 41 [collective investment scheme].
